<official-title>To preserve certain immigration benefits for victims of Hurricane Katrina, and for other purposes.</official-title>

<section id="H5BF6508FD84C4917B22503CFAE64CE05" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Immigration Relief for Hurricane Katrina Victims Act of 2005</short-title></quote>.</text></section> 
<section id="HF57BF5720AAF4AD7936DBED1BC4422E0" section-type="subsequent-section" display-inline="no-display-inline"><enum>2.</enum><header>Special immigrant status</header> 
<subsection id="H73EAAEB123D342BB83268F2949C2756C"><enum>(a)</enum><header>In General</header><text>For purposes of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>), the Secretary of Homeland Security may provide an alien described in subsection (b) with the status of a special immigrant under section 101(a)(27) of such Act (8 U.S.C. 1101(a(27)), if the alien—</text> 
<paragraph id="H76DD3EFD1BAF444AACA68B8FBAA690B0"><enum>(1)</enum><text>files with the Secretary of Homeland Security a petition under section 204 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154</external-xref>) for classification under section 203(b)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)(4)</external-xref>); and</text></paragraph> 
<paragraph id="H17E7B523D8FE4545A853E4A76989B33E"><enum>(2)</enum><text>is otherwise eligible to receive an immigrant visa and is otherwise admissible to the United States for permanent residence, except in determining such admissibility, the grounds for inadmissibility specified in section 212(a)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(4)</external-xref>) shall not apply.</text></paragraph></subsection> 
<subsection id="H962B5DF5CE6449B88624003407B9AECF"><enum>(b)</enum><header>Aliens Described</header> 
<paragraph id="HDD368A5FD0104FF5A5FDC649C0364500"><enum>(1)</enum><header>Principal aliens</header><text>An alien is described in this subsection if—</text> 
<subparagraph id="HCA75BAA8EFBA4E75A148560944B76D63"><enum>(A)</enum><text>the alien was the beneficiary of—</text> 
<clause id="HFBBF8CEBEAF341BAB532A6CE80AEFD2F"><enum>(i)</enum><text>a petition that was filed with the Secretary of Homeland Security on or before August 29, 2005—</text> 
<subclause id="H0E772499315949F8B2FA5D0031439692"><enum>(I)</enum><text>under section 204 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154</external-xref>) to classify the alien as a family-sponsored immigrant under section 203(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(a)</external-xref>) or as an employment-based immigrant under section 203(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>); or</text></subclause> 
<subclause id="HABBD8A17BCEF4477AB70C747F2A9E5D5"><enum>(II)</enum><text>under section 214(d) (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(d)</external-xref>) of such Act to authorize the issuance of a nonimmigrant visa to the alien under section 101(a)(15)(K) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(K)</external-xref>); or</text></subclause></clause> 
<clause id="H6538700395F54BA4A071F19B00F684EC"><enum>(ii)</enum><text>an application for labor certification under section 212(a)(5)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(5)(A)</external-xref>) that was filed under regulations of the Secretary of Labor on or before such date; and</text></clause></subparagraph> 
<subparagraph id="H6399BBBB9D6F42E4BF603F8CC2CD8761"><enum>(B)</enum><text>such petition or application was revoked or terminated (or otherwise rendered null), either before or after its approval, due to a specified hurricane disaster that had as a consequence—</text> 
<clause id="H58EFB91F656042BDB8D7F1A5CC437EBC"><enum>(i)</enum><text>the death or disability of the petitioner, applicant, or alien beneficiary; or</text></clause> 
<clause id="H690F3F2C7768437BB4108600EDC5F666"><enum>(ii)</enum><text>loss of employment due to physical damage to, or destruction of, the business of the petitioner or applicant.</text></clause></subparagraph></paragraph> 
<paragraph id="H8AF76522DB4944929EDDD896D3D9BBCD"><enum>(2)</enum><header>Spouses and children</header> 
<subparagraph id="HACCCD67109F14F1CA55317B3B685AC17"><enum>(A)</enum><header>In general</header><text>An alien is described in this subsection if—</text> 
<clause id="HF0EB59F9986E4509A59BE8A652FF3B00"><enum>(i)</enum><text>the alien was, on August 29, 2005, the spouse or child of a principal alien described in paragraph (1); and</text></clause> 
<clause id="HED0AD36D4E034B2FA33DDC8FA69F730"><enum>(ii)</enum><text>the alien—</text> 
<subclause id="HAFB482332E614962B9023205057984CB"><enum>(I)</enum><text>is accompanying such principal alien; or</text></subclause> 
<subclause id="H5CEA2949700A40578205114B9E3ECC"><enum>(II)</enum><text>is following to join such principal alien not later than August 29, 2007.</text></subclause></clause></subparagraph> 
<subparagraph id="H7AC8D22904AF40FCBDF15972DE6887F0"><enum>(B)</enum><header>Construction</header><text>For purposes of construing the terms <term>accompanying</term> and <term>following to join</term> in subparagraph (A)(ii), any death of a principal alien that is described in paragraph (1)(B)(i) shall be disregarded.</text></subparagraph></paragraph> 
<paragraph id="H618E539AA15F4924B9DAA6BFEF96CC95"><enum>(3)</enum><header>Grandparents of orphans</header><text>An alien is described in this subsection if the alien is a grandparent of a child, both of whose parents died as a consequence of a specified hurricane disaster, if either of such deceased parents was, on August 29, 2005 a citizen or national of the United States or an alien lawfully admitted for permanent residence in the United States.</text></paragraph></subsection> 
<subsection id="HB553170FB9D947DAB6EF3EFB66DB6579"><enum>(c)</enum><header>Priority Date</header><text>Immigrant visas made available under this section shall be issued to aliens in the order in which a petition on behalf of each such alien is filed with the Secretary of Homeland Security under subsection (a)(1), except that if an alien was assigned a priority date with respect to a petition described in subsection (b)(1)(A)(i), the alien may maintain that priority date.</text></subsection> 
<subsection id="H8A59A1C959F24B0A8F33BCED18802D74"><enum>(d)</enum><header>Numerical Limitations</header><text>For purposes of the application of sections 201 through 203 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151–1153</external-xref>) in any fiscal year, aliens eligible to be provided status under this section shall be treated as special immigrants described in section 101(a)(27) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(27)</external-xref>) who are not described in subparagraph (A), (B), (C), or (K) of such section.</text></subsection></section> 
<section id="HCA7946765E9E4AA4B98F52C5083163D8"><enum>3.</enum><header>Extension of filing or reentry deadlines</header> 
<subsection id="H5B3ACF6D0B8A4C23BA13E604A0BD7746"><enum>(a)</enum><header>Automatic Extension of Nonimmigrant Status</header> 
<paragraph id="HF91F20C4911A49668B33E52725E8234"><enum>(1)</enum><header>In general</header><text>Notwithstanding section 214 of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184</external-xref>), in the case of an alien described in paragraph (2) who was lawfully present in the United States as a nonimmigrant on August 29, 2005, the alien may remain lawfully in the United States in the same nonimmigrant status until the later of—</text> 
<subparagraph id="H12EA2D08C3B34F79ACF5A7AA17F10086"><enum>(A)</enum><text>the date such lawful nonimmigrant status otherwise would have terminated if this subsection had not been enacted; or</text></subparagraph> 
<subparagraph id="HF2339872C6364D84B5E2C41B99EB7EDD"><enum>(B)</enum><text>1 year after the death or onset of disability described in paragraph (2).</text></subparagraph></paragraph> 
<paragraph id="H8EBAC893D05B4C2F94CB64F008EF46C"><enum>(2)</enum><header>Aliens described</header> 
<subparagraph id="H241504E47F1145ECA495E7D0887500D8"><enum>(A)</enum><header>Principal aliens</header><text>An alien is described in this paragraph if the alien was disabled as a consequence of a specified hurricane disaster.</text></subparagraph> 
<subparagraph id="H7C9C7E5CC9854EB6819F90F26BBC2713"><enum>(B)</enum><header>Spouses and children</header><text>An alien is described in this paragraph if the alien was, on August 29, 2005, the spouse or child of—</text> 
<clause id="HC629E4C6E7594182B120E754EED47E90"><enum>(i)</enum><text>a principal alien described in subparagraph (A); or</text></clause> 
<clause id="H63304418AB704D1DACBCE6885CDF3243"><enum>(ii)</enum><text>an alien who died as a consequence of a specified hurricane disaster.</text></clause></subparagraph></paragraph> 
<paragraph id="H997D16102FCF4BAB866E942837E46805"><enum>(3)</enum><header>Authorized employment</header><text>During the period in which a principal alien or alien spouse is in lawful nonimmigrant status under paragraph (1), the alien shall be provided an <quote>employment authorized</quote> endorsement or other appropriate document signifying authorization of employment not later than 30 days after the alien requests such authorization.</text></paragraph></subsection> 
<subsection id="H7DB23273F9A74746BF36BC2903448B05"><enum>(b)</enum><header>New Deadlines for Extension or Change of Nonimmigrant Status</header> 
<paragraph id="HA4E4CE737EDC41D7881675E1915EB2D1"><enum>(1)</enum><header>Filing delays</header><text>In the case of an alien who was lawfully present in the United States as a nonimmigrant on August 29, 2005, if the alien was prevented from filing a timely application for an extension or change of nonimmigrant status due to a circumstance described in paragraph (3)(A) that is a consequence of a specified hurricane disaster, the alien’s application shall be considered timely filed if it is filed not later than 180 days after it otherwise would have been due.</text></paragraph> 
<paragraph id="HE3DD67CC68E94670B0CCCAAAFC04E83"><enum>(2)</enum><header>Departure delays</header><text>In the case of an alien who was lawfully present in the United States as a nonimmigrant on August 29, 2005, if the alien was prevented from timely departing the United States due to a circumstance described in paragraph (3)(B) that is a consequence of a specified hurricane disaster, the alien shall not be considered to have been unlawfully present in the United States during the period beginning on August 30, 2005, and ending on the date of the alien’s departure, if such departure occurs on or before December 31, 2005.</text></paragraph> 
<paragraph id="H0F6E7A7FF936434EBA60AB619EBE73B2"><enum>(3)</enum><header>Circumstances preventing timely action</header> 
<subparagraph id="HD8811221D0054700A1B58DDE973200C0"><enum>(A)</enum><header>Filing delays</header><text display-inline="yes-display-inline">For purposes of paragraph (1), circumstances preventing an alien from filing a timely application are—</text> 
<clause id="H86E417552EE6428B8856CFFB9B52B915"><enum>(i)</enum><text>injury;</text></clause> 
<clause id="HF03CC17B5BEA4C019762D3766D130656"><enum>(ii)</enum><text>office closures;</text></clause> 
<clause id="HD22E02BA370E434D98485F7E8F2912E6"><enum>(iii)</enum><text>mail or courier service cessations or delays; and</text></clause> 
<clause id="HC466F2BE6EC8424B885064A855C867D"><enum>(iv)</enum><text>other closures, cessations, or delays affecting case processing or travel necessary to satisfy legal requirements.</text></clause></subparagraph> 
<subparagraph id="HEEE30DC9350740689173EE051EBCD809"><enum>(B)</enum><header>Departure delays</header><text display-inline="yes-display-inline">For purposes of paragraph (2), circumstances preventing an alien from timely departing the United States are—</text> 
<clause id="H7843B03D1687441E00FF9785F500A4AE"><enum>(i)</enum><text>injury;</text></clause> 
<clause id="HE92EBB50E9914DD09702C2EB52948684"><enum>(ii)</enum><text>office closures;</text></clause> 
<clause id="HB30CE673137D4EFFA5B9A67C72E6EB3E"><enum>(iii)</enum><text>airline flight cessations or delays; and</text></clause> 
<clause id="H34A49E5465504CB700DB893CE5202199"><enum>(iv)</enum><text>other closures, cessations, or delays affecting case processing or travel necessary to satisfy legal requirements.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HCB1B7B442AEF4EEE8B58A74B6D74FDF1"><enum>(c)</enum><header>Diversity Immigrants</header> 
<paragraph id="H8BCE046C3B0647BB9F001938881BDE8D"><enum>(1)</enum><header>Waiver of fiscal year limitation</header><text>Notwithstanding section 203(e)(2) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(e)(2)</external-xref>), an immigrant visa number issued to an alien under section 203(c) of such Act for fiscal year 2005 may be used by the alien during the period beginning on October 1, 2005, and ending on April 1, 2006, if the alien establishes that the alien was prevented from using it during fiscal year 2005 due to a circumstance described in paragraph (4) that is a consequence of a specified hurricane disaster.</text></paragraph> 
<paragraph id="H89E2EF87C4BD49FFAAB01C4B30004326"><enum>(2)</enum><header>Worldwide level</header><text>In the case of an alien entering the United States as a lawful permanent resident, or adjusting to that status, under paragraph (1) or (3), the alien shall be counted as a diversity immigrant for fiscal year 2005 for purposes of section 201(e) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(e)</external-xref>), unless the worldwide level under such section for such year has been exceeded, in which case the alien shall be counted as a diversity immigrant for fiscal year 2006.</text></paragraph> 
<paragraph id="HCADD5E0F35D04863BA3E87E297199160"><enum>(3)</enum><header>Treatment of family members of certain aliens</header><text>In the case of a principal alien issued an immigrant visa number under section 203(c) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(c)</external-xref>) for fiscal year 2005, if such principal alien died as a consequence of a specified hurricane disaster, the aliens who were, on August 29, 2005, the spouse and children of such principal alien shall, until June 30, 2006, if not otherwise entitled to an immigrant status and the immediate issuance of a visa under subsection (a), (b), or (c) of section 203 of such Act, be entitled to the same status, and the same order of consideration, that would have been provided to such alien spouse or child under section 203(d) of such Act as if the principal alien were not deceased and as if the spouse or child’s visa application had been adjudicated by September 30, 2005.</text></paragraph> 
<paragraph id="H73391A4223B440C3A32064F7882F6BE0"><enum>(4)</enum><header>Circumstances preventing timely action</header><text>For purposes of paragraph (1), circumstances preventing an alien from using an immigrant visa number during fiscal year 2005 are—</text> 
<subparagraph id="HF6526C48FF57417FAF657D14A4FAF6CE"><enum>(A)</enum><text>office closures;</text></subparagraph> 
<subparagraph id="H3E363043F0994BE7BE089933C986F13F"><enum>(B)</enum><text>mail or courier service cessations or delays;</text></subparagraph> 
<subparagraph id="H8EEE8E2033A04009838D7188E5BC907"><enum>(C)</enum><text>airline flight cessations or delays; and</text></subparagraph> 
<subparagraph id="HBC97C753D7574F20BC3755F17CF091D9"><enum>(D)</enum><text>other closures, cessations, or delays affecting case processing or travel necessary to satisfy legal requirements.</text></subparagraph></paragraph></subsection> 
<subsection id="H66DD4FF07BB74D3CA117B03EBA239F3B"><enum>(d)</enum><header>Extension of Expiration of Immigrant Visas</header> 
<paragraph id="H0E1910BD1824497DBD12D9758730F49F"><enum>(1)</enum><header>In general</header><text>Notwithstanding the limitations under section 221(c) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1201">8 U.S.C. 1201(c)</external-xref>), in the case of any immigrant visa issued to an alien that expires or expired before February 26, 2006 if the alien was unable to effect entry into the United States due to a circumstance described in paragraph (2) that is a consequence of a specified hurricane disaster, then the period of validity of the visa is extended until February 26, 2006, unless a longer period of validity is otherwise provided under this Act.</text></paragraph> 
<paragraph id="H17AC3CBC3C98496AB8066CB82C00E66E"><enum>(2)</enum><header>Circumstances preventing entry</header><text>For purposes of paragraph (1), circumstances preventing an alien from effecting entry into the United States are—</text> 
<subparagraph id="H5C546919E2F04A08008200DEB8EA11D"><enum>(A)</enum><text>destruction of, or damage rendering uninhabitable, the intended residence of the alien;</text></subparagraph> 
<subparagraph id="H3A62178A5F82481490DE0014A3F77CC5"><enum>(B)</enum><text>a legal prohibition on inhabiting or accessing the intended residence of the alien;</text></subparagraph> 
<subparagraph id="HE6CCE4C2D02B48F388B715E655F29FDC"><enum>(C)</enum><text>office closures;</text></subparagraph> 
<subparagraph id="H143820A9DE024EDD8F00773F50C6AD00"><enum>(D)</enum><text>airline flight cessations or delays; and</text></subparagraph> 
<subparagraph id="HB07077EC8B6C4B0B97CEAC497307C34"><enum>(E)</enum><text>other closures, cessations, or delays affecting case processing or travel necessary to satisfy legal requirements.</text></subparagraph></paragraph></subsection> 
<subsection id="H5DEDDBB65AD643B296959722598C21E1"><enum>(e)</enum><header>Grants of Parole Extended</header> 
<paragraph id="HF5087E3A8985454B9E4E9E26947960E0"><enum>(1)</enum><header>In general</header><text>In the case of any parole granted by the Secretary of Homeland Security under section 212(d)(5) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(d)(5)</external-xref>) that expires on a date on or after August 26, 2005, if the alien beneficiary of the parole was unable to return to the United States prior to the expiration date due to a circumstance described in paragraph (2) that is a consequence of a specified hurricane disaster, the parole is deemed extended for an additional 90 days.</text></paragraph> 
<paragraph id="H383936DE6972466E82DDB82E3496E1F9"><enum>(2)</enum><header>Circumstances preventing return</header><text>For purposes of paragraph (1), circumstances preventing an alien from timely returning to the United States are—</text> 
<subparagraph id="H2DA50C2DE0814376BEF5F0F04DE3688B"><enum>(A)</enum><text>office closures;</text></subparagraph> 
<subparagraph id="H0E997A8A5E8549D6A1C13EA5E7B8EA94"><enum>(B)</enum><text>airline flight cessations or delays; and</text></subparagraph> 
<subparagraph id="H201FDB27BDF34FC28950C0E79034AE47"><enum>(C)</enum><text>other closures, cessations, or delays affecting case processing or travel necessary to satisfy legal requirements.</text></subparagraph></paragraph></subsection> 
<subsection id="HB64F69A83E6C46A0B1566FEB84E9CAB5"><enum>(f)</enum><header>Voluntary Departure</header><text>Notwithstanding section 240B of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1229c">8 U.S.C. 1229c</external-xref>), if a period for voluntary departure of an alien under such section expired during the period beginning on August 26, 2005, and ending on October 26, 2005, and the alien was unable voluntarily to depart as a consequence of a specified hurricane disaster, such voluntary departure period is deemed extended for an additional 60 days.</text></subsection></section> 
<section id="HD6E7FDEF8B7C46C7BC4C79772FE41DFC"><enum>4.</enum><header>Humanitarian relief for certain surviving spouses and children</header> 
<subsection id="H7CDA4F69D7E84340BF2B0387B449013B"><enum>(a)</enum><header>Treatment as Immediate Relatives</header> 
<paragraph id="HB38F2D63AE4C4A6B893800A739639CC5"><enum>(1)</enum><header>Spouses</header><text>Notwithstanding the second sentence of section 201(b)(2)(A)(i) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(b)(2)(A)(i)</external-xref>), in the case of an alien who was the spouse of a citizen of the United States at the time of the citizen’s death and was not legally separated from the citizen at the time of the citizen’s death, if the citizen died as a consequence of a specified hurricane disaster, the alien (and each child of the alien) shall be considered, for purposes of section 201(b) of such Act, to be an immediate relative after the date of the citizen’s death, but only if the alien files a petition under section 204(a)(1)(A)(ii) of such Act within 2 years after such date and only until the date the alien remarries. For purposes of such section 204(a)(1)(A)(ii), an alien granted relief under the preceding sentence shall be considered an alien spouse described in the second sentence of section 201(b)(2)(A)(i) of such Act.</text></paragraph> 
<paragraph id="H908DF8F2D57941F3B365EF2103453D5D"><enum>(2)</enum><header>Children</header> 
<subparagraph id="HF82F325D84394DC4B8ECA51200F9E47"><enum>(A)</enum><header>In general</header><text>In the case of an alien who was the child of a citizen of the United States at the time of the citizen’s death, if the citizen died as a consequence of a specified hurricane disaster, the alien shall be considered, for purposes of section 201(b) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(b)</external-xref>), to remain an immediate relative after the date of the citizen’s death (regardless of changes in age or marital status thereafter), but only if the alien (or a parent or guardian of the alien) files a petition under subparagraph (B) within 2 years after such date.</text></subparagraph> 
<subparagraph id="HF684BDF34933448AA05C6325CB81BAFF"><enum>(B)</enum><header>Petitions</header><text>An alien (or parent or guardian) described in subparagraph (A) may file a petition with the Secretary of Homeland Security for classification of the alien under section 201(b)(2)(A)(i) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(b)(2)(A)(i)</external-xref>). For purposes of such Act, such a petition shall be considered a petition filed under section 204(a)(1)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154(a)(1)(A)</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="HFD1FB752E2ED4A52A63C00C25645AF25"><enum>(3)</enum><header>Unconditional status</header><text>An alien who obtains the status of an alien lawfully admitted for permanent residence pursuant to this subsection shall not be considered to have obtained such status on a conditional basis, and shall not be subject to section 216 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1186a">8 U.S.C. 1186a</external-xref>).</text></paragraph></subsection> 
<subsection id="H5C119DC658E247B98C34002C2B9D86E3"><enum>(b)</enum><header>Spouses, Children, Unmarried Sons and Daughters of Lawful Permanent Resident Aliens</header> 
<paragraph id="H61EECE608B8B46048F9B00CF93966B7B"><enum>(1)</enum><header>In general</header><text>Any spouse, child, or unmarried son or daughter of an alien described in paragraph (3) who is included in a petition for classification as a family-sponsored immigrant under section 203(a)(2) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(a)(2)</external-xref>) that was filed by such alien before August 29, 2005, shall be considered (if the spouse, child, son, or daughter has not been admitted or approved for lawful permanent residence by such date) a valid petitioner for preference status under such section with the same priority date as that assigned prior to the death described in paragraph (3)(A). No new petition shall be required to be filed. Such spouse, child, son, or daughter may be eligible for deferred action and work authorization.</text></paragraph> 
<paragraph id="HD8B5DF15C1AD406A9EBF37EA13FBFF58"><enum>(2)</enum><header>Self-petitions</header><text>Any spouse, child, or unmarried son or daughter of an alien described in paragraph (3) who is not a beneficiary of a petition for classification as a family-sponsored immigrant under section 203(a)(2) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> may file a petition for such classification with the Secretary of Homeland Security, if the spouse, child, son, or daughter was present in the United States on August 29, 2005. Such spouse, child, son, or daughter may be eligible for deferred action and work authorization.</text></paragraph> 
<paragraph id="HAE9B52A1B2FA44939EEB9CBBF0B90027"><enum>(3)</enum><header>Aliens described</header><text>An alien is described in this paragraph if the alien—</text> 
<subparagraph id="HD2B456D4E3E04568A122B843B0C3B1DA"><enum>(A)</enum><text>died as a consequence of a specified hurricane disaster; and</text></subparagraph> 
<subparagraph id="H9FE5A0BB3BF3470E99558EE9AAD58E95"><enum>(B)</enum><text>on the day of such death, was lawfully admitted for permanent residence in the United States.</text></subparagraph></paragraph> 
<paragraph id="H1E5559CF11B041F5935E73983446EAD3"><enum>(4)</enum><header>Unconditional status</header><text>An alien who obtains the status of an alien lawfully admitted for permanent residence pursuant to this subsection shall not be considered to have obtained such status on a conditional basis, and shall not be subject to section 216 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1186a">8 U.S.C. 1186a</external-xref>).</text></paragraph></subsection> 
<subsection id="H0E9BF3A92AEC4E7996EB626D01A1957C"><enum>(c)</enum><header>Applications for Adjustment of Status by Surviving Spouses and Children of Employment-Based Immigrants</header> 
<paragraph id="HE472544F999F4F0CA9420008E5A5A699"><enum>(1)</enum><header>In general</header><text>Any alien who was, on August 29, 2005, the spouse or child of an alien described in paragraph (2), and who applied for adjustment of status prior to the death described in paragraph (2)(A), may have such application adjudicated as if such death had not occurred.</text></paragraph> 
<paragraph id="H9F1818146AB94933B9843C2942CC00BD"><enum>(2)</enum><header>Aliens described</header><text>An alien is described in this paragraph if the alien—</text> 
<subparagraph id="H2490DC6BA72C4D8DA61B009011CDBA9D"><enum>(A)</enum><text>died as a consequence of a specified hurricane disaster; and</text></subparagraph> 
<subparagraph id="H125C172F9C234154A914F2763D5538A9"><enum>(B)</enum><text>on the day before such death, was—</text> 
<clause id="HAFC3D1F4DF0A461FAC1CE385F180BE90"><enum>(i)</enum><text>an alien lawfully admitted for permanent residence in the United States by reason of having been allotted a visa under section 203(b) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>); or</text></clause> 
<clause id="H9C0FB37500F44D87853710B4100FCD9"><enum>(ii)</enum><text>an applicant for adjustment of status to that of an alien described in clause (i), and admissible to the United States for permanent residence.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HBCC83B9882A946E5A2504023587EF444"><enum>(d)</enum><header>Applications for asylum or admission as refugee by surviving spouses and children of asylees and refugees</header> 
<paragraph id="HD823FAA003BA4BD28D002F9BC5827923"><enum>(1)</enum><header>Asylum</header> 
<subparagraph id="H42E8B3904E2147D18F8C4EAE34B5A16B"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Any alien who was, on August 29, 2005, the spouse or child of an individual described in subparagraph (B), may have the alien’s eligibility to be granted asylum determined under section 208(b)(3) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158(b)(3)</external-xref>) as if such individual had not died.</text></subparagraph> 
<subparagraph id="HB27702BD116A435993B3C4CE46812545"><enum>(B)</enum><header>Principals described</header><text>An individual is described in this subparagraph if the individual—</text> 
<clause id="H60D64227D977425A9199D90289C17800"><enum>(i)</enum><text>died as a consequence of a specified hurricane disaster; and</text></clause> 
<clause id="HE3E67137A611495EB800F6D755944F03"><enum>(ii)</enum><text>before such death, was granted asylum under section 208 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1158">8 U.S.C. 1158</external-xref>).</text></clause></subparagraph></paragraph> 
<paragraph id="HCB9D25681FE1417EB92562AD521EBDDC" display-inline="no-display-inline"><enum>(2)</enum><header>Admission as a refugee</header> 
<subparagraph id="HBA601033B2DE4A088C857FFAE180F880"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Any alien who was, on August 29, 2005, the spouse or child of an individual described in subparagraph (B), may have the alien’s eligibility to be admitted to the United States as a refugee determined under section 207(c)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157(c)(2)</external-xref>) as if such individual had not died.</text></subparagraph> 
<subparagraph id="HD965AE41766B4711B4D4F5475DFEF32"><enum>(B)</enum><header>Principals described</header><text>An individual is described in this subparagraph if the individual—</text> 
<clause id="H8A08B8C3B942413EAC8C8381CD2C71F"><enum>(i)</enum><text>died as a consequence of a specified hurricane disaster; and</text></clause> 
<clause id="H98327B10222047959626DB8894BD007D"><enum>(ii)</enum><text>before such death, was admitted to the United States as a refugee under section 207 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1157">8 U.S.C. 1157</external-xref>).</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H88E8C600E56541D694843C75E636A055"><enum>(e)</enum><header>Waiver of Public Charge Grounds</header><text>In determining the admissibility of any alien accorded an immigration benefit under this section, the grounds for inadmissibility specified in section 212(a)(4) of the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182(a)(4)</external-xref>) shall not apply.</text></subsection></section> 
<section id="H246C7BD59ECA436DADBADCAF4D5A33"><enum>5.</enum><header>Naturalization</header> 
<subsection id="H3AD60FD82C884443B749573BF2F01D50"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">With respect to an applicant for naturalization who resided, on August 29, 2005, within a portion of a district of U.S. Citizenship and Immigration Services that was declared by the President to be affected by a specified hurricane disaster, the Secretary of Homeland Security may administer the provisions of title III of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1401">8 U.S.C. 1401 et seq.</external-xref>) without regard to any provision of such title otherwise requiring residence to be maintained, or any other action to be taken, in any specific State or district of U.S. Citizenship and Immigration Services.</text></subsection> 
<subsection id="HCF26EFFC855C44ADA9FF4E41D32048DB"><enum>(b)</enum><header>Court authority to administer oaths</header><text>Notwithstanding section 310(b)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1421">8 U.S.C. 1421(b)(1)</external-xref>), with respect to an applicant for naturalization described in subsection (a), an eligible court (as defined in section 310(b)(5) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1421">8 U.S.C. 1421(b)(5)</external-xref>)) may administer the oath of allegiance under section 337(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1448">8 U.S.C. 1448(a)</external-xref>) to the applicant regardless of whether the applicant is permanently residing within the jurisdiction of the court.</text></subsection></section> 
<section id="HFCB1C69FABAB40B4AD9DE2C4D2CDBCC1"><enum>6.</enum><header>Foreign students and exchange program participants</header> 
<subsection id="H62C7B909EC0E42DCA8604B5E74603D77"><enum>(a)</enum><header>In general</header><text>In the case of an nonimmigrant alien described in subsection (b), the alien’s nonimmigrant status shall be considered to have been maintained during the period beginning on August 29, 2005, and ending on February 1, 2006, if, on February 1, 2006, the alien is enrolled in a course of study, or participating in a designated exchange visitor program, sufficient to satisfy the terms and conditions of the alien’s nonimmigrant status on August 29, 2005.</text></subsection> 
<subsection id="HF906049C987C4FB09D1EC89E75EBD0"><enum>(b)</enum><header>Aliens described</header><text>An alien is described in this subsection if the alien—</text> 
<paragraph id="H5464E6C77E6E4AE0A2D4E0379D56ED"><enum>(1)</enum><text>was, on August 29, 2005, lawfully present in the United States in the status of a nonimmigrant described in subparagraph (F), (J), or (M) of section 101(a)(15) of the Immigration and Nationality Act (8 U.S. C. 1101(a)(15)); and</text></paragraph> 
<paragraph id="HD7AF79B0AE4440D5AC0066E7AD518CF"><enum>(2)</enum><text display-inline="yes-display-inline">fails to satisfy a term or condition of such status as a consequence of a specified hurricane disaster.</text></paragraph></subsection></section> 
<section id="H22BE6573E5004FABBE54D955F74062D9"><enum>7.</enum><header>Notices of change of address</header> 
<subsection id="HBAF976555C8644338C2925C14D5EF6A6"><enum>(a)</enum><header>In general</header><text>In the case of any notice of change of address otherwise required to be submitted to the Secretary of Homeland Security by an alien described in subsection (b)—</text> 
<paragraph id="H4742EA77C25E47B586614B69AAA5BC3"><enum>(1)</enum><text>if the notice relates to a change of address occurring during the period beginning on August 29, 2005, and ending on November 15, 2005, the alien shall have until December 1, 2005, to submit such notice; and</text></paragraph> 
<paragraph id="HD4429A1D5EE449C3B651877E40D6419"><enum>(2)</enum><text display-inline="yes-display-inline">if the notice relates to a change of address occurring during the period beginning on November 16, 2005, and ending on February 16, 2006, the alien shall have until February 28, 2006, to submit such notice.</text></paragraph></subsection> 
<subsection id="H3A2FBFBEE91D469FB4EBE837B9FBCD62"><enum>(b)</enum><header>Aliens described</header><text display-inline="yes-display-inline">An alien is described in this subsection if the alien—</text> 
<paragraph id="HE47E5437ACF148EAAF3401D1AB95FF57"><enum>(1)</enum><text>resided, on August 29, 2005, within a district of U.S. Citizenship and Immigration Services that was declared by the President to be affected by a specified hurricane disaster; and</text></paragraph> 
<paragraph id="H56A49E487CFE40CA89F9CB3BC0868D90"><enum>(2)</enum><text>is required, under section 265 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1305">8 U.S.C. 1305</external-xref>) or any other provision of law, to notify the Secretary of Homeland Security in writing of a change of address.</text></paragraph></subsection></section> 
<section id="HCADD1832CF6E49CBA6ED51BBDDB6B651"><enum>8.</enum><header>Temporary administrative relief</header><text display-inline="no-display-inline">The Secretary of Homeland Security, for humanitarian purposes or to ensure family unity, may provide temporary administrative relief to any alien who—</text> 
<paragraph id="HA2165326A719482082EF938D2512F3C9"><enum>(1)</enum><text>was lawfully present in the United States on August 29, 2005;</text></paragraph> 
<paragraph id="HC2177FD450574A71B3720090519D1841"><enum>(2)</enum><text>was on such date the spouse, parent, or child of an individual who died or was disabled as a consequence of a specified hurricane disaster; and</text></paragraph> 
<paragraph id="H5830EBC5DC754AE988CF175DAF9DD52C"><enum>(3)</enum><text>is not otherwise entitled to relief under any other provision of this Act.</text></paragraph></section> 
<section id="HDF5F24B7908A45E8BE22961672DC64BA" section-type="subsequent-section" display-inline="no-display-inline"><enum>9.</enum><header>Employment verification during effectiveness of major disaster declaration</header> 
<subsection id="H6203B39E2F754909850935896FDB9464"><enum>(a)</enum><header>In general</header><text>Section 274A(b)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(b)(1)</external-xref>) is amended—</text> 
<paragraph id="H3FB682F312994BA9A8E8835330F2FC90"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>The person</quote> and inserting <quote>Subject to subparagraph (F), the person</quote>; and</text></paragraph> 
<paragraph id="HAA039D55C82E4DE384A3F71FDCE2B497"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block style="OLC" id="H04BD5FB8427D45BE879614808B00ED3F" display-inline="no-display-inline"> 
<subparagraph id="H08884025A45A451CBF192C50D8DDA58"><enum>(F)</enum><header>Special rule during major disaster declaration</header><text display-inline="yes-display-inline">In a case in which the President has declared a major disaster under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>), the Secretary of Homeland Security may provide, in the Secretary’s sole and unreviewable discretion and only during the period in which such declaration is in effect, that a person or other entity hiring, recruiting, or referring an individual for employment in the United States is not required to make the attestation or conduct the verification required under subparagraph (A) until, at the latest, 90 days after the hiring, recruitment, or referral, if the individual hired, recruited or referred attests under penalty of perjury at the time of being hired, recruited, or referred that the individual does not possess the documents necessary to satisfy clause (i) or (ii) of subparagraph (A) as a result of such disaster.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H1A307846C7444994B87F3DC800A8D2FA"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 274A(b)(2) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(b)(2)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block style="OLC" id="HA903693E5AD74338A8EDEF8C68DF3FA" display-inline="no-display-inline"><quoted-block-continuation-text quoted-block-continuation-text-level="paragraph">Paragraph (1)(F) shall not be construed to affect the obligation under the preceding sentence.</quoted-block-continuation-text><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0AB929AFE987439BB651AFB752072958"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act and shall apply to hiring, recruitment, or referral of an individual for employment in the United States occurring on or after August 29, 2005.</text></subsection></section> 
<section id="HCF2A9A88C3214BA99C2752BF5657CC01" section-type="subsequent-section" display-inline="no-display-inline"><enum>10.</enum><header>Replacement of documents evidencing identity and employment authorization for victims of Hurricane Katrina</header> 
<subsection id="HC8FF4B3999F3485D0041A707C45C00F3"><enum>(a)</enum><header>Immediate assistance</header> 
<paragraph id="HF297A8260F464FBC80C0EEF3FA71BFA"><enum>(1)</enum><header>Document replacement</header><text>The Secretary of Homeland Security is authorized to provide immediate assistance in States in which persons displaced by a specified hurricane disaster are residing for the purpose of replacing for such persons documents that were—</text> 
<subparagraph id="HD297C61DCB49407DA639A072A900D3BA"><enum>(A)</enum><text>previously issued by the Secretary and described in subparagraph (B), (C), or (D) of section 274A(b)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(b)(1)</external-xref>); and</text></subparagraph> 
<subparagraph id="HD4EBA5195AF244B28EDE2B9618A6082"><enum>(B)</enum><text>lost, stolen, or destroyed due to such disaster.</text></subparagraph></paragraph> 
<paragraph id="HE706B7CEED8841F9861D2C84D3D9FD56"><enum>(2)</enum><header>Substitute</header><text>Where replacement of a document described in paragraph (1) is not feasible, the Secretary of Homeland Security may provide to a displaced person described in such paragraph a temporary substitute document.</text></paragraph></subsection> 
<subsection id="HBC09A415C7F646FEB73B784BA839B966"><enum>(b)</enum><header>Procedures for document replacement</header><text display-inline="yes-display-inline">The Secretary of Homeland Security shall ensure that, when the Secretary replaces (or provides a temporary substitute for) a document relating to an alien and described in subparagraph (B), (C), or (D) of section 274A(b)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(b)(1)</external-xref>) that was lost, stolen, or destroyed due to a specified hurricane disaster, the Secretary—</text> 
<paragraph id="HF5A69A0191E14EDF8EECC14872EB8DC2"><enum>(1)</enum><text display-inline="yes-display-inline">authenticates information using biometric identifiers contained in records of the Department of Homeland Security; and</text></paragraph> 
<paragraph id="H734AF28EAD8041F5AB8B103B27778E14"><enum>(2)</enum><text display-inline="yes-display-inline">annotates the records in U.S. Citizenship and Immigration Services information systems in such a way as to indicate that the replacement or substitute document was issued in the absence of an original due to such disaster.</text></paragraph></subsection> 
<subsection id="H4ACD43CB1B9D461C9800FAB3D93580AA"><enum>(c)</enum><header>Waiver of fees for database access</header> 
<paragraph id="H5DA8C59D80CE4BECBC9553E73F95E900"><enum>(1)</enum><header>U.S. Citizenship and Immigration Services</header><text display-inline="yes-display-inline">The Director of U.S. Citizenship and Immigration Services is authorized to waive fees and costs associated with a request, made by a person or agency described in paragraph (2), for use of the Verification Information System database associated with the Systematic Alien Verification for Entitlements Program in order to verify immigration status or employment eligibility with respect to a displaced person described in subsection (a)(1).</text></paragraph> 
<paragraph id="HE07913EFCDE94C10001431D1E595DEF"><enum>(2)</enum><header>Requesting persons</header><text>The persons described in this paragraph are as follows:</text> 
<subparagraph id="H3C3CD9404FCA4A869049118DC1950709"><enum>(A)</enum><text>Employers.</text></subparagraph> 
<subparagraph id="H14CD1B4B1D9A4300AA26700066A8044E"><enum>(B)</enum><text>State or local government agencies.</text></subparagraph> 
<subparagraph id="H6E98AF5BB46E49E3BF7B42891353A025"><enum>(C)</enum><text>The American National Red Cross.</text></subparagraph> 
<subparagraph id="H4C33462CF89A4A4E808B7495F671D2F"><enum>(D)</enum><text>Organizations described in <external-xref legal-doc="usc" parsable-cite="usc/26/501">section 501(c)(3)</external-xref> of the Internal Revenue Code of 1986 and exempt from tax under section 501(a) of such Code whose mission is to assist displaced persons described in subsection (a)(1).</text></subparagraph></paragraph></subsection> </section> 
<section id="H50F5A24426D14C2CB9E0621294523CCC"><enum>11.</enum><header>Age-out protections</header><text display-inline="no-display-inline">In administering Federal immigration laws, the Secretary of Homeland Security may grant any application or benefit notwithstanding the applicant or beneficiary (including a derivative beneficiary of a principal applicant or beneficiary) reaching an age that would render the applicant or beneficiary ineligible for the relief or benefit sought, if the failure to meet the age requirement is a consequence of a specified hurricane disaster.</text></section> 
<section id="H226454886D51487889B41A5F8235B8F"><enum>12.</enum><header>Evidence of death, disability, or loss of employment</header> 
<subsection id="HBF190C54565B4C0E00017F96548545E"><enum>(a)</enum><header>In General</header><text>The Secretary of Homeland Security shall establish appropriate standards for evidence demonstrating, for purposes of this Act, that any of the following occurred as a consequence of a specified hurricane disaster.</text> 
<paragraph id="HEC98E260D054460A962484BAB0EB4675"><enum>(1)</enum><text>Death.</text></paragraph> 
<paragraph id="H1239F7A28AB74E1EBB618F9782036378"><enum>(2)</enum><text>Disability.</text></paragraph> 
<paragraph id="HB0E0415BB7724FCC8E21F8CF4D5CC62C"><enum>(3)</enum><text>Loss of employment due to physical damage to, or destruction of, a business.</text></paragraph></subsection> 
<subsection id="HCEBCD3A9202B41FDAF015EB3289EBD39"><enum>(b)</enum><header>Death certificates</header><text>The standards established under subsection (a) shall authorize the Secretary to make a determination of death in the absence of a death certificate, where appropriate.</text></subsection> 
<subsection id="H4F4AAA5B551B41C287D116D637C3ABED"><enum>(c)</enum><header>Affidavit of surviving spouse</header><text display-inline="yes-display-inline">For purposes of a benefit under section 2, or subsection (b) or (c) of section 4, that is conditioned on the beneficiary having been the spouse of an individual who died as a consequence of a specified hurricane disaster, the standards established under subsection (a) shall authorize the Secretary to make a determination of death based on the sworn affidavit of such surviving spouse, in the absence of evidence to the contrary.</text></subsection></section> 
<section id="H1DE9D5BA478B4B2CA10068003C93BBFA"><enum>13.</enum><header>Waiver of Regulations</header><text display-inline="no-display-inline">The Secretary of Homeland Security shall carry out this Act as expeditiously as possible. The Secretary of Homeland Security is not required to promulgate regulations prior to implementing this Act.</text></section> 
<section id="H9A8C2D3034024E69813B7E48FB52B46"><enum>14.</enum><header>Definitions</header> 
<subsection id="HDFCFE55A7ACB45E9A6E911F33BB817AE"><enum>(a)</enum><header>Application of <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> Provisions</header><text>Except as otherwise specifically provided in this Act, the definitions used in the <act-name parsable-cite="INA">Immigration and Nationality Act</act-name> (excluding the definitions applicable exclusively to title III of such Act) shall apply in the administration of this Act.</text></subsection> 
<subsection id="H4958B3618ACF4081004C68F565C02920"><enum>(b)</enum><header>Specified Hurricane Disaster</header><text>For purposes of this Act, the term <term>specified hurricane disaster</term> means any major disaster resulting from Hurricane Katrina declared by the President under the Robert T. Stafford Disaster and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>).</text></subsection></section>
