<section section-type="section-one" id="HACC0C085C957465F003D4495994700EB" display-inline="no-display-inline"><enum>1.</enum><header>Energy production incentives</header>
<subsection id="HEE0E02AC5FFA4E7DA09CCD5D0073B422"><enum>(a)</enum><header>In general</header><text>A State may provide to any entity—</text>
<paragraph id="H6007E61C437A40AA9779C0EDC8E06400"><enum>(1)</enum><text>a credit against any tax or fee owed to the State under a State law, or</text></paragraph>
<paragraph id="HC61434B9B2E34ACE8EEEFB7C00DCB314"><enum>(2)</enum><text>any other tax incentive,</text></paragraph><continuation-text continuation-text-level="subsection">determined by the State to be appropriate, in the amount calculated under and in accordance with a formula determined by the State, for production described in subsection (b) in the State by the entity that receives such credit or such incentive.</continuation-text></subsection>
<subsection id="HB3696C50F527430DB5B571D31361C100"><enum>(b)</enum><header>Eligible entities</header><text>Subsection (a) shall apply with respect to the production in the State of—</text>
<paragraph id="H2AD97A8107C34723B64FDC4E7F98D68B"><enum>(1)</enum><text>electricity from coal mined in the State and used in a facility, if such production meets all applicable Federal and State laws and if such facility uses scrubbers or other forms of clean coal technology,</text></paragraph>
<paragraph id="H331707E13A85498082AD408656BD4F7"><enum>(2)</enum><text>electricity from a renewable source such as wind, solar, or biomass, or</text></paragraph>
<paragraph id="H00395C5DFEAC4621B2B313841B7FDC8E"><enum>(3)</enum><text>ethanol.</text></paragraph></subsection></section>
<section id="HF79869337AF4496A9D95905B8231E73C"><enum>2.</enum><header>Effect on interstate commerce</header><text display-inline="no-display-inline">Any action taken by a State in accordance with this Act with respect to a tax or fee payable, or incentive applicable, for any period beginning after the date of the enactment of this Act shall—</text>
<paragraph id="H246D83E8DE72411BADD25500410475FB"><enum>(1)</enum><text>be considered to be a reasonable regulation of commerce, and</text></paragraph>
<paragraph id="H3F302FC55FFE4DC3B2E06483F0CF22F1"><enum>(2)</enum><text>not be considered to impose an undue burden on interstate commerce or to otherwise impair, restrain, or discriminate, against interstate commerce.</text></paragraph></section>
