<official-title>To ensure that States do not issue driver’s licenses or identification cards to sex offenders unless the offenders are in compliance with all applicable registration requirements.</official-title>

<section id="H59BAC6CB9BB843C096B20270F61EAA59" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Our Children from Sexual Predators Act of 2005</short-title></quote>.</text></section> 
<section id="H03D5495B848345889FBE73918F7D9CC7"><enum>2.</enum><header>Issuance of driver’s licenses or identification cards to sex offenders</header><text display-inline="no-display-inline">A State or tribal actor that issues driver’s licenses or identification cards must have in effect throughout the jurisdiction of the actor laws and policies that ensure the following:</text> 
<paragraph id="H55B38C765436426A007DA3B3D3F09B49"><enum>(1)</enum><text>The actor does not issue a driver’s license, commercial driver’s license, or identification card to a sex offender or renew the driver’s license, commercial driver’s license or identification card of a sex offender until the actor has satisfactory evidence indicating that the sex offender is in compliance with all applicable sex offender registration requirements.</text></paragraph> 
<paragraph id="H2A4934180D484A14BACA9EF8E59F2BF9"><enum>(2)</enum><text>A driver’s license, commercial driver’s license, or identification card issued to a sex offender expires on the first anniversary date of the offender’s birthday, measured from the birthday nearest the date of issuance.</text></paragraph></section> 
<section id="H800F7F8EE43B44CBAD48467285A3FB2"><enum>3.</enum><header>Implementation by States and Indian tribes</header> 
<subsection id="H8E7061541541466D8E34AEC99D244B58"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Each State actor or tribal actor shall have not more than 2 years from the date of the enactment of this Act in which to fully implement this Act. </text></subsection> 
<subsection id="H9F5E29C40EE0438B8C7E29CFC7A04000"><enum>(b)</enum><header>Implementation by tribes and in Indian country</header><text>The Attorney General shall coordinate with the Secretary of the Interior to assist tribal actors in fully implementing this Act throughout the jurisdiction of each tribal actor. </text></subsection> 
<subsection id="HDD81B08E5A574BF29CCFD1359919C846"><enum>(c)</enum><header>Ineligibility for funds</header> 
<paragraph id="H884CA86B07CB43FCBE31A0B29E00497C"><enum>(1)</enum><header>In general</header><text>For any fiscal year after the expiration of the period specified in subsection (a), a State actor or tribal actor that fails to fully implement this Act shall not receive 10 percent of the funds that would otherwise be allocated for that fiscal year to the actor under any of the following programs: </text> 
<subparagraph id="H9BB231F8627D4D9B8C68629F65CDDC78"><enum>(A)</enum><header>Byrne</header><text>Subpart 1 of Part E of title I of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3750">42 U.S.C. 3750 et seq.</external-xref>), whether characterized as the Edward Byrne Memorial State and Local Law Enforcement Assistance Programs, the Edward Byrne Memorial Justice Assistance Grant Program, or otherwise. </text></subparagraph> 
<subparagraph id="H74F1C2AA256C469CAFAA7D4E34E144F3"><enum>(B)</enum><header>LLEBG</header><text>The Local Government Law Enforcement Block Grants program. </text></subparagraph> 
<subparagraph id="H3B80CCD685F54B4EA80014D984CEE351"><enum>(C)</enum><header>Other law enforcement grants</header><text>Any other program under which the Attorney General provides grants or other financial assistance. </text></subparagraph></paragraph> 
<paragraph id="HE2ACEA4ED615493EBC9323E5CFC7A361"><enum>(2)</enum><header>Reallocation</header><text>Amounts not allocated under a program referred to in paragraph (1) to an actor for failure to fully implement this Act shall be reallocated under that program to State actors and tribal actors that have not failed to fully implement this Act.</text></paragraph></subsection></section> 
<section id="HD439FD5215F54D89BC899D8FA6FE4B71"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H4BA267F6278243D1A4A7640269C2B177"><enum>(1)</enum><header>State actor</header><text>The term <term>State actor</term> means any of the following: </text> 
<subparagraph id="HA760617710D44E65AC00B07F09B24985"><enum>(A)</enum><text>A State. </text></subparagraph> 
<subparagraph id="H6855989B6D5A45A8B0C2F53927CD753"><enum>(B)</enum><text>The District of Columbia, the Commonwealth of Puerto Rico, Guam, American Samoa, the United States Virgin Islands, or any other territory or possession of the United States. </text></subparagraph></paragraph> 
<paragraph id="H2726B0520A5D4806B46E417385FABF00"><enum>(2)</enum><header>Tribal actor</header><text>The term <term>tribal actor</term> means a federally recognized Indian tribe.</text></paragraph> 
<paragraph id="HD82C9C63E0AC4DFD8D2E9FECA93906FA"><enum>(3)</enum><header>Sex offender</header><text display-inline="yes-display-inline">The term <term>sex offender</term> means an individual who, either before or after the enactment of this Act, was convicted of, or adjudicated a juvenile delinquent for, an offense (other than an offense involving sexual conduct where the victim was at least 13 years old and the offender was not more than 4 years older than the victim and the sexual conduct was consensual, or an offense consisting of consensual sexual conduct with an adult) whether Federal, State, local, tribal, foreign (other than an offense based on conduct that would not be a crime if the conduct took place in the United States), military, juvenile or other, that is—</text> 
<subparagraph id="HF24AF3AA2C2248EFB5AB5C687540E22B"><enum>(A)</enum><text>a specified offense against a minor;</text></subparagraph> 
<subparagraph id="H2D62FD498F8140339B552047FDCD04E6"><enum>(B)</enum><text>a serious sex offense; or</text></subparagraph> 
<subparagraph id="H93D252C5439B4C229DB462E66BC356C6"><enum>(C)</enum><text>a misdemeanor sex offense against a minor.</text></subparagraph></paragraph> 
<paragraph id="H482B43D2FE52405FAF410662FCA2C704"><enum>(4)</enum><header>Specified offense against a minor</header><text display-inline="yes-display-inline">The term <term>specified offense against a minor</term> means an offense against a minor that involves any of the following:</text> 
<subparagraph id="HCEFDE593FA664A91926B6D4FBCBB5077"><enum>(A)</enum><text display-inline="yes-display-inline"> Kidnapping (unless committed by a parent). </text></subparagraph> 
<subparagraph id="H9CFC33318AC745D19D3E587101447E00"><enum>(B)</enum><text>False imprisonment (unless committed by a parent). </text></subparagraph> 
<subparagraph id="H5C4AE6CF7BB046D8BAEAC09D8FFF1100"><enum>(C)</enum><text>Solicitation to engage in sexual conduct. </text></subparagraph> 
<subparagraph id="HF74606205D31455AB3EAECFF9F4495"><enum>(D)</enum><text>Use in a sexual performance. </text></subparagraph> 
<subparagraph id="H62BAF67BB92C4F648C006C8C537350F5"><enum>(E)</enum><text>Solicitation to practice prostitution. </text></subparagraph> 
<subparagraph id="H8C4A411C187E4E0DA0D334E122EA1DA5"><enum>(F)</enum><text>Possession, production, or distribution of child pornography. </text></subparagraph> 
<subparagraph id="H8C17120DE1324465B4C27BC6ACBB1558"><enum>(G)</enum><text>Criminal sexual conduct towards a minor. </text></subparagraph> 
<subparagraph id="H6518F7357FD4473B87C83C38841DD0E8"><enum>(H)</enum><text>Any conduct that by its nature is a sexual offense against a minor. </text></subparagraph> 
<subparagraph id="HE3E821019B1C43FEA05203007D00261D"><enum>(I)</enum><text>Any other offense designated by the Attorney General for inclusion in this definition. </text></subparagraph> 
<subparagraph id="HF0DEAF5C069C4683BDBDC797B5F8D7A0"><enum>(J)</enum><text>Any attempt or conspiracy to commit an offense described in this paragraph.</text></subparagraph></paragraph> 
<paragraph id="H8988422AEE954809BAE1F88B521C5DFC"><enum>(5)</enum><header>Serious sex offense</header><text>The term <term>serious sex offense</term> means—</text> 
<subparagraph id="HE1417BC3ED91402F00245F6539DD7BAA"><enum>(A)</enum><text display-inline="yes-display-inline"> a sex offense punishable under the law of a jurisdiction by imprisonment for more than one year; </text></subparagraph> 
<subparagraph id="HC77BF03471BE40718F6D327D9B218EA6"><enum>(B)</enum><text>any Federal offense under chapter 109A, 110, 117, or <external-xref legal-doc="usc" parsable-cite="usc/18/1591">section 1591</external-xref> of title 18, United States Code; </text></subparagraph> 
<subparagraph id="H3FBAF953B2A9488691034F173449A4B2"><enum>(C)</enum><text>an offense in a category specified by the Secretary of Defense under section 115(a)(8)(C) of title I of <external-xref legal-doc="public-law" parsable-cite="pl/105/119">Public Law 105–119</external-xref> (<external-xref legal-doc="usc" parsable-cite="usc/10/951">10 U.S.C. 951</external-xref> note); </text></subparagraph> 
<subparagraph id="H8BEAD210D3BE49B798333692AE452563"><enum>(D)</enum><text>any other offense designated by the Attorney General for inclusion in this definition.</text></subparagraph></paragraph> 
<paragraph id="H97B93F96A12643548D59D2AA4DBE7287"><enum>(6)</enum><header>Misdemeanor sex offense against a minor</header><text>The term <term>misdemeanor sex offense against a minor</term> means a sex offense against a minor punishable by imprisonment for not more than one year.</text></paragraph> 
<paragraph id="HA578A06014A84489A0CA8558CA90E537"><enum>(7)</enum><header>Minor</header><text display-inline="yes-display-inline">The term <term>minor</term> means an individual who has not attained the age of 18 years. </text> </paragraph></section>
