<section id="HC70CA44E71F54CE799CA4EDDE08553AF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Eminent Domain Limitation Act of 2005</short-title></quote>.</text></section> 
<section id="HAB413618BC944926A48FADA18570F216"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text> 
<paragraph id="HE25BAE89D4A94FDBB060C62E1DD1E9DA"><enum>(1)</enum><text>the protection of private property is one of the three basic tenets of American government;</text></paragraph> 
<paragraph id="HB85894FDED4E4AEB93725E16BE09213E"><enum>(2)</enum><text>it is the constitutional duty of the Federal Government to defend the Constitution; </text></paragraph> 
<paragraph id="HE980206DEAB44A9095B0AF3544D8AFF3"><enum>(3)</enum><text>the United States Supreme Court’s decision of June 23, 2005 in the case of Kelo et al v. City of New London et al appears to expand the definition of public use under eminent domain to significantly threaten private property rights;</text></paragraph> 
<paragraph id="H921ADE920DEE40B7822B376F7679793E"><enum>(4)</enum><text>economic development is not a public use, for the purposes of eminent domain; and</text></paragraph> 
<paragraph id="H0D05BB68784246CDAA477EDE913F8CF3"><enum>(5)</enum><text>no property should be taken for a public use unless the need for such taking is exigent.</text></paragraph></section> 
<section id="H204DB9BD390B4EAD85BB58E3C2200F3" section-type="subsequent-section"><enum>3.</enum><header>Limitations on State use of eminent domain</header> 
<subsection id="HFD0C852846364555B2E2C3F7E7CCB4DB"><enum>(a)</enum><header>In general</header><text>No State shall be eligible to receive any Federal assistance for any economic development unless that State has in effect a law relating to takings meeting the criteria set forth in subsection (b).</text></subsection> 
<subsection id="HACACD4714EA44589B58D57C9293F06F7"><enum>(b)</enum><header>Criteria</header><text>The law relating to takings must—</text> 
<paragraph id="HC078A5F26D524B1AB4816784058EA8F4"><enum>(1)</enum><text display-inline="yes-display-inline">prohibit the use of eminent domain for economic development;</text></paragraph> 
<paragraph id="HFD6C9902D25B44A685DC4E88E5925CDD"><enum>(2)</enum><text display-inline="yes-display-inline">limit the uses for which eminent domain may be used to public health and safety, rights-of-way for public utilities and public highways and parks; and</text></paragraph> 
<paragraph id="H277C52B28ACC46E30004774C4700F1E6"><enum>(3)</enum><text>require the entity engaging in the taking to show the necessity for it and that no reasonable alternatives exist.</text></paragraph></subsection> 
<subsection id="HA45EF0DC2D40468D884607A8CF078784"><enum>(c)</enum><header>Administration</header><text>The President shall make rules to carry out this Act and determine which States are in compliance and direct appropriate agencies and entities to withhold assistance accordingly.</text></subsection> 
<subsection id="H2AC2B8A22F7A4BACAAF23FE7D9A2B15"><enum>(d)</enum><header>Effective date</header><text>This section applies with respect to fiscal year 2007 and succeeding fiscal years.</text> </subsection></section>
