<official-title>To amend the Internal Revenue Code of 1986 to exclude from gross income employer contributions to college tuition plans and education savings accounts.</official-title>

<section section-type="section-one" id="HE31CEF88E2B241D69C81E5EE6F8D3CCE" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Education Savings Act of 2005</short-title></quote>.</text></section> 
<section id="H8859B73379C542F68EF7764C1923E383"><enum>2.</enum><header>Exclusion from gross income for contributions to education savings entities</header> 
<subsection id="HFEC6FDC70F83405799955CDF24E8B170"><enum>(a)</enum><header>In general</header><text>Part III of subchapter B of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986 (relating to items specifically excluded from gross income) is amended by inserting after section 127 the following new section:</text>

<section id="H7E615865B52B4A8C9D90179100979B48"><enum>127A.</enum><header>Contributions to education savings entities</header> 
<subsection id="HCEB3716072034FD1AE003DE2A5819F01"><enum>(a)</enum><header>In general</header><text>Gross income of an employee does not include amounts paid by the employer as contributions to an education savings entity held by the employee or spouse of the employee if the contributions are made pursuant to a program which is described in subsection (b).</text></subsection> 
<subsection id="HE571C8FCE97D4A4500E1D45E73A28AA"><enum>(b)</enum><header>Educational assistance program</header><text>For purposes of this section, an educational assistance program is a separate written plan of an employer for the benefit of such employer’s employees—</text> 
<paragraph id="HF550DC3086FF4EB1874541B19280B407"><enum>(1)</enum><text>under which the employer makes contributions to education savings entities of such employees or spouses of employees, and</text></paragraph> 
<paragraph id="H0DB1BED82DF94F7681370069EAB9AB3E"><enum>(2)</enum><text>which meets requirements similar to the requirements of paragraphs (2), (3), (4), (5), and (6) of section 127(b).</text></paragraph></subsection> 
<subsection id="H1286F73DB5DE40D79D21E583E26EBF2C"><enum>(c)</enum><header>Definitions and special rules</header><text>For purposes of this section—</text> 
<paragraph id="HA7F272B0D6114032B88E282F6942F0BC"><enum>(1)</enum><header>Education savings entity</header><text>The term <term>education savings entity</term> means—</text> 
<subparagraph id="H8E6C5E2123CC436BB036DE7008049600"><enum>(A)</enum><text>a qualified tuition program (as defined in section 529(b)), and</text></subparagraph> 
<subparagraph id="H0919F1A227294F228CFC7CFA9CD569E3"><enum>(B)</enum><text>a Coverdell education savings account (as defined in section 530(b)).</text></subparagraph></paragraph> 
<paragraph id="H4EE9D4B8014C4866B4F09E22002C91E4"><enum>(2)</enum><header>Employee and employer</header><text>The terms <term>employee</term> and <term>employer</term> shall have the meaning given such terms by paragraphs (2) and (3), respectively, of section 127(c).</text></paragraph> 
<paragraph id="H123A24291440484EA2E9D887EE0261F0"><enum>(3)</enum><header>Applicable rules</header><text>Rules similar to the rules of paragraphs (4), (5), (6), and (7) of section 127(c) shall apply.</text></paragraph></subsection> 
<subsection id="H7C109DAF3AE2487ABA9FA525071090A7"><enum>(d)</enum><header>Cross reference</header><text>For reporting and recordkeeping requirements, see section 6039D.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H22B87F916654437CB48C6C42172FCD2C"><enum>(b)</enum><header>Exclusion from employment taxes</header> 
<paragraph id="H61A554BF29C140A6B683B112708CC274"><enum>(1)</enum><text>Sections 3121(a)(18), 3306(b)(13), and 3401(a)(18) of such Code are each amended by inserting <quote>127A,</quote> after <quote>127,</quote> each place it appears.</text></paragraph> 
<paragraph id="HAE6C74BC50764AF2A226BDEBEED42769"><enum>(2)</enum><text>Section 3231(e)(6) of such Code is amended by striking <quote>section 127</quote> and inserting <quote>section 127 or 127A</quote>.</text></paragraph></subsection> 
<subsection id="H6366B72977E64519835B2CB750B43439"><enum>(c)</enum><header>Reporting and recordkeeping requirements</header><text>Section 6039D(d)(1) of such Code is amended by inserting <quote>127A,</quote> after <quote>127,</quote>.</text></subsection> 
<subsection id="HF543D76419114FC8B007FE4ED0B9299C"><enum>(d)</enum><header>Other conforming amendments</header> 
<paragraph id="HCA83F644792D4DCC8C29F09FA9DC7241"><enum>(1)</enum><text>Section 51A(b)(5)(B) of such Code is amended by striking <quote>or</quote> at the end of clause (iii), by redesignating clause (iv) as clause (v), and by inserting after clause (iii) the following new clause:</text>

<clause id="H4AB7725277A74F799653D163210715B6"><enum>(iv)</enum><text>section 127A (relating to contributions to education savings entities), but only to the extent paid or incurred to a person not related to the employer, or</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HAB5F880632F64C76BBB747313452BF00"><enum>(2)</enum><text>Sections 125(f), 414(n)(3)(C), and 414(t)(2) of such Code are each amended by inserting <quote>127A,</quote> after <quote>127,</quote> each place it appears.</text></paragraph> 
<paragraph id="H6A1F55E7FE1D449A9F8D63CCD2F5FF37"><enum>(3)</enum><text>Section 132(j)(8) of such Code is amended by striking <quote>section 127</quote> and inserting <quote>section 127 or 127A</quote>.</text></paragraph> 
<paragraph id="HB1699E8D556D490D86B751C44D2EC21"><enum>(4)</enum><text>Section 1397(a)(2)(A) of such Code is amended by inserting at the end the following new clause:</text>

<clause id="H1184CE5915434C13904C5319BB002F70"><enum>(iii)</enum><text>Any amount paid or incurred by an employer which is excludable from the gross income of an employee under section 127A, but only to the extent paid or incurred to a person not related to the employer.</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H608D26E9219247F0B061000009151BCD"><enum>(5)</enum><text>Section 209(15) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/409">42 U.S.C. 409(15)</external-xref>) is amended by striking <quote>or 129</quote> and inserting <quote>, 127A, or 129</quote>.</text></paragraph></subsection> 
<subsection id="H65D92D65D2EC4022B216F2E7C69EA16F"><enum>(e)</enum><header>Clerical amendment</header><text>The table of sections for part III of subchapter B of chapter 1 of such Code is amended by inserting after the item relating to section 127 the following new item:</text>

<subsection id="H4EEEA635E9994EFE9E2C281BCF6D12B4"><enum>(f)</enum><header>Effective date</header><text>The amendments made by this section shall apply to remuneration paid after December 31, 2005.</text></subsection></section>
