<subsection id="H4817B1C5BD8C4A6DA12EB0782C85F446"><enum>(a)</enum><header>Short title</header><text display-inline="yes-display-inline">This Act may be cited as the <quote><short-title>Scott Gardner Act</short-title></quote>.</text></subsection>

<section id="HD8E34E65F66C4B24A6DE089C33F8D659"><enum>2.</enum><header>Improved Federal sharing of immigration information</header> 
<subsection id="H5A53B86D3F914155ABEA8C0A6E899C4"><enum>(a)</enum><header>In general</header><text>The Secretary of Homeland Security shall share with the Attorney General immigration information.</text> </subsection> 
<subsection id="H8C0C2ED799AC41A08E97C65B96812F9F"><enum>(b)</enum><header>Improved operation of Federal immigration databases</header> 
<paragraph id="HC4EAB0B1646D4007B809FC3451D17DCF"><enum>(1)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary and the Attorney General shall jointly submit to Congress a report on improving performance of Federal immigration databases to ensure the prompt entry of immigration information into such databases.</text></paragraph> 
<paragraph id="HBAB5450F3A3F477E81AF25E7A2D2657E"><enum>(2)</enum><header>Compatibility</header><text>Such report shall contain recommendations to improve the compatibility among Federal immigration databases in order to—</text> 
<subparagraph id="H8412181BECD94B5E99BAE1E5D2B33D6B"><enum>(A)</enum><text display-inline="yes-display-inline">improve data entry, including eliminating of data entry backlogs;</text></subparagraph> 
<subparagraph id="H9C045BDF3D964CDA9B00D298D0000061"><enum>(B)</enum><text>increase efficiency; and</text></subparagraph> 
<subparagraph id="HD1DD38CA1FF04884ACC7A0B2AB8834A6"><enum>(C)</enum><text>increase accessibility of information to Federal, State, and local law enforcement agencies.</text></subparagraph></paragraph> 
<paragraph id="H427A6B2D87D64B9DB11DDAEB73399E3F"><enum>(3)</enum><header>Progress</header><text display-inline="yes-display-inline">Such report shall include information on the progress that has been made with respect to the elimination of data entry backlogs in such databases and any additional resources required to eliminate such backlogs.</text></paragraph> </subsection> 
<subsection id="H50D753F33AA34ED98CDE64FBC5B84DE2"><enum>(c)</enum><header>Definitions</header><text>For purposes of this section and section 3:</text> 
<paragraph id="HCDBEB50C26D649A3AA03AF1F23880028"><enum>(1)</enum><text>The term <term>DWI</term> means driving while intoxicated and includes similar motor vehicle violations. </text> </paragraph> 
<paragraph id="HBD0FE495835F46E68F570898FC935F38"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>Federal immigration database</term> means each of the following:</text> 
<subparagraph id="HCE1CB6F94AEC4058BA30A835675B205D"><enum>(A)</enum><text>The database of the LESC insofar as it relates to immigration information.</text></subparagraph> 
<subparagraph id="HCF29630BDC24481E8CE3244CE9710793"><enum>(B)</enum><text display-inline="yes-display-inline">The database of the NCIC insofar as it relates to immigration information.</text></subparagraph> 
<subparagraph id="H93E3AD59AC604295B9E583291049379F"><enum>(C)</enum><text>Any other database containing immigration information identified by the Secretary of Homeland Security.</text></subparagraph></paragraph> 
<paragraph id="H5C320768EF624CF9957FBFED9EFF5989"><enum>(3)</enum><text>The term <term>immigration information</term> means information specified by the Secretary of Homeland Security, in consultation with the Attorney General, relating to immigration, including illegal immigration.</text></paragraph> 
<paragraph id="HF6A9B5671C3C4360A700942C00B7813B"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>LESC</term> means the Law Enforcement Support Center.</text></paragraph> 
<paragraph id="H657A083E197749CB96EBF3DFA00A010"><enum>(5)</enum><text display-inline="yes-display-inline">The term <term>NCIC</term> means the National Criminal Information Center.</text></paragraph> 
<paragraph id="H2101D3A166414FC29D7502A186C522D4"><enum>(6)</enum><text>The term <term>Secretary</term> means the Secretary of Homeland Security. </text></paragraph></subsection> </section> 
<section id="HAF4BF460FE0640D7001E311845FE7F61"><enum>3.</enum><header>State and local reporting of immigration information</header> 
<subsection id="H75AAF4A13E064A9FA7835E0047F097BA"><enum>(a)</enum><header>Requirement</header> 
<paragraph id="H490D64F6B15F4D1597D9B24124A76500"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subsection (c), the director of each State and local law enforcement agency shall collect and report to the Secretary such immigration and DWI information and collected in the course of the director’s normal duties, and in such form and manner, as the Secretary may specify for entry into Federal immigration databases.</text></paragraph> 
<paragraph id="H183D134EFB3540AEBF529C4FE3B0F863"><enum>(2)</enum><header>Condition of receipt of SCAAP funding</header><text display-inline="yes-display-inline">If the director of a State or local law enforcement agency does not collect and report information in accordance with paragraph (1), such State or local law enforcement agency shall be ineligible to receive funding under the State Criminal Alien Assistance Program under section 241(i) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(i)</external-xref>).</text></paragraph> 
<paragraph id="HFE78DCF2357A496D8373CECBEFBAB1"><enum>(3)</enum><header>Report on resources</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary and the Attorney General shall jointly submit to Congress a report on additional resources required by State and local law enforcement agencies to comply with the requirement of paragraph (1).</text> </paragraph></subsection> 
<subsection id="HC45F345464D745A791DEA99B00AE7EF8"><enum>(b)</enum><header>Promotion of Law Enforcement Support Center</header><text>The Secretary shall promote the use of the LESC to State and local law enforcement agencies.</text></subsection> 
<subsection id="H2BFC29791EAF4A568B1050EA0071D0F3"><enum>(c)</enum><header>Exemption from state and local reporting of immigration information</header><text display-inline="yes-display-inline">State and local law enforcement agencies are not required to collect and report immigration information relating to individuals who assist law enforcement agencies in the performance of their duties, including as an informant, witness or in other similar capacity. </text></subsection></section> 
<section id="H43E3D993F1E94C1A86AB4B4368CE1DD0"><enum>4.</enum><header>DWI and immigration information in the National Criminal Information Center</header> 
<subsection id="HDA616FB780BB479A983C26A99A496E0"><enum>(a)</enum><header>Inclusion</header><text display-inline="yes-display-inline">DWI and immigration information in the NCIC—</text> 
<paragraph id="HBCC507D0A532443DB836F449005E66E7"><enum>(1)</enum><text>shall appear as a flag on the wants/warrants page of the NCIC; and</text></paragraph> 
<paragraph id="H6097244EEBCE4E6E904861CCDB310B6"><enum>(2)</enum><text>shall be timely and readily available to State and local law enforcement officers while they are in the course of their normal duties.</text></paragraph></subsection> 
<subsection id="H3ADCD70B080B47148F7FA9A8E0DD4ECC"><enum>(b)</enum><header>Mandatory detention</header><text display-inline="yes-display-inline">A State or local law enforcement officer who finds a flag for a DWI and immigration violation of an alien on the wants/warrants page of the NCIC and who arrests the alien shall detain the alien in a State or local jail until the alien can be transferred to Federal custody. </text></subsection></section> 
<section id="H4F4DEB87C0654DAAB4034CBAD58B4C00"><enum>5.</enum><header>State and local enforcement of Federal immigration laws</header> 
<subsection id="H1DBA94DC238D4404A6FAECB71F611C9F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 287(g) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1357">8 U.S.C. 1357(g)</external-xref>) is amended—</text> 
<paragraph id="H2FF3D0EC2F834C2E83034BC2043557C1"><enum>(1)</enum><text>in paragraph (1), by striking <quote>may</quote> and inserting <quote>shall</quote> the first place it appears;</text></paragraph> 
<paragraph id="H1AC06F8BCA0047E9ACDB00A6984BC3C1"><enum>(2)</enum><text>in paragraph (2), by adding at the end the following new sentence: <quote>If such training is provided by a State or political subdivision of a State to an officer or employee of such State or political subdivision of a State, the cost of such training (including applicable cost of overtime) shall be reimbursed by the Secretary of Homeland Security.</quote>; and</text></paragraph> 
<paragraph id="HDC2171480201441B80F8E5007646EF00"><enum>(3)</enum><text>by striking paragraph (9) and redesignating paragraph (10) as paragraph (9).</text></paragraph></subsection> 
<subsection id="H88A262641FF9467F9729774B648B025B"><enum>(b)</enum><header>Effective dates</header> 
<paragraph id="HD46EE6BEC72340E5AE2223A0A3764094"><enum>(1)</enum><header>Requirement for agreement</header><text>The amendments made by paragraphs (1) and (3) of subsection (a) shall take effect on such date (not later than 1 year after the date of the enactment of this Act) as the Secretary of Homeland Security shall specify.</text></paragraph> 
<paragraph id="HC469D3F87B5F484582451767A0D61F64"><enum>(2)</enum><header>Payment for training costs</header><text>The amendment made by subsection (a)(2) shall take effect on the first day of the first fiscal year beginning after the date of the enactment of this Act.</text></paragraph></subsection></section> 
<section id="H9876AC8ED7E448C7954E2DA700FED2A2"><enum>6.</enum><header>Detention and deportation of aliens for driving while intoxicated (DWI)</header> 
<subsection id="H704C6EE12D5B4DD1BDF5D6F7C21F2C5"><enum>(a)</enum><header>In general</header><text>Section 236 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1226">8 U.S.C. 1226</external-xref>) is amended—</text> 
<paragraph id="HB883AED8421D4AF1994800AF97756BD"><enum>(1)</enum><text>in subsection (c)(1)—</text> 
<subparagraph id="HDC349232326C4397B1E00F6752678CC"><enum>(A)</enum><text>in subparagraph (C), by striking <quote>or</quote> at the end;</text></subparagraph> 
<subparagraph id="H6DD0C38FD5A44B98A1BC872AA65D42"><enum>(B)</enum><text>in subparagraph (D), by adding <quote>or</quote> at the end; and</text></subparagraph> 
<subparagraph id="H2E7029376BCE47529F0056C4485231E1"><enum>(C)</enum><text>by inserting after subparagraph (D) the following new subparagraph:</text> 
<quoted-block style="traditional" id="HD83B912D98C4450195055E6D2DCE42BC" display-inline="no-display-inline"> 
<subparagraph id="H2061FB6FC3364FF4BFC22CD5ABB369AE"><enum>(E)</enum><text>is deportable on any grounds and is apprehended for driving while intoxicated, driving under the influence, or similar violation of State law (as determined by the Secretary of Homeland Security) by a State or local law enforcement officer covered under an agreement under section 287(g),</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H643FDFAE87B5403CBB096593A664A5A4"><enum>(2)</enum><text>by redesignating subsection (e) as subsection (f); and</text></paragraph> 
<paragraph id="HD8855B22813A473DBA4C199730B2CE4C" commented="no"><enum>(3)</enum><text>by inserting after subsection (d) the following new subsection:</text> 
<quoted-block style="traditional" id="HBF8880D1BA7245FB9F6B00EB27788C80" display-inline="no-display-inline"> 
<subsection id="HD627B9EEA2A4421AA834DCF88D62AE09"><enum>(e)</enum><header>Driving while intoxicated</header><text display-inline="yes-display-inline">If a State or local law enforcement officer apprehends an individual for an offense described in subsection (c)(1)(E) and the officer has reasonable ground to believe that the individual is an alien—</text> 
<paragraph id="H8EB5B97122D444D6B58F80A01F6ECC39"><enum>(1)</enum><text display-inline="yes-display-inline">the officer shall verify with the databases of the Federal Government, including the National Criminal Information Center and the Law Enforcement Support Center, whether the individual is an alien and whether such alien is unlawfully present in the United States; and</text></paragraph> 
<paragraph id="H3B814DCB164240E1B4941E5C12BF7F3D"><enum>(2)</enum><text display-inline="yes-display-inline">if any such database—</text> 
<subparagraph id="H5332ED65BBFD4B4CA352076B09D10592"><enum>(A)</enum><text>indicates that the individual is an alien unlawfully present in the United States—</text> 
<clause id="H47DD4D697A5F4678925734204DF6C0FE"><enum>(i)</enum><text>an officer covered under an agreement under section 287(g) is authorized to issue a Federal detainer to maintain the alien in custody in accordance with such agreement until the alien is convicted for such offense or the alien is transferred to Federal custody;</text></clause> 
<clause id="H2850945B7EC541E8B6CDE228603831BD"><enum>(ii)</enum><text display-inline="yes-display-inline">the officer is authorized to transport the alien to a location where the alien can be transferred to Federal custody and shall be removed from the United States in accordance with applicable law; and</text></clause> 
<clause id="HE3867E18BBD04406B74CD2C6CA27D5C5"><enum>(iii)</enum><text>the Secretary of Homeland Security shall reimburse the State and local law enforcement agencies involved for the costs of transporting aliens when such transportation is not done in the course of their normal duties; or</text></clause></subparagraph> 
<subparagraph id="H00672CC3866549DE99F78D8307743DFF"><enum>(B)</enum><text display-inline="yes-display-inline">indicates that the individual is an alien but is not unlawfully present in the United States, the officer shall take the alien into custody for such offense in accordance with State law and shall promptly notify the Secretary of Homeland Security of such apprehension and maintain the alien in custody pending a determination by the Secretary with respect to any action to be taken by the Secretary against such alien.</text></subparagraph></paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HEAEAC782D32C455A8D6134C35E08E719"><enum>(b)</enum><header>Deportation for DWI</header> 
<paragraph id="H2C06BA9FACDA40D786B369ACADA373D0"><enum>(1)</enum><header>In general</header><text>Section 237(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1227">8 U.S.C. 1227(a)(2)</external-xref>) is amended by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" id="HA872577CE97B449D864B7FED22291B7C" display-inline="no-display-inline"> 
<subparagraph id="H6CD36EB3A18D44C4AFB1EAD63B669600"><enum>(F)</enum><header>Driving while intoxicated</header><text display-inline="yes-display-inline">Any alien who is convicted of driving while intoxicated, driving under the influence, or similar violation of State law (as determined by the Secretary of Homeland Security), or who refuses in violation of State law to submit to a Breathalyzer test or other test for the purpose of determining blood alcohol content is deportable and shall be deported.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H2E657E450A8A46E29251D22CBEA02151"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall apply to violations or refusals occurring after the date of the enactment of this Act. </text></paragraph></subsection> 
<subsection id="H574112058D4841AE9C793CE121AB7EC"><enum>(c)</enum><header>Sharing of information by motor vehicle administrators regarding DWI convictions and refusals</header><text>Each State motor vehicle administrator shall—</text> 
<paragraph id="HE2133303BD1042729FC7C9781E92906C"><enum>(1)</enum><text>share with the Secretary of Homeland Security information relating to any alien who has a conviction or refusal described in section 237(a)(2)(F) of the Immigration and Nationality Act; </text></paragraph> 
<paragraph id="HFAF1D0A304724243982417F1A69D38D1"><enum>(2)</enum><text>share such information with other State motor vehicle administrators through the Drivers License Agreement of the American Association of Motor Vehicle Administrators; and</text></paragraph> 
<paragraph id="H30A3362F85944529B1E657A390EB3533"><enum>(3)</enum><text display-inline="yes-display-inline">enter such information into the NCIC in a timely manner.</text></paragraph></subsection></section> 
<section id="HE159A6064D0C49FEB11E0051D8D152EF"><enum>7.</enum><header>Federal detention facilities</header> 
<subsection id="HE2B520D3E79C445884E7B128D7A6F9CB"><enum>(a)</enum><header>Report on current allocation formula; recommendations for stop-gap measures</header><text>Not later than 90 days after the date of the enactment of this Act, the Secretary of Homeland Security shall submit to Congress a report describing the formula for allocation of Federal detention facilities for aliens under section 241(g) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1231">8 U.S.C. 1231(g)</external-xref>). The Secretary shall include in such report recommendations for measures for the temporary expansion of State and local jails to detain increased numbers of illegal aliens pending construction or expansion of Federal detention facilities.</text></subsection> 
<subsection id="H5225D03EF6A444FEACC59249CBE4514E"><enum>(b)</enum><header>New construction in high concentration areas</header><text>In accordance with such section, the Secretary shall ensure that, to the greatest extent practicable, construction of new detention facilities is undertaken in or near areas in which the Secretary has determined that there is a high concentration of illegal aliens.</text></subsection> 
<subsection id="HCCA1774E9B9E46C7B894AE8FE300BEA3"><enum>(c)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated such sums as necessary to carry out this section. </text></subsection> </section>
