<section section-type="section-one" id="H86A2E4D9A1B64881A6E1EB1C749C1715" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Food Freshness Disclosure Act of 2005</short-title></quote>. </text></section> 
<section id="H62A99B53266A4C52A719158B953C2F65"><enum>2.</enum><header>Federal food, drug, and cosmetic act; requirement of inclusion of freshness date on food labeling</header> 
<subsection id="H497C9E79E0314BE2B4F84BFA07BC1F"><enum>(a)</enum><header>In general</header><text>Section 403 of the <act-name parsable-cite="FFDCA">Federal Food, Drug, and Cosmetic Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/343">21 U.S.C. 343</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block act-name="Federal Food, Drug, and Cosmetic Act" id="H639523EAF65046A8004CC86FBF5E0266"> 
<subsection id="HCDD76AB573834C9EAD85001EBB6BB64E"><enum>(y)</enum><text>Except as provided in subparagraph (6), unless its label bears information on freshness in accordance with the following:</text> 
<paragraph id="HA17DA20A038D4A48A277DD227F41C000"><enum>(1)</enum><text>The label of the food states a date upon which the food will no longer be fresh (in this paragraph referred to as the <quote>freshness date</quote>). The freshness date is a date selected by the manufacturer, packer, or distributor of the food on the basis of tests and other information showing that the food, until that date, under the conditions of handling, storage, preparation, and use prescribed by label directions, will—</text> 
<subparagraph id="HE62965ADBAA745099F03B01051239CD1"><enum>(A)</enum><text>when consumed contain not less than the quantity of each nutrient set forth in the food label in accordance with paragraph (q) and with <external-xref legal-doc="regulation" parsable-cite="cfr/21/101.9">section 101.9(g)(4)</external-xref> of title 21, Code of Federal Regulations; and</text></subparagraph> 
<subparagraph id="H9C1A1412A8964A7CBB4457D2003DDF00"><enum>(B)</enum><text>otherwise be not adulterated and of an acceptable quality.</text></subparagraph></paragraph> 
<paragraph id="H354C295A9DFF4E280047A0CC161CED35"><enum>(2)</enum><text>The freshness date is stated in terms of the day and month if the product will not be fresh after three months on the shelf or in terms of the month and year if the product will be fresh for more than three months on the shelf. The day, month, and year are declared in uncoded numerical sequence, except that the month may be indicated by letters.</text></paragraph> 
<paragraph id="H2175616C5CE947899875D209A2187B79"><enum>(3)</enum><text>The phrase <quote>best if used by</quote> precedes the freshness date.</text></paragraph> 
<paragraph id="HDF3B7394877A42448791747B86BE3172"><enum>(4)</enum><text>On the label, the freshness date is—</text> 
<subparagraph id="HD304DF673C454E1C9D01299800639198"><enum>(A)</enum><text>in single easy-to-read type style using upper and lower case letters in the standard form;</text></subparagraph> 
<subparagraph id="H2C801C1DA27C4749AF941679A8B81FE4"><enum>(B)</enum><text>in a type size no smaller than 8 point; and</text></subparagraph> 
<subparagraph id="H36030B32C2974B0EBC31ADA39CEE8FCA"><enum>(C)</enum><text>located in a conspicuous place on the package of the product.</text></subparagraph></paragraph> 
<paragraph id="H66C38D3D599B4045BE8C3D2D93903E3C"><enum>(5)</enum><text>The freshness date is on the containers of any food sent to the seller of such food to consumers.</text></paragraph> 
<paragraph id="HA077AE282FA84AACBB4500B6FCA322CF"><enum>(6)</enum><text>The requirements of subparagraphs (1) through (4) shall not apply to any food that, under <external-xref legal-doc="regulation" parsable-cite="cfr/21/101.9">section 101.9(j)</external-xref> of title 21, Code of Federal Regulations, is exempt from the nutrition labeling requirements of section 101.9 of such title.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H9F639095C59647EF99AC00A6B141253"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) takes effect upon the expiration of the 180-day period beginning on the date of the enactment of this Act.</text></subsection></section>
