<legis-type>A BILL</legis-type> 
<official-title>To provide additional funds to local educational agencies for elementary and secondary education and pupil services for students displaced by Hurricane Katrina, and for other purposes.</official-title>

<section id="H6AF47DEC6316410DB0FA74B4952E532B" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Displaced Student Relief Act</short-title></quote>.</text></section> 
<section id="H5A8BFF3EC87544F193B6A3A5BB9913B0"><enum>2.</enum><header>Education and pupil services for elementary and secondary students displaced by Hurricane Katrina</header> 
<subsection id="H100299C990C74314BCBF638492E00ED"><enum>(a)</enum><header>In general</header><text>From funds appropriated under this section, the Secretary of Education shall make grants to local educational agencies in fiscal years 2005 and 2006 for the purpose of facilitating the enrollment, attendance, and success in public elementary and secondary schools of displaced students.</text></subsection> 
<subsection id="H32432A9EB94648888294729C3EA35306"><enum>(b)</enum><header>Maximum grant amount</header><text>The maximum amount of the grant a local educational agency may receive under this section for any fiscal year is—</text> 
<paragraph id="H50AD8B432D7343BB009B4B3800ED6C47"><enum>(1)</enum><text display-inline="yes-display-inline">the number of displaced students in the geographic area served by the local educational agency, as determined by the Secretary; multiplied by</text></paragraph> 
<paragraph id="HD55E0E11882343338D78AA89A0194DF5"><enum>(2)</enum><text>$8,305.</text></paragraph></subsection> 
<subsection id="HF1CE3BAD9A58489192A6B1236C1EF7D"><enum>(c)</enum><header>Use of funds</header><text>Local educational agencies shall use funds received under this section for education and pupil services for displaced students who are enrolled in public schools served by the agency. Such services may include the following:</text> 
<paragraph id="H6E999A10C0234122BC201758E7B43391"><enum>(1)</enum><text>Outreach to families affected by a specified hurricane disaster in order to facilitate such families in enrolling displaced students in school.</text></paragraph> 
<paragraph id="HF6AE6ED0482A44B38C4B1BC12F47BD37"><enum>(2)</enum><text display-inline="yes-display-inline">Hiring additional teachers, paraprofessionals, and pupil services personnel required due to the enrollment of such students.</text></paragraph> 
<paragraph id="H6B6CB62BADF84652B1393324FBFB00C8"><enum>(3)</enum><text>Procurement of additional equipment and classroom supplies required due to the enrollment of such students.</text></paragraph> 
<paragraph id="H89B1A7786BE54E90A943B900C75DC7B4"><enum>(4)</enum><text>Procurement of additional classroom space required due to the enrollment of such students.</text></paragraph> 
<paragraph id="H319CFBB3FF7548F4B409B33980B5B979"><enum>(5)</enum><text>Transportation services provided to such students.</text></paragraph> 
<paragraph id="H278868DEBAB14746828261A1CB5449B2"><enum>(6)</enum><text>Counseling and other mental health services for such students.</text></paragraph> </subsection> 
<subsection id="H5105F0F39456446A93BBDB6F82F6ADC3"><enum>(d)</enum><header>Application</header><text display-inline="yes-display-inline">No local educational agency may receive a grant under this section unless the local educational agency submits an application to the Secretary at such time, in such manner, and containing or accompanied by such information as the Secretary may reasonably require.</text></subsection> 
<subsection id="HF8064DB7822F4692ADE75FF00DAF263"><enum>(e)</enum><header>School lunches</header><text>Notwithstanding any other provision of law, a displaced student is deemed eligible for free lunches under section 9 of the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1758">42 U.S.C. 1758</external-xref>).</text></subsection> 
<subsection id="HBAB0E597BF894874ABA4A0FEB2665C05"><enum>(f)</enum><header>Reports</header><text>6 months after the date of the enactment of this Act, and every 6 months thereafter, the Secretary of Education shall submit reports to the appropriate committees of the Congress concerning the implementation of this section.</text> </subsection> 
<subsection id="H3BC239AB4BD542A6929EBDC0B53F14A5" display-inline="no-display-inline"><enum>(g)</enum><header>Definitions</header><text>For purposes of this section:</text> 
<paragraph id="H2CE5B30B56F440AC91EB092C87CA42CE"><enum>(1)</enum><text>The term <term>child</term> means any person within the age limits for which the State in which the person is located provides free public education.</text></paragraph> 
<paragraph id="HC9F47DE6D3B543E8B44942157FA7949E"><enum>(2)</enum><text>The term <term>displaced student</term> means a child who—</text> 
<subparagraph id="H0FFD14B2BC394414B071BC1D00570429"><enum>(A)</enum><text>is a homeless child or youth (as defined in section 725 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11434a">42 U.S.C. 11434a</external-xref>));</text></subparagraph> 
<subparagraph id="HAC6864E6ECC94975B4A732E214678CF5"><enum>(B)</enum><text>but for a specified hurricane disaster, would be enrolled during a school year in an elementary or secondary school in a State;</text></subparagraph> 
<subparagraph id="HEC38C3AAB0B548B58FC2688264493FE7"><enum>(C)</enum><text>is unable, due to such disaster, to access the education and pupil services that the child otherwise would be receiving at such school; and</text></subparagraph> 
<subparagraph id="HD466ACA33D074B8DA0747F7700F4F567"><enum>(D)</enum><text>due to such disaster, is enrolled at a public elementary or secondary school in a different geographic location in a State.</text></subparagraph></paragraph> 
<paragraph id="H8FC09F21B3CC422D9321968F49F418D8"><enum>(3)</enum><text>The term <term>local educational agency</term> has the meaning given such term in section 9101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/8/7801">8 U.S.C. 7801</external-xref>).</text></paragraph> 
<paragraph id="H12EFF67F2B3C465192A9C6E143E490C3"><enum>(4)</enum><text display-inline="yes-display-inline">The terms <term>pupil services</term> and <term>pupil services personnel</term> have the meanings given such terms in section 9101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/8/7801">8 U.S.C. 7801</external-xref>).</text></paragraph> 
<paragraph id="H178CCA124FB14F2899A1C1776EE9B8B1"><enum>(5)</enum><text>The term <term>specified hurricane disaster</term> means any major disaster resulting from Hurricane Katrina declared by the President under the Robert T. Stafford Disaster and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>).</text></paragraph> 
<paragraph id="H61E3E05748384D25B100B159B5328629"><enum>(6)</enum><text display-inline="yes-display-inline">The term <term>State</term> has the meaning given such term in section 9101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/8/7801">8 U.S.C. 7801</external-xref>).</text></paragraph></subsection> 
<subsection id="HCFF44426A5F740DE0047A1F769AF626"><enum>(h)</enum><header>Authorization of appropriations</header><text>To carry out this section, there are authorized to be appropriated such sums as may be necessary for fiscal years 2005 and 2006. Amounts made available under the preceding sentence for fiscal year 2005 shall remain available for expenditure during fiscal year 2006.</text></subsection></section>
