<official-title>To amend the Immigration and Nationality Act to increase penalties for employing illegal aliens.</official-title>

<section id="H9C7AAB6D46CE4B0688EA9DC614E74EF3" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>10k Run for the Border Act</short-title></quote>.</text></section> 
<section id="HC1FEA5DE41D549049C008E21F3C52FB1"><enum>2.</enum><header>Increase in penalties for employing illegal aliens</header> 
<subsection id="HF6AD414BE20E48CEBDED206CA87309AC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 274A(e)(4)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(e)(4)(A)</external-xref>) is amended—</text> 
<paragraph id="HF10158B138424EC7B2E7D914E67B575"><enum>(1)</enum><text>in clause (i), by striking <quote>$250 and not more than $2,000</quote> and inserting <quote>$10,000 and not more than $80,000</quote>;</text></paragraph> 
<paragraph id="H8B9A8CD296164C9FA3D59407F601B9C5"><enum>(2)</enum><text>in clause (ii), by striking <quote>$2,000 and not more than $5,000</quote> and inserting <quote>$80,000 and not more than $200,000</quote>; and</text></paragraph> 
<paragraph id="H9D4F9E3F6BA945EEB9D4D587A60041A5"><enum>(3)</enum><text>in clause (iii), by striking <quote>$3,000 and not more than $10,000</quote> and inserting <quote>$120,000 and not more than $1,600,000</quote>.</text></paragraph></subsection> 
<subsection id="HFFCD22E2E7A04875AD94D538A405F712"><enum>(b)</enum><header>Use of additional penalty funds</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, of the additional amounts of fines paid under section 274A(e)(4)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a(e)(4)(A)</external-xref>) by one or more employers and that are attributable to the amendments made by subsection (a)—</text> 
<paragraph id="H88DD58B2107D46DFBDFEDACEFCEFC78D"><enum>(1)</enum><text>if State or local law enforcement officials have provided material assistance in the investigation or prosecution of cases of such employers that resulted in such fines—</text> 
<subparagraph id="H2D45F886228D4F649549485CF8370900"><enum>(A)</enum><text>80 percent shall be paid, in a manner specified by the Secretary of Homeland Security, to the State or local State law enforcement agencies which employed such individuals; and</text></subparagraph> 
<subparagraph id="HDE7B3F42039B43F68B216F344FDB99C1"><enum>(B)</enum><text display-inline="yes-display-inline">20 percent shall be used by the Secretary to cover costs of detention of illegal aliens; and</text></subparagraph></paragraph> 
<paragraph id="H907615CE4E8E4CF885EA689E002916DF"><enum>(2)</enum><text>if paragraph (1) does not apply—</text> 
<subparagraph id="H2F7E0E2193994525AF1EEF5BCA65E703"><enum>(A)</enum><text>80 percent shall be paid to States (and political subdivisions of States) under the State Criminal Alien Assistance Program under section 241(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1251">8 U.S.C. 1251(i)</external-xref>) for purposes of reimbursing those States and political subdivisions for costs of incarceration of undocumented criminal aliens; and</text></subparagraph> 
<subparagraph id="H9B7710D77C9943B7833ED9C42C795FCB"><enum>(B)</enum><text>20 percent shall be used by the Secretary to cover costs of detention of illegal aliens in Federal facilities.</text></subparagraph></paragraph></subsection> 
<subsection id="H825E3F0639F34558B1797587B6646678"><enum>(c)</enum><header>Effective date</header><text>The amendments made by subsection (a) shall apply to violations occurring on or after the date of the enactment of this Act.</text></subsection></section>
