<official-title>To establish the AmeriCorps Disaster Relief Corps to carry out national service projects that address the needs arising from the consequences of Hurricane Katrina, and other major disasters and emergencies.</official-title>

<section id="H96E75D3DAABC4B6084173E1DA6BE32A9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>AmeriCorps Disaster Relief Corps Act of 2005</short-title></quote>.</text></section> 
<section id="HC23AFD991B3E412296C062343FDE272F"><enum>2.</enum><header>Authority</header><text display-inline="no-display-inline">The Corporation for National and Community Service (referred to in this Act as the <quote>Corporation</quote>), pursuant to section 126(b) of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12576">42 U.S.C. 12576(b)</external-xref>), shall carry out the activities authorized under this Act.</text></section> 
<section id="HBE6E7929F6394A8F83A75BC0E4F928B9"><enum>3.</enum><header>Establishment of special AmeriCorps Disaster Relief Corps</header> 
<subsection id="H50DE54C22B274846B7A6C1225F992B13"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established an AmeriCorps Disaster Relief Corps, to be administered by the Corporation, to carry out full- or part-time service projects that provide food, clothing, shelter, and other humanitarian assistance for victims of major disasters and emergencies, projects involving cleaning, repair, and reconstruction of structures, facilities, and lands located within the disaster area, and other projects arising from the consequences of major disasters and emergencies.</text></subsection> 
<subsection id="HEF1D8BE3BDBB45998B8FBF16758BA0BA"><enum>(b)</enum><header>Recruitment of participants and eligibility</header> 
<paragraph id="HF0E7522A39264360BE21940600C0A58E"><enum>(1)</enum><header>Recruitment</header><text>The Corporation shall endeavor to recruit up to 10,000 additional eligible participants for the national service program established under subsection (a).</text></paragraph> 
<paragraph id="H8F7A0445C0B8426189BD88EEA3EC5C4"><enum>(2)</enum><header>Eligibility</header><text display-inline="yes-display-inline">Eligibility to participate in the national service program established under subsection (a) shall be on the same basis as for participation in an approved national service position authorized by subtitle C or E of title I of the National and Community Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12571">42 U.S.C. 12571 et seq.</external-xref>) or by title I of the Domestic Volunteer Service Act of 1973 (<external-xref legal-doc="usc" parsable-cite="usc/42/4951">42 U.S.C. 4951 et seq.</external-xref>). Individuals selected as participants in the program shall be eligible for living allowances, educational awards, and other support authorized for participants in approved national service positions under such Acts.</text></paragraph> 
<paragraph id="HCB037C0809F24D0283948638DFBFE6E3"><enum>(3)</enum><header>Priority</header><text>In conducting recruiting under paragraph (1), the Corporation and recipients of assistance to operate projects shall give priority to those individuals dislocated as a result of major disasters and emergencies and may permit alternative documentation requirements relating to demonstrating eligibility of such individuals.</text></paragraph></subsection> 
<subsection id="H6B0F884103354370BA84E780ECD539BE"><enum>(c)</enum><header>Projects</header><text display-inline="yes-display-inline">Participants for the national service program established under subsection (a) may serve on projects that—</text> 
<paragraph id="H0625AF99E00944D6BF99652317DFFBB"><enum>(1)</enum><text display-inline="yes-display-inline">help those affected by major disasters and emergencies assess their needs; </text></paragraph> 
<paragraph id="H1CE6C67BF589427CA5120408E1D5F8C"><enum>(2)</enum><text display-inline="yes-display-inline">assist in the construction of temporary housing for the displaced victims of a major disaster or emergency;</text></paragraph> 
<paragraph id="H694AFE3F6CC141178F31132928787496"><enum>(3)</enum><text display-inline="yes-display-inline">provide relocation services for victims of the hurricane, including food, water and clothing distribution and housing location services;</text></paragraph> 
<paragraph id="H8E4BF96DC5624C329C4972D96F65C0C2"><enum>(4)</enum><text>conduct outreach to local businesses, building owners, and others with applications for disaster relief and for other assistance to be provided by Federal or State government;</text></paragraph> 
<paragraph id="H6BBA97FC92834D69BEB3A6AD8FE5855D"><enum>(5)</enum><text>provide employment services for victims, such as identifying job training, job placement, and other opportunities;</text></paragraph> 
<paragraph id="H2CF8E2957E444C639BB67920BA68B02C"><enum>(6)</enum><text>conduct environmental surveys, monitoring water quality and determining the environmental impact on the affected region;</text></paragraph> 
<paragraph id="HD93F47CA6BAE4B5598A544D6F5322E8"><enum>(7)</enum><text>provide teaching and administrative support functions for school systems where displaced children have enrolled;</text></paragraph> 
<paragraph id="H7720EE6B0AB641A400984C00BBD56761"><enum>(8)</enum><text display-inline="yes-display-inline">work with schools to identify and mentor students coping with the impact of a major disaster or emergency;</text></paragraph> 
<paragraph id="H2C652AEBE3F74A858DA8AD22AB9BAFBB"><enum>(9)</enum><text>work with public officials to prepare them for future disasters or emergencies; and </text></paragraph> 
<paragraph id="HFC6647159CB94A3AA5C7F19FA0F5311C"><enum>(10)</enum><text>otherwise assist with the rebuilding of the affected regions.</text></paragraph></subsection></section> 
<section id="H065D750848F04397B08176C0C8008BBF"><enum>4.</enum><header>Grants to States, cities, organizations; cooperation with Federal agencies</header><text display-inline="no-display-inline">The Corporation may use funds authorized under this Act in support of projects or activities consistent with those specified in section 3(c) to—</text> 
<paragraph id="HA59F434FABB1458D9B6E028177FFCA03"><enum>(1)</enum><text>make grants to, or enter into agreements with States, subdivisions of States, or other organizations to support AmeriCorps projects under section 121 of the National and Community Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12571">42 U.S.C. 12571</external-xref>);</text></paragraph> 
<paragraph id="HEA2651D73EAB4312BEDCB70050CBE200"><enum>(2)</enum><text>support the National Civilian Community Corps authorized under subtitle E of title I of the National and Community Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12611">42 U.S.C. 12611</external-xref>);</text></paragraph> 
<paragraph id="H042A0666D3CD4675B54B1F173179466C"><enum>(3)</enum><text>support the VISTA program under title I of the Domestic Volunteer Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/4451">42 U.S.C. 4451 et seq.</external-xref>); and</text></paragraph> 
<paragraph id="HEC4220FD6440486C8466FAF38FF4E844"><enum>(4)</enum><text>enter into a contract or cooperative or other agreement with another Federal agency.</text></paragraph></section> 
<section id="H7AF1482F25A8453298F122A75CD2ECC9"><enum>5.</enum><header>Definitions</header><text display-inline="no-display-inline">As used in this Act, the terms <term>emergency</term> and <term>major disaster</term> have the meaning given such terms in paragraphs (1) and (2) of section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C 5122(1) and (2)).</text></section> 
<section id="H408E885A65FB48DF0076AE40CFD38D2"><enum>6.</enum><header>Transfer of funds to the National Service Trust</header><text display-inline="no-display-inline">The Corporation shall transfer funds to the National Service Trust established in section 145 of the National and Community Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/12601">42 U.S.C. 12601</external-xref>) an amount required under the Strengthen AmeriCorps Program Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/45">Public Law 108–45</external-xref>) (<external-xref legal-doc="usc" parsable-cite="usc/42/12605">42 U.S.C. 12605 et seq.</external-xref>) to provide educational awards and related assistance authorized under subtitle D of title I of the National and Community Service Act (42 U.S.C. 12601 et. seq.) </text></section> 
<section id="H39612F8599594995A09FF5AF567B7F9F" commented="no"><enum>7.</enum><header>Authority for third-term benefits and educational award</header><text display-inline="no-display-inline"> Notwithstanding any other provision of law, an individual serving in a program authorized by this Act may serve a third term of service in an approved national service position and may receive in-service benefits and a post-service educational award authorized under the national service laws on the same basis as an individual serving in a first or second term of service.</text></section> 
<section id="H18ABE0C2F15A4727BA49BEBF68E25E00"><enum>8.</enum><header>Administrative expenses</header><text display-inline="no-display-inline">The Corporation may use up to two percent of funds authorized under section 12 for the administration of this Act. </text></section> 
<section id="H255432C82DDF4D689B98EBD6BE855CB9" commented="no"><enum>9.</enum><header>Acceptance of donated services</header><text display-inline="no-display-inline">Section 196(a)(2) (<external-xref legal-doc="usc" parsable-cite="usc/42/12651g">42 U.S.C. 12651g(a)(2)</external-xref>) of the National and Community Service Act is amended by striking <quote>money or property</quote> and inserting <quote>money, services, or property</quote>. </text></section> 
<section id="H3626FC5F859F41CD83FCFC70EA8F1D"><enum>10.</enum><header>Grants not subject to annual appropriations limitations</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, funds provided under this Act to administer, reimburse, or support any national service program authorized under the national service laws, shall not be considered in applying any limitation on funding for such programs in annual appropriations Acts. </text></section> 
<section id="HDB32531609B442F9A159AC1B4700237E"><enum>11.</enum><header>Authority to support programs operated by Federal agencies</header><text display-inline="no-display-inline">Notwithstanding any other provision of law, the Corporation may use funds authorized under this Act to enter into a contract or cooperative agreement with another Federal agency to support a national service program carried out by that agency consistent with section 121(b) of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12571">42 U.S.C. 12571(b)</external-xref>).</text></section> 
<section id="H73D113C07B91455EBA761237D9952E92"><enum>12.</enum><header>Authorization of Appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Corporation $150,000,000 for each of fiscal years 2006 and 2007 to carry out this Act.</text> </section>
