<legis-type>AN ACT</legis-type> 
<official-title display="yes">To amend the Federal Trade Commission Act to increase civil penalties for violations involving unfair or deceptive acts or practices that exploit popular reaction to an emergency or major disaster, and to authorize the Federal Trade Commission to seek civil penalties for such violations in actions brought under section 13 of that Act.</official-title>

<section section-type="section-one" id="H5D0416094E5D4F2BBE59A3901F135132" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>American Spirit Fraud Prevention Act</short-title></quote>.</text></section> 
<section id="HC4F09EF6BE1E4A9FBDB06739F228B225"><enum>2.</enum><header>Increase in penalties for unfair or deceptive acts or practices exploiting reaction to certain emergencies and major disasters</header> 
<subsection id="H55FF84CA25D54B219445C9DEAE45CD3D"><enum>(a)</enum><header>Violations of prohibition against unfair or deceptive acts or practices</header><text>Section 5(m)(1) of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(m)(1)</external-xref>) is amended by adding at the end the following:</text>

<subparagraph indent="up2" id="HED389E4A42904E648FD5F24854AD16E3"><enum>(D)</enum><text>In the case of a violation involving an unfair or deceptive act or practice in a national emergency period or disaster period, or relating to an international disaster, the amount of the civil penalty under this paragraph shall be double the amount otherwise provided in this paragraph, if the act or practice exploits popular reaction to the national emergency or major disaster that is the basis for such period, or to the international disaster.</text></subparagraph> 
<subparagraph indent="up2" id="H780FA7832CDD4950B91D9006EEE29DD0"><enum>(E)</enum><text>In this paragraph—</text> 
<clause id="H4A11DA9178004E5EA6C62560509F1EC7"><enum>(i)</enum><text>the term <term>national emergency period</term> means the period that—</text> 
<subclause id="HA63CE1C1D710436EACC149F040068281"><enum>(I)</enum><text>begins on the date the President declares a national emergency under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601 et seq.</external-xref>); and</text></subclause> 
<subclause id="HBC6FC4DE9AAF4146B3C613FB4635FA37"><enum>(II)</enum><text>ends on the expiration of the 1-year period beginning on the date of the termination of the national emergency;</text></subclause></clause> 
<clause id="H27356460C9024CCF9E4DACB8605E84E0"><enum>(ii)</enum><text>the term <term>disaster period</term> means the 1-year period beginning on the date the President declares an emergency or major disaster under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>); and</text></clause> 
<clause id="H137CD5C0769E478B93D5DC4FDCDAEE48"><enum>(iii)</enum><text>the term <quote>international disaster</quote> means any natural or man-made disaster in response to which the President furnishes assistance to any foreign country, international organization, or private voluntary organization pursuant to section 491 of the Foreign Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2292">22 U.S.C. 2292(b)</external-xref>).</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H8E6753E42D974CF2BA3D98982513ED32"><enum>(b)</enum><header>Violations of other laws enforced by the Federal Trade Commission</header><text>Section 13 of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/53">15 U.S.C. 53</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HA8369A47C2E6450EB912F6C617B67EF6"><enum>(e)</enum> 
<paragraph display-inline="yes-display-inline" id="HD645DAB7C94D466000D34837581150EE"><enum>(1)</enum><text>If a person, partnership, or corporation is found, in an action under subsection (b), to have committed a violation involving an unfair or deceptive act or practice in a national emergency period or a disaster period, or relating to an international disaster, and if the act or practice exploits popular reaction to the national emergency or major disaster that is the basis for such period, or to the international disaster, the court, after awarding equitable relief (if any) under any other authority of the court, shall hold the person, partnership, or corporation liable for a civil penalty of not more than $22,000 for each such violation.</text></paragraph> 
<paragraph indent="up1" id="H97E0D049E05947CBBD7600522828FD3D"><enum>(2)</enum><text>In this subsection—</text> 
<subparagraph id="H3309D7F4DBB64ACA92AE62A0E2F733C1"><enum>(A)</enum><text>the term <term>national emergency period</term> means the period that—</text> 
<clause id="H48AAC67BF841446BA9CA70A222B42692"><enum>(i)</enum><text>begins on the date the President declares a national emergency under the National Emergencies Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1601">50 U.S.C. 1601 et seq.</external-xref>); and</text></clause> 
<clause id="H3FD1F9197C644FDFA800E53343012DA4"><enum>(ii)</enum><text>ends on the expiration of the 1-year period beginning on the date of the termination of the national emergency; </text></clause></subparagraph> 
<subparagraph id="HD139BD842AE74831BD76D6CFED2BA12"><enum>(B)</enum><text>the term <term>disaster period</term> means the 1-year period beginning on the date the President declares an emergency or major disaster under the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5121">42 U.S.C. 5121 et seq.</external-xref>); and</text></subparagraph> 
<subparagraph id="HA90C9D61F7564F33B28076C24F4EE232"><enum>(C)</enum><text>the term <quote>international disaster</quote> means any natural or man-made disaster in response to which the President furnishes assistance to any foreign country, international organization, or private voluntary organization pursuant to section 491 of the Foreign Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2292">22 U.S.C. 2292(b)</external-xref>).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
