<official-title>To amend the Public Health Service Act to establish a program to provide screenings and treatment for cancer to minority or underserved populations, and for other purposes.</official-title>

<section section-type="section-one" id="HD33912AADDEF494F8D14B2047D074985" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cancer Testing, Education, Screening, and Treatment Act</short-title></quote>.</text></section> 
<section id="HB9D9087F0FC145C6BE8EDA293347B150"><enum>2.</enum><header>Cancer prevention and treatment for minority or underserved populations</header><text display-inline="no-display-inline">Part D of title III of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b et seq.</external-xref>) is amended by inserting after section 330L the following:</text>

<section id="H0033B8149B3E4C2EB7CA54C60734AF54"><enum>330M.</enum><header>Cancer prevention and treatment for minority or underserved populations</header> 
<subsection id="HE3D5E2D0C0C648398C56422D5D35109E"><enum>(a)</enum><header>Grants</header><text>The Secretary may make grants to qualifying health centers and nonprofit organizations for the development, expansion, or operation of programs that, for individuals otherwise served by such centers and organizations, provide—</text> 
<paragraph id="H812355C10CEA4A94A855D4FC088920EE"><enum>(1)</enum><text>information and education on cancer prevention;</text></paragraph> 
<paragraph id="H5E6994B502984EF296BD38F36BE94C6"><enum>(2)</enum><text>screenings for cancer;</text></paragraph> 
<paragraph id="H047FBC6D9BEF4E55AE87E112C0665771"><enum>(3)</enum><text>counseling on cancer, including counseling upon a diagnosis of cancer; and</text></paragraph> 
<paragraph id="H6E6D56AED85A40A09CB82B02EA5784CF"><enum>(4)</enum><text>treatment for cancer.</text></paragraph></subsection> 
<subsection id="H090246FE4348470BA278A5C0EA98BC23"><enum>(b)</enum><header>Preference in making grants</header><text>In making grants under subsection (a), the Secretary shall give preference to applicants that—</text> 
<paragraph id="HC9CFEAE289EE4D739FB6FEEF58EF0017"><enum>(1)</enum><text>have service populations that include a significant number of low-income minority individuals who are at-risk for cancer;</text></paragraph> 
<paragraph id="HF0F53EC4AB834B108F76C4C801AC81D5"><enum>(2)</enum><text>will, through programs under subsection (a)—</text> 
<subparagraph id="HE46AAD16200E407C8D1E18FA92AAF1C7"><enum>(A)</enum><text>emphasize early detection of and comprehensive treatment for cancer;</text></subparagraph> 
<subparagraph id="HC3E2DFE1F8874E38BFDE23006C11CCCF"><enum>(B)</enum><text>provide comprehensive treatment services for cancer in its earliest stages; and</text></subparagraph> 
<subparagraph id="H4681A4D7FCF945AEBA96004011BF6C11"><enum>(C)</enum><text>carry out subparagraphs (A) and (B) for two or more types of cancer; and</text></subparagraph></paragraph> 
<paragraph id="H03B9C443BF1847C288E083B950E60029"><enum>(3)</enum><text>in order to provide treatment for cancer, have established or will establish referral arrangements with entities that provide screenings for low-income individuals.</text></paragraph></subsection> 
<subsection id="H0C79C3E4B2744A7F9E038228C5CCF66C"><enum>(c)</enum><header>Appropriate cultural context</header><text>As a condition for the receipt of a grant under subsection (a), the applicant shall agree that, in the program carried out with the grant, services will be provided in the languages most appropriate for, and with consideration for the cultural backgrounds of, the individuals for whom the services are provided.</text></subsection> 
<subsection id="H25855ACAC5A849FDAF76C4181F7944B5"><enum>(d)</enum><header>Outreach services</header><text>As a condition for the receipt of a grant under subsection (a), the applicant shall agree to provide outreach activities to inform the public of the services of the program, and to provide information on cancer.</text></subsection> 
<subsection id="HCBAB5DE946334F3B80A62DA28FFBA16"><enum>(e)</enum><header>Application for grant</header><text>A grant may be made under subsection (a) only if an application for the grant is submitted to the Secretary and the application is in such form, is made in such manner, and contains such agreements, assurances, and information as the Secretary determines to be necessary to carry out this section.</text></subsection> 
<subsection id="H7256B7C04F584CFBBB48A1501E3DD772"><enum>(f)</enum><header>Designation of types of cancer</header><text>In making a grant under subsection (a), the Secretary shall designate the type or types of cancer with respect to which the grant is being made.</text></subsection> 
<subsection id="H44EDB4A4916845A4B9992667AC1FECC" display-inline="no-display-inline"><enum>(g)</enum><header>Definition</header><text>For purposes of this section, the term <quote>qualifying health center</quote> includes community health centers, migrant health centers, health centers for the homeless, health centers for residents of public housing, and community clinics.</text> </subsection> 
<subsection id="H4A941D27A2F7421EBFD19FFF923E7B01"><enum>(h)</enum><header>Authorization of appropriations</header><text>For the purpose of carrying out this section, there are authorized to be appropriated such sums as may be necessary for each of the fiscal years 2005 through 2010.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
