<official-title>To amend Federal crime grant programs relating to domestic violence to encourage States and localities to implement gun confiscation policies, reform stalking laws, create integrated domestic violence courts, and hire additional personnel for entering protection orders, and for other purposes.</official-title>

<section id="HA8B0483AE4F84551AB88EAA9D2AF50D0" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Domestic Violence Victim Protection Act</short-title></quote>.</text> </section> 
<section id="HB17194F8107948FC903F2DA60397911C"><enum>2.</enum><header>Encouragement of gun confiscation policies in domestic violence cases</header><text display-inline="no-display-inline">Section 2101(c) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796hh">42 U.S.C. 3796hh(c)</external-xref>) is amended—</text> 
<paragraph id="H0A46FFBDDA6144FBA3253EDC2556E6B9"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (3);</text></paragraph> 
<paragraph id="HD5BAD471D33B4644857F26FDC570DCAF"><enum>(2)</enum><text>by striking the period at the end of paragraph (4) and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H1CA3D4058F0548DAB141500920A555A2"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H8588E959C14B4285A5385B0045994D78"><enum>(5)</enum><text>certify that their laws or official policies—</text> 
<subparagraph id="HCFCB3DFA284549388FE7911BB6B39BCA"><enum>(A)</enum><text>provide that a law enforcement officer who has probable cause that an act of domestic violence has been committed may—</text> 
<clause id="HCFB9EEC70B92422DADE492973BD0663"><enum>(i)</enum><text>question persons present to determine whether there are weapons on the premises; and</text></clause> 
<clause id="HD3CACB56AFB64BA4A45486D339DC31A4"><enum>(ii)</enum><text>upon observing or learning that a weapon is present on the premises, seize any weapon that the officer reasonably believes would expose the victim or any other household member to a risk of serious bodily injury;</text></clause></subparagraph> 
<subparagraph id="H4891FDE69D2247ABA3890000EE6BE42E"><enum>(B)</enum><text>provide that a court, as part of the relief provided in a protection order—</text> 
<clause id="HB7C3D115533A444C8BBF69EECAB59F"><enum>(i)</enum><text>may order that the defendant is prohibited from possessing any firearm or other weapon; and</text></clause> 
<clause id="H7E707A304F014919B83C5891CD2396C"><enum>(ii)</enum><text>may order that any location may be searched for such a weapon, and such weapon may be seized, if the court has reasonable cause to believe that a firearm or other weapon of the defendant is at that location.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H879400DFAD784CD9A78C08BBB2578829"><enum>3.</enum><header>Elimination of specific intent to cause fear from the elements of the offense of stalking</header><text display-inline="no-display-inline">Section 40602 of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/14031">42 U.S.C. 14031</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H21F47DA667834C2BB5C62F58A3377F99"><enum>(c)</enum><header>Elements of stalking offense</header><text>To be eligible to receive a grant under subsection (a), a State or unit of local government shall, in addition to the requirements of subsection (b), certify that its laws or official policies relating to the offense of stalking require, as elements of the offense, not more than the following: that the defendant has on more than one occasion harassed or threatened the victim.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HD31362D5A99B45938794004F982269FF"><enum>4.</enum><header>Encouragement of integrated domestic violence courts</header><text display-inline="no-display-inline">Section 40412 of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13992">42 U.S.C. 13992</external-xref>) is amended—</text> 
<paragraph id="H92C87606E79E469EBACAE7C30000F406"><enum>(1)</enum><text>by inserting <quote>(a) <header-in-text level="subsection" style="OLC">In General.—</header-in-text></quote> at the beginning; and</text></paragraph> 
<paragraph id="H7D032A6AC3604A4FB40369006B8C57D3"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="H05158DF8E0E040ADB15094E5ECFB32A8"><enum>(b)</enum><header>Integrated domestic violence courts</header><text>Training provided pursuant to grants made under this subtitle may include training in the context of establishing and maintaining courts that provide, wherever practicable, for domestic matters (whether civil or criminal) that arise out of the same family or domestic circumstance to be assigned to a judicial unit for the processing of those matters on a coordinated basis.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H7D337A5A39BB4D1DABD9BF71B5792BF8"><enum>5.</enum><header>Hiring and maintaining of additional personnel for entering protection orders</header> 
<subsection id="HEBB5A2A0AD41411CAE36F800BF626F72"><enum>(a)</enum><header>Grants to encourage arrest policies</header><text>Section 2101(b) of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796hh">42 U.S.C. 3796hh(b)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="HAA76632618314F38009700670742DCA"><enum>(9)</enum><text>To hire and maintain additional personnel for entering information relating to protection orders.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H912067F51E2B437BB7A5059DE2D4A1A8"><enum>(b)</enum><header>Grants relating to stalking and domestic violence</header><text>Section 40602 of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/14031">42 U.S.C. 14031</external-xref>) is amended by striking the period at the end of subsection (a) and inserting the following: <quote>, which may include hiring and maintaining additional personnel for entering such data.</quote>.</text></subsection></section>
