<official-title>To amend title XVIII of the Social Security Act to provide extended and additional protection to Medicare beneficiaries who enroll for the Medicare prescription drug benefit during 2006.</official-title>

<section id="H6473F222B81E484B00D089BB20CA5055" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>The Medicare Informed Choice Act of 2005</short-title></quote>.</text></section> 
<section id="H1072138E6BDE4356B1C431A161938543" commented="no"><enum>2.</enum><header>Extended period of open enrollment during all of 2006 without late enrollment penalty</header><text display-inline="no-display-inline">Section 1851(e)(3)(B) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-21">42 U.S.C. 1395w–21(e)(3)(B)</external-xref>) is amended—</text> 
<paragraph id="H187EBB7F8ED1421E904E20F74024BDB3"><enum>(1)</enum><text>in clause (iii), by striking <quote>May 15, 2006</quote> and inserting <quote>December 31, 2006</quote>; and</text></paragraph> 
<paragraph id="H05D03531094646B9963C9E3B4EF9479D"><enum>(2)</enum><text>by adding at the end the following new sentence:</text> 
<quoted-block style="OLC" id="H7B0A2B697A954630A01FA362E43326AB" display-inline="no-display-inline"><quoted-block-continuation-text quoted-block-continuation-text-level="subparagraph">An individual making an election during the period beginning on November 15, 2006, and ending on December 15, 2006, shall specify whether the election is to be effective with respect to 2006 or with respect to 2007 (or both).</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></section> 
<section id="H0BE9A53BE2324259872B00FD2BA5278B"><enum>3.</enum><header>One-time change of plan enrollment for medicare prescription drug benefit during all of 2006</header> 
<subsection id="HC0EC819865224EC88CAF405841032F43"><enum>(a)</enum><header>Application to MA–PD plans</header><text>Section 1851(e) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-21">42 U.S.C. 1395w–21(e)</external-xref>) is amended—</text> 
<paragraph id="H255971A835AD457898083FA600000488"><enum>(1)</enum><text>in paragraph (2)(B)—</text> 
<subparagraph id="HE53ED2EADC994855B7E2171B2F500C3"><enum>(A)</enum><text>in the heading, by striking <quote><header-in-text level="subparagraph" style="OLC">for first 6 months</header-in-text></quote>;</text></subparagraph> 
<subparagraph id="H08016D40F01E476689A22B67773D7352"><enum>(B)</enum><text>in clause (i)—</text> 
<clause id="H1583175504DE4B098EB1DBD5C09291FC"><enum>(i)</enum><text>by striking <quote>the first 6 months of 2006</quote> and inserting <quote>2006</quote>; and</text></clause> 
<clause id="HB25911281E014F97B2537335E9D55F3D"><enum>(ii)</enum><text>by striking <quote>the first 6 months during 2006</quote> and inserting <quote>2006</quote>;</text></clause></subparagraph> 
<subparagraph id="H0EF8795CCC9247D89216EC64308C6FD4"><enum>(C)</enum><text>in clause (ii), by inserting <quote>(other than during 2006)</quote> after <quote>paragraph (3)</quote>; and</text></subparagraph> 
<subparagraph id="HB28D0873B678431C8CB4619C2898DF72"><enum>(D)</enum><text>in clause (iii), by striking <quote>2006</quote> and inserting <quote>2007</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HC4C3DE82247A4CA9A5AA164E2F49658E"><enum>(2)</enum><text>in paragraph (4), by striking <quote>2006</quote> and inserting <quote>2007</quote> each place it appears.</text></paragraph></subsection> 
<subsection id="H7D99D07A91C24236B34EA9A08181C660"><enum>(b)</enum><header>Conforming amendment to part D</header><text display-inline="yes-display-inline">Section 1860D–1(b)(1)(B)(iii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-101">42 U.S.C. 1395w–101(b)(1)(B)(iii)</external-xref>) is amended by striking <quote>subparagraphs (B) and (C) of paragraph (2)</quote> and inserting <quote>paragraph (2)(C)</quote>. </text> </subsection></section> 
<section id="HEFB981950B89443AAD3410B6A4AF75EB"><enum>4.</enum><header>Protection from loss of employment-based retiree health coverage upon enrollment for medicare prescription drug benefit during 2006</header><text display-inline="no-display-inline">Section 1860D–22(a)(2) (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-132">42 U.S.C. 1395w–132(a)(2)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="HDE330E268D894AB68408E1ED235E6C99"><enum>(D)</enum><header>Protection from loss of employment-based coverage</header><text>The sponsor of the plan may not involuntarily discontinue coverage of an individual under a group health plan before January 1, 2007, based upon the individual’s decision to enroll in a prescription drug plan or an MA–PD plan under this part.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H8CAF93D51D504C989DB9F9594E226E4F"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this section shall be effective as if included in the enactment of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>).</text></section>
