<section id="H70A86A5A343A4071A822E7C8E82C77C0"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H54D28FFEFE8D49B2BA88A90037FA70E2"><enum>(1)</enum><header>Additional coverage</header><text>The term <term>additional coverage</term> has the meaning given the term in section 502(b)(1) of the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1502">7 U.S.C. 1502(b)(1)</external-xref>).</text></paragraph> 
<paragraph id="H812EA82482B6455B84BD84CA4F3EF398"><enum>(2)</enum><header>Insurable commodity</header><text>The term <term>insurable commodity</term> means an agricultural commodity (excluding livestock) for which the producers on a farm are eligible to obtain a policy or plan of insurance under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>).</text></paragraph> 
<paragraph id="H3D8A3E66A54D4B02AAB34D5B2F69445C"><enum>(3)</enum><header>Livestock</header><text>The term <term>livestock</term> includes—</text> 
<subparagraph id="HA912CAFA3E30474791CE2C4D57C722"><enum>(A)</enum><text>cattle;</text></subparagraph> 
<subparagraph id="HBEC888BEEE2447B49699009D665F267C"><enum>(B)</enum><text>bison;</text></subparagraph> 
<subparagraph id="H680C0F0C383443B9BCA69B24DD514DAF"><enum>(C)</enum><text>sheep;</text></subparagraph> 
<subparagraph id="H173A926301BD432AB378AC72002B5783"><enum>(D)</enum><text>swine; and</text></subparagraph> 
<subparagraph id="HFE0FBE76779C4821B46032F740A2B93C"><enum>(E)</enum><text>other livestock, as determined by the Secretary.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HDAFAD7211B184636BE684289BAB24F7D"><enum>(4)</enum><header>Noninsurable commodity</header><text>The term <term>noninsurable commodity</term> means a crop for which the producers on a farm are eligible to obtain assistance under section 196 of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7333">7 U.S.C. 7333</external-xref>).</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H8336BDA5A76C4A21A647E421472CF9CD"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text></paragraph></section> 
<title id="HCED65CAE6176451D93E7F9B3B53DF88"><enum>I</enum><header>Agricultural production losses</header> 
<section id="H6BD8557B90334BACAA5106E3FAAD19B"><enum>101.</enum><header>Crop disaster assistance</header> 
<subsection id="H16FCBFD211E942FA90F6E751D7B80598"><enum>(a)</enum><header>In general</header><text>The Secretary shall use such sums as are necessary of funds of the Commodity Credit Corporation to make emergency financial assistance authorized under this section available to producers on a farm that have incurred qualifying losses described in subsection (c).</text></subsection> 
<subsection id="H681169576ED64545BDACF15E5564A027"><enum>(b)</enum><header>Administration</header> 
<paragraph id="HD1A6A08AA530410AA1954697FF6D8C9E"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the Secretary shall make assistance available under this section in the same manner as provided under section 815 of the Agriculture, Rural Development, Food and Drug Administration and Related Agencies Appropriations Act, 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/106/387">Public Law 106–387</external-xref>; 114 Stat. 1549A–55), including using the same loss thresholds for quantity and economic losses as were used in administering that section, except that the loss threshold shall be 25 percent instead of 35 percent and the payment rate shall be 50 percent of the established price, instead of 65 percent.</text></paragraph> 
<paragraph id="H3322710624F041299617E78384ED609"><enum>(2)</enum><header>Loss thresholds for quality losses</header><text>In the case of a payment for quality loss for a crop under subsection (c)(2), the loss thresholds for quality loss for the crop shall be determined under subsection (d).</text></paragraph></subsection> 
<subsection id="HD0D4CC5300224F0B88EC8300F42DD4D"><enum>(c)</enum><header>Qualifying losses</header><text>Assistance under this section may be made available for losses due to damaging weather or any related condition (including losses due to crop diseases and insects and delayed harvest) associated with crops that are (as determined by the Secretary) any combination of (as determined by the producers on a farm)—</text> 
<paragraph id="H80A6DE6F7D0A4D7C9631E608E100FE17"><enum>(1)</enum><text>quantity losses for the 2005 crop;</text></paragraph> 
<paragraph id="H6F763F9FA9C3487100834E4C255B1CE0"><enum>(2)</enum><text>quality losses for the 2005 crop; or</text></paragraph> 
<paragraph id="H304C843264BF4807003853223433344C"><enum>(3)</enum><text>severe economic losses for the 2005 crop.</text></paragraph></subsection> 
<subsection id="H28EF823F680C4E9DB4BF75A646D1B384"><enum>(d)</enum><header>Quality losses</header> 
<paragraph id="HACEAD0805892482D94CCAE4BC677C800"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (3), the amount of a payment made to producers on a farm for a quality loss for a crop under subsection (c)(2) shall be equal to the amount obtained by multiplying—</text> 
<subparagraph id="HA0D8B1DB474E4FFA00215F393531F3AA"><enum>(A)</enum><text>75 percent of the payment quantity determined under paragraph (2); by</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0523DA926BD646109BEACB5FE607DE6F"><enum>(B)</enum><text>50 percent of the payment rate determined under paragraph (3).</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H134BDF949E7E4F2FBA56DD95881C0000"><enum>(2)</enum><header>Payment quantity</header><text>For the purpose of paragraph (1)(A), the payment quantity for quality losses for a crop of a commodity on a farm shall equal the lesser of—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H731E5044E91B47349EA2F3004685DD82"><enum>(A)</enum><text>the actual production of the crop of the commodity on the farm; or</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HC3D1EDD5F20A411E8DF043006182E310"><enum>(B)</enum><text>the quantity of expected production of the crop of the commodity on the farm, using the formula used by the Secretary to determine quantity losses for the crop of the commodity under subsection (c)(1).</text></subparagraph></paragraph> 
<paragraph id="H3E0E1192C3E8424FA92800FD68EF0902"><enum>(3)</enum><header>Payment rate</header><text>For the purpose of paragraph (1)(B) and in accordance with paragraphs (5) and (6), the payment rate for quality losses for a crop of a commodity on a farm shall be equal to the difference between—</text> 
<subparagraph id="H2509CCA1F8124DB5B01B429D6819B6BA"><enum>(A)</enum><text>the per unit market value that the units of the crop affected by the quality loss would have had if the crop had not suffered a quality loss; and</text></subparagraph> 
<subparagraph id="H2CB211F94684480096F8D673C161B00"><enum>(B)</enum><text>the per unit market value of the units of the crop affected by the quality loss.</text></subparagraph></paragraph> 
<paragraph id="H9C4048A444C042F886941E00AA30B11E"><enum>(4)</enum><header>Eligibility</header><text>For producers on a farm to be eligible to obtain a payment for a quality loss for a crop under subsection (c)(2), the amount obtained by multiplying the per unit loss determined under paragraph (1) by the number of units affected by the quality loss shall be at least 25 percent of the value that all affected production of the crop would have had if the crop had not suffered a quality loss.</text></paragraph> 
<paragraph id="H470E479D6E54454D89FBA7CECDB21B"><enum>(5)</enum><header>Marketing contracts</header><text>In the case of any production of a commodity that is sold pursuant to 1 or more marketing contracts (regardless of whether the contract is entered into by the producers on the farm before or after harvest) and for which appropriate documentation exists, the quantity designated in the contracts shall be eligible for quality loss assistance based on the 1 or more prices specified in the contracts.</text></paragraph> 
<paragraph id="HC007520EEB164C02A6F11D53D7E28D5B"><enum>(6)</enum><header>Other production</header><text>For any additional production of a commodity for which a marketing contract does not exist or for which production continues to be owned and produced by the producers on a farm, quality losses shall be based on the average local market discounts for reduced quality, as determined by the appropriate State committee of the Farm Service Agency.</text></paragraph> 
<paragraph id="H29398DC20A7E432D9F6D5E67CC391035"><enum>(7)</enum><header>Quality adjustments and discounts</header><text>The appropriate State committee of the Farm Service Agency shall identify the appropriate quality adjustment and discount factors to be considered in carrying out this subsection, including the average local discount or loans made by the Farm Service Agency or crop insurance coverage under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>).</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H9F34F324A2EA48A297AECB04705C36D1"><enum>(8)</enum><header>Eligible production</header><text>The Secretary shall carry out this subsection in a fair and equitable manner for all eligible production, including the production of fruits and vegetables, other specialty crops, and field crops.</text></paragraph></subsection> 
<subsection id="HC053BF88BE6F4EF182B14610C99869D7"><enum>(e)</enum><header>Eligibility for assistance</header> 
<paragraph id="H7533546B2359473C94A13C314199FDE6"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the producers on a farm shall not be eligible for assistance under this section with respect to losses to an insurable commodity or noninsurable commodity if the producers on the farm—</text> 
<subparagraph id="HE0BEE1FF559B408B00732063CCCB3B7F"><enum>(A)</enum><text>in the case of an insurable commodity, did not obtain a policy or plan of insurance for the insurable commodity under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>) for the crop incurring the losses;</text></subparagraph> 
<subparagraph id="HC90C5E7203B640D99000A88F096D70D5"><enum>(B)</enum><text>in the case of a noninsurable commodity, did not file the required paperwork, and pay the administrative fee by the applicable State filing deadline, for the noninsurable commodity under section 196 of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7333">7 U.S.C. 7333</external-xref>) for the crop incurring the losses;</text></subparagraph> 
<subparagraph id="HC890500F4D664168ABC177EB626C7D3"><enum>(C)</enum><text>had average adjusted gross income (as defined by section 1001D(a) of the Food Security Act of 1985 (7 U.S.C. 1308–3a(a)), of greater than $2,500,000 in 2004; or</text></subparagraph> 
<subparagraph id="HCEAF0636555E4F18BB968E221C4341BD"><enum>(D)</enum><text>were not in compliance with highly erodible land conservation and wetland conservation provisions.</text></subparagraph></paragraph> 
<paragraph id="HE6BE90A46B50407E98B1ED8F065867B0"><enum>(2)</enum><header>Contract waiver</header><text>The Secretary may waive paragraph (1) with respect to the producers on a farm if the producers enter into a contract with the Secretary under which the producers agree—</text> 
<subparagraph id="H70C2CDEC6EF647D8B6639446FA001FC"><enum>(A)</enum><text>in the case of an insurable commodity, to obtain a policy or plan of insurance under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>) providing additional coverage for the insurable commodity for each of the next 2 crops, at a coverage level this provides—</text> 
<clause id="H2A663F304C1B4CA79128CE661EFAA58D"><enum>(i)</enum><text>not less than 65 percent of the actual production history for the crop produced on the farm; and</text></clause> 
<clause id="H395A16EA39B849FCB980FAD6B746DBBE"><enum>(ii)</enum><text>100 percent of the expected market price or a comparable coverage (as determined by the Federal Crop Insurance Corporation); and</text></clause></subparagraph> 
<subparagraph id="H451BF37D19DD475D8EAA3D001B92CAB7"><enum>(B)</enum><text>in the case of a noninsurable commodity, to file the required paperwork and pay the administrative fee by the applicable State filing deadline, for the noninsurable commodity for each of the next 2 crops under section 196 of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7333">7 U.S.C. 7333</external-xref>).</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HB997B95BE88449309ECAD1FE8BF68522"><enum>(3)</enum><header>Effect of violation</header><text>In the event of the violation of a contract under paragraph (2) by a producer, the producer shall reimburse the Secretary for the full amount of the assistance provided to the producer under this section.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H7575A3CB2FBB43D5BE5E9B38C524BDAC"><enum>(f)</enum><header>Timing</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HD0D068AADD26428BB22C9D795DC9A5F2"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Secretary shall make payments to producers on a farm for a crop under this section not later than 60 days after the date the producers on the farm submit to the Secretary a completed application for the payments.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HE6E8D56F03FE488A8166C10090B8C757"><enum>(2)</enum><header>Interest</header><text>If the Secretary does not make payments to the producers on a farm by the date described in paragraph (1), the Secretary shall pay to the producers on a farm interest on the payments at a rate equal to the current (as of the sign-up deadline established by the Secretary) market yield on outstanding, marketable obligations of the United States with maturities of 30 years.</text></paragraph></subsection></section> 
<section id="H29221E0D6A204D9AA3EAF6A5CD7EB501"><enum>102.</enum><header>Livestock assistance program</header> 
<subsection id="HBE2925DE74264056A15EF5BBF655E924"><enum>(a)</enum><header>Emergency financial assistance</header><text>The Secretary shall use such sums as are necessary of funds of the Commodity Credit Corporation to make and administer payments for livestock losses to producers for 2005 losses in a county that has received an emergency designation by the President or the Secretary during calendar year 2005, of which an amount determined by the Secretary shall be made available for the American Indian livestock program under section 806 of the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/106/387">Public Law 106–387</external-xref>; 114 Stat. 1549A–51).</text></subsection> 
<subsection id="H2A2DD4F4D652481BA09C73A352A0306E"><enum>(b)</enum><header>Administration</header><text>The Secretary shall make assistance available under this section in the same manner as provided under section 806 of the Agriculture, Rural Development, Food and Drug Administration, and Related Agencies Appropriations Act, 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/106/387">Public Law 106–387</external-xref>; 114 Stat. 1549A–51).</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H5C784AF295D24BDF9C97C6AA8993006D"><enum>(c)</enum><header>Mitigation</header><text>In determining the eligibility for or amount of payments for which a producer is eligible under the livestock assistance program, the Secretary shall not penalize a producer that takes actions (recognizing disaster conditions) that reduce the average number of livestock the producer owned for grazing during the production year for which assistance is being provided.</text></subsection> 
<subsection id="H3F2DAB026E054E9787CBA6EFABBC7230"><enum>(d)</enum><header>Interest on prior payments</header> 
<paragraph id="HD813EA54D65E44F68384A4C9CD1A17E"><enum>(1)</enum><header>In general</header><text>Payments that were due to a producer under section 101(b) of the Emergency Supplemental Appropriations for Hurricane Disasters Assistance Act, 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/108/324">Public Law 108–324</external-xref>; 118 Stat. 1234) but not paid by the Secretary as of August 28, 2005, shall earn interest at a rate equal to the current (as of August 28, 2005) market yield on outstanding, marketable obligations of the United States with maturities of 30 years.</text></paragraph> 
<paragraph id="H3DCCE3D85CAE47DFB54313468EFB3C"><enum>(2)</enum><header>Funding</header><text>Interest payable under paragraph (1) shall be carried out using only funds made available for travel expenses, or salaries and expenses of Presidential appointees, of the Department of Agriculture.</text></paragraph></subsection> 
<subsection id="HF466D44FE31A4EADB94E4FC591472106"><enum>(e)</enum><header>Livestock indemnity payments</header> 
<paragraph id="HB7EA67A548924B05835C9FED60F55BDA"><enum>(1)</enum><header>In general</header><text>The Secretary shall use such sums as are necessary of funds of the Commodity Credit Corporation to make livestock indemnity payments to producers on farms that have incurred livestock losses during calendar year 2005 due to a disaster, as determined by the Secretary, including losses due to hurricanes, floods, and anthrax.</text></paragraph> 
<paragraph id="H775EF541CA7A4DAEAFCA85913CA82288"><enum>(2)</enum><header>Payment rates</header><text>The payment rate for indemnity payments made to producers on a farm under paragraph (1) shall be equal to—</text> 
<subparagraph id="HD048DA6C711D4B12A2F65221B8001D6C"><enum>(A)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="H4A50435321B442869EA99BF7B942FC51"><enum>(i)</enum><text>in the case of a cow, steer, or bull that weighs 500 pounds or more on the date of death of the cow, steer, or bull, $400 per head; and</text></clause> 
<clause id="H09F78C7BE8B141FE81A389542CAA3606" indent="up1"><enum>(ii)</enum><text>in the case of a cow, steer, or bull that weighs less than 500 pounds on the date of death of the cow, steer, or bull, $250 per head; and</text></clause></subparagraph> 
<subparagraph id="HAC3319E77C6A47FEA03D48AD990609DF"><enum>(B)</enum><text>in the case of other types of livestock, a rate determined by the Secretary based on documentation provided by the producers on a farm, including a death certificate or other certification provided by a licensed veterinarian.</text></subparagraph></paragraph></subsection></section> 
<section id="H9E8685ED3B944736B200056CC4432ECE"><enum>103.</enum><header>Conservation programs</header>

<paragraph commented="no" display-inline="no-display-inline" id="HE453DEC6372C46B88DE3CB5980E402E6"><enum>(1)</enum><header>Definition of disaster</header><text display-inline="yes-display-inline">Section 3(k) of the <act-name parsable-cite="SBA">Small Business Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632(k)</external-xref>) is amended—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H0D561717DA9C430F92D497A444F483C"><enum>(A)</enum><text display-inline="yes-display-inline">by inserting <quote>(1)</quote> before <quote>For the purposes</quote>; and</text></subparagraph>

<subsection commented="no" display-inline="no-display-inline" id="H5B8043D491DF443B933E909C3579106E"><enum>(b)</enum><header>Limitation on loans</header><text display-inline="yes-display-inline">From funds otherwise appropriated for loans under section 7(b) of the <act-name parsable-cite="SBA">Small Business Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)</external-xref>), not more than $9,000,000 may be used during each of fiscal years 2005 through 2008, to provide drought disaster loans to non-farm-related small business concerns in accordance with this section and the amendments made by this section.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H9481CF945A9A46358F6061C7A612BDB6"><enum>(c)</enum><header>Prompt response to disaster requests</header><text display-inline="yes-display-inline">Section 7(b)(2)(D) of the <act-name parsable-cite="SBA">Small Business Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/636">15 U.S.C. 636(b)(2)(D)</external-xref>) is amended in the second sentence by striking <quote>Upon receipt of such certification, the Administration may</quote> and inserting <quote>Not later than 30 days after the date of receipt of such certification by a Governor of a State, the Administration shall respond in writing to that Governor on its determination and the reasons therefore, and may</quote>.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H583068879CE740FBA1EF00A0DFED23F7"><enum>(d)</enum><header>Rulemaking</header><text display-inline="yes-display-inline">Not later than 45 days after the date of enactment of this Act, the Administrator of the Small Business Administration shall promulgate final rules to carry out this section and the amendments made by this section.</text></subsection></section> 
<section id="HA0689E250AE34B639882522ED9BC7811"><enum>105.</enum><header>Assistance to fisheries for red tide outbreak in New England</header> 
<subsection id="HF1459E9FB6EE4D8D9193B7BA1729A4D6"><enum>(a)</enum><header>In general</header><text>Out of any funds in the Treasury not otherwise appropriated, the Secretary of the Treasury shall transfer to the Secretary of Commerce to provide assistance to fisheries suffering due to the red tide outbreak in New England—</text> 
<paragraph id="H8DA64FA326E04B36A698DDCD38D9095E"><enum>(1)</enum><text>on October 1, 2005, $15,000,000; and</text></paragraph> 
<paragraph id="H6AEED49394924DB8B93FE100B5639686"><enum>(2)</enum><text>on October 1, 2006, $10,000,000.</text></paragraph></subsection> 
<subsection id="HBFC51B4C06994635AFA6CAB6682EC9D2"><enum>(b)</enum><header>Receipt and acceptance</header><text>The Secretary of Commerce shall be entitled to receive, shall accept, and shall use to carry out this section the funds transferred under subsection (a), without further appropriation.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HD00E9119C2304E55A0C18FC9EEA6482E"><enum>(c)</enum><header>Availability of funds</header><text>Funds transferred under subsection (a) shall remain available until expended.</text></subsection></section> 
<section id="HB02776DA482E487BA7C4B7AFD9A693CC"><enum>106.</enum><header>Flooded crop and grazing land</header> 
<subsection id="H50B6509BECA944278937BD8C686895A9"><enum>(a)</enum><header>In general</header><text>The Secretary shall compensate eligible owners of flooded crop and grazing land in—</text> 
<paragraph id="H99089C1B063D41199000DAC5D630F19"><enum>(1)</enum><text>the Devils Lake basin; and</text></paragraph> 
<paragraph id="H6E35E25A59124456A4D78C846225317C"><enum>(2)</enum><text>the McHugh, Lake Laretta, and Rose Lake closed drainage areas of the State of North Dakota.</text></paragraph></subsection> 
<subsection id="H715C3A7C7B3140A79D3C9C9B8C058063"><enum>(b)</enum><header>Eligibility</header> 
<paragraph id="HBE939C23CC6B4E2DA167C869EA8885E4"><enum>(1)</enum><header>In general</header><text>To be eligible to receive compensation under this section, an owner shall own land described in subsection (a) that, during the 2 crop years preceding receipt of compensation, was rendered incapable of use for the production of an agricultural commodity or for grazing purposes (in a manner consistent with the historical use of the land) as the result of flooding, as determined by the Secretary.</text></paragraph> 
<paragraph id="H90395A7718584410B2CE1300B9426EEB"><enum>(2)</enum><header>Inclusions</header><text>Land described in paragraph (1) shall include—</text> 
<subparagraph id="HB60344227346432FA84CD7C19E845679"><enum>(A)</enum><text>land that has been flooded;</text></subparagraph> 
<subparagraph id="H00BD748E56D74F7A8FC0AA8729984B68"><enum>(B)</enum><text>land that has been rendered inaccessible due to flooding; and</text></subparagraph> 
<subparagraph id="H5CD1CAC9AD394A7EAE22D49B18810052"><enum>(C)</enum><text>a reasonable buffer strip adjoining the flooded land, as determined by the Secretary.</text></subparagraph></paragraph> 
<paragraph id="H8C4650B9D12F48A7AD00E397D3FC6B3"><enum>(3)</enum><header>Administration</header><text>The Secretary may establish—</text> 
<subparagraph id="H62DC70489BA14A2E93F3960443E978DB"><enum>(A)</enum><text>reasonable minimum acreage levels for individual parcels of land for which owners may receive compensation under this section; and</text></subparagraph> 
<subparagraph id="HE16B994632AF4F41846917930890B294"><enum>(B)</enum><text>the location and area of adjoining flooded land for which owners may receive compensation under this section.</text></subparagraph></paragraph></subsection> 
<subsection id="H72D36BAA0F67470E89378371A264AA71"><enum>(c)</enum><header>Sign-Up</header><text>The Secretary shall establish a sign-up program for eligible owners to apply for compensation from the Secretary under this section.</text></subsection> 
<subsection id="H53C555EE82DB490392497B002D935531"><enum>(d)</enum><header>Compensation payments</header> 
<paragraph id="H2E969EB27891414087D45ACB71C4841"><enum>(1)</enum><header>In general</header><text>Subject to paragraphs (2) and (3), the rate of an annual compensation payment under this section shall be equal to 90 percent of the average annual per acre rental payment rate (at the time of entry into the contract) for comparable crop or grazing land that has not been flooded and remains in production in the county where the flooded land is located, as determined by the Secretary.</text></paragraph> 
<paragraph id="H8DADCCDEF0B54BA3987B50E44BA18823"><enum>(2)</enum><header>Reduction</header><text>An annual compensation payment under this section shall be reduced by the amount of any conservation program rental payments or Federal agricultural commodity program payments received by the owner for the land during any crop year for which compensation is received under this section.</text></paragraph> 
<paragraph id="H50DA118220054AA7987E9E4C5F9EBBF5"><enum>(3)</enum><header>Exclusion</header><text>During any year in which an owner receives compensation for flooded land under this section, the owner shall not be eligible to participate in or receive benefits for the flooded land under—</text> 
<subparagraph id="H4621CF75363141EEB0007970DF54B3E3"><enum>(A)</enum><text>the Federal crop insurance program established under the Federal Crop Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1501">7 U.S.C. 1501 et seq.</external-xref>);</text></subparagraph> 
<subparagraph id="HAC8C1A5465BF417C8634F65855490006"><enum>(B)</enum><text>the noninsured crop assistance program established under section 196 of the Federal Agriculture Improvement and Reform Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/7/7333">7 U.S.C. 7333</external-xref>); or</text></subparagraph> 
<subparagraph id="HA02AC77DB2D743F6A256E3CDDDD51DF0"><enum>(C)</enum><text>any Federal agricultural crop disaster assistance program.</text></subparagraph></paragraph></subsection> 
<subsection id="HDCEB5F0FF51B40FFA5EFBA9E14653B4B"><enum>(e)</enum><header>Relationship to agricultural commodity programs</header><text>The Secretary, by regulation, shall provide for the preservation of cropland base, allotment history, and payment yields applicable to land described in subsection (a) that was rendered incapable of use for the production of an agricultural commodity or for grazing purposes as the result of flooding.</text></subsection> 
<subsection id="H79A1AC5717D9413CA26B7DDCBD9FD3"><enum>(f)</enum><header>Use of land</header> 
<paragraph id="H3312EB5AD5C445AFBC26A18DE2D5B688"><enum>(1)</enum><header>In general</header><text>An owner that receives compensation under this section for flooded land shall take such actions as are necessary to not degrade any wildlife habitat on the land that has naturally developed as a result of the flooding.</text></paragraph> 
<paragraph id="HB2C21DF965DF443B93FB54387D247750"><enum>(2)</enum><header>Recreational activities</header><text>To encourage owners that receive compensation for flooded land to allow public access to and use of the land for recreational activities, as determined by the Secretary, the Secretary may—</text> 
<subparagraph id="HDC90095FA2E141E985C4BFDEEF5FE6D5"><enum>(A)</enum><text>offer an eligible owner additional compensation; and</text></subparagraph> 
<subparagraph id="H37EC023F8BD94638B885BE92BF1599EC"><enum>(B)</enum><text>provide compensation for additional acreage under this section.</text></subparagraph></paragraph></subsection> 
<subsection id="H1DE4BD28EE88471DB0F38B576E379927"><enum>(g)</enum><header>Funding</header> 
<paragraph id="H44754A4BE9464AD6AC68C02034F86BA"><enum>(1)</enum><header>In general</header><text>The Secretary shall use $15,000,000 of funds of the Commodity Credit Corporation to carry out this section.</text></paragraph> 
<paragraph id="H2851737B4A1948C1B98E70766502C31F"><enum>(2)</enum><header>Pro-rated payments</header><text>In a case in which the amount made available under paragraph (1) for a fiscal year is insufficient to compensate all eligible owners under this section, the Secretary shall pro-rate payments for that fiscal year on a per acre basis.</text></paragraph></subsection></section> 
<section id="H9991F4CDFD924B61888C32A476E7D2AF"><enum>107.</enum><header>Regulations</header> 
<subsection id="H34147AB6B7ED4CD78509CA343952704F"><enum>(a)</enum><header>In general</header><text>The Secretary may promulgate such regulations as are necessary to implement this Act and the amendments made by this Act.</text></subsection> 
<subsection id="H8278D28274684D1D90BBDBB4254BC60"><enum>(b)</enum><header>Procedure</header><text>The promulgation of the regulations and administration of this Act and the amendments made by this Act shall be made without regard to—</text> 
<paragraph id="HB1595E6289DD482281513D2DFABEA8F9"><enum>(1)</enum><text>the notice and comment provisions of <external-xref legal-doc="usc" parsable-cite="usc/5/553">section 553</external-xref> of title 5, United States Code;</text></paragraph> 
<paragraph id="H0BDC5F289C014C6DA39B03EFBD163B94"><enum>(2)</enum><text>the Statement of Policy of the Secretary of Agriculture effective July 24, 1971 (36 Fed. Reg. 13804), relating to notices of proposed rulemaking and public participation in rulemaking; and</text></paragraph> 
<paragraph id="HCA9385840256447FBB471466E1E50900"><enum>(3)</enum><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/44/35">chapter 35</external-xref> of title 44, United States Code (commonly known as the <quote>Paperwork Reduction Act</quote>).</text></paragraph></subsection>

<subsection commented="no" display-inline="no-display-inline" id="HF9523514FF5145A493D49D0947E08488"><enum>(e)</enum><header>Additional grants</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HADE89042832942D697F10799477406BA"><enum>(1)</enum><header>In general</header><text>The Secretary shall use $175,000,000 of funds of the Commodity Credit Corporation to make additional grants in accordance with paragraph (2) to—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H01F41062F3884A8900D4649DA05CAF4D"><enum>(A)</enum><text>the States of Alabama, Florida, Louisiana, Mississippi, and Tennessee; and</text></subparagraph> 
<subparagraph id="H91FAAE60B16A49A0B204DBF69D084CF3"><enum>(B)</enum><text>any other State that is housing evacuees or suffering damage from Hurricane Katrina or a related condition.</text></subparagraph></paragraph> 
<paragraph id="H95B1B74E5C1A4F7700EDC8DA96CBE300"><enum>(2)</enum><header>Purpose of grants</header><text>A grant provided under paragraph (1) shall—</text> 
<subparagraph id="H54A6BF52D41348E0A004353F029CB700"><enum>(A)</enum><text>be in an amount determined by the Secretary; and</text></subparagraph> 
<subparagraph id="HEA3438FBA7AC4E34A74DF95804F57B00"><enum>(B)</enum><text>be used in accordance with paragraph (3) to support activities that promote agriculture.</text></subparagraph></paragraph> 
<paragraph id="HBB9E076E4018412E924DFCC4BC45E313"><enum>(3)</enum><header>Use of funds</header><text>A State may use funds from a grant awarded under this subsection—</text> 
<subparagraph id="H444012797A3F4AD7847BFAE3F375E17F"><enum>(A)</enum><text>to supplement State food bank programs or other nutrition assistance programs;</text></subparagraph> 
<subparagraph id="HFDA53D9041654E1F8CA23C69F1E47BCD"><enum>(B)</enum><text>to promote the purchase, sale, or consumption of agricultural products;</text></subparagraph> 
<subparagraph id="H0392ED0DF77F4D89ADCBF6FEE420B066"><enum>(C)</enum><text>to provide economic assistance to agricultural producers, giving a priority to the support of specialty crops; or</text></subparagraph> 
<subparagraph id="HAD07D854068640F1AEB09D476BDA8E8D"><enum>(D)</enum><text>for other purposes as determined by the Secretary.</text></subparagraph></paragraph></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="H85B3EE14EEA94B65A44F9B92A21F2EDB"><enum>202.</enum><header>Extension of marketing loans</header> 
<subsection commented="no" display-inline="no-display-inline" id="H9B05BFBAEB0C48F7B52FF59E45316719"><enum>(a)</enum><header>In general</header><text>Notwithstanding section 1203(b) of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/7933">7 U.S.C. 7933(b)</external-xref>), the Secretary shall extend the date of settlement of any marketing assistance loan made available under subtitle B of that Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7931">7 U.S.C. 7931 et seq.</external-xref>) for a period of not less than 180 days after the date on which the loan reaches maturity.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H01F94E3B79AB498D995B00A23470547E"><enum>(b)</enum><header>Storage payments</header><text>During the period of an extension under subsection (a), the Secretary shall make storage payments for any commodity affected by the marketing assistance loan for which the extension was granted.</text></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="HAD1880C1DC404BE881F372EF001CF1E7"><enum>203.</enum><header>Supplemental economic loss payments</header><text display-inline="no-display-inline">The Secretary shall make a supplemental economic loss payment to any producer on a farm that received a payment or loan for crop year 2005 under title I of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/7901">7 U.S.C. 7901 et seq.</external-xref>) at a rate equal to the product obtained by multiplying—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="HA12AB537FCF542A09C79D5AB223CC7F"><enum>(1)</enum><text display-inline="yes-display-inline">20 percent of the direct payment rate in effect for the program crop of the farmer;</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H21FA8ABF074D4CD9956E31AFE6F9D5BE"><enum>(2)</enum><text>the program crop base of the farmer; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H0811D2B632AC4E34AAF9A72867CFCCB"><enum>(3)</enum><text>the program payment yield for each program crop of the farmer.</text></paragraph></section> 
<section id="H3E5E9EBA042D4BCB969B9B00F69E7183"><enum>204.</enum><header>National dairy market loss payments</header> 
<subsection id="HEF03EA1DAA2349CFB6DCFCDB7B5BE3A2"><enum>(a)</enum><header>In general</header><text>Section 1502 of the Farm Security and Rural Investment Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/7/7982">7 U.S.C. 7982</external-xref>) is amended by striking <quote>2005</quote> each place it appears in subsections (f) and (g)(1) and inserting <quote>2006</quote>.</text></subsection> 
<subsection changed="not-changed" commented="no" display-inline="no-display-inline" id="H612B908876C34E95A84C00AD55366E08"><enum>(b)</enum><header>Period of effectiveness</header><text>Notwithstanding section 257 of the Balanced Budget and Emergency Deficit Control Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/2/907">2 U.S.C. 907</external-xref>), the amendment made by subsection (a) shall be effective only during the period beginning on the first day of the first month beginning after the date of enactment of this Act and ending September 30, 2006.</text></subsection></section></title>
