<official-title>To amend the Controlled Substances Act to prohibit third-party Internet sales sites from posting offers to sell controlled substances, and for other purposes.</official-title>

<section id="HABD58D461A924FFA8DDFB489007C1E19" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Internet Drug Sales Accountability Act</short-title></quote>.</text></section> 
<section id="H7E2D114CA30A4435BA5D3338140600D4"><enum>2.</enum><header>Sales of controlled substances through third-party Internet sales sites</header><text display-inline="no-display-inline">The Controlled Substances Act (<external-xref legal-doc="usc" parsable-cite="usc/21/801">21 U.S.C. 801 et seq.</external-xref>) is amended by inserting after section 423 the following section:</text>

<section id="HBAB9BA9267B54F979B4002EC4948A044"><enum>424. </enum><header>Prohibitions regarding sales of controlled substances through third-party Internet sales sites</header> 
<subsection id="H1BFF5C6F85AC4634A9B722903F9EF246"><enum>(a)</enum><header>In general</header><text>Subject to subsection (d), it is unlawful for a person who controls a third-party Internet sales site—</text> 
<paragraph id="HBED90F712A564DE58869754D00E0FAB5"><enum>(1)</enum><text>to accept for posting on the site an offer to sell an item that the person knows is a controlled substance; or</text></paragraph> 
<paragraph id="H6964E1F3607B42F3BAC3DA515B55A64D"><enum>(2)</enum><text>to fail to promptly remove from the site an offer to sell an item when a Federal or State official notifies the person, in accordance with subsection (e), that the item is a controlled substance.</text></paragraph></subsection> 
<subsection id="H19174E5E67B641B6BEF5718048F50674"><enum>(b)</enum><header>Third-party Internet sales site</header><text display-inline="yes-display-inline">For purposes of this section, the term <quote>third-party Internet sales site</quote> means an Internet site, operated as part of a business, that permits users of the site to post an offer to sell an item directly to a consumer.</text></subsection> 
<subsection id="HA6B61125173D440D84F56EC88150553"><enum>(c)</enum><header>Advertising</header><text>For purposes of this section, the term <quote>offer</quote>, with respect to the sale of an item, includes an advertisement for the sale of the item.</text></subsection> 
<subsection id="H2E25E30D92674EB400F4278C43CB61B8"><enum>(d)</enum><header>Exclusion regarding licensed pharmacies</header><text display-inline="yes-display-inline">Subsection (a) does not have any applicability with respect to the sale of controlled substances by a licensed pharmacy, including a licensed Internet pharmacy.</text></subsection> 
<subsection id="HB23AB5B88B2348DC872F29D134F4C492"><enum>(e)</enum><header>Notice regarding controlled substance</header><text display-inline="yes-display-inline">A person who controls a third-party Internet sales site shall create a system for receipt of notice under subsection (a)(2) in accordance with this subsection if the notice is in writing and the notice—</text> 
<paragraph id="HDFC6A60BAFC14EDC8F02B2DE343F88EE"><enum>(1)</enum><text>specifies this section as the relevant statutory authority;</text></paragraph> 
<paragraph id="HFAC9B205BFDC45AFAB161574CE284F86"><enum>(2)</enum><text>specifies the name, title, physical address, and contact information of the Federal or State official or officials who sent the notice;</text></paragraph> 
<paragraph id="HA6F26C99FC19440AB5E19F9FF1B61C03"><enum>(3)</enum><text>specifies the third-party Internet site involved;</text></paragraph> 
<paragraph id="HB36EF008881748C28D892412BCC6D3D0"><enum>(4)</enum><text>specifies the offer with which the notice is concerned, including the controlled substance involved;</text></paragraph> 
<paragraph id="H10AA260916BC447F880597F38CAFE28"><enum>(5)</enum><text>specifies the location of the offer on the site through the uniform resource locator (commonly referred to as the URL) or through the Internet Protocol numbers that constitute the address of the location; and</text></paragraph> 
<paragraph id="HD243F8F180024B029EF1C14E69E7579C"><enum>(6)</enum><text display-inline="yes-display-inline">is provided to the designated agent of the third-party Internet sales site designated in accordance with <external-xref legal-doc="usc" parsable-cite="usc/17/512">section 512</external-xref> of title 17, United States Code, if the site has designated such an agent.</text></paragraph></subsection> 
<subsection id="HD4F3D352C87342CDB51400CEDBBBAA00" display-inline="no-display-inline"><enum>(f)</enum><header>Penalties</header> 
<paragraph id="H951F554554FD4EA89155F7DC5F00E192"><enum>(1)</enum><header>Criminal penalties</header> 
<subparagraph id="HD99576EDD0DB42F583A9114A8F8F7B"><enum>(A)</enum><header>First conviction</header><text>A person who violates subsection (a) shall be fined under title 18, United States Code, or imprisoned not more than one year, or both, subject to subparagraph (B).</text></subparagraph> 
<subparagraph id="HB8ACE4A5FE0247D89BDBBDB4E32C21B5"><enum>(B)</enum><header>Subsequent convictions</header><text display-inline="yes-display-inline">If a person commits a violation of subsection (a) after a single prior conviction of the person under this paragraph, the person shall for such violation be fined under title 18, United States Code, or imprisoned not more than five years, or both. If a person commits a violation of such subsection after two or more prior convictions of the person under this paragraph, the person shall for such violation be fined under such title or imprisoned not more than 10 years, or both.</text></subparagraph></paragraph> 
<paragraph id="HC100DC0E65844FF1A420CB07FCE6B2B9"><enum>(2)</enum><header>Civil penalty</header><text>A person who violates a requirement under subsection (e) is subject to a civil penalty not exceeding $1,000,000 for each such violation.</text></paragraph> </subsection> 
<subsection id="H47A2739099EB4D379FB1C6178FAB6ED4"><enum>(g)</enum><header>Protection for identifying and removing illegal offers</header> 
<paragraph id="H73E34EE48E0940FFBD8C982DB70000C5"><enum>(1)</enum><header>Monitoring and removal of offers</header><text>A third-party Internet sales site should monitor and remove in good faith any posting of an offer to sell an item that the third-party Internet sales site believes to violate Federal or State law, or that is the subject of a notice described in subsection (e).</text></paragraph> 
<paragraph id="H36CB31AF86F64D4A9B72B1BA93B16972"><enum>(2)</enum><header>Protection against liability</header><text>A third-party Internet sales site that in good faith monitors and removes any posting in accordance with paragraph (1) shall not be liable under any Federal or State law.</text></paragraph></subsection> 
<subsection id="H58C005DCBA7B48849C0660C942E0217D"><enum>(h)</enum><header>Additional definitions</header><text>For purposes of this section:</text> 
<paragraph id="HC7180666F1FD4355876488AA9822C333"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>control</quote>, with respect to an Internet site, means to have the legal right to exercise control over all or substantially all of the content of the site, without regard to the extent to which such authority actually is exercised.</text></paragraph> 
<paragraph id="H5BBFEBF18F6A44B091F448705EEF1424"><enum>(2)</enum><text>The term <term>Internet</term> means collectively the myriad of computer and telecommunications facilities, including equipment and operating software, which comprise the interconnected world-wide network of networks that employ the transmission control protocol/internet protocol, or any predecessor or successor protocols to such protocol, to communicate information of all kinds by wire or radio.</text></paragraph> 
<paragraph id="HAE2D11122CD44A02B1088C659B91C01D"><enum>(3)</enum><text display-inline="yes-display-inline">The terms <term>Internet site</term>, with respect to the Internet, mean a specific location on the Internet that is determined by Internet Protocol numbers or by any successor protocol for determining a specific location on the Internet.</text></paragraph> 
<paragraph id="H0F396069D5B04579A0E0AD23E3169F9D"><enum>(4)</enum><text>The term <quote>licensed Internet pharmacy</quote> mean an Internet site that is controlled by a licensed pharmacy and is used by such pharmacy to make sales of controlled substances or other drugs.</text></paragraph> 
<paragraph id="H1E9B9A99AF9D4AFFB27D3C1102874662"><enum>(5)</enum><text>The term <quote>licensed pharmacy</quote> means a person who is licensed as a pharmacy under applicable Federal or State law.</text></paragraph> 
<paragraph id="H3C2C51AD81BF4352A3A9E3BE92F315F2"><enum>(6)</enum><text>The term <quote>remove</quote>, with respect to an offer posted on a third-party Internet sales site, includes disabling public access to the offer.</text></paragraph> </subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></section>
