<official-title>To provide relief to students, schools, and student borrowers affected by natural disaster.</official-title>

<section id="H0438638563C845F8AFB9EFB1BDCA9179" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Katrina College Student Relief Act</short-title></quote>.</text></section> 
<section id="HB8A804C331524345B7ADE7EC4D3FE767" section-type="subsequent-section"><enum>2.</enum><header>Waivers of student grant repayment by students affected by disasters</header><text display-inline="no-display-inline">Section 484B(b)(2) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1091b">20 U.S.C. 1091b(b)(2)</external-xref>) is amended by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" id="HAAEFE728930040B1A35D4DE7D9C9ACB0" display-inline="no-display-inline"> 
<subparagraph id="HC57E71E698054563AE7D1BA2D73DFE35"><enum>(D)</enum><header>Waivers of student grant repayment by students affected by disasters</header><text display-inline="yes-display-inline">The Secretary may waive the amounts that students are required to return under this section with respect to grant assistance under this title if the withdrawals on which the returns are based are withdrawals by students—</text> 
<clause id="H13D8429D6DEF46878F4C23A3DA6DE4CC"><enum>(i)</enum><text>who were residing in, employed in, or attending an institution of higher education that is located in, or were dependent students whose parent or parents were residing or employed in, an area in which the President has declared that a major disaster exists, in accordance with section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>);</text></clause> 
<clause id="H6714F061B01A423DA66CB8B9C8B1E3A4"><enum>(ii)</enum><text display-inline="yes-display-inline">whose attendance was interrupted because of the impact of the disaster on the student or the institution; and</text></clause> 
<clause id="HEE3E3B192DA146C092FD5089236DBD"><enum>(iii)</enum><text display-inline="yes-display-inline">whose withdrawal ended within the academic year during which the designation occurred or during the next succeeding academic year.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H3E955C423B94464D8963970673C3C800"><enum>3.</enum><header>Student loan deferment</header> 
<subsection id="HF728F71A211E4F2483FDEFC1EB758200"><enum>(a)</enum><header>Guaranteed Loans</header><text>Section 428(b)(1)(M) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1078">20 U.S.C. 1078(b)(1)(M)</external-xref>) is amended—</text> 
<paragraph id="H227DFF760B3549DFA4FD4B00E1403FE4"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of clause (ii);</text></paragraph> 
<paragraph id="HFA777E6191914F9C930864A929CF7B85"><enum>(2)</enum><text>by inserting <quote>or</quote> after the semicolon at the end of clause (iii); and</text></paragraph> 
<paragraph id="H803B4FAC73014724A0E3E7E368CF5138"><enum>(3)</enum><text>by adding after clause (iii) the following new clause:</text> 
<quoted-block style="OLC" id="H6BF5FE37B49242E8B6DF73000643A3F9" display-inline="no-display-inline"> 
<clause id="H98C171A9B3FD4F8B9E70543FF6FF28E2"><enum>(iv)</enum><text display-inline="yes-display-inline">not in excess of 6 months in the case of a borrower—</text> 
<subclause id="H73A27868801B47E09699DFFC6BFCFF6C"><enum>(I)</enum><text display-inline="yes-display-inline">who was attending an institution of higher education that is located in, or was employed or residing in, an area in which the President has declared that a major disaster exists, in accordance with section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>); and </text></subclause> 
<subclause id="H88247C49DFD046A59D940445CD21A6AD"><enum>(II)</enum><text>whose attendance, employment, or residence was interrupted because of the impact of the disaster;</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H9B764C27B0934682862E4C24A86B15E6"><enum>(b)</enum><header>Direct loans</header><text>Section 455(f)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e(f)(2)</external-xref>) is amended—</text> 
<paragraph id="H59F92CFC7CF041EEB88F0035FFD8FCE4"><enum>(1)</enum><text>by striking the period at the end of subparagraph (C) and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="H1A9665CABD904505928965285856ED7C"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" id="H63B5158BDF3D4B239B43143D99C50196" display-inline="no-display-inline"> 
<subparagraph id="HDF3EFDA912A2475AB6C98007DCEC2C"><enum>(D)</enum><text display-inline="yes-display-inline">not in excess of 6 months in the case of a borrower—</text> 
<clause id="HBE8C2E35FA994FA68B049988E2007F00"><enum>(i)</enum><text display-inline="yes-display-inline">who was attending an institution of higher education that is located in, or was employed or residing in, an area in which the President has declared that a major disaster exists, in accordance with section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>); and </text></clause> 
<clause id="H3268E5BCA8AA4DADAF3400A46EDD2190"><enum>(ii)</enum><text>whose attendance, employment, or residence was interrupted because of the impact of the disaster;</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H47E7BEE8DD2A40F3AB56E4F7CA27809"><enum>(c)</enum><header>Perkins Loans</header><text>Section 464(c)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1087dd">20 U.S.C. 1087dd(c)(2)(A)</external-xref>) is amended—</text> 
<paragraph id="H888404B9030C4C20884D48ED53BEF71F"><enum>(1)</enum><text>by striking <quote>or</quote> at the end of clause (iii);</text></paragraph> 
<paragraph id="H3B2352035B944C1B92A81DCAD33B33E6"><enum>(2)</enum><text>by inserting <quote>or</quote> after the semicolon at the end of clause (iv); and</text></paragraph> 
<paragraph id="H1ED97DFF957B4115BE6E00A60EE6E00"><enum>(3)</enum><text>by inserting after clause (iv) the following new clause:</text>

<clause id="HA3DDF2AB879B4063806000A9DD2D848F" indent="up2"><enum>(v)</enum><text display-inline="yes-display-inline">not in excess of 6 months in the case of a borrower—</text> 
<subclause id="HE1096E6B71BA4FB0B867D05B75C02216"><enum>(I)</enum><text display-inline="yes-display-inline">who was attending an institution of higher education that is located in, or was employed or residing in, an area in which the President has declared that a major disaster exists, in accordance with section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>); and </text></subclause> 
<subclause id="H8781178767F84C20BA162545218D9711"><enum>(II)</enum><text>whose attendance, employment, or residence was interrupted because of the impact of the disaster;</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H45E526FF522C43AF982B40C5EF339D33"><enum>4.</enum><header>Expected family contribution</header><text display-inline="no-display-inline">Section 474 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087nn">20 U.S.C. 1087nn</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="H6E6ECC86BFA7444199D5FFCE52B66E60" display-inline="no-display-inline"> 
<subsection id="H8822D12C236C486E8257DD582BEED7D6"><enum>(c)</enum><header>Recalculation of EFC for students affected by disasters</header><text display-inline="yes-display-inline">The Secretary shall provide for the recalculation of expected family contribution for the current academic year, when possible, and for the ensuing academic year, for any student—</text> 
<paragraph id="H7DB3161A02084341B1888843CFC5B720"><enum>(1)</enum><text display-inline="yes-display-inline">who resides in, is employed in, or is attending an institution of higher education that is located in, or is a dependent student whose parent or parents reside or are employed in, an area in which the President has declared that a major disaster exists, in accordance with section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>); and</text></paragraph> 
<paragraph id="H72E6428B898C4732A55EDBB805E6F9F5"><enum>(2)</enum><text>whose income or assets, or whose family income or assets, are affected by such disaster.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>
