<section section-type="section-one" id="H44697C6F487F4B8CA78400C774C69B7D" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Vocational and Technical Education for the Future Act</short-title></quote>.</text></section> 
<section id="H850BB8084FE74062B4E6C2B26D33956B"><enum>2.</enum><header>References</header><text display-inline="no-display-inline">Wherever in this Act an amendment is expressed in terms of an amendment to or repeal of a section or other provision, the amendment or repeal shall be considered to be made to a section or other provision of the Carl D. Perkins Vocational and Technical Education Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/20/2301">20 U.S.C. 2301 et seq.</external-xref>).</text></section> 
<section id="H9AF829FFB8C74040B63552BDA4FB107C"><enum>3.</enum><header>Purposes and definitions</header> 
<subsection id="H91313137C85C41BF807B22DAE1DC417"><enum>(a)</enum><header>Purposes</header><text>Section 2(2) (<external-xref legal-doc="usc" parsable-cite="usc/20/2301">20 U.S.C. 2301(2)</external-xref>) is amended by inserting <quote>rigorous and challenging</quote> after <quote>integrate</quote>.</text></subsection> 
<subsection id="HA8D0EB1BB65046DF9054D4FC8017A9C8"><enum>(b)</enum><header>Definitions</header><text>Section 3 (<external-xref legal-doc="usc" parsable-cite="usc/20/2302">20 U.S.C. 2302</external-xref>) is amended—</text> 
<paragraph id="H9AA429910AF3403D8FBA55CF497E91D7"><enum>(1)</enum><text>by striking paragraph (26) and redesignating paragraphs (21) through (25) as paragraphs (23) through (27), and paragraphs (27) through (30) as paragraphs (29) through (32), respectively;</text></paragraph> 
<paragraph id="H48828ABAB13341F38B1F6E9D90E4B498"><enum>(2)</enum><text>by redesignating paragraphs (4) through (20) as paragraphs (5) through (21), respectively, and inserting after paragraph (3) the following:</text>

<paragraph id="H409235B2DDB64874892E8E91CBF522FB"><enum>(4)</enum><header>Articulation agreement</header><text>The term <term>articulation agreement</term> means a written commitment, agreed upon at the State level or approved annually and facilitated by the lead administrators of the secondary and postsecondary consortia members as described in section 135(b)(3)(A), to provide a program designed to provide students with a nonduplicative sequence of progressive achievements leading to degrees, certificates, or credentials in a tech-prep education program linked through credit transfer agreements.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HB1259DE664FE425C95E7A1A36E375943"><enum>(3)</enum><text>in paragraph (5) (as so redesignated), by inserting <quote>to students (and parents, as appropriate)</quote> after <quote>providing access</quote>;</text></paragraph>

<clause id="H5976738E88F1409FA3AB1444CCAC9CDB"><enum>(iii)</enum><text>provides, at the postsecondary level, for a 1-year certificate, an associate degree, or industry-recognized credential; and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HA3C8810CE446424AAD741C22851EA2F2"><enum>4.</enum><header>Transition provisions</header><text display-inline="no-display-inline">Section 4 (<external-xref legal-doc="usc" parsable-cite="usc/20/2303">20 U.S.C. 2303</external-xref>) is amended—</text> 
<paragraph id="HF138ABCBF90F4CB3B5148F708CDC7E61"><enum>(1)</enum><text>by striking <quote>the Carl D. Perkins Vocational and Applied Technology Education Act</quote> and inserting <quote> the <quote>Carl D. Perkins Vocational and Technical Education Act of 1998</quote></quote>; and</text></paragraph> 
<paragraph id="H19374F24FE804F2BBE26A1E470062B1"><enum>(2)</enum><text>by striking <quote>the Carl D. Perkins Vocational and Applied Technology Education Amendments of 1998</quote> and inserting <quote>the <short-title>Vocational and Technical Education for the Future Act</short-title>. Each eligible agency shall be assured 1 full fiscal year for transition, to plan for and implement the requirements of this Act</quote>.</text></paragraph></section> 
<section id="HB2CC943C90FD4F14B67BAC885FBF2200"><enum>5.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 8 (<external-xref legal-doc="usc" parsable-cite="usc/20/2307">20 U.S.C. 2307</external-xref>) is amended to read as follows:</text> 
<quoted-block id="HDE39368B0B9440ECB65D15CD50229EE4"> 
<section id="HE78D46DE89D948898767B500CBFEDB4"><enum>8.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to carry out this Act (other than subsection (a), (b), and (c) of section 114, and sections 117 and 118) $1,307,000,000 for fiscal year 2006 and such sums as may be necessary for each of fiscal years 2007 through 2011.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HF7E2B616C5B24D5C00B081F18BFD2C8E"><enum>6.</enum><header>Prohibitions</header> 
<subsection id="HC1DC4966D4F8438C89E6210135ACF2F1"><enum>(a)</enum><header>In general</header><text>The Carl D. Perkins Vocational and Technical Education Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/20/2301">20 U.S.C. 2301 et seq.</external-xref>) is amended by adding after section 8 the following new section:</text> 
<quoted-block id="H9CF0A7717DC2459489B8CF43B19D36E5"> 
<section id="H6CCE07E7EDCA4C90AD007BA8456F9CB9"><enum>9.</enum><header>Prohibitions</header> 
<subsection id="HE644789CA4CE44F8BDFA09789E660E0"><enum>(a)</enum><header>Local control</header><text>Nothing in this Act shall be construed to authorize an officer or employee of the Federal government to mandate, direct, or control a State, local educational agency, or school’s curriculum, program of instruction, or allocation of State or local resources, or mandate a State or any subdivision thereof to spend any funds or incur any costs not paid for under this Act.</text></subsection> 
<subsection id="HEDD31AA242C2448A967764C70EE4E35"><enum>(b)</enum><header>No preclusion of other assistance</header><text>Any State that declines to submit an application to the Secretary for assistance under this Act shall not be precluded from applying for assistance under any other program administered by the Secretary.</text></subsection> 
<subsection id="H58382143463B49F6A600A1C503B50600"><enum>(c)</enum><header>Prohibition on requiring Federal approval or certification of standards</header><text>Notwithstanding any other provision of Federal law, no State shall be required to have academic and vocational and technical content or student academic and vocational and technical achievement standards approved or certified by the Federal government, in order to receive assistance under this Act.</text></subsection> 
<subsection id="HB3E43ADB790A4F09A7375E93B27F3890"><enum>(d)</enum><header>Rule of construction</header><text>Nothing in this section shall be construed to affect the requirements under section 113.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H7A7C1E67062C4A938443554C65ADBD7C"><enum>(b)</enum><header>Table of contents amendment</header><text>The table of contents in section 1(b) is amended by inserting after the item relating to section 8 the following:</text>

<subsection id="H4BDE238E07624099974502AB5565FA69"><enum>(a)</enum><header>Allotment for national activities for 2006</header><text>Section 111(a)(1) (<external-xref legal-doc="usc" parsable-cite="usc/20/2321">20 U.S.C. 2321(a)(1)</external-xref>) is amended to read as follows:</text>

<paragraph id="H15F65B4C8D8542DAB3F98DE9A0E978A7"><enum>(1)</enum><header>Reservations</header><text>From the sum appropriated under section 8 for each fiscal year, the Secretary shall reserve—</text> 
<subparagraph id="HF863E3DD6D784CDE80D64D3FDE00D490"><enum>(A)</enum><text>0.12 percent to carry out section 115;</text></subparagraph> 
<subparagraph id="HEE714E05CF77413599F8BAB885724636"><enum>(B)</enum><text>1.50 percent to carry out section 116, of which—</text> 
<clause id="H73F929DF90CB441A84C55B1F40987CC5"><enum>(i)</enum><text>1.25 percent of the sum shall be available to carry out section 116(b); and</text></clause> 
<clause id="H87A725EC7B874C67B467D0BE9ED68851"><enum>(ii)</enum><text>0.25 percent of the sum shall be available to carry out section 116(h); and</text></clause></subparagraph> 
<subparagraph id="H8FEFA11A639F4E3DB1D80044BCB994B4"><enum>(C)</enum><text>0.54 percent to carry out section 114(d).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H6341AF826F28494EAC584FBC00D699EC"><enum>(b)</enum><header>Minimum allotments</header><text>Section 111(a) (<external-xref legal-doc="usc" parsable-cite="usc/20/2321">20 U.S.C. 2321(a)</external-xref>) is further amended—</text> 
<paragraph id="HFACE881CBFAE43DB9B82CF88DD01E0F4"><enum>(1)</enum><text>in paragraph (3), by striking <quote>(or in the case of fiscal year 1999</quote> and all that follows through <quote>Amendments of 1998)</quote> each place it appears and inserting <quote>(or in the case of fiscal year 2006 only, under this section and under title II of this Act, as such section and title were in effect on the day before the date of enactment of the <short-title>Vocational and Technical Education for the Future Act</short-title>)</quote>; and</text></paragraph> 
<paragraph id="HB4EA9D3E403341DB9D4BACF1AA6FDD5D"><enum>(2)</enum><text>by amending paragraph (4)(A) to read as follows:</text> 
<quoted-block id="H80B88E87B01248AFBEA5BE1C9E306FEB"> 
<subparagraph id="H322BDF37A77E44BA9539AD852FFE2351"><enum>(A)</enum><header>In general</header><text>No State shall receive an allotment under this section for a fiscal year that is less than the allotment the State received for fiscal year 2005 under this section and under title II of this Act (as such section and title were in effect on the day before the date of enactment of the <short-title>Vocational and Technical Education for the Future Act</short-title>).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H5F1F1BECE89E48AB851F8B93BE52352B"><enum>(c)</enum><header>Within State allocation</header><text>Section 112 (<external-xref legal-doc="usc" parsable-cite="usc/20/2322">20 U.S.C. 2322</external-xref>) is amended—</text> 
<paragraph id="HE720C2081AD543338922B88939B2C618"><enum>(1)</enum><text>by amending subsection (a) to read as follows:</text> 
<quoted-block id="H59F9A2C4FDAD403A8225A68190010C2"> 
<subsection id="H7670FDD83C254EBDBC3D248FE508D93D"><enum>(a)</enum><header>Allocation formula</header><text>From the amount allotted to each State under section 111 for a fiscal year, the State board (hereinafter referred to as the <quote>eligible agency</quote>) shall allocate such amount as follows:</text> 
<paragraph id="HE8C96067D7724F2283F071AFCED9294"><enum>(1)</enum><text>Subject to paragraph (4), not less than 88 percent shall be made available for distribution under section 131 or 132, of which the eligible agency shall first make available for the activities described in section 135(b)(3) not less than the amount allotted in fiscal year 2005 to such eligible agency under title II of this Act (as such title was in effect on the day before the date of enactment of the <short-title>Vocational and Technical Education for the Future Act</short-title>), reduced by the percentage by which the amount allotted to the State under section 111 for the fiscal year is less than the amount allotted under such section to such State for fiscal year 2005. Of the remainder of the 88 percent, not more than 10 percent may be used in accordance with subsection (c).</text></paragraph> 
<paragraph id="H77618BA6DD654CC489E2FE6019566800"><enum>(2)</enum><text>Subject to paragraph (4), not more than 10 percent shall be made available to carry out State leadership activities described in section 124, of which—</text> 
<subparagraph id="H4FAC4DD32C154F478FDCBA45FC57D38"><enum>(A)</enum><text>an amount equal to not more than 1 percent of the amount allotted to the State under section 111 for the fiscal year shall be made available to serve individuals in State institutions, such as State correctional institutions and institutions that serve individuals with disabilities; and</text></subparagraph> 
<subparagraph id="H7130CB016815402FAB6B6C8BF7D07963"><enum>(B)</enum><text>not less than $60,000 and not more than $150,000 shall be available for services that prepare individuals for nontraditional fields.</text></subparagraph></paragraph> 
<paragraph id="H370E3DE39A714789B5D0F809272400D8"><enum>(3)</enum><text>An amount equal to not more than 2 percent, or $250,000, whichever is greater, shall be made available for administration of the State plan, which may be used for the costs of—</text> 
<subparagraph id="H2905A00D5A52420180B4EBAB0396E640"><enum>(A)</enum><text>developing the State plan;</text></subparagraph>

<paragraph id="H8F27923149114640BFC49DA6772DCCB3"><enum>(4)</enum><text>If the amount allocated for any fiscal year under paragraph (2) shall be less than the amount allocated under such paragraph for fiscal year 2005, additional amounts may be made available from the amount allocated under paragraph (1) for the purposes described in paragraph (2). <clause id="HC5CDBA2FC5134B22BB1F2DE457583102"><enum>(i)</enum><header>In general</header><text>Each eligible recipient shall establish in the local plan submitted under section 134, levels of performance for each of the core indicators of performance described in paragraph (2)(A) and (B), as appropriate for the eligible recipient, for vocational and technical education activities authorized under this title. The levels of performance established under this subparagraph shall, at a minimum—</text> 
<subclause id="H064DB689B2144861B4FD04CE00F57F08"><enum>(I)</enum><text>be expressed in a percentage or numerical form, so as to be objective, quantifiable, and measurable; and</text></subclause> 
<subclause id="H139399568654456A9F2494A6F5705788"><enum>(II)</enum><text>require the eligible recipient to make continuous and substantial improvement in the academic and vocational and technical achievement of vocational and technical education students.</text></subclause></clause> 
<clause id="H3D4107D89CC541B48254EB00D846A516"><enum>(ii)</enum><header>Identification in the local plan</header><text>Each eligible recipient shall identify, in the local plan submitted under section 134, levels of performance for each of the core indicators of performance for the first 2 program years covered by the local plan.</text></clause> 
<clause id="HBFFDFA5D99BD4F7AAAFEA9B0C7E5E3A5"><enum>(iii)</enum><header>Agreement on local adjusted levels of performance for first 2 years</header><text>The eligible agency and each eligible recipient shall reach agreement on the levels of performance for each of the core indicators of performance, for the first 2 program years covered by the local plan, taking into account the levels identified in the local plan under clause (ii) and the factors described in clause (v). The levels of performance agreed to under this clause shall be considered to be the local adjusted level of performance for the eligible recipient for such years and shall be incorporated into the local plan prior to the approval of such plan.</text></clause> 
<clause id="H43E6F85C349444559DD7DCA4B88E5DF1"><enum>(iv)</enum><header>Agreement on local adjusted levels of performance for subsequent years</header> 
<subclause id="H3FF57CD081A5430782DFE15444D9FDE"><enum>(I)</enum><header>3rd and 4th program years</header><text>Prior to the third program year covered by the local plan, the eligible agency and each eligible recipient shall reach agreement on the local adjusted levels of performance for each of the core indicators of performance for the third and fourth program years covered by the local plan, taking into account the factors described in clause (v).</text></subclause> 
<subclause id="H037340DB4309436EA9AD54C8478B3315"><enum>(II)</enum><header>5th and 6th program years</header><text>Prior to the fifth program year covered by the local plan, the eligible agency and each eligible recipient shall reach agreement on the local adjusted levels of performance for each of the core indicators of performance for the fifth and sixth program years covered by the local plan, taking into account the factors described in clause (v).</text></subclause> 
<subclause id="HBCA12F9DF7E8442287E2A0FA5F547E00"><enum>(III)</enum><header>Agreements incorporated into local plan</header><text>The local adjusted levels of performance agreed to under this clause shall be considered to be the local adjusted levels of performance for the eligible recipient for such years and shall be incorporated into the local plan.</text></subclause></clause> 
<clause id="H25A3E4BF3BEB445A98093B1B8D0024D5"><enum>(v)</enum><header>Factors</header><text>The agreement described in clause (iii) or (iv) shall take into account—</text> 
<subclause id="H5322C512C270460F97CA8107F05014DE"><enum>(I)</enum><text>how the levels of performance involved compare with the local adjusted levels of performance established for other eligible recipients taking into account factors including the characteristics of participants when the participants entered the program and the services or instruction to be provided; and</text></subclause> 
<subclause id="HA62CE796922046A0AA8C07A905DF93E8"><enum>(II)</enum><text>the extent to which such levels of performance promote continuous and substantial improvement on the indicators of performance by such eligible recipient.</text></subclause></clause> 
<clause id="H227D92CF578D467E89453D66C3EB5C7E"><enum>(vi)</enum><header>Revisions</header><text>If unanticipated circumstances arise with respect to an eligible recipient resulting in a significant change in the factors described in clause (v), the eligible recipient may request that the local adjusted levels of performance agreed to under clause (iii) or (iv) be revised. The eligible agency shall issue objective criteria and methods for making such revisions.</text></clause></subparagraph> 
<subparagraph id="HFA84A6B61E504948900115A6D72668EF"><enum>(B)</enum><header>Levels of performance for additional indicators</header><text>Each eligible recipient may identify in the local plan, local levels of performance for any additional indicators of performance. Such levels shall be considered to be the local levels of performance for purposes of this title.</text></subparagraph> 
<subparagraph id="H61AFB27489484B1B925C86ACD39854E3"><enum>(C)</enum><header>Local report</header> 
<clause id="H99A2C43AB83F4734B64B11C3F64C54DF"><enum>(i)</enum><header>Content of report</header><text>Each eligible recipient that receives an allotment under section 111 shall annually prepare and submit to the eligible agency a report regarding—</text> 
<subclause id="HE1C0657766D640858014824EE87B9500"><enum>(I)</enum><text>the progress of such recipient in achieving the local adjusted levels of performance on the core indicators of performance; and</text></subclause> 
<subclause id="H29C421517833478DB185490601024366"><enum>(II)</enum><text>in the case of an eligible recipient that receives funds described in section 112(a) for activities described in section 135(b)(3), the progress in achieving the local adjusted levels of performance on the core indicators of performance with respect to tech-prep program participants.</text></subclause></clause> 
<clause id="HF55E6B25DD824B21A95E47BADCAD6207"><enum>(ii)</enum><header>Data</header><text>Each eligible recipient shall—</text> 
<subclause id="H93F6CEC0D8044E558988E47F1F4846A9"><enum>(I)</enum><text>disaggregate data for each of the indicators of performance under section 113(b)(2) for the categories of students enumerated under section 1111(b)(2)(C)(v)(II) of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> that are served under this Act; and</text></subclause> 
<subclause id="H2BE5CC1C902F449F85111E4789984410"><enum>(II)</enum><text>identify and quantify any disparities or gaps in performance between any such category of students and the performance of all students served by the eligible recipient under the Act.</text></subclause></clause> 
<clause id="H79F41DC48DA94160B069E34E14399044"><enum>(iii)</enum><header>Rules for reporting of data</header><text>The disaggregation of data under clause (ii) shall be required except in a case in which the number of students in a category is insufficient to yield statistically reliable information or in which the results would reveal personally identifiable information about an individual student.</text></clause> 
<clause id="H262F251B6A5948349FE8655C9BCDC7E8"><enum>(iv)</enum><header>Availability</header><text>The report described in clause (i) shall be made available to the public through a variety of formats, including electronically through the Internet.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H5F396CA58B664137B400242BBC6757A4"><enum>(d)</enum><header>State report</header><text>Section 113(c) (<external-xref legal-doc="usc" parsable-cite="usc/20/2323">20 U.S.C. 2323(c)</external-xref>) is amended—</text>

The advisory panel shall transmit to the Secretary and to Congress an independent analysis of the findings and recommendations resulting from such assessment. Such awards shall be based on an eligible agency exceeding State adjusted levels of performance established under section 113(b) and showing sustained or significant improvement.</text></paragraph> 
<paragraph id="HDA450B344C994FC79EE45CFE73F91448"><enum>(2)</enum><header>Special consideration</header><text>In awarding these grants, the Secretary may consider—</text> 
<subparagraph id="HB6F4FD8BA32D4088886220BFB6F07127"><enum>(A)</enum><text>an eligible agency’s success in effectively developing connections between secondary education and postsecondary education and training;</text></subparagraph> 
<subparagraph id="HB2DD7AEF7C5D408A82964EABCF8C9844"><enum>(B)</enum><text>an eligible agency’s integration of rigorous and challenging academic and technical coursework; and</text></subparagraph> 
<subparagraph id="H996C23BF395445A294A2254984D628F4"><enum>(C)</enum><text>an eligible agency’s progress in having special populations participating in vocational and technical education meet State adjusted levels of performance.</text></subparagraph></paragraph> 
<paragraph id="HDB9E49E3BD674E6197F8D48D2475BB06"><enum>(3)</enum><header>Use of funds</header><text>The funds awarded to an eligible agency under this subsection may be used to carry out any activities authorized under section 124, including demonstrations of innovative programs.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

<subsection id="H3A29D6E66BA941C5B072F916A696EB65"><enum>(a)</enum><header>Assistance for the outlying areas</header><text>Section 115 (<external-xref legal-doc="usc" parsable-cite="usc/20/2325">20 U.S.C. 2325</external-xref>) is amended to read as follows:</text>

<subsection id="H5093989BAAE448E1A0AD3249B13DBFD3"><enum>(c)</enum><header>Restriction</header><text>The Republic of Palau shall cease to be eligible to receive funding under this section upon entering into an agreement for extension of United States educational assistance under the Compact of Free Association after the date of enactment of the <short-title>Vocational and Technical Education for the Future Act</short-title>.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="H4475E92DD6D64F93A28CC46874341645"><enum>(2)</enum><header>Application</header><text>The jointly designated agency shall submit an application to the Secretary at the same time the State submits its state plan under section 122. The application shall be in such a manner and be accompanied by such information as the Secretary may reasonably require. At a minimum, the application shall describe how the jointly designated agency will assist the eligible agency in meeting its adjusted levels of performance under section 113(b).</text></paragraph> 
<paragraph id="HB3820A753C4543D7965935899C7F35C0"><enum>(3)</enum><header>Activities</header><text>The jointly designated agency shall conduct activities—</text> 
<subparagraph id="H93F5D2CD5C5E406AA493E38F47D24318"><enum>(A)</enum><text>to provide support for career guidance and academic counseling programs designed to promote improved career and education decision making by students (and parents, as appropriate) regarding education and training options and preparations for high skill, high wage occupations;</text></subparagraph> 
<subparagraph id="HAE4C1565103A4B8DBCECC8F292A00FE"><enum>(B)</enum><text>to make available to students, parents, teachers, administrators, and counselors, and improve accessibility to, information and planning resources that relate academic and vocational and technical educational preparation to career goals and expectations;</text></subparagraph> 
<subparagraph id="HA45BC449F3884D04BD23F7CD616CE4B4"><enum>(C)</enum><text>to equip teachers, administrators, and counselors with the knowledge, skills, and occupational information needed to assist students and parents with educational and other postsecondary opportunities and education financing;</text></subparagraph> 
<subparagraph id="H950155983B1243989CFB67F20961CA26"><enum>(D)</enum><text>to assist appropriate State entities in tailoring resources and training for use by such entities;</text></subparagraph> 
<subparagraph id="H59567E9A1FF1435BA3E0EB036172989"><enum>(E)</enum><text>to improve coordination and communication among administrators and planners of programs authorized by this Act and by section 15 of the Wagner-Peyser Act (<external-xref legal-doc="usc" parsable-cite="usc/29/49l-2">29 U.S.C. 49<italic>l</italic>–2</external-xref>) at the Federal, State, and local levels to ensure nonduplication of efforts and the appropriate use of shared information and data; and</text></subparagraph> 
<subparagraph id="H1CB4EAB66EB947339E4E7FCB313F41EA"><enum>(F)</enum><text>to provide ongoing means for customers, such as students and parents, to provide comments and feedback on products and services and to update resources, as appropriate, to better meet customer requirements.</text></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HC2FB2F72E664437DA1FBF91FA8414866"><enum>(2)</enum><text>in subsection (e)(1), by striking <quote>an identification</quote> and inserting <quote>a description</quote>; and</text></paragraph>

<paragraph id="H040FADCA7B394E86AA474912B0681421"><enum>(2)</enum><text>consultation with the Governor and appropriate agencies, groups, and individuals including parents, students, teachers, representatives of businesses, labor organizations, eligible recipients, State and local officials, and local program administrators, involved in the planning, administration, evaluation, and coordination of programs funded under this title;</text></paragraph> 
<paragraph id="HC0FFAE90A82E45A2BE46C15700EA9CD5"><enum>(3)</enum><text>convening and meeting as an eligible agency (consistent with State law and procedure for the conduct of such meetings) at such time as the eligible agency determines necessary to carry out the eligible agency’s responsibilities under this title, but not less than four times annually; and</text></paragraph> 
<paragraph id="H1EDABE71779A44AFB2F8F151C8D45D36"><enum>(4)</enum><text>the adoption of such procedures as the eligible agency considers necessary to—</text> 
<subparagraph id="H78AD2EB398334A3097039B4151ECBA9C"><enum>(A)</enum><text>implement State level coordination with the activities undertaken by the State boards under section 111 of <external-xref legal-doc="public-law" parsable-cite="pl/105/220">Public Law 105–220</external-xref>; and</text></subparagraph> 
<subparagraph id="H5CC3517BCC1B49B8B74FBA6F4983B2EE"><enum>(B)</enum><text>make available to the service delivery system under section 121 of <external-xref legal-doc="public-law" parsable-cite="pl/105/220">Public Law 105–220</external-xref> within the State a listing of all school dropout, postsecondary, and adult programs assisted under this title.</text></subparagraph></paragraph></subsection> 
<subsection id="H85F1952400FE48A68F5F0060783EB031"><enum>(b)</enum><header>Exception</header><text>Except with respect to the responsibilities set forth in subsection (a), the eligible agency may delegate any of the other responsibilities of the eligible agency that involve the administration, operation, supervision of activities assisted under this title, in whole or in part, to one or more appropriate State agencies.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>

<clause id="H3E39BDB784CD42C981E0869ED56C523E"><enum>(i)</enum><text>incorporate both secondary and postsecondary education elements;</text></clause> 
<clause id="H393D81C761A14B78007E436D4702F999"><enum>(ii)</enum><text>include rigorous and challenging academic content and vocational and technical content in a coordinated, nonduplicative progression of courses that align secondary education with postsecondary education to adequately prepare sudents to succeed in postsecondary education;</text></clause> 
<clause id="H7207689E735D4ECBB9FD011CD605302B"><enum>(iii)</enum><text>lead to a postsecondary 1-year certificate, associate or baccalaureate degree, or a proficiency credential in conjunction with a secondary school diploma; and</text></clause>

<subparagraph id="H8BEE7981BCAB409FBA9E641292B33803"><enum>(D)</enum><text>encourages applied learning that contributes to the academic and vocational and technical knowledge of the student;</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph>

<paragraph id="H2A7CB5C7066B455D9B4CEC32B56012D2"><enum>(1)</enum><header>Plan</header><text>If a State fails to meet the agreed upon State adjusted levels of performance required under section 113(b)(3), the eligible agency shall develop and implement a program improvement plan (with special consideration to performance gaps identified under section 113(c)(2)) in consultation with the appropriate agencies, individuals, and organizations for the first program year succeeding the program year in which the eligible agency failed to meet the State adjusted levels of performance, in order to avoid a sanction under paragraph (3).</text></paragraph> 
<paragraph id="H79168CE0ED014C54B4311EAF1D00B0D1"><enum>(2)</enum><header>Technical assistance</header><text>If the Secretary determines that an eligible agency is not properly implementing the eligible agency’s responsibilities under section 122, or is not making substantial progress in meeting the purposes of this Act, based on the State’s adjusted levels of performance, the Secretary shall work with the eligible agency to implement improvement activities consistent with the requirements of this Act.</text></paragraph> 
<paragraph id="H9848CAF558C84B5EBBD925539D3D006E"><enum>(3)</enum><header>Subsequent action</header> 
<subparagraph id="HA8C18AE819744B4CB6A17B9C8EBEA8DF"><enum>(A)</enum><header>In general</header><text>If an eligible agency fails to meet the State adjusted levels of performance and the purposes of this Act, has not implemented an improvement plan as described in paragraph (1), has shown no improvement within 1 year after implementing an improvement plan as described in paragraph (1), or has failed to meet the State adjusted levels of performance and the purposes of this Act for 2 or more consecutive years, the Secretary may, after notice and opportunity for a hearing, withhold from the eligible agency all, or a portion of, the eligible agency’s allotment under this title.</text></subparagraph> 
<subparagraph id="H851970647BA84109B1EABFE97260975"><enum>(B)</enum><header>Waiver for exceptional circumstances</header><text>The Secretary may waive the sanction in subparagraph (A) due to exceptional or uncontrollable circumstances, such as a natural disaster or a precipitous and unforeseen decline in the financial resources of the State.</text></subparagraph></paragraph> 
<paragraph id="H854A9EB8647B4B0E8BE2F0CA59AF3320"><enum>(4)</enum><header>Funds resulting from reduced allotments</header> 
<subparagraph id="HF55BE3FF2F5D410D9DFA35E4582D00A4"><enum>(A)</enum><header>In general</header><text>The Secretary shall use funds withheld under paragraph (3) for a State served by an eligible agency, to provide (through alternative arrangements) services and activities within the State to meet the purposes of this Act.</text></subparagraph> 
<subparagraph id="H1A1E1DD79BBE435F9B1F2EB92148BC70"><enum>(B)</enum><header>Redistribution</header><text>If the Secretary cannot satisfactorily use funds withheld under paragraph (3), then the amount of funds retained by the Secretary as a result of a reduction in an allotment made under paragraph (3) shall be redistributed to other eligible agencies in accordance with section 111.</text></subparagraph></paragraph></subsection> 
<subsection id="H2EF5A70712EB4BFA9CF46484ADBE8C80"><enum>(b)</enum><header>Local program improvement</header> 
<paragraph id="H9AEA902C31FE47949E4409B61800F7F6"><enum>(1)</enum><header>Local evaluation</header><text>Each eligible agency shall evaluate annually, using the local adjusted levels of performance described in section 113(b)(4), the vocational and technical education activities of each eligible recipient receiving funds under this title.</text></paragraph> 
<paragraph id="HC149532F56D346A89BE782F8B91C2355"><enum>(2)</enum><header>Plan</header> 
<subparagraph id="H0CE6EA8B5F284E0B8CEB98F4B87C3F70"><enum>(A)</enum><header>In general</header><text>If, after reviewing the evaluation, the eligible agency determines that an eligible recipient is not making substantial progress in achieving the local adjusted levels of performance, or that an eligible recipient demonstrates under section 113(b)(4)(C) persistent or a widening of performance gaps between multiple categories of students served by the eligible recipient in comparison to all students in the State served under the Act, the eligible agency shall—</text> 
<clause id="HF5B8224F23464F37BB09AD47746068FB"><enum>(i)</enum><text>conduct an assessment of the educational needs that the eligible recipient shall address to overcome local performance deficiencies;</text></clause> 
<clause id="HF1656BA343024255B300744CDF8C37CA"><enum>(ii)</enum><text>enter into an improvement plan agreement with an eligible recipient based on the results of the assessment, for the first program year succeeding the program year in which the eligible recipient failed to meet the local adjusted levels of performance, which plan shall demonstrate how the local performance deficiencies will be corrected and include strategies for professional development and instructional and other programmatic innovations of demonstrated effectiveness, giving special consideration to performance gaps identified under section 113(b)(4)(C); and</text></clause> 
<clause id="H37BEE1F055394741811460DF2B0059CC"><enum>(iii)</enum><text>conduct regular evaluations of the progress being made toward reaching the local adjusted levels of performance as described in section 113(b)(4) and progress on implementing the improvement plan.</text></clause></subparagraph> 
<subparagraph id="H2B5298375FC54151A24E9270CE6599E6"><enum>(B)</enum><header>Consultation</header><text>The eligible agency shall conduct the activities described in paragraph (2) in consultation with teachers, parents, other school staff, appropriate agencies, and other appropriate individuals and organizations.</text></subparagraph></paragraph> 
<paragraph id="HB4C074DD405843269734B51567ACDB5"><enum>(3)</enum><header>Technical assistance</header><text>If the eligible agency determines that an eligible recipient is not properly implementing the eligible recipient’s responsibilities under section 134, or is not making substantial progress in meeting the purpose of this Act, based on the local adjusted levels of performance, the eligible agency shall provide technical assistance to the eligible recipient to assist such recipient in carrying out the improvement activities consistent with the requirements of this Act.</text></paragraph> 
<paragraph id="HFD285D8D91CB4A56976C28D840B6A429"><enum>(4)</enum><header>Subsequent action</header>

<subclause id="H9F2ED6FEB82E4E0CA35F1B6B3FF396EA" display-inline="yes-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">a nonprofit institution of higher education that offers—</text></subclause> 
<subclause id="H71AF3C43DE6F428690AABF2421C36F" indent="down1"><enum>(aa)</enum><text>a 2- or 4-year degree program, or a 2-year certificate program, and is qualified as an institution of higher education pursuant to section 102 of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>) (except those institutions described in section 102(a)(1)(C) of such Act), including an institution receiving assistance under the Tribally Controlled College or University Assistance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/25/1801">25 U.S.C. 1801 et seq.</external-xref>) and a tribally controlled postsecondary vocational and technical institution; or</text></subclause> 
<subclause id="HCE5883AE23C742938E18C9B2A7CC7EBE" indent="down1"><enum>(bb)</enum><text>a 2-year apprenticeship program that follows secondary instruction, if such nonprofit institution of higher education is not prohibited from receiving assistance under part B of title IV of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1071">20 U.S.C. 1071 et seq.</external-xref>) pursuant to the provisions of section 435(a)(3) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1083">20 U.S.C. 1083(a)</external-xref>); or</text></subclause></clause> 
<clause id="HC27C93D1E1D944B4AE31DC39F8CD2BD4"><enum>(II)</enum><text>a proprietary institution of higher education that offers a 2-year associate degree program and is qualified as an institution of higher education pursuant to section 102 of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>), if such proprietary institution of higher education is not subject to a default management plan required by the Secretary,</text></clause><continuation-text continuation-text-level="subparagraph">and may include nonprofit organizations that provide eligible recipients with technology and programs to enhance math and science skills, employers, and labor organizations;</continuation-text></subparagraph> 
<subparagraph id="H9F7A5F043A3D45D398782DE981EDCB1C"><enum>(B)</enum><text>consist of a minimum of 2 years of secondary school preceding graduation and a minimum of 2 years of higher education, or an apprenticeship program of at least 2 years, following secondary instruction;</text></subparagraph> 
<subparagraph id="H537E4F71D0DE4EC5BB173D2DA1A2E239"><enum>(C)</enum><text>meet academic standards developed by the State, including standards developed under section 1111 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311</external-xref>) for secondary students, and support proficiency in mathematics, science, reading, writing, communications, and technologies;</text></subparagraph> 
<subparagraph id="H561C7B5C5BD24028B4A441ACAE99E973"><enum>(D)</enum><text>are comprised of model sequences of courses that integrate rigorous and challenging academics and vocational and technical education;</text></subparagraph> 
<subparagraph id="H8A51600ECFEA463300C200C3723E3012"><enum>(E)</enum><text>provide technical preparation in a career field such as engineering technology; applied science; a mechanical, industrial, or practical art or trade; agriculture; health occupations; business; applied economics; advanced manufacturing; or other high-skill, high-wage, high-demand occupations as determined by the State;</text></subparagraph> 
<subparagraph id="HEC9BD820732944EAA3A9E183708E741D"><enum>(F)</enum><text>use, if appropriate and available, work-based or worksite learning in conjunction with academic and vocational and technical education;</text></subparagraph> 
<subparagraph id="HCCED1F87E990435BBCBABC11559BDCD7"><enum>(G)</enum><text>use educational technology and distance learning, as appropriate, to involve all the consortium partners more fully in the development and operation of programs;</text></subparagraph> 
<subparagraph id="HF52A25B581D749D688D7E5361BF4A348"><enum>(H)</enum><text>facilitate and promote close working relationships among eligible recipients to ensure that programs within a geographic area are closely integrated with tech-prep program activities;</text></subparagraph> 
<subparagraph id="HE863A6E2647A4556A7BD09B90764A582"><enum>(I)</enum><text>are sustainable and use performance indicator data, described in section 113, to inform program quality;</text></subparagraph> 
<subparagraph id="H57ADBEB9C29042F198BE827655A899A2"><enum>(J)</enum><text>include academic and career counseling for participants that provides information to students (and parents, as appropriate) regarding tech-prep programs and supports student progress in completing tech-prep programs;</text></subparagraph> 
<subparagraph id="HE8486DBC85BD422BBCDCDFE37658E00"><enum>(K)</enum><text>include in-service training for teachers that—</text> 
<clause id="H0AC2873784314003937F8D022F2D52A5"><enum>(i)</enum><text>provides for joint training for teachers in tech-prep programs; and</text></clause> 
<clause id="H0D2EE656550041B185F84809E08105A8"><enum>(ii)</enum><text>is designed to ensure that teachers and administrators stay current with the needs, expectations, and methods of business and all aspects of an industry; and</text></clause></subparagraph> 
<subparagraph id="H22F172E6758B426BBAF3EB17AB7C7324"><enum>(L)</enum><text>provide students with transferable credit between the consortium members, as described in subparagraph (A), and may include programs that allow secondary programs to be co-located on postsecondary campuses;</text></subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H0D836872A788409D817302B784668774"><enum>(D)</enum><text>in paragraph (5) (as so redesignated)—</text>

<subsection id="HB279C09CBFAB4449B01419BAD4E39290"><enum>(a)</enum><header>Participation on equitable basis</header> 
<paragraph id="HE902E56231854B2DA5ACBBDD922C9939"><enum>(1)</enum><header>In general</header><text>To the extent consistent with the number of children in the school district of a local educational agency that is eligible to receive funds under this Act, or that serves the area in which a program assisted under this Act is located, who are enrolled in private nonprofit elementary schools and secondary schools, or, with respect to instructional or personnel training programs funded by an eligible agency, the local educational agency, after consultation with appropriate private school officials—</text> 
<subparagraph id="H88C5855B6F574491850900A61CDE6BDA"><enum>(A)</enum><text>shall provide, on an equitable basis and as may be necessary, for the benefit of such children in such schools, secular, neutral, and nonideological services (or other benefits), materials, and equipment, including the participation of the teachers of such children (and other educational personnel serving such children) in training programs; or</text></subparagraph> 
<subparagraph id="H96EAAB753C80418E00994278E200BF88"><enum>(B)</enum><text>if such services, materials, and equipment are not feasible or necessary in one or more such private schools (as determined by the local educational agency after consultation with the appropriate private school officials), shall provide such other arrangements as will assure equitable participation of such children in the purposes and benefits of this Act.</text></subparagraph></paragraph> 
<paragraph id="HD6CC35EAD19A4A67B46DFD1880C025D9"><enum>(2)</enum><header>Application of requirements</header><text>The requirements of this section relating to the participation of children, teachers, and other personnel serving such children shall apply to programs carried out under this Act by an eligible agency or local educational agency, whether directly or through grants to, or contracts with, other public or private agencies, institutions, or organizations.</text></paragraph></subsection> 
<subsection id="H285B0A4E75BE4687AD3DEC745347EFDA"><enum>(b)</enum><header>Equal expenditures</header> 
<paragraph id="HD21A1C9B6E20499DB5D45DDD100C68D"><enum>(1)</enum><header>In general</header><text>Expenditures for programs under subsection (a) shall be equal (consistent with the number of children to be served) to expenditures for programs under this Act for children enrolled in the public schools of the local educational agency.</text></paragraph> 
<paragraph id="HB6544856981843AEBEF4002EB787BDF"><enum>(2)</enum><header>Concentrated programs</header><text>When funds available to a local educational agency under this Act are used to concentrate programs on a particular group, attendance area, or grade or age level, the local educational agency shall, after consultation with the appropriate private school officials, assure the equitable participation in both the purposes and benefits of such programs for children enrolled in private schools who are included within the group, attendance area, or grade or age level selected for such concentration, taking into account the needs of the individual children and other factors that relate to the expenditures referred to in paragraph (1).</text></paragraph></subsection> 
<subsection id="H6A0EE0D8DBB4488B926644813D786665"><enum>(c)</enum><header>Administrative requirements</header> 
<paragraph id="HAA048E742B8C4B0B976B6D77BC8BFC23"><enum>(1)</enum><header>Funds, materials and equipment</header> 
<subparagraph id="H358513B7E4134316A87BD00B18945FE"><enum>(A)</enum><header>Funds</header><text>The control of funds expended under this section shall be administered by a public agency.</text></subparagraph> 
<subparagraph id="HE9C9FBA299DB4FADA9183BAF96D9EC1E"><enum>(B)</enum><header>Materials and equipment</header><text>The title to materials and equipment provided under this section, shall remain with a public agency for the uses and purposes provided in this Act</text></subparagraph></paragraph> 
<paragraph id="H3944C4A842544811A88B8B9334A37E6D"><enum>(2)</enum><header>Provision of services</header><text>Services provided under this Act shall be provided by employees of a public agency or through contract by such a public agency with a person, association, agency, organization, institution or corporation that, in the provision of such services, is independent of the private school and of any religious organizations, and such employment or contract shall be under the control and supervision of such a public agency. The funds utilized under this section shall not be commingled with State or local funds.</text></paragraph> 
<paragraph id="H032C5C3A542B4FCD9EA77C7E51FB62B3"><enum>(3)</enum><header>Timing and content of consultation</header><text>The consultation required under this section shall include meetings of agency and private school officials and shall occur before the eligible agency and local educational agency makes any decision that affects the opportunities of eligible private school children to participate in programs under this Act. Such meetings shall include a discussion of service delivery mechanisms (including third party contractors) and shall continue throughout implementation and assessment of services under this Act.</text></paragraph></subsection> 
<subsection id="H1B1842C45B9348EDB35F5484775B3363"><enum>(d)</enum><header>Waiver and bypass procedures</header> 
<paragraph id="HC6C8E9E2A2634B85B331F68023F064A3"><enum>(1)</enum><header>State prohibition</header><text>If an eligible agency or local educational agency is prohibited, by reason of any provision of law, from providing for the participation in programs of children enrolled in private elementary schools and secondary schools as required by subsections (a) through (c), the Secretary shall waive such requirements for the agency involved and shall arrange for the provision of services to such children through arrangements that shall be subject to the requirements of this section.</text></paragraph> 
<paragraph id="H39DA674B92B54D2DA31EE480B8F4D74B"><enum>(2)</enum><header>Failure to comply</header><text>If the Secretary determines that an eligible agency or a local educational agency has substantially failed, or is unwilling, to provide for the participation on an equitable basis of children enrolled in private elementary schools and secondary schools as required by subsections (a) through (c), the Secretary may waive such requirements and shall arrange for the provision of services to such children through arrangements that shall be subject to the requirements of this section.</text></paragraph> 
<paragraph id="H967CAAE7748C46A2914F984500F58FB3"><enum>(3)</enum><header>Payment from State allotment</header><text>When the Secretary arranges for services under this subsection, the Secretary shall, after consultation with the appropriate public school and private school officials, pay the cost of such services, including the administrative costs of arranging for those services, from the appropriate allotment of the eligible agency under this Act.</text></paragraph> 
<paragraph id="H8E7EA0C447984A8900E76F63B03F5200"><enum>(4)</enum><header>Duration of determination</header><text>Any determination by the Secretary under this section shall continue in effect until the Secretary determines that there will no longer be any failure or inability on the Act of the eligible agency or local educational agency to meet the requirements of subsections (a) through (c).</text></paragraph> 
<paragraph id="HF9A68913CC55493BA5A384C8DA06E2F"><enum>(5)</enum><header>Review of determination</header><text>The Secretary shall not take any final action under this section until the eligible agency and the local educational agency affected by such action have had an opportunity, for not less than 45 days after receiving written notice thereof, to submit written objections and to appear before the Secretary or the Secretary’s designee to show cause why that action should not be taken.</text></paragraph></subsection> 
<subsection id="H7CB06BAA513C4C87B450A95F46AEB525"><enum>(e)</enum><header>Withholding of allotment or allocation</header><text>Pending final resolution of any investigation or complaint that could result in a waiver under subsection (d)(1) or (d)(2), the Secretary may withhold from the allotment or allocation of the affected eligible agency or local educational agency the amount estimated by the Secretary to be necessary to pay the cost of services to be provided by the Secretary under such subsection.</text></subsection> 
<subsection id="H76D045AE79E84B3ABE17A8FC1B15AB18"><enum>(f)</enum><header>Prior determination</header><text>Any bypass determination by the Secretary under Title I or Title IX of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> shall, to the extent consistent with the purposes of this Act, apply to programs under this Act until such determinations terminate or expire.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
