<official-title>To promote the improvement of information on, and protections against, child sexual abuse.</official-title>

<section section-type="section-one" id="HE377C230CE724504A3784FDEF3237629" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Child Abuse Reform and Enforcement Act of 2005</short-title></quote> or <quote><short-title>CARE Act of 2005</short-title></quote>.</text></section> 
<title id="H6C036DC99195467BBF00B7A355BFEA7"><enum>I</enum><header>Withholding and redistribution of certain State child protection funds</header> 
<section id="HB2796630F4374E6DA9F54943F43F3F15"><enum>101.</enum><header>Withholding and redistribution of State funds</header> 
<subsection id="H28B6F6DD18E540789E86009C1683EF05"><enum>(a)</enum><header>Child abuse prevention and treatment Act</header><text>Beginning 1 year after the date of the enactment of this Act, the Secretary of Health and Human Services shall reduce, by 25 percent, the allocation to a State for a fiscal year under title I of the <act-name parsable-cite="CAPTA">Child Abuse Prevention and Treatment Act</act-name> that does not meet each of the requirements of title II of this Act.</text></subsection> 
<subsection id="HE2E41C39F7384539A24BA5D0B961DEE9"><enum>(b)</enum><header>National Child Protection Act of 1993</header><text>Beginning 1 year after the date of the enactment of this Act, the Attorney General shall reduce, by 25 percent, amounts under a grant under section 4(b) of the National Child Protection Act of 1993 to a State for a fiscal year that does not meet each of the requirements of title II of this Act.</text></subsection> 
<subsection id="H394038C8FE5D47AAA36C7306C5C1CBB6"><enum>(c)</enum><header>Redistribution of funds</header><text>The Attorney General shall, using funds withheld under this section and amounts appropriated pursuant to the authorization of appropriations under section 102, provide grants to States that meet the requirements of title II of this Act. A grant made under this subsection shall be used—</text> 
<paragraph id="H4CB358C63529403CA7A414A479DF2385"><enum>(1)</enum><text>for the computerization of data and criminal history files for purposes of title II of this Act;</text></paragraph> 
<paragraph id="HDFDDE425642E4619847685E117D67807"><enum>(2)</enum><text>for the improvement of existing data and computerized criminal history files for purposes of title II of this Act; and</text></paragraph> 
<paragraph id="HE2C6B2DEAA4F47ADB74467DE164444EA"><enum>(3)</enum><text>to assist the State in the transmittal of data and criminal records to, or the indexing of data and criminal history records in, the national data and criminal history systems for purposes of title II of this Act.</text></paragraph></subsection></section> 
<section id="H638AF90A8EB24109995FC7A1F96924B0"><enum>102.</enum><header>Authorization of appropriations for additional funding grants for the improvement of child abuse crime information</header><text display-inline="no-display-inline">There are authorized to be appropriated for additional grants under section 101(c) $50,000,000 for each of the fiscal years 2006 through 2009.</text></section></title> 
<title id="H004CA7A624A545ABAA36FF57C504541D"><enum>II</enum><header>Child sexual abuse protection and sentencing reform</header> 
<section id="HCBBFE043262142D18E299018CF89FFBF"><enum>201.</enum><header>Requirement to equalize sentencing requirements for intrafamilial and extrafamilial child sexual abuse</header> 
<subsection id="H4F9770D610364771AF14E329B2693BD2"><enum>(a)</enum><header>State study of laws regarding intrafamilial and extrafamilial child sexual abuse</header><text>A State meets the requirements of this subsection if, not later than 1 year after the date of enactment of this Act, the State—</text> 
<paragraph id="H2E7F8E5D50E343C8BE7B6900C3F16E86"><enum>(1)</enum><text>has studied the laws in the State that apply to intrafamilial and extrafamilial sexual abuse of children; and</text></paragraph> 
<paragraph id="HD876E77400D54D3394E752567E44E8E0"><enum>(2)</enum><text>has examined, at a minimum—</text> 
<subparagraph id="H8A63B7966C3E4963B2FE3F5738B9B5D0"><enum>(A)</enum><text>issues concerning differences in laws applicable to intrafamilial and extrafamilial child sexual abuse;</text></subparagraph> 
<subparagraph id="H2B564EDDA26049718E245E2C96E57C80"><enum>(B)</enum><text>issues concerning disparities in charging and sentencing perpetrators of child sexual abuse, resulting from differences in applicable laws; and</text></subparagraph> 
<subparagraph id="H5072D9E5D1D841ED8FE663D971454E45"><enum>(C)</enum><text>issues concerning legislative actions necessary to equalize charging and sentencing of perpetrators of sexual abuse without regard to familial relationship of perpetrator to child victim.</text></subparagraph></paragraph></subsection> 
<subsection id="HE467D533277441BF00A5D1A313182BE"><enum>(b)</enum><header>Report to the Attorney General</header><text>A State meets the requirements of this subsection if the State submits to the Attorney General a report that contains the results of the study conducted under subsection (a).</text></subsection> 
<subsection id="HCD4C0E04E51C47C9973E9BC45E67A7B8"><enum>(c)</enum><header>Legislative actions to equalize sentencing requirements</header> 
<paragraph id="HCA9097B18A454804967B03F87C8D0073"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), a State meets the requirements of this subsection if, not later than 1 year after the date of enactment of this Act, the State has implemented legislative actions necessary to equalize charging and sentencing of perpetrators of sexual abuse without regard to familial relationship of perpetrator to child victim.</text></paragraph> 
<paragraph id="H3BA40A7B90F345ACA343050300F742F7"><enum>(2)</enum><header>Exception</header><text>The Attorney General may provide for an extension of the 1-year time requirement in paragraph (1) for any State if the Attorney General determines that State legislation (other than legislation appropriating funds) is required to meet the additional requirements imposed by this Act.</text></paragraph></subsection></section> 
<section id="H10C2AC191884428E8CD3060851C04BD2"><enum>202.</enum><header>Requirement to gather information on sexual abuse of children</header><text display-inline="no-display-inline">A State meets the requirements of this section if the State—</text> 
<paragraph id="H0EF3FA37D091404C98DA4C6FA002508D"><enum>(1)</enum><text>compiles and analyzes data relating to intrafamilial and extrafamilial sexual abuse of children;</text></paragraph> 
<paragraph id="H7634D19DCC034341A28B7829700043B7"><enum>(2)</enum><text>promotes regulations requiring the gathering of such data by State courts and State agencies for compilation and analysis purposes;</text></paragraph> 
<paragraph id="H49A1FE5CE375453998D1C09EA5FA367"><enum>(3)</enum><text>provides, on an annual basis, to the Attorney General, the Secretary of Health and Human Services, and the Bureau of Justice Statistics a report containing the data referred to in paragraph (1) and a description of the regulations referred to in paragraph (2).</text></paragraph></section></title>
