<section id="H5079A056E7644B47A7677D19BD874B79" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protection Against Gouging Activities Act</short-title></quote>. </text></section> 
<section id="H12DD3058DC7A4CA28BB3C77C17C04E9E"><enum>2.</enum><header>Prohibition on price gouging during national emergency</header> 
<subsection id="H29D047D0858C434EA1E2543E80341242"><enum>(a)</enum><header>Title 18 amendment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/41">Chapter 41</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text> 
<quoted-block style="USC" id="H39C24189030042B5AADB564CE3001E20" display-inline="no-display-inline"> 
<section id="H69828E8A734C433799346445C4EE7FE"><enum>881.</enum><header>Price gouging during national emergency</header> 
<subsection id="HFB6F5250166445C79409B2B371601130"><enum>(a)</enum><text>Whoever engages in price gouging during a period of national emergency shall be fined not more than $5,000 or imprisoned for not more than 5 years, or both.</text></subsection> 
<subsection id="HA59CCF7AE10247C083F6263FA7BB6FF"><enum>(b)</enum><text>As used in this section—</text> 
<paragraph id="HF5137B3906ED4A95A525D1CB6656A195"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>price gouging</quote> means selling or renting any product, service, dwelling, or facility at a price that grossly exceeds the average price at which the same or similar product, service, dwelling, or facility was obtainable in the same geographic area during the 30-day period immediately preceding the period of national emergency, and the increase in price is not—</text> 
<subparagraph id="H9AEEBFDC035D445BBBD932EAD7D3821D"><enum>(A)</enum><text>attributable to any reasonable attendant business risk resulting from the national emergency; or</text></subparagraph> 
<subparagraph id="H5EDEF93CA461474EA0A0AADA94E24F1"><enum>(B)</enum><text>consistent with national or international market trends; and</text></subparagraph></paragraph> 
<paragraph id="HBA64405E416F4F1EB04208B696BAA39"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>period of national emergency</quote> means the period of 90 days immediately following the declaration of an emergency or major disaster as defined in section 102 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5122">42 U.S.C. 5122</external-xref>).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE3A8F57357F3463D9CBAA364A64BEB48"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/41">chapter 41</external-xref> of title 18, United States Code, is amended by adding at the end the following:</text>
