<legis-type>AN ACT</legis-type> 
<official-title display="yes">To provide for the sale, acquisition, conveyance, and exchange of certain real property in the District of Columbia to facilitate the utilization, development, and redevelopment of such property, and for other purposes.</official-title>

<section id="H4ED0957C4E4744D7B1C4C34EE4580833" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal and District of Columbia Government Real Property Act of 2006</short-title></quote>. </text></section> 
<title id="H3C9540D9DC5B46578E949CA996E4C5CE"><enum>I</enum><header>Real property conveyances between the General Services Administration and the District of Columbia</header> 
<section id="H8968D9A8325E44F483F5F2836971E9C7"><enum>101.</enum><header>Exchange of Title Over Reservation 13 and Certain Other Properties</header> 
<subsection id="HCA4FDD0A07594B4B82ACE8B9800769C0"><enum>(a)</enum><header>Conveyance of Properties</header> 
<paragraph id="HB0C81DAC238D4BAAB0DF55F6742FB3A5"><enum>(1)</enum><header>In general</header><text>On the date on which the District of Columbia conveys to the Administrator of General Services all right, title, and interest of the District of Columbia in the property described in subsection (c), the Administrator shall convey to the District of Columbia all right, title, and interest of the United States in—</text> 
<subparagraph id="HBB2D8EE7288B403B8DA92CE0BA4B79B1"><enum>(A)</enum><text>U.S. Reservation 13, subject to the conditions described in subsection (b); and</text></subparagraph> 
<subparagraph id="H3613A565244B4182ABC61CBB01BBA420"><enum>(B)</enum><text>Old Naval Hospital.</text></subparagraph></paragraph> 
<paragraph id="HA708578EEF6F4E7581AAA514B729141"><enum>(2)</enum><header>Properties defined</header><text>In this section—</text> 
<subparagraph id="HA92AB36225B34DCC8298DDB01F3EB9FC"><enum>(A)</enum><text display-inline="yes-display-inline">the term <term>U.S. Reservation 13</term> means that parcel of land in the District of Columbia consisting of the approximately 66 acres which is bounded on the north by Independence Avenue Southeast, on the west by 19th Street Southeast, on the south by G Street Southeast, and on the east by United States Reservation 343, and being the same land described in the Federal transfer letter of October 25, 2002, from the United States to the District of Columbia, and subject to existing matters of record; and</text></subparagraph> 
<subparagraph id="HCF09C79B6AAC4A6D84DD56A3F0DBFBB"><enum>(B)</enum><text>the term <term>Old Naval Hospital</term> means the property in the District of Columbia consisting of Square 948 in its entirety, together with all the improvements thereon.</text></subparagraph></paragraph></subsection> 
<subsection id="H599DA101551C4800BC7D8FF45544AF69"><enum>(b)</enum><header>Conditions For Conveyance of Reservation 13</header><text>As a condition for the conveyance of U.S. Reservation 13 to the District of Columbia under this section, the District of Columbia shall agree—</text> 
<paragraph id="H3C90B6A4B0B64A49B5DD272B8DD243B6"><enum>(1)</enum><text display-inline="yes-display-inline">to set aside a portion of the property for the extension of Massachusetts Avenue Southeast and the placement of a potential commemorative work to be established pursuant to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/89">chapter 89</external-xref> of title 40, United States Code, at the terminus of Massachusetts Avenue Southeast (as so extended) at the Anacostia River;</text></paragraph> 
<paragraph id="H7D654F83E01C45F2940077C64D85F82"><enum>(2)</enum><text>to convey all right, title, and interest of the District of Columbia in the portion set aside under paragraph (1) to the Secretary of the Interior (acting through the Director of the National Park Service) at such time as the Secretary may require, if a commemorative work is established in the manner described in paragraph (1);</text></paragraph> 
<paragraph id="H10DB46D5EF244357849BA037ECC5F447"><enum>(3)</enum><text display-inline="yes-display-inline">to permit the Court Services and Offender Supervision Agency for the District of Columbia to continue to occupy a portion of the property consistent with the requirements of the District of Columbia Appropriations Act, 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/96">Public Law 107–96</external-xref>; 115 Stat. 931); and</text></paragraph> 
<paragraph id="HCBEC8FC7A0F94028934229DBE77283CC"><enum>(4)</enum><text display-inline="yes-display-inline">to develop the property consistent with the Anacostia Waterfront Corporation's Master Plan for Reservation 13 (also known as the Hill East Waterfront).</text></paragraph></subsection> 
<subsection id="H310C6475D9B54571A3434CA83FF74605"><enum>(c)</enum><header>District of Columbia Property to be Conveyed to the Administrator</header><text>The property described in this subsection is the real property consisting of Building Nos. 16, 37, 38, 118, and 118–A and related improvements, together with the real property underlying those buildings and improvements, on the West Campus of Saint Elizabeths Hospital, as described in the quitclaim deed of September 30, 1987, by and between the United States and the District of Columbia and recorded in the Office of the Recorder of Deeds of the District of Columbia on October 7, 1987.</text></subsection></section> 
<section id="H2B6FD0DB73244942B738D4AB01C7AFB9"><enum>102.</enum><header>Termination of claims</header> 
<subsection id="H99C406D9D10E4B13A605AA578152A127"><enum>(a)</enum><header>In General</header><text>Notwithstanding any other provision of law, the United States is not required to perform, or to reimburse the District of Columbia for the cost of performing, any of the following services:</text> 
<paragraph id="H14FC84707D3145AC861908CB419E37E9"><enum>(1)</enum><text>Repairs or renovations pursuant to section 4(f) of the Saint Elizabeths Hospital and District of Columbia Mental Health Services Act (<external-xref legal-doc="usc" parsable-cite="usc/24/225b">24 U.S.C. 225b(f)</external-xref>; sec. 44–903(f), D.C. Official Code).</text></paragraph> 
<paragraph id="H790866494CA1462DB356620639CAB0B7"><enum>(2)</enum><text>Preservation, maintenance, or repairs pursuant to a use permit executed on September 30, 1987, under which the United States (acting through the Secretary of Health and Human Services) granted permission to the District of Columbia to use and occupy portions of the Saint Elizabeths Hospital property known as the <quote>West Campus</quote>.</text></paragraph> 
<paragraph id="HFD846958E3244B4D88BE57DD81F56EC4"><enum>(3)</enum><text>Mental health diagnostic and treatment services for referrals as described in section 9(b) of the Saint Elizabeths Hospital and District of Columbia Mental Health Services Act (<external-xref legal-doc="usc" parsable-cite="usc/24/225g">24 U.S.C. 225g(b)</external-xref>; sec. 44–908(b), D.C. Official Code), but only with respect to services provided on or before the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="HDEAE4FAC7E38444ABCA882D21EBA573D"><enum>(b)</enum><header>Effect on Pending Claims</header><text display-inline="yes-display-inline">Any claim of the District of Columbia against the United States for the failure to perform, or to reimburse the District of Columbia for the cost of performing, any service described in subsection (a) which is pending as of the date of the enactment of this Act shall be extinguished and terminated.</text></subsection></section></title> 
<title id="H1F7A8177EAFC4DB0825C80A6D3E0DA87"><enum>II</enum><header>Streamlining management of properties located in the District of Columbia</header> 
<section id="HF1969A7ACF7B409ABDD79573F689F13"><enum>201.</enum><header>Transfer of Administrative Jurisdiction Over Certain Properties</header> 
<subsection id="HB2BFBA74E5E141E5B623C5D00000613E"><enum>(a)</enum><header>Transfer of Administrative Jurisdiction From District of Columbia to United States</header> 
<paragraph id="H9F2802E1CE86422DBAC4C5B743F6D1CB"><enum>(1)</enum><header>In general</header><text>Administrative jurisdiction over each of the following properties (owned by the United States and as depicted on the Map) is hereby transferred, subject to the terms in this subsection, from the District of Columbia to the Secretary of the Interior for administration by the Director:</text> 
<subparagraph id="H8D8F2926B4E54B31A3606CC2C325D399"><enum>(A)</enum><text>An unimproved portion of Audubon Terrace Northwest, located east of Linnean Avenue Northwest, that is within U.S. Reservation 402 (National Park Service property).</text></subparagraph> 
<subparagraph id="H1EDDCE18B57B4965BD18000068613F03"><enum>(B)</enum><text>An unimproved portion of Barnaby Street Northwest, north of Aberfoyle Place Northwest, that abuts U.S. Reservation 545 (National Park Service property).</text></subparagraph> 
<subparagraph id="HD53F0967554346A4AA49AFCD1C1F3CF6"><enum>(C)</enum><text>A portion of Canal Street Southwest, and a portion of V Street Southwest, each of which abuts U.S. Reservation 467 (National Park Service property).</text></subparagraph> 
<subparagraph id="H3939C0CFD9F34B91AB707BFCD04CE660"><enum>(D)</enum><text>Unimproved streets and alleys at Fort Circle Park located within the boundaries of U.S. Reservation 497 (National Park Service property).</text></subparagraph> 
<subparagraph id="HBEB18F3060E8496BA32E00DA3B91A496"><enum>(E)</enum><text>An unimproved portion of Western Avenue Northwest, north of Oregon Avenue Northwest, that abuts U.S. Reservation 339 (National Park Service property).</text></subparagraph> 
<subparagraph id="H60F3066BB8F2402B0007BDE3D048439"><enum>(F)</enum><text>An unimproved portion of 17th Street Northwest, south of Shepherd Street Northwest, that abuts U.S. Reservation 339 (National Park Service property).</text></subparagraph> 
<subparagraph id="H0F28E98D2D1943BBAC2543D2B58562EC"><enum>(G)</enum><text>An unimproved portion of 30th Street Northwest, north of Broad Branch Road Northwest, that is within the boundaries of U.S. Reservation 515 (National Park Service property).</text></subparagraph> 
<subparagraph id="H8B13374780FA4D4CBBF143ABF6DB161F"><enum>(H)</enum><text>Subject to paragraph (2), lands over I–395 bounded by Washington Avenue Southwest, 2nd Street Southwest, and the C Street Southwest ramps to I–295.</text></subparagraph> 
<subparagraph id="H66479BED68A5486287B52240EBB01C8E"><enum>(I)</enum><text>A portion of U.S. Reservation 357 at Whitehaven Parkway Northwest, previously transferred to the District of Columbia in conjunction with the former proposal for a residence for the Mayor of the District of Columbia.</text></subparagraph></paragraph> 
<paragraph id="H9090F97454F844E5B797D100F7AE922D"><enum>(2)</enum><header>Use of certain property for memorial</header><text display-inline="yes-display-inline">In the case of the property for which administrative jurisdiction is transferred under paragraph (1)(H), the property shall be used as the site for the establishment of a memorial to honor disabled veterans of the United States Armed Forces authorized to be established by the Disabled Veterans’ LIFE Memorial Foundation by <external-xref legal-doc="public-law" parsable-cite="pl/106/348">Public Law 106–348</external-xref> (114 Stat. 1358; <external-xref legal-doc="usc" parsable-cite="usc/40/8903">40 U.S.C. 8903</external-xref> note), except that—</text> 
<subparagraph id="HEF4884FFD99348D1BAE4823D7E479514"><enum>(A)</enum><text>the District of Columbia shall retain administrative jurisdiction over the subsurface area beneath the site for the tunnel, walls, footings, and related facilities;</text></subparagraph> 
<subparagraph id="H92EE0F755C834661A1E3E83A9B73421"><enum>(B)</enum><text>C Street Southwest shall not be connected between 2nd Street Southwest and Washington Avenue Southwest without the approval of the Architect of the Capitol; and</text></subparagraph> 
<subparagraph id="H1E6B24C676F54FE1A800D65C573706B7"><enum>(C)</enum><text>a walkway shall be included across the site of the memorial between 2nd Street Southwest and Washington Avenue Southwest.</text></subparagraph></paragraph> 
<paragraph id="H29949FDBC4934AAE907264BBE4743900"><enum>(3)</enum><header>Additional transfer</header> 
<subparagraph id="H7D7FFE13F11D42D7AA8B22150981C883"><enum>(A)</enum><header>In general</header><text>Administrative jurisdiction over the parcel bounded by 2nd Street Southwest, the C Street Southwest ramp to I–295, the D Street Southwest ramp to I–395, and I–295 is hereby transferred, subject to the terms in this paragraph, from the District of Columbia as follows:</text> 
<clause id="H1F9CBD363D2644FFBDE372B65700893B"><enum>(i)</enum><text>The northernmost .249 acres is transferred to the Secretary for administration by the Director, who (subject to the approval of the Architect of the Capitol) shall landscape the parcel or use the parcel for special needs parking for the memorial referred to in paragraph (2).</text></clause> 
<clause id="HE3ED3E0F29844E109D89BBB102AF5530"><enum>(ii)</enum><text display-inline="yes-display-inline">The remaining portion is transferred to the Architect of the Capitol.</text></clause></subparagraph> 
<subparagraph id="H384B5B5CFA684DD9BA81EB23514DC05"><enum>(B)</enum><header>Retention of jurisdiction over subsurface area</header><text display-inline="yes-display-inline">The District of Columbia shall retain administrative jurisdiction over the subsurface area beneath the parcel referred to in subparagraph (A) for the tunnel, walls, footings, and related facilities.</text></subparagraph></paragraph></subsection> 
<subsection id="H7EECEB58507245ADA6B3D163F42EB133"><enum>(b)</enum><header>Transfer of Administrative Jurisdiction From United States to District of Columbia</header><text>Administrative jurisdiction over the following property owned by the United States and depicted on the Map is hereby transferred from the Secretary to the District of Columbia for administration by the District of Columbia:</text> 
<paragraph id="H3677D20B52DB4E8EABF2506D44AFCBF"><enum>(1)</enum><text>A portion of U.S. Reservation 451.</text></paragraph> 
<paragraph id="H95B700A338684E48A2C2E637BA7E327E"><enum>(2)</enum><text>A portion of U.S. Reservation 404.</text></paragraph> 
<paragraph id="HE233C4936E464FB7A3AE54CEA8DD5DC6"><enum>(3)</enum><text>U.S. Reservations 44, 45, 46, 47, 48, and 49.</text></paragraph> 
<paragraph id="H173A97D1D3BC4D22872278063DB850EA"><enum>(4)</enum><text>U.S. Reservation 251.</text></paragraph> 
<paragraph id="HD9F37A6A4F134EABB2009C995CF09EA1"><enum>(5)</enum><text>U.S. Reservation 8.</text></paragraph>

<subsection id="H8AE366739FDE471CA5ED9BC8CF02FC89"><enum>(c)</enum><header>Effective Date</header><text>The transfers of administrative jurisdiction under this section shall take effect on the date of the enactment of this Act.</text></subsection></section> 
<section id="HB8D02FED402C48C7B4622DE945203B70"><enum>202.</enum><header>Exchange of Title Over Certain Properties</header> 
<subsection id="H3A9F993B9B604E82BAB56342A78E818C"><enum>(a)</enum><header>Conveyance of Title</header> 
<paragraph id="HD22B951B89934C85BE33D168CA6F59"><enum>(1)</enum><header>In general</header><text>On the date on which the District of Columbia conveys to the Secretary all right, title, and interest of the District of Columbia in each of the properties described in subsection (b) for use as described in such subsection, the Secretary shall convey to the District of Columbia all right, title, and interest of the United States in each of the properties described in subsection (c).</text></paragraph> 
<paragraph id="HE12A94012DF04FEC80E6B9BA11015BE5"><enum>(2)</enum><header>Administration by National Park Service</header><text>The properties conveyed by the District of Columbia to the Secretary under this section shall be administered by the Director upon conveyance.</text></paragraph></subsection> 
<subsection id="H60D0F094CF5E40008BA49D69C6038600"><enum>(b)</enum><header>Properties to be Conveyed to the Secretary; Use</header><text>The properties described in this subsection and their uses are as follows (as depicted on the Map):</text> 
<paragraph id="H06024DE779C24A1CA201CA63C5DA16F2"><enum>(1)</enum><text>Lovers Lane Northwest, abutting U.S. Reservation 324, for the closure of a one-block long roadway adjacent to Montrose Park.</text></paragraph> 
<paragraph id="H1A801D2DA8B44163B049189209D49CDA"><enum>(2)</enum><text>Needwood, Niagara, and Pitt Streets Northwest, within the Chesapeake and Ohio Canal National Historical Park, for the closing of the rights-of-way now occupied by the Chesapeake and Ohio Canal.</text></paragraph></subsection> 
<subsection id="HE14A754FD3DD4EA696656BBAF2D130B0"><enum>(c)</enum><header>Properties to be Conveyed to the District of Columbia</header><text>The properties described in this subsection are as follows (as depicted on the Map):</text>

<paragraph id="HB2CCAEB3D5944388AEE4B9D707605174"><enum>(3)</enum><text>U.S. Reservations 243, 244, 245, 247, and 248.</text></paragraph> 
<paragraph id="HCA2C61E772F64A0C89764E068CA3C76F"><enum>(4)</enum><text>U.S. Reservations 128, 129, 130, 298, and 299.</text></paragraph>

<section id="H401E0C54B7EB4902A6FD400059BBDCD7"><enum>203.</enum><header>Conveyance of United States Reservation 174</header> 
<subsection id="HB5C6156C88DB4258A5E130C100B4BDCF"><enum>(a)</enum><header>Conveyance; Use</header><text>If the District of Columbia enacts a final plan for the development of the former Convention Center Site which meets the requirements of subsection (b)—</text> 
<paragraph id="H24CC58C4CEF144EBB1FCB7232ECFE674"><enum>(1)</enum><text>the Secretary shall convey all right, title, and interest of the United States in U.S. Reservation 174 (as depicted on the Map) to the District of Columbia upon the enactment of such plan; and</text></paragraph> 
<paragraph id="H4F1636E69CA2444D9BAF019018BC9C75"><enum>(2)</enum><text>the District shall use the property so conveyed in accordance with such plan.</text></paragraph></subsection> 
<subsection id="H789B225E7A724F3B967DD475004BCC00"><enum>(b)</enum><header>Requirements For Development Plan</header><text>The plan for the development of the former Convention Center Site meets the requirements of this subsection if—</text> 
<paragraph id="HB86B142E63FA4BB493E5FA0099001409"><enum>(1)</enum><text>the plan is developed through a public process;</text></paragraph> 
<paragraph id="HE4E15827BF294266881CA045604082CA"><enum>(2)</enum><text>during the process for the development of the plan, the District of Columbia considers at least one version of the plan under which U.S. Reservation 174 is set aside as public open space as of the date of the enactment of this Act and shall continue to be set aside as public open space (including a version under which facilities are built under the surface of such portion); and</text></paragraph> 
<paragraph id="H4FB3D77F562E4F29A13E3F227E00F977"><enum>(3)</enum><text>not less than 1<fraction>1/4</fraction> acres of the former Convention Center Site are set aside for public open space under the plan.</text></paragraph></subsection> 
<subsection id="H63DEBB06888245658137A7FA2B50036D"><enum>(c)</enum><header>Former Convention Center Site Defined</header><text>In this section, the <quote>former Convention Center Site</quote> means the parcel of land in the District of Columbia which is bounded on the east by 9th Street Northwest, on the north by New York Avenue Northwest, on the west by 11th Street Northwest, and on the south by H Street Northwest. </text></subsection></section> 
<section id="H7D3FF97CDF274FB68201F9C859707340" display-inline="no-display-inline" section-type="subsequent-section"><enum>204.</enum><header>Conveyance to Architect of the Capitol</header> 
<subsection id="HD53F7C1D28EC4E0381D4009F07327353"><enum>(a)</enum><header>In general</header><text>Prior to conveyance of title to U.S. Reservation 13 to the District of Columbia under this Act, the District of Columbia shall convey, with the approval of the Architect of the Capitol and subject to subsections (b) and (c), not more than 12 acres of real property to the Architect of the Capitol.</text></subsection> 
<subsection id="H1B20FF1247E44149B16B55FAA25044C2"><enum>(b)</enum><header>Title held by Secretary</header><text>If title to the real property identified for conveyance under subsection (a) is held by the Secretary, not later than 30 days after being notified by the Architect of the Capitol that property has been so identified, the Secretary shall agree or disagree to conveying the interest in such property to the Architect of the Capitol.</text></subsection> 
<subsection id="HED1C9C17944841B1B1403169F5761F67"><enum>(c)</enum><header>Review</header><text>If the Secretary agrees to the conveyance under subsection (b), or if title to the property is held by the District of Columbia, the real property shall be conveyed after a 30-day review period beginning on the date on which notice of the conveyance is received by the Committee on Homeland Security and Governmental Affairs and the Committee on Rules of the Senate and the Committee on Government Reform and the Committee on Transportation and Infrastructure of the House of Representatives.</text></subsection>
<subsection id="HF9DC0B295780456583D35E5918AAEE73"><enum>(d)</enum><header><?xm-replace_text ?>Study</header><text display-inline="yes-display-inline">The Architect of the Capitol shall not construct a mail screening facility on any real property conveyed under this section unless each of the following conditions is satisfied:</text>
<paragraph id="HE00D56298B7944A1AA5EABB7579CDE8"><enum>(1)</enum><text>A study is completed that analyzes—</text>
<subparagraph id="H88FF2BBCFE6A43FAA48EDA0094202C3B"><enum>(A)</enum><text>whether one or more other underutilized, surplus, or excess Federal facilities exist in which such a mail screening facility could be more economically located; and</text></subparagraph>
<subparagraph id="H5584E9300DFB488892F8005BB65B1566"><enum>(B)</enum><text>whether it would be more efficient and economical for the House of Representatives and Senate to share one mail screening facility.</text></subparagraph></paragraph>
<paragraph id="H1A6DD9CF3A1E41328BB719C91E15DB46"><enum>(2)</enum><text>The study is submitted to the relevant committees of Congress.</text></paragraph>
<paragraph id="H9A96CD7714CC45F2B8B4A2AD9747A769"><enum>(3)</enum><text>No fewer than 30 days have lapsed since the date of the submission under paragraph (2).</text></paragraph></subsection> </section></title> 
<title id="H17253A972A4F4D3885D134754F4DA094"><enum>III</enum><header>Poplar Point</header> 
<section id="H6EA1732B84524D44A85BE6F478BEC681"><enum>301.</enum><header>Conveyance of Poplar Point to District of Columbia</header> 
<subsection id="H38F82589C6EC4F5AB5DCB6F756FC0FC"><enum>(a)</enum><header>Conveyance</header><text>Upon certification by the Secretary of the Interior (acting through the Director) that the District of Columbia has adopted a land-use plan for Poplar Point which meets the requirements of section 302, the Director shall convey to the District of Columbia all right, title, and interest of the United States in Poplar Point, in accordance with this title.</text></subsection> 
<subsection id="H3341474570724E9FB79D5C00C074D982"><enum>(b)</enum><header>Withholding of Existing Facilities and Properties of National Park Service From Initial Conveyance</header><text>The Director shall withhold from the conveyance made under subsection (a) the facilities and related property (including necessary easements and utilities related thereto) which are occupied or otherwise used by the National Park Service until such terms for conveyance are met under section 303.</text></subsection> 
<subsection id="HB2E1448679DF4FFD9C50562F8D726619"><enum>(c)</enum><header>Deed Restriction For Park Purposes</header><text display-inline="yes-display-inline">The deed for the conveyance of Poplar Point provided for in subsection (a) shall include a restriction requiring that 70 acres be maintained for park purposes in perpetuity, as identified in the land use plan required under section 302. Any person (including an individual or public entity) shall have standing to enforce the restriction. </text></subsection></section> 
<section id="HEBBAC531481F4B72B236E5FB147542F"><enum>302.</enum><header>Requirements For Poplar Point Land-Use Plan</header> 
<subsection id="H0E143EEA05D94177B3E956158086CFDF"><enum>(a)</enum><header>In General</header><text>The land-use plan for Poplar Point meets the requirements of this section if the plan includes each of the following elements:</text> 
<paragraph id="H6CCAA6C4FCE9426AAD619BBB5B00AC08"><enum>(1)</enum><text>The plan provides for the reservation of a portion of Poplar Point for park purposes, in accordance with subsection (b).</text></paragraph> 
<paragraph id="HC6F83791D5D74160B371A9D7AA5896D0"><enum>(2)</enum><text>The plan provides for the identification of existing facilities and related properties of the National Park Service, and the relocation of the National Park Service to replacement facilities and related properties, in accordance with subsection (c).</text></paragraph> 
<paragraph id="HFFFD3E7F705B489AB993D89100A91E10"><enum>(3)</enum><text>Under the plan, at least two sites within the areas designated for park purposes are set aside for the placement of potential commemorative works to be established pursuant to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/40/89">chapter 89</external-xref> of title 40, United States Code, and the plan includes a commitment by the District of Columbia to convey back those sites to the National Park Service at the appropriate time, as determined by the Secretary.</text></paragraph> 
<paragraph id="H2A56314785F34BE990C93904F5CCAEA8"><enum>(4)</enum><text display-inline="yes-display-inline">To the greatest extent practicable, the plan is consistent with the Anacostia Waterfront Framework Plan referred to in section 103 of the Anacostia Waterfront Corporation Act of 2004 (sec. 2–1223.03, D.C. Official Code).</text></paragraph></subsection> 
<subsection id="H80C32E75963C429AA877B09BBF20F1CA"><enum>(b)</enum><header>Reservation of Areas For Park Purposes</header><text>The plan shall identify a portion of Poplar Point consisting of not fewer than 70 acres (including wetlands) which shall be reserved for park purposes and shall require such portion to be reserved for such purposes in perpetuity.</text></subsection> 
<subsection id="H42BE9DCCDE1244F4B1D51BD446824A9"><enum>(c)</enum><header>Identification of Existing and Replacement Facilities and Properties For National Park Service</header> 
<paragraph id="HE6AC8481C9C94BB2918255704636C6CE"><enum>(1)</enum><header>Identification of existing facilities</header><text display-inline="yes-display-inline">The plan shall identify the facilities and related property (including necessary easements and utilities related thereto) which are occupied or otherwise used by the National Park Service in Poplar Point prior to the adoption of the plan.</text></paragraph> 
<paragraph id="HB50B0A006DA04C088CA911E4ED8875D"><enum>(2)</enum><header>Relocation to replacement facilities</header> 
<subparagraph id="H815A5DA5DBE9447E88983F4654DCB6FA"><enum>(A)</enum><header>In general</header><text>To the extent that the District of Columbia and the Director determine jointly that it is no longer appropriate for the National Park Service to occupy or otherwise use any of the facilities and related property identified under paragraph (1), the plan shall—</text> 
<clause id="HCB68482D482842D7B82F94A50270562D"><enum>(i)</enum><text display-inline="yes-display-inline">identify other suitable facilities and related property (including necessary easements and utilities related thereto) in the District of Columbia to which the National Park Service may be relocated;</text></clause> 
<clause id="H3149DE69DFC14008B375FCFA8300D99E"><enum>(ii)</enum><text>provide that the District of Columbia shall take such actions as may be required to carry out the relocation, including preparing the new facilities and properties and providing for the transfer of such fixtures and equipment as the Director may require; and</text></clause> 
<clause id="HE7399856025B47BEA51E37A45BC7B5A0"><enum>(iii)</enum><text>set forth a timetable for the relocation of the National Park Service to the new facilities.</text></clause></subparagraph> 
<subparagraph id="H4E81AD93CA234C29B8CF556036D79590"><enum>(B)</enum><header>Restriction on use of property reserved for park purposes</header><text>The plan may not identify any facility or property for purposes of this paragraph which is located on any portion of Poplar Point which is reserved for park purposes in accordance with subsection (b).</text></subparagraph></paragraph> 
<paragraph id="H78379A7FEBAB4726A3BF71E4EFCF50F"><enum>(3)</enum><header>Consultation required</header><text>In developing each of the elements of the plan which are required under this subsection, the District of Columbia shall consult with the Director.</text></paragraph></subsection></section> 
<section id="H8B4EBB5FC7494855B029EB94A926614C"><enum>303.</enum><header>Conveyance of Replacement Facilities and Properties For National Park Service</header> 
<subsection id="H0F7D35F63E1E45C9A8B42986DC21737E"><enum>(a)</enum><header>Conveyance of Facilities and Related Properties</header><text>Upon certification by the Director that the facilities and related property to which the National Park Service is to be relocated under the land-use plan under this title (in accordance with section 302(c)) are ready to be occupied or used by the National Park Service—</text> 
<paragraph id="HB34F7CE7B1C34399ABEDD15010C287FC"><enum>(1)</enum><text>the District of Columbia shall convey to the Director all right, title, and interest at no cost in the facilities and related property (including necessary easements and utilities related thereto) to which the National Park Service is to be relocated (without regard to whether such facilities are located in Poplar Point); and</text></paragraph> 
<paragraph id="H490606D4E8E04A1DAF29E84D07DB2EBE"><enum>(2)</enum><text>the Director shall convey to the District of Columbia all right, title, and interest in the facilities and related property which were withheld from the conveyance of Poplar Point under section 301(b) and from which the National Park Service is to be relocated.</text></paragraph></subsection> 
<subsection id="H9B6D2AB553D4496F003B8BBEA4454292"><enum>(b)</enum><header>Restriction on Construction Projects Pending Certification of Facilities</header> 
<paragraph id="H896A991A82AB4AFA8867B94823CD0037"><enum>(1)</enum><header>In general</header><text>The District of Columbia may not initiate any construction project with respect to Poplar Point until the Director makes the certification referred to in subsection (a).</text></paragraph> 
<paragraph id="H0BF7B1AB1EC74C17AA9001FA41549D2E"><enum>(2)</enum><header>Exception for projects required to prepare facilities for occupation by national park service</header><text display-inline="yes-display-inline">Paragraph (1) shall not apply with respect to any construction project required to ensure that the facilities and related property to which the National Park Service is to be relocated under the land-use plan under this title (in accordance with section 302(c)) are ready to be occupied by the National Park Service.</text></paragraph></subsection></section> 
<section id="HEC0B040FCDB246D098EE4001C8D4631"><enum>304.</enum><header>Poplar Point Defined</header><text display-inline="no-display-inline">In this title, <quote>Poplar Point</quote> means the parcel of land in the District of Columbia which is owned by the United States and which is under the administrative jurisdiction of the District of Columbia or the Director on the day before the date of enactment of this Act, and which is bounded on the north by the Anacostia River, on the northeast by and inclusive of the southeast approaches to the 11th Street bridges, on the southeast by and inclusive of Route 295, and on the northwest by and inclusive of the Frederick Douglass Memorial Bridge approaches to Suitland Parkway, as depicted on the Map.</text></section></title> 
<title id="H4846E940E65A4552A3AC1F12F9B9D9D3"><enum>IV</enum><header>General Provisions</header> 
<section id="H6C76A0A26DB14C83A764DF0019A9D860"><enum>401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions apply:</text> 
<paragraph id="H81B15F6AAB82402EA12DF45EFB72FAAE"><enum>(1)</enum><text>The term <term>Administrator</term> means the Administrator of General Services.</text></paragraph> 
<paragraph id="HDF92B1FF1AED45F4ACBF0659FA469DD"><enum>(2)</enum><text>The term <term>Director</term> means the Director of the National Park Service. </text></paragraph> 
<paragraph id="H0FB2A35CF2064AEE9C4BB1F8B09DC241"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>Map</term> means the map entitled <quote>Transfer and Conveyance of Properties in the District of Columbia</quote>, numbered 869/80460, and dated July 2005, which shall be kept on file in the appropriate office of the National Park Service.</text></paragraph> 
<paragraph id="HC2A77CEC7329440D84F4556E004849E3"><enum>(4)</enum><text>The term <term>park purposes</term> includes landscaped areas, pedestrian walkways, bicycle trails, seating, opensided shelters, natural areas, recreational use areas, and memorial sites reserved for public use. </text></paragraph> 
<paragraph id="H74F56DCB77E64ADD91FDD665C239CA5"><enum>(5)</enum><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph></section> 
<section id="H6D3E721A50274853BD7FA6366F475B78"><enum>402.</enum><header>Limitation on Costs</header><text display-inline="no-display-inline">The United States shall not be responsible for paying any costs and expenses, other than costs and expenses related to or associated with environmental liabilities or cleanup actions provided under law, which are incurred by the District of Columbia or any other parties at any time in connection with effecting the provisions of this Act or any amendment made by this Act.</text></section> 
<section id="H76E08542BFE946158334B000DDBF00F4"><enum>403.</enum><header>Authorization of Parties to Enter Into Contracts</header><text display-inline="no-display-inline">An officer or employee of the United States or the District of Columbia may contract for payment of costs or expenses related to any properties which are conveyed or for which administrative jurisdiction is transferred under this Act or any amendment made by this Act.</text></section> 
<section id="HD4B5D3E877AA47F689A5B72BCDBF98D4"><enum>404.</enum><header>No Effect on Compliance With Environmental Laws</header><text display-inline="no-display-inline">Nothing in this Act or any amendment made by this Act may be construed to affect or limit the application of or obligation to comply with any environmental law, including section 120(h) of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9620">42 U.S.C. 9620(h)</external-xref>).</text></section> 
<section id="HC8A56B99EBC948ECA402D8F7ABC3B974"><enum>405.</enum><header>Congressional reports</header> 
<subsection id="HDECDB88413E548419EB1EBA4D1EA8CE"><enum>(a)</enum><header>District of Columbia</header><text display-inline="yes-display-inline">Not later than January 31 of each year, the Mayor of the District of Columbia shall report to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Government Reform, the Committee on Energy and Commerce, the Committee on Resources, and the Committee on Transportation and Infrastructure of the House of Representatives on the use and development during the previous year of land for which title is conveyed to the District of Columbia and land for which administrative jurisdiction is transferred to the District of Columbia pursuant to this Act.</text></subsection> 
<subsection id="HD37C3E1A204C4590AC7B85DEC900216F"><enum>(b)</enum><header>Comptroller General</header><text display-inline="yes-display-inline">The Comptroller General shall report periodically to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Government Reform, the Committee on Energy and Commerce, the Committee on Resources, and the Committee on Transportation and Infrastructure of the House of Representatives on—</text> 
<paragraph id="HB72DF8120115456083AAB4D1C4E524BF"><enum>(1)</enum><text display-inline="yes-display-inline">the use and development during the previous 2 years of land for which title is conveyed and land for which administrative jurisdiction is transferred pursuant to this Act; and</text></paragraph> 
<paragraph id="H9699E153364445CF96F7D2279E130512"><enum>(2)</enum><text display-inline="yes-display-inline">if applicable, how such use and development complies with the Anacostia Waterfront Framework Plan referred to in section 103 of the Anacostia Waterfront Corporation Act of 2004 (sec. 2–1223.03, D.C. Official Code).</text></paragraph></subsection> 
<subsection id="H5171D7201D144DC58DA699F225C400F8"><enum>(c)</enum><header>Sunset</header><text display-inline="yes-display-inline">This section shall expire 10 years after the date of enactment of this Act.</text></subsection></section> 
<section id="H456D25CD8E4B4CB4B6E007321F2946CD"><enum>406.</enum><header>Treatment as Properties Transferred to Architect of the Capitol as Part of Capitol Buildings and Grounds</header><text display-inline="no-display-inline">Upon transfer to the Architect of the Capitol of title to, or administrative jurisdiction over, any property pursuant to this Act, the property shall be a part of the United States Capitol Grounds and shall be subject to sections 9, 9A, 9B, 9C, 14, and 16(b) of the Act entitled <quote>An Act to define the area of the United States Capitol Grounds, to regulate the use thereof, and for other purposes</quote> (relating to the policing of the United States Capitol Grounds) and sections 5101 to 5107 and 5109 of title 40, United States Code (relating to prohibited acts within the United States Capitol Grounds).</text> </section> 
<section id="H395A7D5C0B324D05B180139FBB651DEC"><enum>407.</enum><header>Deadline For Provision of Deeds and Related Documents</header><text display-inline="no-display-inline">With respect to each property conveyed under this Act or any amendment made by this Act, the Mayor of the District of Columbia, the Administrator, or the Secretary (as the case may be) shall execute and deliver a quitclaim deed or prepare and record a transfer plat, as appropriate, not later than 6 months after the property is conveyed.</text></section> 
<section id="H1AA80A7DF7AB4786A30045A1AC39CA6B"><enum>408.</enum><header>OMB report</header> 
<subsection id="H87752F22A820492BB08BF8C9D140065"><enum>(a)</enum><header>OMB report on surplus and excess property</header><text display-inline="yes-display-inline">Not later than 6 months after the date of enactment of this Act, the Director of the Office of Management and Budget shall submit a report on surplus and excess government property to Congress including—</text> 
<paragraph id="H565A620EB07E41A6BDF65B9230115EB"><enum>(1)</enum><text display-inline="yes-display-inline">the total value and amount of surplus and excess government property, provided in the aggregate, as well as totaled by agency; and</text> </paragraph> 
<paragraph id="H108588AC95A4405594C74B00D71227C5"><enum>(2)</enum><text>a list of the 100 most eligible surplus government properties for sale and how much they are worth.</text> </paragraph></subsection> 
<subsection id="H0D73E58FC93C4671B7EFED3F4B20F304"><enum>(b)</enum><header>Data sharing among federal agencies</header><text>Not later than 6 months after the date of enactment of this Act, the Director of the Office of Management and Budget shall—</text> 
<paragraph id="HAE662A4F34BF48E0BF307BDA129C4D22"><enum>(1)</enum><text>develop and implement procedures requiring Federal agencies to share data on surplus and excess Federal real property under the jurisdiction of each agency; and</text> </paragraph> 
<paragraph id="HA9D947C40D904F22AFA3E2B78F001499"><enum>(2)</enum><text>report to Congress on the development and implementation of such procedures.</text> </paragraph></subsection></section></title>
