<official-title>To require the Secretary of Housing and Urban Development to make single family properties held by the Department pursuant to foreclosure under the FHA mortgage insurance program available for occupancy by families displaced by Hurricane Katrina.</official-title>

<section id="H76BB2BB66EDB4206B15F756FBB7CB7F4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hurricane Katrina Victims Emergency Shelter Act of 2005</short-title></quote>.</text></section> 
<section id="HCEF99E27949F4E2896EFB6020711C6AA"><enum>2.</enum><header>Availability of HUD inventory properties</header> 
<subsection id="HF94ACA1E18F34FB2A3AFD04715C2BA"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of law, the Secretary of Housing and Urban Development shall make covered properties available for occupancy by eligible families, as provided in this section.</text></subsection> 
<subsection id="HE7B3DAF90F134DCA91157D1777CBA437"><enum>(b)</enum><header>6-month reservation for use only by eligible families</header> 
<paragraph id="HB12D67FF620B41D7918958F67F005DFA"><enum>(1)</enum><header>Requirement to offer only to eligible families</header><text>During the 6-month period beginning on the date of the enactment of this Act, the Secretary may not dispose of any covered property under any provision of law other than this Act and may not offer, or enter into any agreement for disposition of, a covered property under any other such provision.</text></paragraph> 
<paragraph id="H914138F279FE4A69B57B00B7F1F3F969"><enum>(2)</enum><header>Request and occupancy</header><text display-inline="yes-display-inline">If, during the period referred to in paragraph (1), an eligible family makes a request, in such form as the Secretary may require, to occupy a covered property, the Secretary shall, in accordance with the selection criteria established pursuant to subsection (d), make the covered property available to the eligible family for occupancy in accordance with the terms under subsection (e).</text></paragraph></subsection> 
<subsection id="H3BC4498DBD7248F391EB740863B98D94"><enum>(c)</enum><header>Continued availability</header> 
<paragraph id="HCE70A6AB98984C3F9D104E9D55006485"><enum>(1)</enum><header>Availability for eligible families</header><text>During the 18-month period that begins upon the conclusion of the period under subsection (b)(1), the Secretary shall offer each covered property for occupancy by affected families, but, except as provided in paragraph (2) of this subsection, may dispose of covered properties under other applicable provisions of law and may offer and enter into agreements for disposition of covered properties under such other provisions.</text></paragraph> 
<paragraph id="H3BA7C7610141473CB5EAF22B5D8F2081"><enum>(2)</enum><header>Request and occupancy</header><text display-inline="yes-display-inline">If, during the period referred to in paragraph (1), an eligible family makes a request, in such form as the Secretary may require, to occupy a covered property for which the Secretary has not entered into any agreement for disposition under any other provision of law, the Secretary shall, in accordance with the selection criteria established pursuant to subsection (d), make the covered property available to the eligible family for occupancy in accordance with the terms under subsection (e).</text></paragraph></subsection> 
<subsection id="HF4BA42E3684F40EAA67EA8F3877FCA32"><enum>(d)</enum><header>Selection criteria</header><text>The Secretary shall establish criteria to select an eligible family to occupy a covered property for which more than one family has submitted such a request. Such criteria shall provide preference for eligible families having incomes not exceeding the median income for the area in which the primary residence of the family referred to in subsection (g)(2) was located.</text></subsection> 
<subsection id="HDCCF2A6E3C73402783EBEA1795C8594B"><enum>(e)</enum><header>Occupancy terms</header><text>Occupancy in a covered property pursuant to this section shall be subject to the following terms:</text> 
<paragraph id="H930985B737A74F359369C7E094878621"><enum>(1)</enum><header>5-years rent-free</header><text display-inline="yes-display-inline">The eligible family may reside in the property under the terms of a lease (or renewable leases) which shall provide for rent-free occupancy, but which in no case may extend beyond the expiration of the 5-year period beginning upon initial occupancy of the property by the family. </text></paragraph> 
<paragraph id="HF5059F8BA3EA41F1BF103BEE17CC8D23"><enum>(2)</enum><header>Option to purchase</header><text>At any time during the occupancy of a covered property by an eligible family pursuant to paragraph (1), the eligible family may purchase the property from the Secretary at price equal to the lesser of—</text> 
<subparagraph id="H00C1A300B3424090B1EF33144641613F"><enum>(A)</enum><text>the fair market value of the property as of the time of initial occupancy by such family, as determined by the Secretary, or</text></subparagraph> 
<subparagraph id="H0C419FC8C1D94A71ABC2ABAF20D1E88E"><enum>(B)</enum><text>the fair market value of the property as of the time of such purchase, as determined by the Secretary, less the cost of any repairs or improvements made by the family during occupancy of the property.</text></subparagraph><continuation-text continuation-text-level="paragraph">The Secretary shall periodically inform each eligible family occupying a covered property of the availability of the property for purchase under this paragraph.</continuation-text></paragraph></subsection> 
<subsection id="H252B128D298440CCBEACAFE4F97DF376"><enum>(f)</enum><header>Outreach</header><text>The Secretary shall take such actions as may be appropriate to inform eligible families of the availability of covered properties pursuant to this section.</text></subsection> 
<subsection id="HEB6B330A5E744992A7B61B56959D804E"><enum>(g)</enum><header>Definitions</header><text>For purposes of this section, the following definitions shall apply:</text> 
<paragraph id="H28DE767E0A9840F8BEAE4C93DB00B7AF"><enum>(1)</enum><header>Covered property</header><text>The term <quote>covered property</quote> means any property that—</text> 
<subparagraph id="H87C6240B97944E10B7D62D3471EC2B02"><enum>(A)</enum><text>is designed as a dwelling for occupancy by one to four families;</text></subparagraph> 
<subparagraph id="H77E2E3B520A74198B8C60676168F4391"><enum>(B)</enum><text>was previously subject to a mortgage insured under the National Housing Act; and</text></subparagraph> 
<subparagraph id="H222C9FC76A134632AD94B570C7468800"><enum>(C)</enum><text>is owned by the Secretary pursuant to the payment of insurance benefits under such Act.</text></subparagraph></paragraph> 
<paragraph id="H5E593158243148219ECE3124D904DA9F"><enum>(2)</enum><header>Eligible family</header><text>The term <quote>eligible family</quote> means a person or household whose primary residence, as of August 29, 2005—</text> 
<subparagraph id="H2EC0E4EF3986454288CD1FF5CF41FAB2"><enum>(A)</enum><text>was located in an area within which the President declared, under the Robert T. Stafford Disaster Assistance and Emergency Relief Act, a major disaster to have occurred pursuant to Hurricane Katrina; and</text></subparagraph> 
<subparagraph id="HFDAE233442214198A170C14217EA93D4"><enum>(B)</enum><text display-inline="yes-display-inline">was, as a result of Hurricane Katrina, destroyed or damaged to such an extent that the residence is not habitable.</text></subparagraph></paragraph> 
<paragraph id="HE40583EB82AD4500847E4116F42500B2"><enum>(3)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Housing and Urban Development.</text> </paragraph></subsection> </section>
