<official-title>To establish a program for gas stamps and to impose a windfall profits tax on crude oil, natural gas, and products thereof.</official-title>

<section id="H2955103161FA4C0C9C5CF37E50D7AEAC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Gas Stamps Act of 2005</short-title></quote>.</text></section> 
<section id="H8E467D0D5B70429CBB82D8ED03CBEE10" display-inline="no-display-inline"><enum>2.</enum><header>Gas stamps</header><text display-inline="no-display-inline">The Secretary of Energy shall establish a program for the equitable allocation among the States of gas stamps for distribution to individuals eligible to receive food stamps who can demonstrate a need for gasoline. The Secretary, in coordination with the Secretary of Agriculture, shall, to the extent practicable, provide for the distribution of gas stamps under this section in conjunction with the distribution of food stamps. The program established under this section shall provide for the national distribution of not to exceed $330,000,000 in each of the first 3 months after the date of enactment of this Act.</text></section> 
<section id="HCA2AABAE78DB40CBA2FD06FAE53C72F7" section-type="subsequent-section"><enum>3.</enum><header>Windfall profits tax on crude oil, natural gas, and products thereof</header> 
<subsection id="H85F8937565E049B99E014FDE00A129AC"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle E of the Internal Revenue Code of 1986 (relating to alcohol, tobacco, and certain other excise taxes) is amended by adding at the end the following new chapter:</text>

<toc-entry level="section">Sec. 5896. Imposition of tax</toc-entry></toc> 
<section id="H6DF4C996C2824C5CA15C805F26FA9526"><enum>5896.</enum><header>Imposition of tax</header> 
<subsection id="HA1B1E05635EA42CE95BEEAE9081116FE"><enum>(a)</enum><header>In general</header><text>In addition to any other tax imposed under this title, there is hereby imposed an excise tax on the sale in the United States of any crude oil, natural gas, or other taxable product a tax equal to the windfall profit on such sale.</text></subsection> 
<subsection id="H342BA60359744FC29764298300096FC5"><enum>(b)</enum><header>Definitions</header><text>For purposes of this section—</text> 
<paragraph id="H527F6A5FCB454E84A141EE0E2FDC78F"><enum>(1)</enum><header>Windfall profit</header><text>The term <term>windfall profit</term> means, with respect to any sale, so much of the profit on such sale as exceeds a 15 percent pretax rate of return.</text></paragraph> 
<paragraph id="HD1CE52FA781049D49C009CE1EFEEC350"><enum>(2)</enum><header>Taxable product</header><text>The term <term>taxable product</term> means any fuel which is a product of crude oil or natural gas.</text></paragraph> </subsection> 
<subsection id="H8FEAE574BB7243BF8238B600241DA027"><enum>(c)</enum><header>Liability for payment of tax</header><text>The taxes imposed by subsection (a) shall be paid by the seller.</text></subsection> 
<subsection id="H16AC178BE53C4D1A85BD4699A9872CD"><enum>(d)</enum><header>Termination</header><text>No tax shall be imposed under this section with respect to any sales after the date on which the Secretary certifies that $990,000,000 has been received under this section.</text></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H9CE35E3A40D94C0898647E8989AC224B"><enum>(b)</enum><header>Clerical amendment</header><text>The table of chapters for subtitle E of such Code is amended by adding at the end the following new item:</text>
