<official-title>To amend titles 23 and 49, United States Code, to promote the integration of local land use planning and transportation planning.</official-title>

<section id="H3386C36BAE4F4761A2ED8D7537DA5FA9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Growing Smarter Through Transportation Infrastructure Act of 2005</short-title></quote>.</text></section> 
<section id="H01CF178F6C5C4737ACA6B300E2FE18BE"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="HCAE37316CAAA4617BDEE21DDA7817B49"><enum>(1)</enum><text>It is in the national interest to encourage States and local governments to integrate land use planning with transportation planning in order to—</text> 
<subparagraph id="H3C98824BF3334983BBF3C5E7FC059BEE"><enum>(A)</enum><text>promote the long-term conservation and preservation of undeveloped open spaces and farmland; and</text></subparagraph> 
<subparagraph id="H41404DA103194F26B3C4BF3E8300598B"><enum>(B)</enum><text>stimulate the revitalization of established urban centers while meeting the Nation’s immediate and long-term transportation needs.</text></subparagraph></paragraph> 
<paragraph id="H338AAE935C9F48DDA2E9BCC2E498FFE0"><enum>(2)</enum><text>It is further in the national interest to ensure that Federal funds used to plan, design, build, and maintain transportation infrastructure are utilized to promote the integration of land use planning and transportation planning and to ensure that transportation projects resulting from the process are consistent with applicable land use plans of affected units of general purpose local government.</text></paragraph> 
<paragraph id="H601FBC422A3A4A30961BF07FCF7D18B0"><enum>(3)</enum><text>Conservation and preservation of undeveloped open spaces and farmland are consistent with economic development.</text></paragraph></section> 
<section id="H282AF756AFC44442A0E304646E2600A0"><enum>3.</enum><header>Highway planning</header> 
<subsection id="H306E173473EF4EF7A2FAB95CE3700DA"><enum>(a)</enum><header>Metropolitan planning</header> 
<paragraph id="H6754B4D07DF447CAA0E5D97DC7C6DD44"><enum>(1)</enum><header>Scope of planning process</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/134">Section 134(f)(1)</external-xref> of title 23, United States Code, is amended—</text> 
<subparagraph id="H985FB95C79A648C8BB176CD2844CF76B"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of subparagraph (F);</text></subparagraph> 
<subparagraph id="H689FACEA9A0843B293B31319A48FCFA3"><enum>(B)</enum><text>by striking the period at the end of subparagraph (G) and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="HE12B2DD3B6C44D27907CEA1F5B8FD8BB"><enum>(C)</enum><text>by adding at the end the following:</text>

<subparagraph id="HA1FF3A6A97B94D6EA4AA0687F8A78E91"><enum>(H)</enum><text>ensure consistency with local land use plans.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H4AF9BFCE53ED4782B3B6E2AA73CFD2C6"><enum>(2)</enum><header>Long-range transportation plan</header><text>Section 134(g) of such title is amended by adding at the end the following:</text>

<paragraph id="HEE41B588D34D445E87B4B53E59CC129"><enum>(7)</enum><header>Coordination with affected units of local government</header><text>The metropolitan planning organization shall coordinate the development of the long-range transportation plan with affected units of general purpose local government to ensure consistency with local land use plans.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H38DFAEA6573845B291ADAE3628C4D2C7"><enum>(3)</enum><header>Local land use plan defined</header><text>Section 134 of such title is amended by adding at the end the following:</text>

<subsection id="H7592E6790AAB486682DBFA9F82BE93DF"><enum>(p)</enum><header>Local land use plan defined</header><text>In this section and section 135, the term <term>local land use plan</term> means a municipal, multimunicipal, county, or multicounty comprehensive plan or transportation improvement plan.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H35CDAAD0CDB24C0787516531D5FB913D"><enum>(b)</enum><header>Statewide planning</header> 
<paragraph id="HB77E09FA80FD42F4A1C95CE000E9D8E6"><enum>(1)</enum><header>Scope of planning process</header><text><external-xref legal-doc="usc" parsable-cite="usc/23/135">Section 135(c)(1)</external-xref> of title 23, United States Code, is amended—</text> 
<subparagraph id="H3C161C612EDE4D5DAEEF1511C47F50BA"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of subparagraph (F);</text></subparagraph> 
<subparagraph id="H85D13DFBE3C640F5A7513F6F0061CE66"><enum>(B)</enum><text>by striking the period at the end of subparagraph (G) and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="H6248847E58FC4A08A1ECF330FC2F9C4D"><enum>(C)</enum><text>by adding at the end the following:</text>

<paragraph id="H9DDEB12AF78C4B169CDC32F9F5178688"><enum>(2)</enum><header>Long-range transportation plan</header><text>Section 135(e) of such title is amended by adding at the end the following:</text>

<paragraph id="H84F97C248506455BA0A303E8586EE4B7"><enum>(1)</enum><header>Scope of planning process</header><text><external-xref legal-doc="usc" parsable-cite="usc/49/5303">Section 5303(b)</external-xref> of title 49, United States Code, is amended—</text> 
<subparagraph id="H0E99F6BBDCE0454087F28E1CEA1ECC65"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of subparagraph (F);</text></subparagraph> 
<subparagraph id="H72731F65B84C4697A95145CE1700FC00"><enum>(B)</enum><text>by striking the period at the end of subparagraph (G) and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="H8934586E14C5402D96B82217C19DAA1C"><enum>(C)</enum><text>by adding at the end the following:</text>
