<official-title>To establish minimum standards relating to a factor for life insurance eligibility and rates, and for other purposes.</official-title>

<section id="H1A0BA683701541E1AA19B6372565D77F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Life Insurance Fairness for Travelers Act of 2005</short-title></quote>.</text></section> 
<section id="HC2F5853594CE442EB53E54F6792807CE"><enum>2.</enum><header>Amendments to TRIA</header><text display-inline="no-display-inline"> The Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/297">Public Law 107–297</external-xref>; 116 Stat. 2322) is amended by adding at the end the following new title: </text>

<title id="H41A56DBE7F314D0099BC0DBC47358EC"><enum>IV</enum><header>Fairness for life insurance purchasers</header> 
<section id="H559326ABFA6D4068A7667906526DE9D9"><enum>401.</enum><header>Congressional findings and purposes</header> 
<subsection id="H8CC12FAB12264C788B9B1F5BEBA2B451"><enum>(a)</enum><header>Findings</header><text>The Congress finds that—</text> 
<paragraph id="H201F31DAC3A64A22998F83A6EDC7F0C1"><enum>(1)</enum><text>life insurance companies are increasingly using the future plans of Americans to engage in lawful foreign travel as a reason to either deny persons life insurance or to charge premiums that are not commensurate with the risk of such travel; and</text></paragraph> 
<paragraph id="HE447EBE993D144EE956670329DCAEB2D"><enum>(2)</enum><text>that such denials of insurance and disproportionate premiums may deter Americans from purchasing insurance that they and their families may need.</text></paragraph></subsection> 
<subsection id="H0585B0FFB0994A5AA46E2D72C908BB10"><enum>(b)</enum><header>Purpose</header><text>The purpose of this title is to establish uniform rules relating to the use of foreign travel as a factor in setting life insurance eligibility and rating.</text></subsection></section> 
<section id="HD489E89B40BD40C392BF4F87B5AD6E00"><enum>402.</enum><header>Prohibition against discrimination in life insurance policies based on future foreign travel plans</header> 
<subsection id="H55B899F32A3248C39E54711F024220F5"><enum>(a)</enum><header>In general</header><text>It shall be unlawful for any insurer to deny any person life insurance, or to otherwise discriminate in the issuance, cancellation, amount of coverage, or conditions of life insurance, based upon the intent of such person to engage in future lawful foreign travel.</text></subsection> 
<subsection id="H7E7D7C3EE14549398BB5A41C1B8BC38B"><enum>(b)</enum><header>Insurance rates</header><text>It shall be unlawful for any insurer to charge rates for life insurance which are excessive or unfairly discriminatory in relation to the actuarial risk associated with future lawful foreign travel of such person.</text></subsection> </section> 
<section id="H45BB9B4681494BBAB470A419C6596056"><enum>403.</enum><header>Administrative enforcement</header> 
<subsection id="HA3938CF6250244E0A4A9EFB7A8836D4B"><enum>(a)</enum><header>State enforcement</header><text>In addition to such other remedies as are provided under State law, the chief law enforcement officer of a State, or an official or agency designated by a State, may bring an action to enjoin any person who has violated or is violating this title.</text></subsection> 
<subsection id="H20500B9C29B141EFABEEBE99BA1B14D0"><enum>(b)</enum><header>Enforcement by the secretary</header><text>The Secretary shall enforce this Act in any State that the Secretary determines does not have a comparable State law or a law that the Secretary has determined is not inconsistent under section 405.</text></subsection></section> 
<section id="H0254D98C1BF24F87A1AE18B979E035CF"><enum>404.</enum><header>Effect on State laws</header> 
<subsection id="H6AC0EF0A63D94A5B83CE388D008043C8"><enum>(a)</enum><header>In general</header><text>This title does not annul, alter, or affect, or exempt any insurer subject to the provisions of this title from complying with the laws of any State with respect to the use of prospective lawful foreign travel for the purposes of underwriting or rating life insurance except to the extent that such laws are inconsistent with any provision of this title and then only to the extent of the inconsistency. The Secretary is authorized to determine whether such inconsistencies exist. The Secretary may not determine that any State law is inconsistent with any provision of this title if the Secretary determines that such law gives greater protection to the insured.</text></subsection> 
<subsection id="H52B6B2D1F10D432283DF419673C1AD7E"><enum>(b)</enum><header>State exemptions</header><text>The Secretary shall, by regulation, exempt from the requirements of this title any class of insurance transactions within any State if the Secretary determines that under the law of that State that class of transaction is subject to requirements substantially similar to those imposed under this title or that such law gives greater protection to the consumer, and that there is adequate provision for enforcement.</text></subsection></section> 
<section id="H1F60AD877C8A4F3E88BB0066BF7BE6C5"><enum>405.</enum><header>Definitions</header><text display-inline="no-display-inline">In this title, the following definitions shall apply:</text> 
<paragraph id="H9BD875FFE3104DD596400000338BB179"><enum>(1)</enum><header>Insurer</header><text>The term <term>insurer</term> means any entity, including any affiliate thereof, that is licensed or admitted to engage in the business of providing life insurance in any State.</text></paragraph> 
<paragraph id="HBFB1F225A9264426B3D0779BD6B0D89C"><enum>(2)</enum><header>Insured</header><text>The term <term>insured</term> means any natural person who purchases, or attempts to purchase, life insurance.</text></paragraph> 
<paragraph id="H41052F476F374E73B794B538D9E5FF35"><enum>(3)</enum><header>Life insurance</header> 
<subparagraph id="HBDA589726CFD4073BFB03C58BC2F4C6"><enum>(A)</enum><header>In general</header><text>The term <term>life insurance</term> means insurance for which the probabilities of the duration of human life or the rate of mortality are an element or condition of insurance.</text></subparagraph> 
<subparagraph id="HFE588AD876DE410A005105C5CCCB0810"><enum>(B)</enum><header>Included insurance</header><text>Such term includes the granting of—</text> 
<clause id="HE8D9FCC2A29A47AE9DF69C69BE71DF12"><enum>(i)</enum><text>endowment benefits;</text></clause> 
<clause id="H4214898C166E428C82EBD3AAD5A2C028"><enum>(ii)</enum><text>additional benefits in the event of death by accident or accidental means;</text></clause> 
<clause id="H1F45EB5C27244C909DD020DB29B633A5"><enum>(iii)</enum><text>disability income benefits;</text></clause> 
<clause id="H451C9166458E4631AA82A2CC1C46D1EA"><enum>(iv)</enum><text>additional disability benefits that operate to safeguard the contract from lapse or to provide a special surrender value, or special benefit in the event of total and permanent disability;</text></clause> 
<clause id="HFB8229C8357A40C18474784EE881B90"><enum>(v)</enum><text>benefits that provide payment or reimbursement for long-term home health care, or long-term care in a nursing home or other related facility;</text></clause> 
<clause id="H8A5888283EF044BB80AA1FD11BDF3B9F"><enum>(vi)</enum><text>burial insurance; and</text></clause> 
<clause id="H7C252C6B3F654C2789629BC84FCCFE1C"><enum>(vii)</enum><text>optional modes of settlement of proceeds of life insurance.</text></clause></subparagraph> 
<subparagraph id="H08F0646F4428499D95AB6BEF25A4C583"><enum>(C)</enum><header>Exclusions</header><text>Such term does not include property and casualty insurance, health insurance or workers compensation insurance.</text></subparagraph></paragraph> 
<paragraph id="H26AB5737847541FFACF7CDCDB5814441"><enum>(4)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Treasury.</text></paragraph></section> 
<section id="HA9C9275FD5C1400EB6A4B75FE7059525"><enum>406.</enum><header>Regulations</header><text display-inline="no-display-inline"> The Secretary shall issue regulations to carry out the purposes of this title.</text></section> 
<section id="HB66EBDCA569340609C96CDE0DFDAD272"><enum>407.</enum><header>Applicability</header><text display-inline="no-display-inline">This title shall apply to any policy for life insurance coverage issued, renewed, altered, or modified or canceled after the expiration of the 6-month period beginning on the date of the enactment of the Life Insurance Fairness for Travelers Act of 2005.</text></section> </title><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H7E3FE3D4E9724530B4CC3DB240EBD1AB"><enum>3.</enum><header>Timing of regulations</header> <text display-inline="no-display-inline">The Secretary of the Treasury shall issue the regulations required by section 406 of the Terrorism Risk Insurance Act of 2002, as added by section 2 of this Act, not later than the expiration of the 6-month period beginning on the date of the enactment of this Act.</text></section> 
<section id="HE1AE30B414054CE487DEE5B3F4419498"><enum>4.</enum><header>Technical amendment</header><text display-inline="no-display-inline"> The table of contents in section 1(b) of the Terrorism Risk Insurance Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/15/6701">15 U.S.C. 6701</external-xref> note) is amended by adding at the end the following new items: </text>
