<official-title>To amend the Internal Revenue Code of 1986 to extend the tax treatment of members of the Armed Forces who die while serving in, or as a result of serving in, a combat zone to employees of contractors of the Federal Government.</official-title>

<section section-type="section-one" id="H228F921461594E178C2FCEDBC1C4D64C" display-inline="no-display-inline"><enum>1.</enum><header>Employees of contractors of Federal Government who die in combat zones</header> 
<subsection id="H35C8AA8741EB453DA4317C549C821D6B"><enum>(a)</enum><header>Decedent income</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/692">Section 692</external-xref> of the Internal Revenue Code of 1986 (relating to income taxes of members of Armed Forces, astronauts, and victims of certain terrorist attacks on death) is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="HEA49C195C8C64017A76041AA69D585C6" display-inline="no-display-inline"> 
<subsection id="HD1CFD48CD7944AE58E72E88685E361A2"><enum>(e)</enum><header>Federal Government contractor employees dying with respect to service in a combat zone</header><text display-inline="yes-display-inline">The provisions of subsections (a) and (b) shall apply to any employee of an entity under contract with the Federal Government whose death occurred while serving in a combat zone (as determined under section 112) or as a result of wounds, disease, or injury incurred while so serving. For purposes of the preceding sentence, rules similar to the rules of subsection (b) regarding missing status shall apply.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H24EC33773CF64A148253918F9ECA4B20"><enum>(b)</enum><header>Death gratuity payable with respect to service of Federal Government contractors in a combat zone</header> 
<paragraph id="H58C5238738BA4B6BBD766FCA850A530"><enum>(1)</enum><header>In general</header><text>Section 134 of such Code (relating to certain military benefits) is amended by adding at the end the following new subsection:</text>

<subsection id="HB5EA6CBFAE1948F19116FA514BA1F1E"><enum>(c)</enum><header>Death gratuity payable with respect to service of Federal Government contractors in a combat zone</header> 
<paragraph id="H02E42CBB606B411B996C0147AFB5BB73"><enum>(1)</enum><header>In general</header><text>For purposes of this section, the term <term>qualified military benefit</term> includes a death gratuity payable with respect to any employee of an entity under contract with the Federal Government whose death occurred while serving in a combat zone (as determined under section 112) or as a result of wounds, disease, or injury incurred while so serving. This subsection shall be applied without regard to any limitation in subsection (b) relating to the date on which a benefit is in effect.</text></paragraph> 
<paragraph id="HB4ECD18541164EA3B756304300EAEEC"><enum>(2)</enum><header>Limitation</header><text>Paragraph (1) shall not apply to the portion of any death gratuity that exceeds the amount of the maximum death gratuity described in subsection (b)(3)(C).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H2C38146074304F8CA684223B7C8F006E"><enum>(2)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 134(b)(3)(A) of such Code is amended by striking <quote>and paragraphs (4) and (5)</quote> and inserting <quote>, and paragraphs (4) and (5), and subsection (c)</quote>.</text> </paragraph></subsection> 
<subsection id="HE3CB1BB34B764246BBC8D1AA45DFE0FE"><enum>(c)</enum><header>Clerical amendments</header> 
<paragraph id="H7CF7688903E24B5D9C4B11C0268E00B0"><enum>(1)</enum><text>The heading of section 134 of such Code is amended by inserting <quote><header-in-text level="section" style="OLC">, etc</header-in-text></quote> after <quote><header-in-text level="section" style="OLC">benefits</header-in-text></quote>.</text></paragraph> 
<paragraph id="H925B85B6FD9A45F3A46FA63B5FFC62D5"><enum>(2)</enum><text>The heading of section 692 of such Code is amended by inserting <quote><header-in-text level="section" style="OLC">, etc.,</header-in-text></quote> after <quote><header-in-text level="section" style="OLC">attacks</header-in-text></quote>.</text></paragraph> 
<paragraph id="H3FF5EDE6430B4AE500ECA52900EC85BF"><enum>(3)</enum><text display-inline="yes-display-inline">The item in the table of sections for part III of subchapter B of chapter 1 of such Code relating to section 134 is amended by inserting <quote>, etc</quote> after <quote>benefits</quote>.</text></paragraph> 
<paragraph id="HB6BE728FA42940B9B4FE5A67D8E7CA3"><enum>(4)</enum><text display-inline="yes-display-inline">The item in the table of sections for part II of subchapter J of chapter 1 of such Code relating to section 692 is amended by inserting <quote>, etc.,</quote> after <quote>attacks</quote>.</text></paragraph> </subsection> 
<subsection id="H53974D4CDA0D43A6842D4DF54DF2567F"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply with respect to deaths occurring after December 31, 2003.</text> </subsection> </section>
