<official-title>To make permanent the teacher loan forgiveness provisions of the Teacher-Taxpayer Protection Act of 2003, and for other purposes.</official-title>

<section id="HB3F05B179F2447E3BBF367B085BCA536" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Teacher Recruitment and Retention Act of 2005</short-title></quote>.</text></section> 
<section id="HA444BEB8C6844546ADC9CFFA1443F256"><enum>2.</enum><header>Extension of authority</header><text display-inline="no-display-inline">Section 3(b) of the Taxpayer-Teacher Protection Act of 2004 is amended by striking paragraph (3).</text></section> 
<section id="H047D7318C7DC420287FCBD67D342DE7"><enum>3.</enum><header>Expansion of loan forgiveness to certain special education personnel</header> 
<subsection id="H8931904DBA4F4230ACF946F73329FEC4"><enum>(a)</enum><header>FFEL loans</header><text>Section 428J(g) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-10">20 U.S.C. 1078–10(g)</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block style="OLC" id="HC970E4741A3A40139499EAFFE214DCDB" display-inline="no-display-inline"> 
<paragraph id="H42C5DD7C12494135BC24DB0564C1C9C1"><enum>(3)</enum><header>Treatment of speech-language pathologists as teachers</header><text>For the purposes of this section—</text> 
<subparagraph id="H4FCF4F6D143C47808441C932E6303FBB"><enum>(A)</enum><text>a speech-language pathologist who is employed full-time to perform services principally in a school described in subsection (b)(1)(A) shall be treated as employed full-time as a teacher in such school;</text></subparagraph> 
<subparagraph id="H4DDC596E86C44B9C977B2C4FCFF930E2"><enum>(B)</enum><text display-inline="yes-display-inline">such a speech-language pathologist who has, at a minimum, a bachelor’s degree in speech-language pathology, or communication, sciences, and disorders, shall be treated as a highly qualified teacher for purposes of subsection (b)(1)(B); and</text></subparagraph> 
<subparagraph id="H4E5F5105019545848FC5D45425A1B00"><enum>(C)</enum><text display-inline="yes-display-inline">a speech-language pathologist who meets the requirements of subparagraphs (A) and (B) of this paragraph, shall be treated as a special education teacher whose primary responsibility is to provide special education to children with disabilities (as those terms are defined in section 602 of the Individuals with Disabilities Education Act).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </subsection></section>
