<official-title>To amend selected statutes to clarify existing Federal law as to the treatment of students privately educated at home under State law.</official-title> 
</form>

<section id="H195E936BAA2F4CA4AF1BE4F77FE90933" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Home School Non-Discrimination Act of 2005</short-title></quote>.</text></section> 
<section id="HBB2A730C77E240B0A6A900C67DE6FE6"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds as follows:</text> 
<paragraph id="H98181781F9EF4FF4A45816DCEFE400D"><enum>(1)</enum><text>The right of parents to direct the education of their children is an established principle and precedent under the United States Constitution.</text></paragraph> 
<paragraph id="HBF7640BEA77442B0B81269EF3FD35156"><enum>(2)</enum><text>Congress, the President, and the Supreme Court, in exercising their legislative, executive, and judicial functions, respectively, have repeatedly affirmed the rights of parents.</text></paragraph> 
<paragraph id="H8163CF5E821F4DA4BED312B448B174BB"><enum>(3)</enum><text>Education by parents at home has proven to be an effective means for young people to achieve success on standardized tests and to learn valuable socialization skills.</text></paragraph> 
<paragraph id="H55403FC625A74342BEAF39B905D8000"><enum>(4)</enum><text>Young people who have been educated at home are proving themselves to be competent citizens in postsecondary education and the workplace.</text></paragraph> 
<paragraph id="H8EA594ECA8924DA091F7B099AB1CA8C2"><enum>(5)</enum><text>The rise of private home education has contributed positively to the education of young people in the United States.</text></paragraph> 
<paragraph id="HB85C19E886EE488CB3C918B72BBE9DD8"><enum>(6)</enum><text>Several laws, written before and during the rise of private home education, are in need of clarification as to their treatment of students who are privately educated at home pursuant to State law.</text></paragraph> 
<paragraph id="HC8EE719B01304472A200F8772D1037D5"><enum>(7)</enum><text>The United States Constitution does not allow Federal control of homeschooling.</text></paragraph></section> 
<section id="HB26466DA857746DC8B27B0106EBEDB5"><enum>3.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text> 
<paragraph id="H22F1AA12615945648C83B4C39638BDDC"><enum>(1)</enum><text>private home education, pursuant to State law, is a positive contribution to the United States; and</text></paragraph> 
<paragraph id="H7B24CDB625D44D0C98B085E78B5466F"><enum>(2)</enum><text>parents who choose this alternative education should be encouraged within the framework provided by the United States Constitution.</text></paragraph></section> 
<section id="HB1C749AC76034988BB18007296A23BE3" commented="no"><enum>4.</enum><header>Clarification of provisions on institutional and student eligibility under the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name></header> 
<subsection id="HDEE4104C356F4212BE4531DDB4377E05" commented="no"><enum>(a)</enum><header>Clarification of institutional eligibility</header><text>Section 101(a)(1) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)(1)</external-xref>) is amended by inserting <quote>meeting the requirements of section 484(d)(3) or</quote> after <quote>only persons</quote>.</text></subsection> 
<subsection id="H138207C88D36454E9C61EE45F26DBA7D" commented="no"><enum>(b)</enum><header>Clarification of student eligibility</header><text>Section 484(d) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1091">20 U.S.C. 1091(d)</external-xref>) is amended by striking the heading and inserting <header-in-text level="subsection" style="OLC"><quote>Satisfaction of Secondary Education Standards</quote>.</header-in-text></text></subsection></section> 
<section id="H36306FAEB2654418869000EE09001E25"><enum>5.</enum><header>Clarification of absence of consent for initial evaluation under the Individuals with Disabilities Education Act</header><text display-inline="no-display-inline">Section 614(a)(1)(D)(ii)(I) of the Individuals with Disabilities Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1414">20 U.S.C. 1414(a)(1)(D)(ii)(I)</external-xref>) is amended to read as follows:</text> 
<quoted-block display-inline="no-display-inline" id="H212C0E088CDC4F1F9EF42B417B85FAFA" style="OLC"> 
<subclause id="HD713B1881F32462D94D3DA69E9E148F6"><enum>(I)</enum><header>For initial evaluation</header><text display-inline="yes-display-inline">A local educational agency may pursue the initial evaluation of a child by utilizing the procedures described in section 615, except to the extent inconsistent with State law relating to parental consent for an initial evaluation under clause (i)(I), only if the child is enrolled in public school or is seeking to be enrolled in public school.</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H86A81D4801D94C57ACB901C98ED09C4B" commented="no"><enum>6.</enum><header>Clarification of the Coverdell education savings account as to its applicability for expenses associated with students privately educated at home under state law</header> 
<subsection id="HC2B1636978984E8A00F5EF5D26289E06" commented="no"><enum>(a)</enum><header>In general</header><text>Paragraph (4) of <external-xref legal-doc="usc" parsable-cite="usc/26/530">section 530(b)</external-xref> of the Internal Revenue Code of 1986 (relating to qualified elementary and secondary education expenses) is amended by adding at the end the following new subparagraph:</text> 
<quoted-block id="H2EE10D7E53354F73B3C2C506F142B3A9"> 
<subparagraph id="H4966067C903E47458021476D6497C4D"><enum>(C)</enum><header>Special rule for home schools</header><text>For purposes of clauses (i) and (iii) of subparagraph (A), the terms <term>public, private, or religious school</term> and <term>school</term> shall include any home school which provides elementary or secondary education if such school is treated as a home school or private school under State law.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H865602ADC46C44F6A03E7B4990156871" commented="no"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall apply to taxable years beginning after the date of the enactment of this Act.</text></subsection></section> 
<section id="HC43608A014F74EB09B4BF4EF71B60600"><enum>7.</enum><header>Clarification of Section <enum-in-header>444</enum-in-header> of the General Education Provisions Act as to publicly held records of students privately educated at home under state law</header><text display-inline="no-display-inline">Section 444 of the General Education Provisions Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1232g">20 U.S.C. 1232g</external-xref>; also referred to as the Family Educational Rights and Privacy Act of 1974) is amended—</text> 
<paragraph id="H68404B4ABBE1422A96B4CFE91082100"><enum>(1)</enum><text>in subsection (a)(5), by adding at the end the following:</text> 
<quoted-block id="HA38D70E4D87245B09E20004302A3161B"> 
<subclause id="HDBE39F5DC23740B1A06222A286E44B71" indent="up4" commented="no"><enum>(C)</enum><text>For students in non-public education (including any student educated at home or in a private school in accordance with State law), directory information may not be released without the written consent of the parents of such student.</text></subclause><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HA30824F44C63423EBD6BBC2C972BB53B"><enum>(2)</enum><text>in subsection (a)(6), by striking <quote>, but does not include a person who has not been in attendance at such agency or institution.</quote> and inserting <quote>, including any non-public school student (including any student educated at home or in a private school as provided under State law). This paragraph shall not be construed as requiring an educational agency or institution to maintain education records or personally identifiable information for any non-public school student.</quote>; and</text></paragraph> 
<paragraph id="H19C579A495B34A40819624ADD60A249"><enum>(3)</enum><text>in subsection (b)(1), by striking subparagraph (F) and inserting the following:</text> 
<quoted-block id="H69F1FB9D5735438B8BD77003F32EDDA"> 
<subparagraph id="HEFC538D2ABD2457999AA24009E6119FD"><enum>(F)</enum><text>organizations conducting studies for, or on behalf of, educational agencies or institutions for the purpose of developing, validating, or administering predictive tests, administering student aid programs, and improving instruction, if—</text> 
<clause id="H241FA77ACD4F46DC91D8C584EFAD6BD7"><enum>(i)</enum><text>such studies are conducted in such a manner as will not permit the personal identification of students and their parents by persons other than representatives of such organizations and such information will be destroyed when no longer needed for the purpose for which it is conducted; and</text></clause> 
<clause id="HF19F241AC1A6492D879B35BB5371ACF5" commented="no"><enum>(ii)</enum><text>for students in non-public education, education records or personally identifiable information may not be released without the written consent of the parents of such student.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HF53C0487292A49DE8C7267786FFD5766" commented="no"><enum>8.</enum><header>Clarification of eligibility for students privately educated at home under state law for the Robert C. Byrd Honors Scholarship Program</header><text display-inline="no-display-inline">Section 419F(a) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1070d-36">20 U.S.C. 1070d–36(a)</external-xref>) is amended by inserting <quote>(or a home school, whether treated as a home school or a private school under State law)</quote> after <quote>public or private secondary school</quote>.</text></section> 
<section id="HD71105E566874043AA00F14E29ADD968" commented="no"><enum>9.</enum><header>Clarification of the Fair Labor Standards Act as applied to students privately educated at home under state law</header><text display-inline="no-display-inline">Section 3(l) of the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/203">29 U.S.C. 203(l)</external-xref>) is amended by adding at the end the following: <quote>The Secretary shall extend the hours and periods of permissible employment applicable to employees between the ages of 14 and 16 years of age who are privately educated at a home school (whether the home school is treated as a home school or a private school under State law) beyond such hours and periods applicable to employees between the ages of 14 and 16 years of age who are educated in traditional public schools.</quote>.</text></section>
<section id="HB6B796C9D85043BDB223E172508D8352" section-type="subsequent-section" display-inline="no-display-inline"><enum>10.</enum><header>Recruitment and enlistment of home-schooled students in the Armed Forces</header>
<subsection id="H2EE22952909446FF81ACCAA2C900517E"><enum>(a)</enum><header>Home-schooled students</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/31">Chapter 31</external-xref> of title 10, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/10/503">section 503</external-xref> the following new section:</text>
<quoted-block style="USC" id="HC1CA6DF7E6274E9BB9ACB88DFD6817D3" display-inline="no-display-inline">
<section id="H15FFA813EF8E43C29201D43F5C4F4129"><enum>503a.</enum><header>Recruitment and enlistment of home-schooled students</header>
<subsection id="H3373297DF532499B9F665F70857DE2F0" display-inline="no-display-inline"><enum>(a)</enum><header>Policy on recruitment and enlistment</header><text>The Secretary concerned shall prescribe a policy for the recruitment and enlistment of home-schooled students. The Secretary of Defense shall ensure that the polices prescribed under this section apply, to the extent practicable, uniformly across the armed forces</text></subsection>
<subsection id="H81661A4B65A14FD89B13CA71D5DF2DCE" commented="no"><enum>(b)</enum><header>Elements</header><text>The policy prescribed by the Secretary concerned under subsection (a) shall include the following:</text>
<paragraph id="HA52827E73FB34267AB6402401256237E" commented="no"><enum>(1)</enum><text>Identification of qualified graduates of home schooling for purposes of recruitment and enlistment in the armed forces that is in accordance with the requirements described in subsection (c).</text></paragraph>
<paragraph id="HCF5C5AAB6EF9496F854E1D19A2CC214B" commented="no"><enum>(2)</enum><text>Provision for the treatment, within the Department of Defense classification system of educational credentials for recruitment purposes, of graduates of home schooling within the same tier status as regular high school graduates, with no practical limit with regard to enlistment.</text></paragraph>
<paragraph id="HB4EC9F29522346EDB49E21D3C23259FB" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">Exemption of graduates of home schooling from any requirement for a secondary school diploma or a General Education Development (GED) certificate of high school equivalency as a precondition for enlistment in the armed forces.</text></paragraph></subsection>
<subsection id="HA7B1C5559B1347B791625F675467EF00" commented="no"><enum>(c)</enum><header>Qualified home-school graduates</header><text>In identifying a graduate of home schooling for purposes of subsection (b), the Secretary concerned shall ensure that the graduate meets each of the following requirements:</text>
<paragraph id="HC67DA5F215CA46E1BEBB514535367B94" commented="no"><enum>(1)</enum><text>The graduate has taken the Armed Forces Qualification Test and scored at the 50th percentile or above.</text></paragraph>
<paragraph id="H3AC64B721C7B40890040437DF0CD755B" commented="no"><enum>(2)</enum><text>The graduate has provided the Secretary concerned with—</text>
<subparagraph id="H5BE264F6FA434798899F45F09DC16568" commented="no"><enum>(A)</enum><text>a signed home-school notice of intent form that conforms with the State law of the State where the graduate resided when the graduate was in home school; or</text></subparagraph>
<subparagraph id="HD619F5380F304AC8B600B72C26C744D7" commented="no"><enum>(B)</enum><text display-inline="yes-display-inline">a home-school certificate or diploma from the parent or guardian of the graduate or a national curriculum provider.</text></subparagraph></paragraph>
<paragraph id="HFC6463BF949A440AA9FF12FC2E95EAA3" commented="no"><enum>(3)</enum><text>The graduate has provided the Secretary concerned with a copy of the graduate’s transcript for all secondary school grades completed which—</text>
<subparagraph id="HE5BB71CB8D8A4B828821BAD6D2829E95" commented="no"><enum>(A)</enum><text>includes the enrollment date, graduation date, and type of curriculum; and</text></subparagraph>
<subparagraph id="H3853E8060F444B99BD94808949DE0096" commented="no"><enum>(B)</enum><text>reflects successful completion of the last full academic year of schooling from the home-school national curriculum provider, parent, or guardian issuing the home-school certificate or diploma or home-school notice of intent form.</text></subparagraph></paragraph>
<paragraph id="HF4D8D81AF31A448EA8C31400DB5514BF" commented="no"><enum>(4)</enum><text>The home-school curriculum used by the graduate involved parental instruction and supervision and closely patterned the normal credit hours per subject as used in a traditional secondary school.</text></paragraph>
<paragraph id="H87A9749902C5499A81F3D22CD43DAD7E" commented="no"><enum>(5)</enum><text>The graduate has provided the Secretary concerned with a third-party verification letter of the graduate’s home-school status by the Home School Legal Defense Association or a State or county home-school association or organization.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
<subsection id="H5496309195D1407BA2652B52BAEA47CA"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by inserting after the item relating to section 503 the following new item:</text>
