<official-title>To amend title 38, United States Code, to authorize the Secretary of Veterans Affairs to provide adaptive housing assistance to disabled veterans residing temporarily in housing owned by a family member and to make direct housing loans to Native American veterans, and for other purposes.</official-title>

<section id="HB2378DB765204FB6AEE2155C71F8FCFD" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Housing Improvement Act of 2005</short-title></quote>. </text></section> 
<section id="H2696301EBCD04C4FB0EAD77D56FAE8E8"><enum>2.</enum><header>Adaptive housing assistance for disabled veterans residing temporarily in housing owned by family member</header> 
<subsection id="H185D9DA16DBE4C1DB257D48BBC80C7A3"><enum>(a)</enum><header>Assistance authorized</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/21">Chapter 21</external-xref> of title 38, United States Code, is amended by inserting after <external-xref legal-doc="usc" parsable-cite="usc/38/2102">section 2102</external-xref> the following new section:</text>

<section id="HF8F57E920FA04BF992E6454067197C8D"><enum>2102A.</enum><header>Assistance for veterans residing temporarily in housing owned by family member</header> 
<subsection id="HF672C648085D44C4A6C11FB400BD7C41"><enum>(a)</enum><text display-inline="yes-display-inline">In the case of a disabled veteran who is described in subsection (a)(2) or (b)(2) of section 2101 of this title and who is residing, but does not intend to permanently reside, in a residence owned by a member of such veteran’s family, the Secretary may assist the veteran in acquiring such adaptations to such residence as are determined by the Secretary to be reasonably necessary because of the veteran’s disability.</text></subsection> 
<subsection id="H6C1713D3A9D246B495EC1EA47D30C192"><enum>(b)</enum><text>The assistance authorized under subsection (a) may not exceed—</text> 
<paragraph id="H00D513BFD28A470C824319976DE7703" display-inline="no-display-inline"><enum>(1)</enum><text>$10,000, in the case of a veteran described in section 2101(a)(2) of this title; or </text></paragraph> 
<paragraph id="HC277E00AB35643C9A51B063066B89C1F" display-inline="no-display-inline"><enum>(2)</enum><text>$2,000, in the case of a veteran described in section 2101(b)(2) of this title.</text></paragraph></subsection> 
<subsection id="HFA79748696A94FFDB2A6C062293CB1B1" display-inline="no-display-inline"><enum>(c)</enum><text>The assistance authorized by subsection (a) shall be limited in the case of any veteran to one residence.</text></subsection> 
<subsection id="HC4FEE64E838A4EF3AC4EF1EA427DEEB9"><enum>(d)</enum><text>Assistance under this section shall be provided in accordance with such regulations as the Secretary may prescribe.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA18FC03A4FE84476AA83BDB59E881583"><enum>(b)</enum><header>Limitations on adaptive housing assistance</header><text>Section 2102 of such title is amended—</text> 
<paragraph id="HD24B160F280B4BB3BA5841008655E586"><enum>(1)</enum><text>in the matter in subsection (a) preceding paragraph (1)—</text> 
<subparagraph id="HE43F4C21A40A4B86BCB005ACBD3B5FD8"><enum>(A)</enum><text>by striking <quote>shall be limited in the case of any veteran to one housing unit, and the necessary land therefor, and</quote>; and </text></subparagraph> 
<subparagraph id="H9D3755F2218748D68B4447EA69A604EB"><enum>(B)</enum><text>by striking <quote>veteran but shall not exceed $50,000 in any one case—</quote> and inserting <quote>veteran—</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HE07F4B7BED114A40A4562CD000939C42"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="H7C417B8763984D41A76458C5C26FF560"><enum>(d)</enum> 
<paragraph id="H0AAE0F5BB4ED4A9382DB9F1BC7BD26F9" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The aggregate amount of assistance available to a veteran under sections 2101(a) and 2102A of this title shall be limited to $51,000.</text></paragraph> 
<paragraph id="H96EE2717C36744C1A4C401F160A4E779" indent="up1"><enum>(2)</enum><text>The aggregate amount of assistance available to a veteran under sections 2101(b) and 2102A of this title shall be limited to $10,500.</text></paragraph> 
<paragraph id="H649F4E9F2F454D50A514E0972D6715DF" indent="up1"><enum>(3)</enum><text>No veteran may receive more than three grants of assistance under this chapter.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H7FBF496F13C94B3FAAB08C41A5003870"><enum>(c)</enum><header>Coordination of administration of benefits</header><text>Chapter 21 of such title is further amended by adding at the end the following new section:</text>

<section id="HAAFE113D107D4730B82B0051F9C316FA"><enum>2107.</enum><header>Coordination of administration of benefits</header><text display-inline="no-display-inline">The Secretary shall provide for the coordination of the administration of programs to provide specially adapted housing that are administered by the Under Secretary for Health and such programs that are administered by the Under Secretary for Benefits under this chapter, chapter 17, and chapter 31 of this title.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HF3F485ED16BC4F7BAF4FA3CA2BD3C253"><enum>(d)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of such chapter of such title is amended—</text>

<section id="H04DED5C8DB804CC7AB1642A793E553E9"><enum>3.</enum><header>Permanent authority to make direct housing loans to Native American veterans</header> 
<subsection id="H96FBEFED78284FB9AA618ED036F23047"><enum>(a)</enum><header>Permanent authority</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/3761">Section 3761</external-xref> of title 38, United States Code, is amended—</text> 
<paragraph id="H58BF8999B976460A00B38EF9301C217C"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="H70EEC28C92D2408CAE30B0CA79C64F8"><enum>(A)</enum><text>by striking <quote>establish and implement a pilot program under which the Secretary may</quote> in the first sentence; and</text></subparagraph> 
<subparagraph id="HFA09DEC49ACC47559CE612EA9968C758"><enum>(B)</enum><text>by striking <quote>shall establish and implement the pilot program</quote> in the third sentence and inserting <quote>shall make such loans</quote>;</text></subparagraph></paragraph> 
<paragraph id="H2F444E1FD6A54A02B19610CA41909497"><enum>(2)</enum><text>in subsection (b), by striking <quote>In carrying out the pilot program under this subchapter, the</quote> and inserting <quote>The</quote>; </text></paragraph> 
<paragraph id="H9BABD7F18A8743DEB19DC344181E1F38"><enum>(3)</enum><text>by striking subsection (c); and</text></paragraph> 
<paragraph id="H0D6B34F1C902441BA738504948887EC0"><enum>(4)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="H1FE7302F47B74990A2BAE8046FED69B"><enum>(d)</enum><text>In making loans under this section, the Secretary shall consider the views and recommendations, if any, of the Advisory Committee on Native-American Veterans established under section 19032 of the Veterans’ Health-Care Amendments of 1986 (title XIX of <external-xref legal-doc="public-law" parsable-cite="pl/99/272">Public Law 99–272</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HB0D716A3FF80443AA4C442001200481F"><enum>(b)</enum><header>Conforming amendments</header> 
<paragraph id="HDC5262B6D52043BAA7052DE0ECEE9DC"><enum>(1)</enum><text>Section 3762 of such title is amended—</text> 
<subparagraph id="HED8F2FD314844F608668DEFA7D93CEA"><enum>(A)</enum><text>in subsection (a), by inserting <quote>under this subchapter</quote> after <quote>to a Native American veteran</quote>; </text></subparagraph> 
<subparagraph id="H88D2961932764C29AC5C69D5B6FC14AF"><enum>(B)</enum><text>in subsection (b)(1)(E), by striking <quote>the pilot program established under this subchapter is implemented</quote> and inserting <quote>loans under this subchapter are made</quote>;</text></subparagraph> 
<subparagraph id="H099EC85CEE9F4CF7A1565FF809BE6707"><enum>(C)</enum><text>in subsection (c)(1)(B), by striking <quote>carry out the pilot program under this subchapter in a manner that demonstrates the advisability of making direct housing loans</quote> in the second sentence and inserting <quote>make direct housing loans under this subchapter</quote>;</text></subparagraph> 
<subparagraph id="H017F52C813C049D6994BBAAF18E6F39D"><enum>(D)</enum><text>in subsection (i)—</text> 
<clause id="H11034365EFDB4E6AB66F144C004522B5"><enum>(i)</enum><text>by striking <quote>the pilot program provided for under this subchapter and</quote> in paragraph (1);</text></clause> 
<clause id="H06E8AF413DD940D7BC1E00301312EDDA"><enum>(ii)</enum><text>by striking <quote>under the pilot program and in assisting such organizations and veterans in participating in the pilot program</quote> in paragraph (2)(A) and inserting <quote>under this subchapter and in assisting such organizations and veterans with respect to such housing benefits</quote>; and</text></clause> 
<clause id="H4925BA24B63349E680AAEE63A0C08578"><enum>(iii)</enum><text>by striking <quote>in participating in the pilot program</quote> in paragraph (2)(E) and inserting <quote>with respect to such benefits</quote>;</text></clause></subparagraph> 
<subparagraph id="H2974179BDEF94A17B160C08D602ED415"><enum>(E)</enum><text>in subsection (j)—</text> 
<clause id="HFA588FAE8CEC4DAEA7C2691DEC46E48C"><enum>(i)</enum><text>in the matter preceding paragraph (1)—</text> 
<subclause id="H656E6121BED64AD5BF3E99715E273922"><enum>(I)</enum><text>by striking <quote>through 2006</quote>; and</text></subclause> 
<subclause id="HBB72E9ACB10840319EFAE7812679582E"><enum>(II)</enum><text>by striking <quote>relating to the implementation of the pilot program</quote> and inserting <quote>activities conducted</quote>; and</text></subclause></clause> 
<clause id="H22F270FC86AF4C1395DE09FC525341F1"><enum>(ii)</enum><text>by striking <quote>pilot program</quote> each place it appears in paragraphs (3), (4), and (5) and inserting <quote>housing benefits under this subchapter</quote>.</text></clause></subparagraph></paragraph> 
<paragraph id="HB0BB7E82FD1C4F8880802011CCD52E7"><enum>(2)</enum><text display-inline="yes-display-inline">Section 8(b) of the Veterans Home Loan Program Amendments of 1992 (<external-xref legal-doc="public-law" parsable-cite="pl/102/547">Public Law 102–547</external-xref>) is repealed.</text></paragraph></subsection> 
<subsection id="H5F622591E9AD4DDEBFB07DCD7C03A0C0"><enum>(c)</enum><header>Establishment of maximum amount of loans</header> 
<paragraph id="H9B7A0DB146DA415DA08F976DDBC0F480" display-inline="no-display-inline"><enum>(1)</enum><header>Maximum loan amount</header><text>Subsection (c)(1)(B) of section 3762 of such title is amended—</text> 
<subparagraph id="H7FC685FDD3774924AE7E001CD05E822F"><enum>(A)</enum><text>by striking <quote>(B) The</quote> and inserting <quote>(B)(i) Subject to clause (ii), the</quote>; and</text></subparagraph> 
<subparagraph id="H01C97A5335614BBE8DE34FE3A1FEE941"><enum>(B)</enum><text>by adding at the end the following new clause:</text>

<subsection id="HAB65115B7D9B41EB843CFFF081D55F54"><enum>(a)</enum><header>Extension</header><text>Subchapter V of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/37">chapter 37</external-xref> of title 38, United States Code, is amended—</text> 
<paragraph id="H755744579A164D16B0D7755F64322D2B"><enum>(1)</enum><text>by redesignating section 3764 as section 3765; and</text></paragraph> 
<paragraph id="H0C283199AE074EA9A554C98FB3101E84"><enum>(2)</enum><text>by inserting after section 3763 the following new section:</text>

<section id="HCB7D778E69AA4EEBA7C951672F098000"><enum>3764.</enum><header>Qualified non-Native American veterans</header> 
<subsection id="H725D2EE3904A440283CD1ECABDD9D121"><enum>(a)</enum><text>Subject to the succeeding provisions of this section, for purposes of this subchapter—</text> 
<paragraph id="HDF9D786B9F374DDFB0C037F1ADE6079D"><enum>(1)</enum><text>a qualified non-Native American veteran is deemed to be a Native American veteran; and</text></paragraph> 
<paragraph id="H312A1E9AF70641588B27E733433B92F0"><enum>(2)</enum><text>for purposes of applicability to a non-Native American veteran, any reference in this subchapter to the jurisdiction of a tribal organization over a Native American veteran is deemed to be a reference to jurisdiction of a tribal organization over the Native American spouse of the qualified non-Native American veteran.</text></paragraph></subsection> 
<subsection id="H80A3849C629C4E34A09CF7FDB7E14BA1"><enum>(b)</enum><text>In making direct loans under this subchapter to a qualified non-Native American veteran by reason of eligibility under subsection (a), the Secretary shall ensure that the tribal organization permits, and the qualified non-Native American veteran actually holds, possesses, or purchases, using the proceeds of the loan, jointly with the Native American spouse of the qualified non-Native American veteran, a meaningful interest in the lot, dwelling, or both, that is located on trust land.</text></subsection> 
<subsection id="HFDCEBFC15632498CB7BAA5CE074CC263"><enum>(c)</enum><text>Nothing in subsection (b) shall be construed as precluding a tribal organization from imposing reasonable restrictions on the right of the qualified non-Native American veteran to convey, assign, or otherwise dispose of such interest in the lot or dwelling, or both, if such restrictions are designed to ensure the continuation in trust status of the lot or dwelling, or both. Such requirements may include the termination of the interest of the qualified non-Native American veteran in the lot or dwelling, or both, upon the dissolution of the marriage of the qualified non-Native American veteran to the Native American spouse.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H2841C388FD804365BC295E2CCDAE45D"><enum>(b)</enum><header>Conforming amendments</header><text>Section 3765 of such title, as redesignated by subsection (a), is amended by adding at the end the following new paragraph:</text>

<paragraph id="H22F34722A3894FAAA99C833605E508F6"><enum>(5)</enum><text>The term <term>qualified non-Native American veteran</term> means a veteran who—</text> 
<subparagraph id="HADC1B17C207944988C83079B16EE1F44"><enum>(A)</enum><text>is the spouse of a Native American, but</text></subparagraph> 
<subparagraph id="H9DEE1566FF734BE48F79FCA9ACBF34FD"><enum>(B)</enum><text>is not a Native American.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HC50732E0CB8D41CC925DC1A65EDF08B3"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of chapter 37 of such title is amended by striking the item relating to section 3764 and inserting the following new items:</text>
