<official-title>To provide vocational rehabilitation services to individuals with disabilities affected by Hurricane Katrina or Hurricane Rita.</official-title>

<section id="HC125464E948D48858DC7B62DDE3D7871" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Assistance for Individuals with Disabilities Affected by Hurricanes Katrina and Rita Act of 2005</short-title></quote>. </text></section> 
<section id="H9830C202221B4317978BAEB4968FFEB"><enum>2.</enum><header>Reallotment of amounts under title I of the Rehabilitation Act of 1973</header> 
<subsection id="H5CC4160F7B604ADDA0DA30B7E2929711"><enum>(a)</enum><header>Reallotment of amounts</header><text display-inline="yes-display-inline">In realloting amounts to States under section 110(b)(2) of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/730">29 U.S.C. 730(b)(2)</external-xref>) for fiscal year 2005, the Commissioner of the Rehabilitation Services Administration shall give preference to affected States.</text></subsection> 
<subsection id="HA6AF0CFE06D9431F9E1ED8144E7B42E3"><enum>(b)</enum><header>Availability of amounts</header><text display-inline="yes-display-inline">For fiscal year 2005, the Commissioner shall make available amounts reallotted under section 110(b)(2) of the Rehabilitation Act of 1973 to any State not later than October 7, 2005, or seven days after the date of the enactment of this Act, whichever occurs later.</text></subsection> 
<subsection id="H394D9BE0F0CC463580A695C7E6D5F46E"><enum>(c)</enum><header>Waiver of non-Federal share requirement</header><text display-inline="yes-display-inline">The Commissioner may waive the requirement contained in the second sentence of section 110(b)(2) of the Rehabilitation Act of 1973 (relating to non-Federal share requirement) with respect to amounts made available to an affected State for fiscal year 2005 if the affected State submits to the Commissioner an application requesting a waiver of such requirement. </text></subsection> </section> 
<section id="HD1262A1DC1CB4A978B9EA43700AF9502"><enum>3.</enum><header>Use of amounts reallotted under title I of the Rehabilitation Act of 1973</header> <text display-inline="no-display-inline">An affected State that receives amounts reallotted under section 110(b)(2) of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/730">29 U.S.C. 730(b)(2)</external-xref>) for fiscal year 2005 (as described in section 2) may use the amounts—</text> 
<paragraph id="HDDF92428CD6E41F0BBF578056310EAC7"><enum>(1)</enum><text display-inline="yes-display-inline">to pay for vocational rehabilitation services (which may include training, mentoring, or job shadowing opportunities) for individuals with disabilities affected by Hurricane Katrina or individuals with disabilities affected by Hurricane Rita that contribute to the economic growth and development of communities;</text></paragraph> 
<paragraph id="HC5462FE4755649268CA9F66D2B13963D"><enum>(2)</enum><text display-inline="yes-display-inline">to enable—</text> 
<subparagraph id="HF552F387D91948F1889B00916287F4BC"><enum>(A)</enum><text>individuals with disabilities affected by Hurricane Katrina to participate in reconstruction or other major disaster assistance activities in the areas in which the individuals resided on August 22, 2005; </text></subparagraph> 
<subparagraph id="H3968D2AC66DA46C700F182114F84D92B"><enum>(B)</enum><text display-inline="yes-display-inline">individuals with disabilities affected by Hurricane Rita to participate in reconstruction or other major disaster assistance activities in the areas in which the individuals resided on the date that is seven days before the date on which the President has declared that a major disaster related to Hurricane Rita exists in such areas; or</text></subparagraph></paragraph> 
<paragraph id="H40B7DFB30E744166852D2482A67D2301"><enum>(3)</enum><text>to carry out other activities in accordance with title I of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/720">29 U.S.C. 720 et seq.</external-xref>).</text></paragraph></section> 
<section id="H7A3442C0B6934A2B87FD4054D771B03B"><enum>4.</enum><header>Definitions</header> <text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H5885918DD27A4FAF005FE642982B1400"><enum>(1)</enum><header>Affected state</header><text>The term <quote>affected State</quote> means a State that contains an area, or that received a significant number of individuals who resided in an area, in which the President has declared that a major disaster exists. </text> </paragraph> 
<paragraph id="H1AC27378A1EF457AA1BC9000CA38206"><enum>(2)</enum><header>Commissioner</header><text display-inline="yes-display-inline">The term <quote>Commissioner</quote> means the Commissioner of the Rehabilitation Services Administration.</text></paragraph> 
<paragraph id="H3A28500700B3429B986CA3B91FC103A1"><enum>(3)</enum><header>Individual with a disability</header><text>The term <term>individual with a disability</term> has the meaning given the term in section 7(20) of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/705">29 U.S.C. 705(20)</external-xref>).</text></paragraph> 
<paragraph id="H0FB3F56792174DA7A1FA04C5DA9F47F"><enum>(4)</enum><header>Individual with a disability affected by Hurricane Katrina</header><text>The term <term>individual with a disability affected by Hurricane Katrina</term> means an individual with a disability who—</text> 
<subparagraph id="H2A50518A079544E8ABAE25AF36A32D99"><enum>(A)</enum><text>resided on August 22, 2005, in an area in which the President has declared that a major disaster related to Hurricane Katrina exists in such area;</text></subparagraph> 
<subparagraph id="HD2B135842E7343568524C195004CDA8"><enum>(B)</enum><text>on August 22, 2005, was eligible under title I of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/720">29 U.S.C. 720 et seq.</external-xref>) for vocational rehabilitation services described in section 103 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/723">29 U.S.C. 723</external-xref>) in the area described in subparagraph (A); and</text></subparagraph> 
<subparagraph id="HEB5C41647A5846CEADCEDA2D71465079"><enum>(C)</enum><text>resides in an area in which the President has declared that an emergency exists, in accordance with section 501 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5191">42 U.S.C. 5191</external-xref>), related to Hurricane Katrina, or in which a major disaster related to Hurricane Katrina exists.</text></subparagraph></paragraph> 
<paragraph id="H0E2905C3B8A940AE854D004463702DB" display-inline="no-display-inline"><enum>(5)</enum><header>Individual with a disability affected by Hurricane Rita</header><text>The term <term>individual with a disability affected by Hurricane Rita</term> means an individual with a disability who—</text> 
<subparagraph id="H5DA4E293B24D4492A2A425C2B1271271"><enum>(A)</enum><text display-inline="yes-display-inline">resided in an area on the date that is seven days before the date on which the President has declared that a major disaster related to Hurricane Rita exists in such area;</text></subparagraph> 
<subparagraph id="H15127B86D39641BE86B1ACB815E186F3"><enum>(B)</enum><text display-inline="yes-display-inline">on the date described in subparagraph (A), was eligible under title I of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/720">29 U.S.C. 720 et seq.</external-xref>) for vocational rehabilitation services described in section 103 of the Rehabilitation Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/29/723">29 U.S.C. 723</external-xref>) in the area described in subparagraph (A); and</text></subparagraph> 
<subparagraph id="HD16B57836B75479F95E14F3EA0C55E73"><enum>(C)</enum><text display-inline="yes-display-inline">resides in an area in which the President has declared that an emergency exists, in accordance with section 501 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5191">42 U.S.C. 5191</external-xref>), related to Hurricane Rita, or in which a major disaster related to Hurricane Rita exists.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HAAF89CC792074DE88B1F58FDE02F59D9"><enum>(6)</enum><header>Major disaster</header><text display-inline="yes-display-inline">The term <term>major disaster</term> means a major disaster declared by the President in accordance with section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>) related to Hurricane Katrina or Hurricane Rita. </text></paragraph> </section>
