<official-title>To amend the Omnibus Crime Control and Safe Streets Act of 1968 to improve the Department of Justice drug court grant program, and for other purposes.</official-title>

<section id="H7FAF343121EF47AEB86D62A4FAECDBB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Drug Courts Improvement Act of 2005</short-title></quote>.</text></section> 
<section id="HBD83EDA183DA46D99016A4E8D4EAD6B8"><enum>2.</enum><header>Improvements to Department of Justice drug court grant program</header><text display-inline="no-display-inline">Section 2951 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3797u">42 U.S.C. 3797u</external-xref>) is amended by adding at the end the following new subsections:</text>

<subsection id="H89EDC2CEA4504D33002F20F3DAC10937"><enum>(c)</enum><header>Mandatory drug testing and mandatory sanctions</header> 
<paragraph id="H5F2D696FE758474C8303AD67F003A1D4"><enum>(1)</enum><header>Mandatory testing</header><text>Grant amounts under this part may be used for a drug court only if the drug court has mandatory periodic testing as described in subsection (a)(3)(A). The Attorney General shall, by prescribing guidelines or regulations, specify standards for the testing. The standards—</text> 
<subparagraph id="H05149AF4E6AA4B6DA647EE27C22415AD"><enum>(A)</enum><text>shall ensure that—</text> 
<clause id="H2A305317981D4AA6AB1D3E9D316DC2CC"><enum>(i)</enum><text>each participant is tested for every controlled substance or addictive substance that the participant has been known to abuse, and for every other commonly used controlled substance or addictive substance; and</text></clause> 
<clause id="HAC563CB1A95F46FCB0B3D2E975FEEF6D"><enum>(ii)</enum><text>the testing is as accurate as practicable; and</text></clause></subparagraph> 
<subparagraph id="HDA94F9C897C64E83AC2ECF2E9D6F69E5"><enum>(B)</enum><text>may specify the regularity of the testing.</text></subparagraph></paragraph> 
<paragraph id="HE0F21E7C4F5540AD97CDAE4DEEDB5B56"><enum>(2)</enum><header>Mandatory sanctions</header><text display-inline="yes-display-inline">Grant amounts under this part may be used for a drug court only if the drug court imposes immediate and dramatic punitive sanctions, therapeutic measures, or both whenever a participant fails a drug test. Such sanctions and measures may include, but are not limited to, one or more of the following:</text> 
<subparagraph id="H38E379D7A77448FABD7B00D3DB10C57F"><enum>(A)</enum><text>Incarceration.</text></subparagraph> 
<subparagraph id="H5477801C26A9476DB6FC727316EB5010"><enum>(B)</enum><text>Detoxification treatment.</text></subparagraph> 
<subparagraph id="HED8CDF5D2FDE4BBCAF1B863422A5C9E6"><enum>(C)</enum><text>Residential treatment.</text></subparagraph> 
<subparagraph id="H7AAA165E888A4B78AAEBF6603343EF00"><enum>(D)</enum><text>Increased time in program.</text></subparagraph> 
<subparagraph id="H977549E7490A4238A377245D31D76560"><enum>(E)</enum><text>Termination from the program.</text></subparagraph> 
<subparagraph id="HB81589B86B7D4C3DA3CD20CAF2286B22"><enum>(F)</enum><text>Increased drug screening requirements.</text></subparagraph> 
<subparagraph id="HF0B9055F9B124148B1A5D834B9F898D3"><enum>(G)</enum><text>Increased court appearances.</text></subparagraph> 
<subparagraph id="H03A9130A9928450F9000DA2FA3500009"><enum>(H)</enum><text>Increased counseling.</text></subparagraph> 
<subparagraph id="H90CBF05BEF2E45A68742FD4FFE0500E6"><enum>(I)</enum><text>Increased supervision.</text></subparagraph> 
<subparagraph id="HE9600C1250C640E5AB5C98335521A7D1"><enum>(J)</enum><text>Electronic monitoring.</text></subparagraph> 
<subparagraph id="H35D3C8C349AF4789B4A47C50DAEEF6F"><enum>(K)</enum><text>In-home restriction.</text></subparagraph> 
<subparagraph id="H6EE28EBE014E40B48D6EF1EA3013BB33"><enum>(L)</enum><text>Community service.</text></subparagraph> 
<subparagraph id="H868FEE13FB774F62BF2434936F9C00E0"><enum>(M)</enum><text>Family counseling.</text></subparagraph> 
<subparagraph id="H93A3A3782651485A8FF3F409ADB5531"><enum>(N)</enum><text>Anger management classes.</text></subparagraph> 
<subparagraph id="H8692829F5C37461487BE204F700BDAE"><enum>(O)</enum><text>Public apology (in written form, verbal form, or both).</text></subparagraph></paragraph></subsection> 
<subsection id="HBEC46BFBC2E641F0905729872D00B7F5"><enum>(d)</enum><header>Hearings in public places</header><text display-inline="yes-display-inline">Grant amounts under this part may be used by a drug court to carry out programs under which the court holds hearings in public places such as schools. Under such a program, the grant amounts may be used for expenses such as audio visual equipment, costs associated with televising or broadcasting court proceedings, security, educational supplies, and portable equipment. For each fiscal year, the Attorney General shall set aside a portion of the amounts made available for that fiscal year for programs under this subsection.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
