<section section-type="section-one" id="HCCD1E44DDA4D46B3B99128482D6EF28D" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Higher Education Extension Act of 2005</short-title></quote>.</text></section> 
<section id="HB08AD397F3644CC8815657DB1D756CB0"><enum>2.</enum><header>Extension of programs</header> 
<subsection id="H732CB13C560D454AA17B68B7DBEBE17E"><enum>(a)</enum><header>Extension of duration</header><text>The authorization of appropriations for, and the duration of, each program authorized under the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001 et seq.</external-xref>) shall be extended through December 31, 2005.</text></subsection> 
<subsection id="HB211BA0DFA53420EBC1B14FF9752879"><enum>(b)</enum><header>Performance of required and authorized functions</header><text>If the Secretary of Education, a State, an institution of higher education, a guaranty agency, a lender, or another person or entity—</text> 
<paragraph id="H5D2CA25C0D624FCB983D9BDDE610FB79"><enum>(1)</enum><text>is required, in or for fiscal year 2004, to carry out certain acts or make certain determinations or payments under a program under the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>, such acts, determinations, or payments shall be required to be carried out, made, or continued during the period of the extension under this section; or</text></paragraph> 
<paragraph id="H9E45FEC1EE0F414EB8DB9608F95934EC"><enum>(2)</enum><text>is permitted or authorized, in or for fiscal year 2004, to carry out certain acts or make certain determinations or payments under a program under the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name>, such acts, determinations, or payments are permitted or authorized to be carried out, made, or continued during the period of the extension under this section.</text></paragraph></subsection> 
<subsection id="H49AD63AB2BC24CFFA4A1BA28108609C4"><enum>(c)</enum><header>Extension at current levels</header><text>The amount authorized to be appropriated for a program described in subsection (a) during the period of extension under this section shall be the amount authorized to be appropriated for such program for fiscal year 2004, or the amount appropriated for such program for such fiscal year, whichever is greater. Except as provided in any amendment to the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> enacted during fiscal year 2005 or 2006, the amount of any payment required or authorized under subsection (b) in or for the period of the extension under this section shall be determined in the same manner as the amount of the corresponding payment required or authorized in or for fiscal year 2004.</text></subsection> 
<subsection id="HD1BAFBBBF9834EFF9CFEE79004884FA"><enum>(d)</enum><header>Advisory committees and other entities continued</header><text>Any advisory committee, interagency organization, or other entity that was, during fiscal year 2004, authorized or required to perform any function under the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001 et seq.</external-xref>), or in relation to programs under that Act, shall continue to exist and is authorized or required, respectively, to perform such function for the period of the extension under this section.</text></subsection> 
<subsection id="H361BA1C73F8547FCBDD3251A0EBA23B"><enum>(e)</enum><header>Additional extension not permitted</header><text>Section 422 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1226a">20 U.S.C. 1226a</external-xref>) shall not apply to further extend the authorization of appropriations for any program described in subsection (a) on the basis of the extension of such program under this section.</text></subsection> 
<subsection id="H9345B14551F54630A1073C505E37F54E"><enum>(f)</enum><header>Exception</header><text>The programs described in subsection (a) for which the authorization of appropriations, or the duration of which, is extended by this section include provisions applicable to institutions in, and students in or from, the Freely Associated States, except that those provisions shall be applicable with respect to institutions in, and students in or from, the Federated States of Micronesia and the Republic of the Marshall Islands only to the extent specified in <external-xref legal-doc="public-law" parsable-cite="pl/108/188">Public Law 108–188</external-xref>.</text></subsection></section>
