R. 3649 IN THE HOUSE OF REPRESENTATIVES September 6, 2005 Mr. Young of Alaska (for himself and Mr. Oberstar) introduced the following bill; which was referred to the Committee on Transportation and Infrastructure, and in addition to the Committees on Ways and Means and Resources, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned A BILL To ensure funding for sportfishing and boating safety programs funded out of the Highway Trust Fund through the end of fiscal year 2005, and for other purposes.

Short title
This Act may be cited as the Sportfishing and Recreational Boating Safety Amendments Act of 2005.
<enum>I</enum><header>Corrections to the Sportfishing and Recreational Boating Safety Act of 2005</header> <section id="H5CDECD15E7D941EDB83964ADB1CDD2FD" section-type="subsequent-section"><enum>101.</enum><header>Effective date of amendments</header> <subsection id="H5F072F2CDFA842F79D00008BDC50B683"><enum>(a)</enum><header>In general</header><text>The Sportfishing and Recreational Boating Safety Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/59">Public Law 109–59</external-xref>) is amended—</text> <paragraph id="H2C80D4B992AA406B891BA0C60051DBFC"><enum>(1) </enum><text display-inline="yes-display-inline">by striking section 10112(b)(2); and </text></paragraph> <paragraph id="H92575625566E42ADB534629256B30003"><enum>(2)</enum><text>by inserting after section 10101 the following:</text> <quoted-block style="OLC" id="H4F2315651BFC4E839971C0C474FC9E00" display-inline="no-display-inline"> <section id="HFE0754586B32408BB905FBE19591EEDF"><enum>10102.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this subtitle shall take effect October 1, 2005.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> <subsection id="H414BF71543CE4176BC00A97BA2C576CB"><enum>(b)</enum><header>Temporary preservation of existing law</header><text display-inline="yes-display-inline">Except as provided by the amendments made by title II of this Act, during the period beginning on the date of the enactment of the Sportfishing and Recreational Boating Safety Act of 2005, and ending upon the expiration of fiscal year 2005, the provisions of law amended by the Sportfishing and Recreational Boating Safety Act of 2005 (as amended by this Act) shall be considered to read as such laws read immediately before the enactment of that Act.</text></subsection></section> <section id="HA608674C05554BFEB7F5A4E366A5F37F"><enum>102.</enum><header>Recreational boating safety funds</header><text display-inline="no-display-inline">Section 10143 of the Sportfishing and Recreational Boating Safety Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/59">Public Law 109–59</external-xref>) is amended—</text> <paragraph id="H3536A4690C5942FB852BA11F6E9D60E3"><enum>(1)</enum><text>in paragraph (1) by striking <quote>under section 10119 of the Sportfishing and Recreational Boating Safety Act of 2005</quote> and inserting <quote>under section 15 of the Dingell-Johnson Sport Fish Restoration Act</quote>;</text></paragraph> <paragraph id="H9637797F8F2A445EBE80D163F600433F"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2) by striking “subsection (a)(2) of section 4 of the Dingell-Johnson Sport Fish Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/777c">16 U.S.C. 777c(a)(2)</external-xref>)” and inserting “subsections (a)(2) and (f) of section 4 of the Dingell-Johnson Sport Fish Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/777c">16 U.S.C. 777c(a)(2)</external-xref> and (f))”;</text></paragraph> <paragraph id="HDE3F9FE830364415B0F7387CBD9698"><enum>(3)</enum><text>in paragraph (4)—</text> <subparagraph id="H371D691AEFAE4F47B23C892EEF10DD2C"><enum>(A)</enum><text>in subparagraph (B) by inserting a closed parenthesis after <quote>(<external-xref legal-doc="usc" parsable-cite="usc/16/777c">16 U.S.C. 777c(a)(2)</external-xref></quote>; and</text> </subparagraph> <subparagraph id="HDA547A6B6EEA47FB90B6BE6209EC9119"><enum>(B)</enum><text>by striking subparagraphs (C) and (D) and inserting the following:</text> <quoted-block id="H1095D68231414539A2A9216CD2F93CF6" style="OLC"> <subparagraph id="HDD3DEED0534541CBBAFE3EDE82804313"><enum>(C)</enum><text>by striking <quote>$5,000,000</quote> and inserting <quote>$5,500,000</quote>; and </text></subparagraph> <subparagraph id="H5C04358C57BE488DB6DEB1FDA6CAA82C"><enum>(D)</enum><text>by inserting <quote>not less than</quote> before <quote>$2,000,000</quote>; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> <paragraph id="H1E345317C2334879BA6E96AB7C9E5123"><enum>(4)</enum><text>in paragraph (5) by striking <quote>unexpected</quote> and inserting <quote>unexpended</quote>. </text></paragraph></section> <section id="H209CFF506D76462CBC00154563003829"><enum>103.</enum><header>Expenditure of remaining balance in Boat Safety Account</header><text display-inline="no-display-inline">Section 10119 of the Sportfishing and Recreational Boating Safety Act of 2005 (<external-xref legal-doc="public-law" parsable-cite="pl/109/59">Public Law 109–59</external-xref>) is amended in the text proposed to be inserted as section 15 of the Dingell-Johnson Sport Fish Restoration Act—</text> <paragraph id="HCFBBEACCB19F4652BA874ED813053BB3"><enum>(1)</enum><text>in paragraph (2)(A)(v) of such text by striking <quote>of this Act</quote> and inserting <quote>of that section</quote>;</text></paragraph> <paragraph id="HB1C0FB46B9E54D4D93A0C88C999C74BC"><enum>(2)</enum><text>in paragraphs (1) through (4) of such text by striking <quote>subsection (b) of that section</quote> each place it appears in such text and inserting <quote>subsection (c) of that section</quote>; and</text></paragraph> <paragraph id="H8F5738A4D80E41DFBDE48BC40005B3D"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (5)—</text> <subparagraph id="HE216EFAD7B6241BBB91546AC24A17B5B"><enum>(A)</enum><text>in subparagraph (A) by striking “subsection (b)” and inserting “subsection (a)(2) of that section”; and </text></subparagraph> <subparagraph id="H86043CD10C1641BFAF28BA32E56ACE5"><enum>(B)</enum><text>in subparagraph (B) by striking “subsection (h)” and inserting “subsection (c) of that section”.</text></subparagraph></paragraph> </section> <enum>II</enum><header>Extension of Recreational Boating Funding Through the End of Fiscal Year 2005</header> <section id="H1837A30AE1484CFEA3F0885D8361E800"><enum>201.</enum><header>National outreach and communications program funding</header><text display-inline="no-display-inline">Section 4(c)(7) of the Dingell-Johnson Sport Fish Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/777c">16 U.S.C. 777c(c)(7)</external-xref>) is amended to read as follows:</text> <quoted-block id="HC0CB97D4FF704D4B9C9E5947AAC7DDA5" style="OLC"> <paragraph id="HEF2F93E7F2944E2E9088E60909CCFE90"><enum>(7)</enum><text>$10,000,000 for fiscal year 2005;</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> <section id="H34D17D62FE024D64B7CB73AFB36E7800"><enum>202.</enum><header>Clean Vessel Act funding</header><text display-inline="no-display-inline">Section 4(b)(4) of the Dingell-Johnson Sport Fish Restoration Act (<external-xref legal-doc="usc" parsable-cite="usc/16/777c">16 U.S.C. 777c(b)(4)</external-xref>) is amended—</text> <paragraph id="HA53874CD5B364601AF19066D142E00F"><enum>(1)</enum><text>in the section heading by striking <quote><header-in-text level="paragraph" style="OLC">First 303 days of fiscal</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Fiscal</header-in-text></quote>;</text></paragraph> <paragraph id="HA4379D7F6D32437AA84598A0E9A9A2E3"><enum>(2)</enum><text>by striking <quote>July 30, 2005</quote> and inserting <quote>September 30, 2005</quote>;</text></paragraph> <paragraph id="HAD9D894999994980A6A1DB07238EEBFF"><enum>(3)</enum><text>by striking <quote>$68,071,233</quote> and inserting <quote>$82,000,000</quote>;</text></paragraph> <paragraph id="HB3CD9DE7D3624619B2FBD06D2E51D3C3"><enum>(4)</enum><text>in subparagraph (A), by striking <quote>$8,301,370</quote> and inserting <quote>$10,000,000</quote>; and</text></paragraph> <paragraph id="H5AFFCF321ABA4B2F9B005EAFC5FA29E5"><enum>(5)</enum><text>in subparagraph (B), by striking <quote>$6,641,096</quote> and inserting <quote>$8,000,000</quote>.</text></paragraph></section> <section id="H647623B9B11542B4A0C0C6DE1514D895"><enum>203.</enum><header>Coast Guard expenses</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/46/13106">Section 13106(c)(1)</external-xref> of title 46, United States Code, is amended—</text> <paragraph id="H388790F10E85496200014FB5DD0773EB"><enum>(1)</enum><text>by striking <quote>$4,150,685</quote> and inserting <quote>$5,000,000</quote>; and</text></paragraph> <paragraph id="HE73B76C0F20644B8A5909D00D698F22B"><enum>(2)</enum><text>by striking <quote>$1,660,274</quote> and inserting <quote>$2,000,000</quote>.</text></paragraph></section> <enum>III</enum><header>Extension of authorization for use of funds in Boat Safety Account</header> <section id="H283A9FBB0D3648C88833C328667BF9AC" section-type="subsequent-section"><enum>301.</enum><header>Extension of authorization for use of funds in Boat Safety Account for obligations before October 1, 2005</header> <subsection id="H461753A0655940A1A0D68ECDBDC8ED89"><enum>(a)</enum><header>Boat safety account</header><text display-inline="yes-display-inline">Subsection (c) of <external-xref legal-doc="usc" parsable-cite="usc/26/9504">section 9504</external-xref> of the Internal Revenue Code of 1986 (relating to expenditures from boat safety account) is amended—</text> <paragraph id="H198533CE5CBE4415B1B0AE3B005158F8"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>August 15, 2005</quote> and inserting <quote>October 1, 2005</quote>, and </text></paragraph> <paragraph id="HA20731E00131498BAB7851F5B5E3FAE5"><enum>(2)</enum><text>by striking <quote>Surface Transportation Extension Act of 2005, Part VI</quote> and inserting <quote>Sportfishing and Recreational Boating Safety Amendments Act of 2005</quote>. </text></paragraph></subsection> <subsection id="H7491A0873ADF41E881B176B5E114A306"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the date of the enactment of this Act.</text> </subsection></section>
