<official-title>To provide student loan forgiveness to the surviving spouses and parents of the victims of Hurricane Katrina.</official-title>

<section id="H696DF276CDAF417FA456D93AD6CF59B" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hurricane Katrina Surviving Spouse Student Loan Relief Act</short-title></quote>.</text> </section> 
<section id="H0E4FB636F18447DBA4E1BB8E70C9E01F"><enum>2.</enum><header>Cancellation of student loan indebtedness for spouses and parents</header> 
<subsection id="HA8696AAF2D2C40878218B8D74834E6E5"><enum>(a)</enum><header>Definitions</header><text>For purposes of this section:</text> 
<paragraph id="H70E236A4ADB746C88900C8ACFC35E774"><enum>(1)</enum><header>Eligible victim</header><text display-inline="yes-display-inline">The term <term>eligible victim</term> means an individual who died (or dies) or became (or becomes) permanently and totally disabled due to injuries caused by Hurricane Katrina, or caused by the flood or other consequences of Hurricane Katrina, as determined in accordance with regulations prescribed by the Secretary.</text></paragraph> 
<paragraph id="H9B95927501074A6394EF4D94B7BC368D"><enum>(2)</enum><header>Eligible spouse</header><text>The term <term>eligible spouse</term> means the spouse of an eligible victim.</text></paragraph> 
<paragraph id="H62396E29AE7948E2A4CEEDC75882695"><enum>(3)</enum><header>Eligible parent</header><text>The term <term>eligible parent</term> means an individual who is the parent of an eligible victim and who is the borrower of a Federal PLUS loan under section 428B, or a Federal Direct PLUS loan under part D of title IV, of the Higher Education Act of 1965, that was obtained and used for the cost of attendance of such eligible victim. Such an individual is an eligible parent for purposes of this Act only with repect to the amounts owed on such loan.</text></paragraph> 
<paragraph id="H869735CEA2A44696AA5F4402A5E61838"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Education.</text></paragraph> 
<paragraph id="H7D70782CAA044D639E4D60C6005449D0"><enum>(5)</enum><header>Federal student loan</header><text>The term <term>Federal student loan</term> means any loan made, insured, or guaranteed under part B, D, or E of title IV of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>.</text></paragraph></subsection> 
<subsection id="H0960A320450543B5ACD312C4F156F9E1"><enum>(b)</enum><header>In general</header><text>The Secretary shall provide for the discharge or cancellation of the Federal student loan indebtedness of an eligible spouse or an eligible parent in the same manner that the Federal student loan indebtedness of an eligible victim is required to be discharged or canceled under sections 437(a), 455(a)(1), and 464(c)(1)(F) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1087">20 U.S.C. 1087(a)</external-xref>, 1087e(a)(1), 1087dd(c)(1)(F)), as the case may be. Such discharge or cancellation shall apply to the principal and accrued unpaid interest outstanding on the date of the injury causing the death or disability of the eligible victim.</text></subsection> 
<subsection id="HCE33B316A0E44113AFD9CE8DECDBE9"><enum>(c)</enum><header>Facilitation of claims</header><text>The Secretary shall—</text> 
<paragraph id="H508545650C7243C5B96B10810064F700"><enum>(1)</enum><text>by regulation, establish procedures for the filing of applications for discharge or cancellation under this section, which regulations shall be prescribed and published within 30 days after the date of enactment of this Act and without regard to the requirements of <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code; and</text></paragraph> 
<paragraph id="HFC3910A9C74947E0953FEFE8EFA2ECD9"><enum>(2)</enum><text>take such actions as may be necessary to publicize the availability of discharge or cancellation of Federal student loan indebtedness for eligible spouses and eligible parents under this section.</text></paragraph></subsection> 
<subsection id="H5648BE8BF8D640809176341B0023B38"><enum>(d)</enum><header>Availability of funds for payments</header><text>Funds available for the purposes of making payments to lenders in accordance with section 437(a) for the discharge of indebtedness of eligible victims shall be available for making payments under section 437(a) to the spouses and parents of such individuals as required by this section.</text></subsection> 
<subsection id="HF9088FD86DC240788009D75FE400F991"><enum>(e)</enum><header>No delay in regulations</header><text>Sections 482(c) and 492 of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1089">20 U.S.C. 1089(c)</external-xref>, 1098a) shall not apply to the regulations required by this section.</text></subsection></section>
