<official-title>To amend titles 10 and 38, United States Code, to improve death benefits for the families of deceased members of the Armed Forces, and for other purposes.</official-title>

<section section-type="section-one" id="H7974318F7FAD42FEA73300DFC2B56E7D" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Honoring Every Requirement of Exemplary Service Act of 2005</short-title></quote> or the <quote><short-title>HEROES Act of 2005</short-title></quote>.</text></section> 
<section id="HC52565CF5DBA408AA316B2C9F974CE4"><enum>2.</enum><header>Death gratuity enhancements</header> 
<subsection id="H498475B1DDAC4AC691848C958CC465B8"><enum>(a)</enum><header>Deaths from combat-related causes or causes incurred in designated operations or areas</header> 
<paragraph id="HA18937886F05464A9B2400A222F0E435"><enum>(1)</enum><header>Amount</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/1478">Section 1478</external-xref> of title 10, United States Code, is amended—</text> 
<subparagraph id="H74534ED30C784E4E840053302F16373E"><enum>(A)</enum><text>in subsection (a), by inserting <quote>, except as provided in subsection (c)</quote> after <quote>$12,000</quote>;</text></subparagraph> 
<subparagraph id="HBC31DBF0AA7247CEBBCA98882BCEB7D5"><enum>(B)</enum><text>by redesignating subsection (c) as subsection (d); and</text></subparagraph> 
<subparagraph id="H90C7A80CBA394595A249721E7C19288C"><enum>(C)</enum><text>by inserting after subsection (b) the following new subsection (c):</text>

<subsection id="H388BDF2FFB0243E3A5B721C78D18CCD7"><enum>(c)</enum><text>The death gratuity payable under sections 1475 through 1477 of this title is $100,000 (as adjusted under subsection (d)) in the case of a death resulting from wounds, injuries, or illnesses that are—</text> 
<paragraph id="HEC2533CD2D0C4A0AAE3DC292B9A62166"><enum>(1)</enum><text>incurred as described in <external-xref legal-doc="usc" parsable-cite="usc/10/1413a">section 1413a(e)(2)</external-xref> of title 10; or</text></paragraph> 
<paragraph id="HD87BD5178A7449FA92F8341D95E4D52"><enum>(2)</enum><text>incurred in an operation or area designated as a combat operation or a combat zone, respectively, by the Secretary of Defense under <external-xref legal-doc="usc" parsable-cite="usc/38/1967">section 1967(e)(1)(A)</external-xref> of title 38.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H82F5529578074F6D90F97B484652752B"><enum>(2)</enum><header>Increases consistent with increases in rates of basic pay</header><text>Subsection (d) of such section, as redesignated by paragraph (1)(B), is amended by striking <quote>amount of the death gratuity in effect under subsection (a)</quote> and inserting <quote>amounts of the death gratuities in effect under subsections (a) and (c)</quote>.</text></paragraph> 
<paragraph id="H70CA2D4AF31E49C291A94416C2B5523"><enum>(3)</enum><header>Conforming amendment</header><text>Subsection (a) of such section, as amended by paragraph (1) of this subsection, is further amended by striking <quote>(as adjusted under subsection (c))</quote> and inserting <quote>(as adjusted under subsection (d))</quote>.</text></paragraph></subsection> 
<subsection id="HCD5E7F5C2F8B40D39C31946CDD876E2C"><enum>(b)</enum><header>Additional gratuity for deaths before effective date</header> 
<paragraph id="H53DB26295E9E4466A9CD51B031300F8"><enum>(1)</enum><header>Requirement to pay additional gratuity</header> 
<subparagraph id="HB8AD21F5E7934D33BD476685FEA822DC"><enum>(A)</enum><text>In the case of a member of the Armed Forces described in subparagraph (B), the Secretary of the military department concerned shall pay a death gratuity in accordance with this subsection that is in addition to the death gratuity payable in the case of such death under sections 1475 through 1477 of title 10, United States Code.</text></subparagraph> 
<subparagraph id="H49B15ED59785479C9B71ECBD229152CD"><enum>(B)</enum><text>The requirements of this subsection apply in the case of a member of the Armed Forces who died before the date of the enactment of this Act as a direct result of one or more wounds, injuries, or illnesses that—</text> 
<clause id="H7107B5B492B24A60B500C6B8F3612526"><enum>(i)</enum><text>were incurred in the theater of operations of Operation Enduring Freedom or Operation Iraqi Freedom; or</text></clause> 
<clause id="HAC268B433FB448C796D9CBF1DBCFD86D"><enum>(ii)</enum><text>were incurred as described in <external-xref legal-doc="usc" parsable-cite="usc/10/1413a">section 1413a(e)(2)</external-xref> of title 10, United States Code, on or after October 7, 2001.</text></clause></subparagraph></paragraph> 
<paragraph id="H10113BA7772944E4A33E6DB51787BEA5"><enum>(2)</enum><header>Amount</header><text>The amount of the additional death gratuity is $238,000.</text></paragraph> 
<paragraph id="HF1CB4DDA00D34855ABD0D4BDF985F9FF"><enum>(3)</enum><header>Beneficiaries</header><text>The beneficiary or beneficiaries who are entitled under <external-xref legal-doc="usc" parsable-cite="usc/10/1477">section 1477</external-xref> of title 10, United States Code, to receive payment of the regular military death gratuity in the case of the death of a member referred to in paragraph (2) shall be entitled to receive the additional death gratuity payable in such case. If there are two or more such beneficiaries, the portion of the total amount of the additional death gratuity payable to a beneficiary in such case shall be the amount that bears the same ratio to the total amount of the additional death gratuity under paragraph (2) as the amount of the share of the regular military death gratuity payable to that beneficiary bears to the total amount of the regular military death gratuity payable to all such beneficiaries in such case.</text></paragraph> 
<paragraph id="HAC99EF23D2854E4B917200F0AB068831"><enum>(4)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph id="HC29418C659AD45509434FB29DE29C86E"><enum>(A)</enum><text>The term <term>additional death gratuity</term> means the death gratuity provided under paragraph (1).</text></subparagraph> 
<subparagraph id="HE680A5DAA05E45BEB988AC90058B1EE0"><enum>(B)</enum><text>The term <term>regular military death gratuity</term>, means a death gratuity payable under sections 1475 through 1477 of title 10, United States Code.</text></subparagraph></paragraph></subsection></section> 
<section id="H9749A463B41849949562615B3B45FAE3"><enum>3.</enum><header>Servicemembers’ group life insurance enhancements</header> 
<subsection id="H544F15D6F0F2452C9E4554FED3C3082"><enum>(a)</enum><header>Increased maximum amount under servicemembers’ group life insurance</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/1967">Section 1967</external-xref> of title 38, United States Code, is amended—</text> 
<paragraph id="HB032356B30954584846093DC1A81DA0"><enum>(1)</enum><text>in subsection (a)(3)(A), by striking clause (i) and inserting the following new clause:</text> 
<quoted-block id="H9CFB35DA4A794ECC80A7113DD9ADE60"> 
<clause indent="up2" id="HFFBB88E215914AA9B69B6E39FD6953E2"><enum>(i)</enum><text>In the case of a member—</text> 
<subclause id="H2B3E53358A1C4AE8AB7680833413A431"><enum>(I)</enum><text>$400,000 or such lesser amount as the member may elect;</text></subclause> 
<subclause id="HFDA22CA164134362B83B7BB045FDD18C"><enum>(II)</enum><text>in the case of a member covered by subsection (e), the amount provided for or elected by the member under subclause (I) plus the additional amount of insurance provided for the member by subsection (e); or</text></subclause> 
<subclause id="H6F935A3E08C94510813E6128147CDEFD"><enum>(III)</enum><text>in the case of a member making an election under paragraph (2)(A) not to be insured under this subchapter, the amount of insurance provided for the member by subsection (e).</text></subclause></clause><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HC4E9AF4ECB784A9A8D7D00A87FE437F8"><enum>(2)</enum><text>in subsection (d), by striking <quote>$250,000</quote> and inserting <quote>$400,000</quote>.</text></paragraph></subsection> 
<subsection id="HF14FEA79C0EC4505BC8926EE00DA42CE"><enum>(b)</enum><header>Additional amount for members serving in certain areas or operations</header> 
<paragraph id="H6003632A9C8242908BC5DFBC502E2DB0"><enum>(1)</enum><header>Increased amount</header><text>Section 1967 of such title is further amended—</text> 
<subparagraph id="HE156AFC5ECBE411E88AF7B1B22ABF097"><enum>(A)</enum><text>by redesignating subsection (e) as subsection (g); and</text></subparagraph> 
<subparagraph id="H955417CAD2904DDE83A1413EB1386010"><enum>(B)</enum><text>by inserting after subsection (d) the following new subsection (e):</text>

<subsection id="HEE366D414A6A455CA142003F847B48D3"><enum>(e)</enum> 
<paragraph display-inline="yes-display-inline" id="HBB4E24C2248D4BDCA504DB982D8ED2C1"><enum>(1)</enum><text>A member covered by this subsection is any member as follows:</text> 
<subparagraph indent="up1" id="HF5ECAF21207641A497A2FB012B09BF3"><enum>(A)</enum><text>Any member who dies as a result of one or more wounds, injuries, or illnesses incurred while serving in an operation or area that the Secretary designates, in writing, as a combat operation or a zone of combat, respectively, for purposes of this subsection.</text></subparagraph> 
<subparagraph indent="up1" id="H135E6ECD9278452595EC49E235E72756"><enum>(B)</enum><text>Any member who formerly served in an operation or area so designated and whose death is determined (under regulations prescribed by the Secretary of Defense) to be the direct result of injury or illness incurred or aggravated while so serving.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="H6939D73F57B644D9A041D050C45FDB05"><enum>(2)</enum><text>The additional amount of insurance under this subchapter that is provided for a member by this subsection is $150,000, except that in a case in which the amount provided for or elected by the member under subclause (I) of subsection (a)(3)(A) exceeds $250,000, the additional amount of insurance under this subchapter that is provided for the member by this subsection shall be reduced to such amount as is necessary to comply with the limitation in paragraph (3).</text></paragraph> 
<paragraph indent="up1" id="H3D13561A219C49FFA0983000E74F1504"><enum>(3)</enum><text>The total amount of insurance payable for a member under this subchapter may not exceed $400,000.</text></paragraph> 
<paragraph indent="up1" id="HE28BC14FE8384C4F8DEDFA2164865F5C"><enum>(4)</enum><text>While a member is serving in an operation or area designated as described in paragraph (1), the cost of insurance of the member under this subchapter that is attributable to $150,000 of insurance coverage shall be contributed as provided in section 1969(b)(2) of this title and may not be deducted or withheld from the member’s pay.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H88996D0C65C94F4B8D5B82A2AE006DBA"><enum>(2)</enum><header>Funding</header><text>Section 1969(b) of such title is amended—</text> 
<subparagraph id="H5AA25428A0834D7591699F23EAE54D73"><enum>(A)</enum><text>by inserting <quote>(1)</quote> after <quote>(b)</quote>; and</text></subparagraph> 
<subparagraph id="HE0A6D79FF0204BDE9D14525EF94EE0BD"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block id="HFEAC8056D906479B903537AB9FF4ACA"> 
<paragraph indent="up1" id="H74AA702DC8884A2B871B1D612EB200DD"><enum>(2)</enum><text>For each month for which a member insured under this subchapter is serving in an operation or area designated as described by paragraph (1)(A) of section 1967(e) of this title, there shall be contributed from the appropriation made for active duty pay of the uniformed service concerned an amount determined by the Secretary and certified to the Secretary concerned to be the cost of Servicemembers’ Group Life Insurance which is traceable to the cost of providing insurance for the member under section 1967 of this title in the amount of $150,000.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="H94102C215EAF4AE79E9FA03B9124FE63"><enum>(c)</enum><header>Conforming amendment</header><text>Section 1967(a)(2)(A) of such title is amended by inserting before the period at the end the following: <quote>, except for insurance provided under paragraph (3)(A)(i)(III)</quote>.</text></subsection> 
<subsection id="HCE72F39D0788418C8EDD4FC17640627F"><enum>(d)</enum><header>Coordination with VGLI</header><text>Section 1977(a) of such title is amended—</text> 
<paragraph id="H11F32F55582B488080A506DCB10C71C"><enum>(1)</enum><text>by striking <quote>$250,000</quote> each place it appears and inserting <quote>$400,000</quote>; and</text></paragraph> 
<paragraph id="H414E89BAD59F4A97A71776882B26CACD"><enum>(2)</enum><text>by adding at the end of paragraph (1) the following new sentence: <quote>Any additional amount of insurance provided a member under section 1967(e) of this title may not be treated as an amount for which Veterans’ Group Life Insurance shall be issued under this section.</quote>.</text></paragraph></subsection> 
<subsection id="H82623603AB38421AA30562F53EBC3F63"><enum>(e)</enum><header>Requirements regarding elections of members to reduce or decline insurance</header><text>Section 1967(a) of such title is further amended—</text> 
<paragraph id="HE075EB173A75467CBBA112C162A5B38D"><enum>(1)</enum><text>in paragraph (2), by adding at the end the following new subparagraph:</text> 
<quoted-block id="H821E06E87E504D768DB0FF2700D1A8D8"> 
<subparagraph id="H8C847859AA5D4430B95E6449D1A20040" indent="up2"><enum>(C)</enum><text>Pursuant to regulations prescribed by the Secretary of Defense, notice of an election of a member not to be insured under this subchapter, or to be insured under this subchapter in an amount less than the maximum amount provided under paragraph (3)(A)(i)(I), shall be provided to the spouse of the member.</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H3CF57636C07B406FAA89001E4F007700"><enum>(2)</enum><text>in paragraph (3)—</text> 
<subparagraph id="H635347A9FBD2458B87EBFC011479F4B7"><enum>(A)</enum><text>in the matter preceding clause (i), by striking <quote>and (C)</quote> and inserting <quote>, (C), and (D)</quote>; and</text></subparagraph> 
<subparagraph id="H1C0E2A33EB304A189EC849410051C457"><enum>(B)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="H988D276CD2254C4BB63CE66144723DB9" indent="up2"><enum>(D)</enum><text>A member with a spouse may not elect not to be insured under this subchapter, or to be insured under this subchapter in an amount less than the maximum amount provided under subparagraph (A)(i)(I), without the written consent of the spouse.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> </paragraph></subsection> 
<subsection id="H49C80500EB004247BC512F9D3FB1DE3B"><enum>(f)</enum><header>Requirement regarding redesignation of beneficiaries</header><text>Section 1970 of such title is amended by adding at the end the following new subsection:</text>

<subsection id="HEDB6630133314D599FE5849FDFE2B5"><enum>(j)</enum><text>A member with a spouse may not modify the beneficiary or beneficiaries designated by the member under subsection (a) without the written consent of the spouse.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H84737BB1842D4FFA8EE8A05C314192E6"><enum>(g)</enum><header>Effective date</header><text>This section and the amendments made by this section shall take effect on the first day of the first month that begins more than 90 days after the date of the enactment of this Act.</text></subsection></section>
