<title id="H2C9E1D491CA84FBBAB58EE162CBF8146"><enum>I</enum><header>Independent Commission to Prevent Fraud and Abuse in the Response to Hurricane Katrina</header> 
<section id="H87609BA9F31C4095851C339120CF7DC8"><enum>101.</enum><header>Establishment of Anti-Fraud Commission</header><text display-inline="no-display-inline">There is established in the legislative branch the Independent Commission to Prevent Fraud and Abuse in the Response to Hurricane Katrina (in this title referred to as the <quote>Commission</quote>).</text></section> 
<section id="H73BAD6AD132842A7891CC53CC33C634"><enum>102.</enum><header>Duties</header> 
<subsection id="HD79465E7B52B4952AEBA84440035D95"><enum>(a)</enum><header>Investigation</header><text>The Commission shall conduct a full, complete, independent, and impartial investigation of—</text> 
<paragraph id="H14616C7D89CD4296A353373CAF73B668"><enum>(1)</enum><text>Federal Government contracting relating to Hurricane Katrina recovery, relief, and reconstruction, to prevent waste, fraud, and abuse; and</text></paragraph> 
<paragraph id="HD1F9F5D758C24193B7CEA84A1F6198E"><enum>(2)</enum><text>allegations of price gouging or profiteering relating to Hurricane Katrina recovery, relief, or reconstruction.</text></paragraph></subsection> 
<subsection id="H862E0CD613FC4078B8D48255F9CB493F"><enum>(b)</enum><header>Specific requirements</header> 
<paragraph id="H4F4E03A761624AC400C6C7D7448FE2B7"><enum>(1)</enum><text>The investigation of the matters described in subsection (a)(1) shall include, at a minimum, the following:</text> 
<subparagraph id="HDC2E75D8E5764A78812C6BBD56680019"><enum>(A)</enum><text>Review of how Federal contracts, subcontracts, grants, and cooperative agreements relating to Hurricane Katrina recovery, relief, and reconstruction are awarded, to determine whether the Federal Government has complied with competition requirements and utilized the appropriate contract type.</text></subparagraph> 
<subparagraph id="H5840B800922645EC97AF2189DD200CA"><enum>(B)</enum><text>Review of whether the awards of Federal contracts, subcontracts, grants, and cooperative agreements relating to Hurricane Katrina recovery, relief, and reconstruction are based on merit as opposed to relationships between awardees and Federal Government officials.</text></subparagraph> 
<subparagraph id="H23807B2825414086BC68F734BFE7DCC8"><enum>(C)</enum><text>Real-time review of spending under Federal contracts, subcontracts, grants, and cooperative agreements for Hurricane Katrina recovery, relief, and reconstruction to determine whether wasteful spending, poor contract management, or other abuses are occurring.</text></subparagraph> 
<subparagraph id="H74BB0CD029C24BC8BB10E66D77D2F49"><enum>(D)</enum><text display-inline="yes-display-inline">Review of auditing and other oversight procedures to ensure accountability of contractors, subcontractors, and government officials.</text></subparagraph> 
<subparagraph id="H093135B64B504770932055D71007C486"><enum>(E)</enum><text>Review of the inclusion and utilization of small and local businesses through contracts, subcontracts, or otherwise.</text></subparagraph> 
<subparagraph id="HC3300F4CDDAF4315B24654D505F7484E"><enum>(F)</enum><text>Review of Federal acquisitions personnel overseeing contracts, subcontracts, grants, and cooperative agreements for Hurricane Katrina recovery, relief, and reconstruction to assess whether there are sufficient Federal acquisitions personnel with appropriate qualifications and training for the hurricane response effort.</text></subparagraph> 
<subparagraph id="H706A7F1D15B549EAAC5DF6A7D143FCBF"><enum>(G)</enum><text>Review of transactions relating to Hurricane Katrina relief, recovery, and reconstruction that are paid for by government issued credit cards.</text></subparagraph></paragraph> 
<paragraph id="H86B60E36EA214E2394A1007177156523"><enum>(2)</enum><text display-inline="yes-display-inline">The investigation of the matters described in subsection (a)(2) shall include, at a minimum, a review of activity in the petroleum and natural gas markets in the aftermath of the hurricane and opportunities for market manipulation or price gouging at each point of commerce in bringing petroleum and natural gas to market, including exploration, development, production, refining, distribution, commodities transactions, and retail sales.</text></paragraph></subsection> 
<subsection id="HE9C79C2CF8F443469443E009E3F9F92F"><enum>(c)</enum><header>Assessment, Analysis, and Evaluation</header><text>During the course of its investigation, the Commission shall assess, analyze, and evaluate relevant persons, policies, procedures, contracts, subcontracts, grants, cooperative agreements, reports, and events, including, at a minimum, the following:</text> 
<paragraph id="H97CA0F7914684212AFBBAAA064C9E50"><enum>(1)</enum><text>The Department of Homeland Security, including the Federal Emergency Management Agency.</text></paragraph> 
<paragraph id="HF91C15C689B642CEAA12575F11B23C9E"><enum>(2)</enum><text>The Department of Defense.</text></paragraph> 
<paragraph id="H96B75CA5B19C43979653797DB28E82A9"><enum>(3)</enum><text>The Army Corps of Engineers.</text></paragraph> 
<paragraph id="H4DBE10F553E14E42A407642024006E5E"><enum>(4)</enum><text>Other Federal agencies that award or oversee contracts, subcontracts, grants, or cooperative agreements for Hurricane Katrina recovery, relief, or reconstruction.</text></paragraph> 
<paragraph id="H3F6773E54DB9438C8BEB2481DC9C7D52"><enum>(5)</enum><text>The approval process for contracts, subcontracts, grants, and cooperative agreements in the Federal agencies listed in paragraphs (1) through (4).</text></paragraph> 
<paragraph id="H2EB2834507AA4609AD00A29204ED67FB"><enum>(6)</enum><text>Communications between private contractors, their representatives, and Federal Government officials concerning potential or existing contracts or subcontracts for Hurricane Katrina relief, recovery, or reconstruction.</text></paragraph> 
<paragraph id="H86361358D8A044D5BEA9A6773FCA5CAB"><enum>(7)</enum><text>Actual cost figures for transactions relating to contracts, subcontracts, grants, and cooperative agreements or paid for by government issued credit cards, for Hurricane Katrina relief, recovery, or reconstruction.</text></paragraph> 
<paragraph id="H3B1DB3CD0FC347FBA105406592B4ABAB"><enum>(8)</enum><text>Pricing policies of individual companies in the petroleum and natural gas industries, actual cost figures for fuel and natural gas transactions, and information regarding decisions by companies to reduce or expand refining capacity.</text></paragraph></subsection></section> 
<section id="H0A10E0D4925647CAB2007F897BE1D8A4"><enum>103.</enum><header>Composition of Commission</header> 
<subsection id="H29231D5CDEE34635AEC47C94736B57A6"><enum>(a)</enum><header>Members</header><text>The Commission shall be composed of 10 members, of whom—</text> 
<paragraph id="H4D7E1E2C641F447DB48D4E7500F44812"><enum>(1)</enum><text>1 member shall be appointed by the President;</text></paragraph> 
<paragraph id="H4234027DCE9C4EA597D17DE0C500D6AA"><enum>(2)</enum><text>1 member shall be jointly appointed by the minority leader of the Senate and the minority leader of the House of Representatives;</text></paragraph> 
<paragraph id="HFC537215AB1042EA00891E5200ADEC78"><enum>(3)</enum><text>2 members shall be appointed by the majority leader of the Senate;</text></paragraph> 
<paragraph id="H4D37C92A20D345368E31F6C183302233"><enum>(4)</enum><text>2 members shall be appointed by the Speaker of the House of Representatives;</text></paragraph> 
<paragraph id="HFE3CF85CFA6A40B8BAFBCCE7B42E8B0"><enum>(5)</enum><text>2 members shall be appointed by the minority leader of the Senate; and</text></paragraph> 
<paragraph id="H3D2C6434B50F43F6B4C5003571C4FBC8"><enum>(6)</enum><text>2 members shall be appointed by the minority leader of the House of Representatives.</text></paragraph></subsection> 
<subsection id="H545C60086D9D47F784E6F468516BF07"><enum>(b)</enum><header>Qualifications; initial meeting</header> 
<paragraph id="H786B7748781E465FA612EC97EDBDA98"><enum>(1)</enum><header>Nongovernmental appointees</header><text>An individual appointed to the Commission may not be an officer or employee of the Federal Government or any State or local government.</text></paragraph> 
<paragraph id="H4FF1D7D8895B4E05BFAFFD7E2B8FD084"><enum>(2)</enum><header>Other qualifications</header><text>Individuals appointed to the Commission should be prominent United States citizens, with national recognition and significant depth of experience in such professions as governmental service, public administration, government contracting, economics, emergency response, and energy policy.</text></paragraph> 
<paragraph id="H488A6D52CE6141788270D8F551DB5108"><enum>(3)</enum><header>Deadline for appointment</header><text>All members of the Commission shall be appointed within 21 days following the date of the enactment of this Act.</text></paragraph> 
<paragraph id="HC20FF3AC0AE64C11B438B6DCAA18C28C"><enum>(4)</enum><header>Chairman and vice chairman</header><text>The chairman and vice chairman of the Commission shall be elected by a majority vote of the members.</text></paragraph> 
<paragraph id="H8D862A947B6C4E9AA04B6C2C68255B3B"><enum>(5)</enum><header>Meetings</header><text>The Commission shall meet and begin the operations of the Commission as soon as practicable. After its initial meeting, the Commission shall meet upon the call of the chairman or a majority of its members.</text></paragraph></subsection> 
<subsection id="H412A3F1087DD403D85224E11C868B2AF"><enum>(c)</enum><header>Quorum; vacancies</header><text>Six members of the Commission shall constitute a quorum. Any vacancy in the Commission shall not affect its powers, but shall be filled in the same manner in which the original appointment was made.</text></subsection> 
<subsection id="HDD11E7AD17A44805833D171F25951E58"><enum>(d)</enum><header>Conflicts of interest</header> 
<paragraph id="HFB870313878A4B30A206ED1D2D2BA5D6"><enum>(1)</enum><header>Financial disclosure</header><text>Each member appointed to the Commission shall submit a financial disclosure report pursuant to the Ethics in Government Act of 1978, notwithstanding the minimum required rate of compensation or time period employed.</text></paragraph> 
<paragraph id="HB22AAB9BDF534614B32B912F030196A4"><enum>(2)</enum><header>Independence from subjects of investigations</header><text>Each member appointed to the Commission shall be independent of any agency, individual, or institution that may be the subject of investigation by the Commission.</text></paragraph></subsection></section> 
<section id="HAE198B7444BC471283D4B5B96F53651"><enum>104.</enum><header>Powers of Commission</header> 
<subsection id="HAB58E8D0DEBA42BBB393773F639EE02B"><enum>(a)</enum><header>In general</header> 
<paragraph id="H274E3617734141AF87AA3CE0A2B24B55"><enum>(1)</enum><header>Hearings and evidence</header><text>The Commission or, on the authority of the Commission, any subcommittee or member thereof, may, for the purpose of carrying out this title—</text> 
<subparagraph id="HDD6578E735824F01BAAB813ED744A7F8"><enum>(A)</enum><text>hold such hearings and sit and act at such times and places, take such testimony, receive such evidence, administer such oaths; and</text></subparagraph> 
<subparagraph id="HCA5CCBC99F93497EB8667E8B772DB674"><enum>(B)</enum><text>subject to paragraph (2)(A), require, by subpoena or otherwise, the attendance and testimony of such witnesses and the production of such books, records, correspondence, memoranda, papers, and documents,</text></subparagraph><continuation-text continuation-text-level="paragraph">as the Commission or such designated subcommittee or designated member may determine advisable.</continuation-text></paragraph> 
<paragraph id="H80E569C7CD0A467AA4AE9E92D6E9C904"><enum>(2)</enum><header>Subpoenas</header> 
<subparagraph id="H4131A65CDE164E9588C29545307BA6C7"><enum>(A)</enum><header>Issuance</header> 
<clause id="HEA1357C40E384E5CB6F692C5A58770A"><enum>(i)</enum><header>In general</header><text>A subpoena may be issued under this subsection only—</text> 
<subclause id="HE2F5986CC577421280506D1E5DAA5F48"><enum>(I)</enum><text>by the agreement of the chairman and the vice chairman; or</text></subclause> 
<subclause id="H12695456324C49788E382E17B4B767B7"><enum>(II)</enum><text>by the affirmative vote of 6 members of the Commission.</text></subclause></clause> 
<clause id="HB7F82E2C2CA94A8FBAC52DAB50166B7C"><enum>(ii)</enum><header>Signature</header><text>Subject to clause (i), subpoenas issued under this subsection may be issued under the signature of the chairman or any member designated by a majority of the Commission, and may be served by any person designated by the chairman or by a member designated by a majority of the Commission.</text></clause></subparagraph> 
<subparagraph id="HDD441C461D1E4974BF8EB805F3D0C68F"><enum>(B)</enum><header>Enforcement</header> 
<clause id="HBF012D080F774FE2B0688EA72CE6D0"><enum>(i)</enum><header>In general</header><text>In the case of contumacy or failure to obey a subpoena issued under this subsection, the United States district court for the judicial district in which the subpoenaed person resides, is served, or may be found, or where the subpoena is returnable, may issue an order requiring such person to appear at any designated place to testify or to produce documentary or other evidence. Any failure to obey the order of the court may be punished by the court as a contempt of that court.</text></clause> 
<clause id="H87C6C220715943349EC315FA836F80B8"><enum>(ii)</enum><header>Additional enforcement</header><text>In the case of any failure of any witness to comply with any subpoena or to testify when summoned under authority of this subsection, the Commission may, by majority vote, certify a statement of fact constituting such failure to the appropriate United States attorney, who may bring the matter before the grand jury for its action, under the same statutory authority and procedures as if the United States attorney had received a certification under sections 102 through 104 of the Revised Statutes of the United States (2 U.S.C. 192 through 194).</text></clause></subparagraph></paragraph> 
<paragraph id="H65947836728049498CC25D763458A3D4"><enum>(3)</enum><header>Scope</header><text>In carrying out its duties under this Act, the Commission may examine the actions and representations of the current Administration as well as prior Administrations.</text></paragraph></subsection> 
<subsection id="H31076C7108D64B55A4D3D041581E99FF"><enum>(b)</enum><header>Contracting</header><text>The Commission may, to such extent and in such amounts as are provided in appropriation Acts, enter into contracts to enable the Commission to discharge its duties of this Act.</text></subsection> 
<subsection id="H52E1316420C345919600D0F5DCFA35D"><enum>(c)</enum><header>Information from Federal agencies</header> 
<paragraph id="HF8DFC5D796D34DAAA144405F50B2A87E"><enum>(1)</enum><header>In general</header><text>The Commission may secure directly from any executive department, bureau, agency, board, commission, office, independent establishment, or instrumentality of the Federal Government, information, suggestions, estimates, and statistics for the purposes of this Act. Each department, bureau, agency, board, commission, office, independent establishment, or instrumentality shall furnish such information, suggestions, estimates, and statistics directly to the Commission, upon request made by the chairman, the chairman of any subcommittee created by a majority of the Commission, or any member designated by a majority of the Commission.</text></paragraph> 
<paragraph id="H7DAF226733AF4844BE7D8E4F97490721"><enum>(2)</enum><header>Receipt, handling, storage, and dissemination</header><text>Information shall be received, handled, stored, and disseminated by members of the Commission and its staff consistent with all applicable statutes, regulations, and Executive orders.</text></paragraph></subsection> 
<subsection id="HE36C3D58CF3842CC9719D2971ECCB28E"><enum>(d)</enum><header>Assistance from Federal agencies</header> 
<paragraph id="H9E7107C84C9E4BC78014FB258D66F37E"><enum>(1)</enum><header>General services administration</header><text>The Administrator of General Services shall provide to the Commission on a reimbursable basis administrative support and other services for the performance of the Commission’s functions.</text></paragraph> 
<paragraph id="H822A8319E1DF426A9EAAC5F109BC05DA"><enum>(2)</enum><header>Other departments and agencies</header><text>In addition to the assistance prescribed in paragraph (1), departments and agencies of the United States may provide to the Commission such services, funds, facilities, staff, and other support services as they may determine advisable and as may be authorized by law.</text></paragraph></subsection> 
<subsection id="H4826858B45324BDDB4C64DA8FDDA003B"><enum>(e)</enum><header>Gifts</header><text>The Commission may accept, use, and dispose of gifts or donations of services or property.</text></subsection> 
<subsection id="H20D26357AB5F4AB3AEE36360FFE8D3E9"><enum>(f)</enum><header>Postal services</header><text>The Commission may use the United States mails in the same manner and under the same conditions as departments and agencies of the United States.</text></subsection></section> 
<section id="HB878C599FA924ADEBE530248294E365E"><enum>105.</enum><header>Staff of Commission</header> 
<subsection id="H8004456C00094DE680B005F5AD8DB6B6"><enum>(a)</enum><header>In general</header> 
<paragraph id="H5630DE6542924861B6F76E97F743E0A2"><enum>(1)</enum><header>Appointment and compensation</header><text>The chairman and the vice chairman jointly, in accordance with rules agreed upon by the Commission, may appoint and fix the compensation of a staff director and such other personnel as may be necessary to enable the Commission to carry out its functions, without regard to the provisions of title 5, United States Code, governing appointments in the competitive service, and without regard to the provisions of chapter 51 and subchapter III of chapter 53 of such title relating to classification and General Schedule pay rates, except that no rate of pay fixed under this subsection may exceed the equivalent of that payable for a position at level V of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5316">section 5316</external-xref> of title 5, United States Code.</text></paragraph> 
<paragraph id="HEECF393FE5554479BA1F6107EB795E97"><enum>(2)</enum><header>Personnel as Federal employees</header> 
<subparagraph id="H61FB3BC20B6B455E96799DEA054CE7B3"><enum>(A)</enum><header>In general</header><text>The staff director and any personnel of the Commission who are employees shall be employees under <external-xref legal-doc="usc" parsable-cite="usc/5/2105">section 2105</external-xref> of title 5, United States Code, for purposes of chapters 63, 81, 83, 84, 85, 87, 89, and 90 of that title.</text></subparagraph> 
<subparagraph id="H2C2A173C08E34D14BC2EE4865E252EF9"><enum>(B)</enum><header>Members of commission</header><text>Subparagraph (A) shall not be construed to apply to members of the Commission.</text></subparagraph></paragraph></subsection> 
<subsection id="HE8A28FF5A4BC42808F87AA1CE147CB1E"><enum>(b)</enum><header>Detailees</header><text>Any Federal Government employee may be detailed to the Commission without reimbursement from the Commission, and such detailee shall retain the rights, status, and privileges of his or her regular employment without interruption.</text></subsection> 
<subsection id="HF9A7547B04F947DAA3CDAFC447E29CEC"><enum>(c)</enum><header>Consultant services</header><text>The Commission is authorized to procure the services of experts and consultants in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/3109">section 3109</external-xref> of title 5, United States Code, but at rates not to exceed the daily rate paid a person occupying a position at level IV of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5315">section 5315</external-xref> of title 5, United States Code.</text></subsection></section> 
<section id="H5D19BE15774B4014B75959E9DD8F47B8"><enum>106.</enum><header>Compensation and travel expenses</header> 
<subsection id="HA8D71274A41745D8B4A5238CCD8D8BF5"><enum>(a)</enum><header>Compensation</header><text>Each member of the Commission may be compensated at a rate not to exceed the daily equivalent of the annual rate of basic pay in effect for a position at level IV of the Executive Schedule under <external-xref legal-doc="usc" parsable-cite="usc/5/5315">section 5315</external-xref> of title 5, United States Code, for each day during which that member is engaged in the actual performance of the duties of the Commission.</text></subsection> 
<subsection id="H40A5892EE7D04F3194D27FCD003F6C1E"><enum>(b)</enum><header>Travel expenses</header><text>While away from their homes or regular places of business in the performance of services for the Commission, members of the Commission shall be allowed travel expenses, including per diem in lieu of subsistence, in the same manner as persons employed intermittently in the Government service are allowed expenses under <external-xref legal-doc="usc" parsable-cite="usc/5/5703">section 5703(b)</external-xref> of title 5, United States Code.</text></subsection></section> 
<section id="HA67A5ADA70B14DB9AA4BBB8B84A90033"><enum>107.</enum><header>Security clearances for Commission members and staff</header> 
<subsection id="HA0FD79566D354C6B005EC3FC1854AD"><enum>(a)</enum><header>In general</header><text>Subject to subsection (b), the appropriate Federal agencies or departments shall cooperate with the Commission in expeditiously providing to the Commission members and staff appropriate security clearances to the extent possible pursuant to existing procedures and requirements.</text></subsection> 
<subsection id="HA541D22C25844587A596825B61064342"><enum>(b)</enum><header>Exception</header><text>No person shall be provided with access to classified information under this title without the appropriate required security clearance access.</text></subsection></section> 
<section id="HBB8F148A8B6346ADB66DC528DCB2A4B0"><enum>108.</enum><header>Reports of Commission; termination</header> 
<subsection id="H787E7071F3514146B047E9E557DF7D28"><enum>(a)</enum><header>Evidence of abuses</header><text>The Commission shall report to Congress and to the President any evidence of waste, fraud, market manipulation, or other abuses it finds, in a timely and ongoing manner.</text></subsection> 
<subsection id="H0DAB5ECD4E024710BE4E927FDD1BFAD0"><enum>(b)</enum><header>Interim reports</header><text>The Commission may submit to Congress and the President interim reports containing such findings, conclusions, and recommendations for corrective measures as have been agreed to by a majority of Commission members.</text></subsection> 
<subsection id="H92E97ED77AE1446E804400F278B4CAE1"><enum>(c)</enum><header>Final report</header><text display-inline="yes-display-inline">Prior to the termination of the Commission, the Commission shall submit to Congress and the President a final report containing such findings, conclusions, and recommendations for corrective measures as have been agreed to by a majority of Commission members.</text></subsection> </section> 
<section id="HF4EB7FB2B7DC4145898B66007F00A11"><enum>109.</enum><header>Termination</header><text display-inline="no-display-inline">The Commission, and all the authorities of this Act, shall terminate 10 months after 80 percent of the funds appropriated by the 109th Congress for Hurricane Katrina recovery, relief, and reconstruction have been expended.</text></section> 
<section id="HB3E837541EDC4A7A8B344D1082754CBD"><enum>110.</enum><header>Funding</header> 
<subsection id="H645A19AACB4E4980003D85111FF0AB29"><enum>(a)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated funds not to exceed $5,000,000 for purposes of the activities of the Commission under this Act.</text></subsection> 
<subsection id="HD96D6E69437E422ABC7835EDE2DA4342"><enum>(b)</enum><header>Duration of availability</header><text>Amounts made available to the Commission under subsection (a) shall remain available until the termination of the Commission.</text></subsection></section></title> 
<title id="HB715ABE831E5430895F28F8EC93605E"><enum>II</enum><header>Clean Contracting for Hurricane Katrina Relief and Recovery</header> 
<subtitle id="HCB9767EBCF294532B230FD1236D874AC"><enum>A</enum><header>Transparency and Accountability</header> 
<section id="H9B3A3D2BE376405AA0188BD4C600694F"><enum>201.</enum><header>Public availability of contract award information</header> 
<subsection id="HF5B90B02A9AA4693BE00906044EBDE2C"><enum>(a)</enum><header>Requirement</header><text display-inline="yes-display-inline">Not later than 14 days after the award of a Hurricane Katrina-related contract by an executive agency, the head of the executive agency shall make publicly available, including by posting on the Internet in a searchable database, the following information with respect to the contract:</text> 
<paragraph id="H6D6609BE76B1430400AFB836F811D4CE"><enum>(1)</enum><text>The name and address of the contractor.</text></paragraph> 
<paragraph id="H54C2378E76C24B4EA1D957F9DCE9A694"><enum>(2)</enum><text>The date of award of the contract. </text></paragraph> 
<paragraph id="HE8F8232B8F7E4E75848766CB225B5EC2"><enum>(3)</enum><text>The number of offers received in response to the solicitation.</text></paragraph> 
<paragraph id="H8F060DB981AB42E1A74038E648CBA44E"><enum>(4)</enum><text>The total amount of the contract.</text></paragraph> 
<paragraph id="H5F3585319C684748A3001064FA72751C"><enum>(5)</enum><text>The contract type.</text></paragraph> 
<paragraph id="H6DF071C957DB402482222CD1A2ECBB10"><enum>(6)</enum><text>The items, quantities, and any stated unit price of items or services to be procured under the contract.</text></paragraph> 
<paragraph id="H16D434AD365145CD82F2AF00644B1884"><enum>(7)</enum><text>With respect to a procurement carried out using procedures other than competitive procedures—</text> 
<subparagraph id="H04CA23D6A6E243100067FAE44BFD599B"><enum>(A)</enum><text>the authority for using such procedures under section 303(c) of title III of the Federal Property and Administrative Services Act of 1949 (41 U.S.C.253(c)) or <external-xref legal-doc="usc" parsable-cite="usc/10/2304">section 2304(c)</external-xref> of title 10, United States Code; and</text></subparagraph> 
<subparagraph id="H5A9B675832FC4DC780FFFFD2B38B7C27"><enum>(B)</enum><text>the number of sources from which bids or proposals were solicited.</text></subparagraph></paragraph> 
<paragraph id="HF2BE93395E134EA3B172578DFCEBB51"><enum>(8)</enum><text>The general reasons for selecting the contractor.</text></paragraph></subsection> 
<subsection id="H771E10E26DC143E68623FB97BF6373C"><enum>(b)</enum><header>Definition</header><text>In this section, the term <quote>executive agency</quote> has the meaning provided in section 4 of the Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/403">41 U.S.C. 403</external-xref>). </text></subsection> 
<subsection id="H970B9291D78F41C4B7756CB1F1AC6C89" display-inline="no-display-inline"><enum>(c)</enum><header>Effective date</header><text>This section shall apply to contracts entered into more than 90 days after the date of the enactment of this Act.</text></subsection></section> 
<section id="HB2970621456E4B3091C38DF08CF75F5B" display-inline="no-display-inline" section-type="subsequent-section"><enum>202.</enum><header>Disclosure of Government contractor overcharges</header> 
<subsection id="H820D1B2083A0497DBED683BE7B6BECA6"><enum>(a)</enum><header>Quarterly Report to Congress</header><text>The head of each Federal agency or department shall submit to the chairman and ranking member of each committee described in subsection (b) on a quarterly basis a report that includes the following:</text> 
<paragraph id="H6D9CC15A0C90484B002FE9765DDD4F65"><enum>(1)</enum><text display-inline="yes-display-inline">A list of audits or other reports issued during the applicable quarter that describe contractor costs in excess of $1,000,000 that have been identified as unjustified, unsupported, questioned, or unreasonable under any Hurricane Katrina-related contract, task or delivery order under a Hurricane Katrina-related task or delivery order contract, or subcontract under a Hurricane Katrina-related contract.</text></paragraph> 
<paragraph id="H6853687A40BB45168392F17BFF4C200"><enum>(2)</enum><text display-inline="yes-display-inline">The specific amounts of costs identified as unjustified, unsupported, questioned, or unreasonable and the percentage of their total value of the contract, task or delivery order, or subcontract.</text></paragraph> 
<paragraph id="H2198046D147D4EC588957766BB95A460"><enum>(3)</enum><text display-inline="yes-display-inline">A list of audits or other reports issued during the applicable quarter that identify significant or substantial deficiencies in any business system of any contractor under any such contract, task or delivery order, or subcontract.</text></paragraph></subsection> 
<subsection id="HA482E07E34624FA391F5D6BDECAC00FC"><enum>(b)</enum><header>Committees</header><text>The report described in subsection (a) shall be submitted to the Committee on Government Reform of the House of Representatives, the Committee on Homeland Security and Governmental Affairs of the Senate, and other committees of jurisdiction.</text></subsection></section> 
<section id="HCB89E8D49BBB4C3E93D2A50374678DBF" display-inline="no-display-inline" section-type="subsequent-section"><enum>203.</enum><header>Provision of information to Congress</header> 
<subsection id="H38340988388A40CF9EAEC8DEE406F598"><enum>(a)</enum><header>Provision of information to congress</header><text display-inline="yes-display-inline">Upon request of the chairman or ranking member of a committee described in subsection (b), the head of an executive agency shall provide, with respect to any Hurricane Katrina-related contract or task or delivery order under a Hurricane Katrina-related task or delivery order contract entered into by the agency, within 14 days after receipt of the request, unredacted copies of any documents relating to the contract or task or delivery order, including any documents required to be maintained in the contracting office contract file, the contract administration office contract file, and the paying office contract file pursuant to subpart 4.8 of the Federal Acquisition Regulation, including—</text> 
<paragraph id="H4D3D32FCBB4C4EC4ABF199375483FF3F"><enum>(1)</enum><text>copies of the contract and all modifications;</text></paragraph> 
<paragraph id="H4683E2B1C5654DEB97E4A303D13876A5"><enum>(2)</enum><text>orders issued under the contract;</text></paragraph> 
<paragraph id="H686921B4562D48AEB0EFFAE327E63D57"><enum>(3)</enum><text>justifications and approvals;</text></paragraph> 
<paragraph id="HA731076EE1754BC883FBE5654DD605A9"><enum>(4)</enum><text>any government estimate of contract price;</text></paragraph> 
<paragraph id="H71265E8983DF47C8995141B1D97FE760"><enum>(5)</enum><text>source selection documentation;</text></paragraph> 
<paragraph id="H13D1F2B3C57D4CB9A444F53E8CFD2FAF"><enum>(6)</enum><text>cost or price analysis;</text></paragraph> 
<paragraph id="HDC1708FD7AE44896A8409447CBA7CD0"><enum>(7)</enum><text>audit reports;</text></paragraph> 
<paragraph id="HABCC291079DA4F13AC50368616C2F8DA"><enum>(8)</enum><text>justification for type of contract;</text></paragraph> 
<paragraph id="HEC08A02C425F429C9F7D2E1B3CBB8B46"><enum>(9)</enum><text>authority for deviations from regulations, statutory requirements, or other restrictions;</text></paragraph> 
<paragraph id="HD55DE16969F84203B56D3F96FC9C0683"><enum>(10)</enum><text>bills, invoices, vouchers, and supporting documents; and</text></paragraph> 
<paragraph id="H126F6E338F0540B08EFD2E0060962BE8"><enum>(11)</enum><text>records of payments or receipts.</text></paragraph></subsection> 
<subsection id="H8EDEE6E28C33404FB652CDC746B00D"><enum>(b)</enum><header>Committees</header><text>The committees referred to in subsection (a) are the following:</text> 
<paragraph id="HD8A5FE0952A84EDA8DB461946E273438"><enum>(1)</enum><text>The Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Government Reform of the House of Representatives.</text></paragraph> 
<paragraph id="H5731CDF2626741ACB14945CBAF0109E5"><enum>(2)</enum><text>The Committees on Appropriations of the Senate and House of Representatives.</text></paragraph> 
<paragraph id="H588FCF2BB9444E5EA928D3C693C5F729"><enum>(3)</enum><text>Each committee that the head of the executive agency determines has legislative jurisdiction for the operations of the department or agency to which the contract, task or delivery order, or other information referred to in subsection (a) relates.</text></paragraph></subsection></section></subtitle> 
<subtitle id="H6B94049F37ED4884A263FC56E6FD991D"><enum>B</enum><header>Prevention of Abusive Contracting Practices</header> 
<section id="HB38092CC4E304BB3810000FA202F51B9"><enum>211.</enum><header>Prohibition on award of monopoly contracts</header> 
<subsection id="H79D3F732F1874BDCA02C126328DA3850"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">The Federal Government may not enter into a Hurricane Katrina-related contract if the contract is a monopoly contract.</text></subsection> 
<subsection id="H25D46D0FBEE94BA59D9FBDA127DA704B" commented="no"><enum>(b)</enum><header>Monopoly contract</header><text display-inline="yes-display-inline">In this section, the term <quote>monopoly contract</quote> means a task or delivery order contract (as defined in section 303K of the Federal Property and Administrative Services Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/41/253k">41 U.S.C. 253k</external-xref>) or <external-xref legal-doc="usc" parsable-cite="usc/10/2304d">section 2304d</external-xref> of title 10, United States Code) that is a Hurricane Katrina-related contract in an amount estimated to exceed $10,000,000 (including all options) awarded to a single contractor.</text></subsection> 
<subsection id="H7AC4D46839F84B67A03C2E948C85D240" commented="no"><enum>(c)</enum><header>Exception</header><text></text> 
<paragraph id="H71083B39F7CB46260084FC22F1A7ABB1" commented="no"><enum>(1)</enum><header>In general</header><text>Notwithstanding subsection (a), a monopoly contract may be awarded if—</text> 
<subparagraph id="H2C166A765F9A4E23854B5B1629B741CC" commented="no"><enum>(A)</enum><text>the head of the agency—</text> 
<clause id="H5C748D6C4770416D8CD091966DA1C508" commented="no"><enum>(i)</enum><text>makes a determination described in paragraph (2); and</text></clause> 
<clause id="H064A7F3C3D334CA5AB3D5758E23C8B85" commented="no"><enum>(ii)</enum><text>justifies the determination in writing and certifies the accuracy and completeness of the justification; </text></clause></subparagraph> 
<subparagraph id="HA3865BF2068A49659B33156080729570" commented="no"><enum>(B)</enum><text>the justification is approved as described in 303(f)(1)(B) of the Federal Property and Administrative Services Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/41/253">41 U.S.C. 253(f)(1)(B)</external-xref>) or <external-xref legal-doc="usc" parsable-cite="usc/10/2304">section 2304(f)(1)(B)</external-xref> of title 10, United States Code; and</text></subparagraph> 
<subparagraph id="H95BE0BC3903E469AA5E527E7CEB8E5C" commented="no"><enum>(C) </enum><text>a statement describing the determination, justification, and approval are submitted to the chairman and ranking member of the committees described in paragraph (3). </text></subparagraph></paragraph> 
<paragraph id="HD86CC039DF0A4F0599FB3F8BC8112A5" commented="no"><enum>(2)</enum><text>A determination described in this paragraph is a determination in writing that—</text> 
<subparagraph id="H158E8D4CAA784AA6855475B0A0CEC7B1" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline"> for one of the reasons set forth in section 303(c) of the Federal Property and Administrative Services Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/41/253">41 U.S.C. 253(c)</external-xref>) or <external-xref legal-doc="usc" parsable-cite="usc/10/2304">section 2304(c)</external-xref> of title 10, United States Code, a single task or delivery order contract is in the best interest of the Federal Government; or</text></subparagraph> 
<subparagraph id="H8EAA8CD739EE48AFAE22477D8504057D" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline"> the task orders expected under the contract are so integrally related that only a single contractor can reasonably perform the work.</text></subparagraph></paragraph> 
<paragraph id="HFFD039C8A56144FA8DA7E1F0169BC6E1" commented="no"><enum>(3)</enum><text>The committees described in this paragraph are the Committee on Government Reform of the House of Representatives, the Committee on Homeland Security and Governmental Affairs of the Senate, the Committees on Appropriations of the House of Representatives and the Senate, and other committees of jurisdiction.</text></paragraph> 
<paragraph id="HEE54CE825C18400A9698C8C41DFEE8C" commented="no"><enum>(4)</enum><text>In the case of a determination described in paragraph (2)(A) that is for the reason set forth in section 303(c)(2) of the Federal Property and Administrative Services Act of 1949 or <external-xref legal-doc="usc" parsable-cite="usc/10/2304">section 2304(c)(2)</external-xref> of title 10, United States Code, the justification and approval required under paragraph (1) may be made after a contract is awarded, but not later than 30 days after the date of the award. </text></paragraph></subsection> 
<subsection id="H7075937F502E4D0A9F007FDFD8D4353"><enum>(d)</enum><header>Multiple awards</header><text display-inline="yes-display-inline">This section applies to a task order contract that is a Hurricane Katrina-related contract for the procurement of advisory and assistance services under section 303I of the Federal Property and Administrative Services Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/41/253i">41 U.S.C. 253i</external-xref>) or <external-xref legal-doc="usc" parsable-cite="usc/10/2304a">section 2304a</external-xref> of title 10, United States Code, notwithstanding section 303I(e) of such Act or section 2304a(d) of such title, respectively.</text></subsection></section> 
<section id="HAA1F796ABCE2443CBD5646BA86446F71" section-type="subsequent-section" display-inline="no-display-inline"><enum>212.</enum><header>Competition in multiple award contracts</header> 
<subsection id="HF1D4A77130FA4C72B9D666AE789F48"><enum>(a)</enum><header>Competition required</header><text display-inline="yes-display-inline">The Federal Government shall use competition in the purchase of goods and services pursuant to any Hurricane Katrina-related contract that is a multiple award contract in accordance with this section.</text></subsection> 
<subsection id="H13920C648B5B4918B32EDFDFCF479C64"><enum>(b)</enum><header>Specific requirements</header><text display-inline="yes-display-inline">Each individual purchase of goods or services by an executive agency or military department in excess of $100,000 that is made under a Hurricane Katrina-related contract that is a multiple award contract shall be made on a competitive basis unless a contracting officer of the executive agency or military department concerned—</text> 
<paragraph id="HCDDF6C1DD0B44724BB9334956B00AAAD"><enum>(1)</enum><text>waives the requirement on the basis of a determination that—</text> 
<subparagraph id="H7A6B940A792346488D1E08C7FCA95B9"><enum>(A)</enum> 
<clause id="H72FE0637A0C44F988380356C5D00BDCC" display-inline="yes-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">in the case of a contract entered into by an executive agency, one of the circumstances described in paragraphs (1) through (4) of section 303J(b) of the Federal Property and Administrative Services Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/41/253j">41 U.S.C. 253j(b)</external-xref>) applies to such individual purchase; or</text></clause> 
<clause id="H3D429771E333456A953E7400DD06D57" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a contract entered into by a military department, one of the circumstances described in paragraphs (1) through (4) of <external-xref legal-doc="usc" parsable-cite="usc/10/2304c">section 2304c(b)</external-xref> of title 10, United States Code, applies to such individual purchase; or</text></clause></subparagraph> 
<subparagraph id="H32DFBD67861E4009BF44D9BF74A8262C"><enum>(B)</enum><text>a statute expressly authorizes or requires that the purchase be made from a specified source; and</text></subparagraph></paragraph> 
<paragraph id="HB22B632807FC4F5FA8FF7383378D7EB"><enum>(2)</enum><text>justifies the determination in writing.</text></paragraph></subsection> 
<subsection id="HECFDAB61A0C343A6A6E5382DA7C27020" display-inline="no-display-inline"><enum>(c)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HDAE2CABDD7EC48CF911B5C54980000D8"><enum>(1)</enum><text>The term <quote>individual purchase</quote> means a task order, delivery order, or other purchase.</text></paragraph> 
<paragraph id="HF2A54E022D924D65901ED3219F59F262"><enum>(2)</enum><text>The term <quote>multiple award contract</quote> means—</text> 
<subparagraph id="H89C585C38C8E4BD19FB600B57B75006E"><enum>(A)</enum><text display-inline="yes-display-inline">a contract that is entered into by the Administrator of General Services under the multiple award schedule program referred to in section 309(b)(3) of the Federal Property and Administrative Services Act of 1949 (<external-xref legal-doc="usc" parsable-cite="usc/41/259">41 U.S.C. 259(b)(3)</external-xref>) or <external-xref legal-doc="usc" parsable-cite="usc/10/2302">section 2302(2)(C)</external-xref> of title 10, United States Code;</text></subparagraph> 
<subparagraph id="HC3A7E5C12BAF4ACE00BB98EC2C87D674"><enum>(B)</enum><text display-inline="yes-display-inline">a multiple award task order contract that is entered into under the authority of sections 2304a through 2304d of title 10, United States Code, or sections 303H through 303K of the Federal Property and Administrative Services Act of 1949 (41 U.S.C. 253h through 253k); and</text></subparagraph> 
<subparagraph id="H8CA90F8A8E0E4F4EB72F60E9B94F8CB2"><enum>(C)</enum><text>any other indefinite delivery, indefinite quantity contract that is entered into by the head of an executive agency with two or more sources pursuant to the same solicitation.</text></subparagraph></paragraph></subsection> </section> 
<section id="HD46961542B324F94B45E3009E2D20090" display-inline="no-display-inline" section-type="subsequent-section"><enum>213.</enum><header>Prohibition on contractor conflicts of interest</header> 
<subsection id="HA6C1284D42064E7CB978E2B124F3874F"><enum>(a)</enum><header>Prohibition</header><text display-inline="yes-display-inline">An agency may not enter into a Hurricane Katrina-related contract for the performance of a function relating to contract oversight with any contractor with a conflict of interest.</text></subsection> 
<subsection id="HA8056DE365B842A78276472FDA57FBDE"><enum>(b)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H6A64740C6285424300A67E0960F2D2B4"><enum>(1)</enum><text>The term <quote>function relating to contract oversight</quote> includes the following specific functions:</text> 
<subparagraph id="HCE4EFC84BB47458D84FDEEAAB0D8F78"><enum>(A)</enum><text>Evaluation of a contractor’s performance.</text></subparagraph> 
<subparagraph id="HC8D4CBB1D3014F8DAE9B68863D1DC276"><enum>(B)</enum><text>Evaluation of contract proposals.</text></subparagraph> 
<subparagraph id="H2670E5C1E2A8448A95D0CD9CA5A9B519"><enum>(C)</enum><text>Development of statements of work.</text></subparagraph> 
<subparagraph id="H1547ED1CA203464EAEBC2CF583C0EA20"><enum>(D)</enum><text>Services in support of acquisition planning.</text></subparagraph> 
<subparagraph id="H83057472B14B4854B60041C2E39E6644"><enum>(E)</enum><text>Contract management.</text></subparagraph></paragraph> 
<paragraph id="H92B7D4BB623B48BC82BA2C21D695AABB"><enum>(2)</enum><text>The term <quote>conflict of interest</quote> includes cases in which the contractor performing the function relating to contract oversight, or any related entity—</text> 
<subparagraph id="HC2777D03C37242C08B72C908B0ECE9C5"><enum>(A)</enum><text>is performing all or some of the work to be overseen;</text></subparagraph> 
<subparagraph id="H7FDDEF0770794E2F8B60B78D7751D9E2"><enum>(B)</enum><text>has a separate ongoing business relationship, such as a joint venture or contract, with any of the contractors to be overseen;</text></subparagraph> 
<subparagraph id="HD9D50170E3614BE8AE0392171B51ED71"><enum>(C)</enum><text>would be placed in a position to affect the value or performance of work it or any related entity is doing under any other Government contract;</text></subparagraph> 
<subparagraph id="HD79BF565CBD349899748151D92B71BBB"><enum>(D)</enum><text>has a reverse role with the contractor to be overseen under one or more separate Government contracts; and</text></subparagraph> 
<subparagraph id="HD3713F08429D458996DCAE006300CF94"><enum>(E)</enum><text>has some other relationship with the contractor to be overseen that could reasonably appear to bias the contractor’s judgment.</text></subparagraph></paragraph> 
<paragraph id="H44256095465D44879945FE46A526AE9C"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>related entity</quote>, with respect to a contractor, means any subsidiary, parent, affiliate, joint venture, or other entity related to the contractor.</text></paragraph></subsection> 
<subsection id="HD51A91904AC84EB3A1A62CBBA3DE1794"><enum>(c)</enum><header>Contracts relating to inherently governmental functions</header><text display-inline="yes-display-inline">An agency may not enter into a Hurricane Katrina-related contract for the performance of inherently governmental functions for contract oversight (as described in subpart 7.5 of part 7 of the Federal Acquisition Regulation).</text></subsection> </section> 
<section id="HD2865BC9BD444E38B8005B3E4CF4E6B7" section-type="subsequent-section" display-inline="no-display-inline"><enum>214.</enum><header>Closing the revolving door</header> 
<subsection id="HA928CC222F2A4F08A132368781AA5C00"><enum>(a)</enum><header>Strengthening the prohibition on former official’s acceptance of compensation from contractor</header> 
<paragraph id="HC0ED9F06E5B646BD8D5D5816FFFD75FF"><enum>(1)</enum><text display-inline="yes-display-inline">Paragraph (1) of section 27(d) of the Office of Federal Procurement Policy Act (<external-xref legal-doc="usc" parsable-cite="usc/41/423">41 U.S.C. 423(d)(1)</external-xref>) is amended—</text> 
<subparagraph id="H871ABDECA47C4FB900A2966BF67F9B14"><enum>(A)</enum><text>in subparagraph (C), by striking <quote>personally made for the Federal agency—</quote> and inserting <quote>participated personally and substantially in—</quote>; and</text></subparagraph> 
<subparagraph id="H3499F0DC2AB24BE3935626416BA11B1B"><enum>(B)</enum><text>in the text preceding subparagraph (A)—</text> 
<clause id="H5B0888E34EFA472580AE58458B3C0078"><enum>(i)</enum><text>by striking <quote>one year</quote> and inserting <quote>two years</quote>; and</text></clause> 
<clause id="H59D651D2F9064561B35EE99E04B2919F"><enum>(ii)</enum><text>by striking <quote>or consultant</quote> and inserting <quote>consultant, lawyer, or lobbyist</quote>.</text></clause></subparagraph></paragraph> 
<paragraph id="HC159F51830D84488006FDDE6A63B5994"><enum>(2)</enum><text>Paragraph (2) of section 27(d) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/41/423">41 U.S.C. 423(d)(2)</external-xref>) is amended to read as follows:</text>

<subsection id="HA62D4A235AB74A5EAB73B5AD466289AD"><enum>(b)</enum><header>Prevention of former employees of private contractors from awarding government contracts to their former employers</header><text>Section 27 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/41/423">41 U.S.C. 423</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H0CB4B3ABC087425B83CFC005FA18F30"><enum>(i)</enum><header>Prohibition on involvement by certain former contractor employees in procurements</header><text>A former employee of a nongovernment entity who becomes an employee of the Federal Government shall not be personally and substantially involved with any Federal agency procurement involving the employee’s former nongovernment entity employer, including any division, affiliate, subsidiary, parent, joint venture, or other related entity of the former employer, for a period of 5 years beginning on the date the employee leaves the employ of the nongovernment entity. In this subsection the term <quote>nongovernment entity</quote> means any entity that is not part of the Federal Government or any State or local government.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HCFFC3C91AE19482281AABD89550874F5"><enum>(c)</enum><header>Requirement for Federal procurement officers to disclose job offers made to relatives</header><text>Section 27(c)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/41/423">41 U.S.C. 423(c)(1)</external-xref>) is amended by inserting after <quote>that official</quote> the following: <quote>or for a relative of that official (as defined in <external-xref legal-doc="usc" parsable-cite="usc/5/3110">section 3110</external-xref> of title 5, United States Code),</quote>.</text></subsection> 
<subsection id="HE175AF051B424279B413F0C8B9FA75C4"><enum>(d)</enum><header>Revised penalties</header><text>Paragraph (1) of section 27(e) of such Act (41 U.S.C. (e)(1)) is amended to read as follows:</text>

<subparagraph id="H2298C5A51BCD41EBBCE0382F1E6C0060"><enum>(A)</enum><text>subsection (a) or (b) for the purpose of either—</text> 
<clause id="HC04C89E7312D43BAAF787F4F5C6B556C"><enum>(i)</enum><text>exchanging the information covered by such subsection for anything of value, or</text></clause> 
<clause id="H616E39B83AB94E8FAC70AB7B6B003EEF"><enum>(ii)</enum><text>obtaining or giving anyone a competitive advantage in the award of a Federal agency procurement contract; or</text></clause></subparagraph> 
<subparagraph id="H039C1877BDB347FBB5816F376F1D99F1"><enum>(B)</enum><text>subsection (c) or (d); </text></subparagraph><continuation-text continuation-text-level="paragraph">shall be imprisoned for not more than 5 years or fined as provided under title 18, United States Code, or both.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

<section id="H0B8EFA39DA024C228C42002FEF8C4EA7"><enum>221.</enum><header>Definition of Hurricane Katrina-related contract</header><text display-inline="no-display-inline">In this title, the term <quote>Hurricane Katrina-related contract</quote> or <quote>Hurricane Katrina-related task or delivery order contract</quote> means a contract for the procurement of property or services to be used in support of Hurricane Katrina rescue, relief, recovery, or reconstruction operations. The term includes any subcontracts under such a contract.</text></section></subtitle></title>
