<official-title>To provide that no Federal funds may be expended for the payment or reimbursement of drugs when prescribed for the treatment of erectile or sexual dysfunction.</official-title>

<section id="HAA7EA0B498A64C86A7BEFF69F0593362" section-type="section-one"><enum>1.</enum><header>No Federal funds for drugs when prescribed for the treatment of erectile or sexual dysfunction</header> 
<subsection id="H704C7E494C1042C7BB3EFD9BEC6CA96"><enum>(a)</enum><header>Restriction</header> 
<paragraph id="H1919277E143B47C9871B5DD030D0D8F1"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, no Federal funds may be expended for the payment or reimbursement, including payment or reimbursement under any Federal health care program, including the programs described in paragraph (2), of a drug when prescribed for the treatment of erectile or sexual dysfunction.</text></paragraph> 
<paragraph id="HB5BCFDCB437741809C28CB1FFD900273"><enum>(2)</enum><header>Programs described</header> 
<subparagraph id="H2F30946F2A564101995FF216E3CC9543"><enum>(A)</enum><header>In general</header><text>The programs described in this paragraph are the following:</text> 
<clause id="H407412AB9BD7469182D8D657E0A3A777"><enum>(i)</enum><text>The Medicare program under title XVIII of the Social Security Act.</text></clause> 
<clause id="H1F48682F347647C884845DA23E3ED3CF"><enum>(ii)</enum><text>The Medicaid program under title XIX of the Social Security Act.</text></clause> 
<clause id="H35D22FA709FA4DC5ACA2722F995EE1C4"><enum>(iii)</enum><text>The social services block grant program under title XX of the Social Security Act.</text></clause> 
<clause id="H9545A33B4CE640EF81FADD9D2DF36767"><enum>(iv)</enum><text>The maternal and child health block grant program under title V of the Social Security Act.</text></clause> 
<clause id="H7FB62D1E7AA24D6B913CD41CE4934F13"><enum>(v)</enum><text>The Public Health Service Act.</text></clause> 
<clause id="H6E729E4B504F43E0B44B24BC347C606D"><enum>(vi)</enum><text display-inline="yes-display-inline">Health related programs administered by the Indian Health Service and programs under the Indian Health care Improvement Act.</text></clause> 
<clause id="HBFF9540CA6924457ABB073CBD7CBFC74"><enum>(vii)</enum><text>The Federal employees health benefits program (FEHBP) under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/89">chapter 89</external-xref> of title 5, United States Code.</text></clause> 
<clause id="H75C6C758E65B4EE896B588561F78D9CD"><enum>(viii)</enum><text>The military health programs under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/55">chapter 55</external-xref> of title 10, United States Code.</text></clause> 
<clause id="HB4476632E54C4D91836694D2949987B7"><enum>(ix)</enum><text>Medical care furnished by the Secretary of Veterans Affairs under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/17">chapter 17</external-xref> of title 38, United States Code.</text></clause> 
<clause id="H973D82A82A0048B3B060AA19BA2D0581"><enum>(x)</enum><text>Health services for Peace Corps volunteers under section 5(e) of the Peace Corps Act (<external-xref legal-doc="usc" parsable-cite="usc/22/2504">22 U.S.C. 2504(e)</external-xref>).</text></clause> 
<clause id="H1C83B06FE52744DC97EFE12015B35DCE"><enum>(xi)</enum><text>Medical services for Federal prisoners under <external-xref legal-doc="usc" parsable-cite="usc/18/4005">section 4005(a)</external-xref> of title 18, United States Code.</text></clause></subparagraph> 
<subparagraph id="H1A51089BBB9946AEAA9F00B84FC48C20"><enum>(B)</enum><header>Federal health care program defined</header><text display-inline="yes-display-inline">For purposes of this section, the term <term>Federal health care program</term> has the meaning given such term in section 1128B(f)(1) of the Social Security Act, 42 U.S.C. 1320a–7b(f)(1), disregarding the reference in such section to <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/89">chapter 89</external-xref> of title 5, United States Code.</text></subparagraph> 
<subparagraph id="HEBD491CB41CC46058B7B202649E3A2B7"><enum>(C)</enum><header>Nonexclusive list</header><text>Nothing in this paragraph shall be construed as limiting the application of paragraph (1) to the programs described in subparagraph (A).</text></subparagraph></paragraph></subsection> 
<subsection id="H306B64D9FC9A4206B06FE5CEF4423292"><enum>(b)</enum><header>Conforming amendments for specific programs</header> 
<paragraph id="H04A598E9A7FE47C78E5B405703369626"><enum>(1)</enum><header>Medicare and medicaid programs</header> 
<subparagraph id="H3F818AA1FC414CDB8D985870BA81FD6" display-inline="yes-display-inline"><enum>(A)</enum><text display-inline="yes-display-inline">Section 1927(d)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396r-8">42 U.S.C. 1396r–8(d)(2)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H0E6D47FDF72A4D96AEC55E6819BAF34"><enum>(K)</enum><text>Agents when prescribed for the treatment of erectile or sexual dysfunction.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="HADAED758A08A4D4EB653ED7BAED9C00" indent="up1"><enum>(B)</enum><header>Excluding federal funding for medicaid coverage for drugs when prescribed for the treatment of erectile or sexual dysfunction</header><text display-inline="yes-display-inline">Section 1903(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(i)</external-xref>) is amended by inserting after paragraph (8) the following new paragraph:</text>

<paragraph id="HB3D7485CA5A24CC5A1B3FCD04C65880"><enum>(9)</enum><text>with respect to covered outpatient drugs when prescribed for the treatment of erectile or sexual dysfunction; or</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H10E4CBC4F8C5437C9561ACECF752A18E"><enum>(2)</enum><header>FEHBP</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/8904">Section 8904</external-xref> of title 5, United States Code, is amended by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" id="H1D26F97C8DE2453083FB07618D9E8772" display-inline="no-display-inline"> 
<subsection id="HC22B4A1F80654809AE923E431EFFF2EA"><enum>(c)</enum><text>A plan may not provide benefits for drugs when prescribed for the treatment of erectile or sexual dysfunction.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H621BC2FE1C92474C94025E2D544D02F9"><enum>(3)</enum><header>Military health program</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/1074g">Section 1074g</external-xref> of title 10, United States Code, is amended—</text> 
<subparagraph id="H21C65278A0104F92970832E13572DB6"><enum>(A)</enum><text>by redesignating subsection (g) as subsection (h); and</text></subparagraph> 
<subparagraph id="HDA4231EA630D40EC89C168CFA8BF4EAA"><enum>(B)</enum><text>by inserting after subsection (f) the following new subsection:</text>

<subsection id="H15FEC52544CC4F4D9DF0191D9EC4C9D3"><enum>(g)</enum><text>Notwithstanding any other provision of this section, the pharmacy benefit program shall not include any benefits for drugs when prescribed for the treatment of erectile or sexual dysfunction.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H26F31F7D6DBA4CCD8233E0D1335EA8E5"><enum>(4)</enum><header>Veterans’ health</header><text><external-xref legal-doc="usc" parsable-cite="usc/38/1707">Section 1707</external-xref> of title 38, United States Code, is amended by adding at the end the following new subsection:</text>

<subsection id="H9BAF08D064C249BE97C71EAC83FD2D36"><enum>(c)</enum><text>Funds appropriated to carry out this chapter may not be used for the provision of drugs when prescribed for the treatment of erectile or sexual dysfunction.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H18E2456EC18D469B92C981B799896CE5"><enum>(5)</enum><header>IHS programs</header><text>Section 225 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1621x">25 U.S.C. 1621x</external-xref>) is amended—</text> 
<subparagraph id="H10EC7D589D8B4A12AE00E24B2CB97B30"><enum>(A)</enum><text>by inserting <quote>(a)</quote> before <quote>Amounts appropriated</quote>; and</text></subparagraph> 
<subparagraph id="HE8462F6043D24396849303B5269581DE"><enum>(B)</enum><text>by adding at the end the following new subsection:</text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="HCF17E8E4B14E49DAB13C3C2FC7A8D31B"> 
<subsection id="HC90A4BA4D5424D268B5CA6EF8900C7F1"><enum>(b)</enum><text>Funds appropriated to carry out this title may not be used for the provision of drugs when prescribed for the treatment of erectile or sexual dysfunction.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </subparagraph></paragraph></subsection> 
<subsection id="HFEF0505A6ADF456A85EECDEA56D1DFA"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">This section shall apply to drugs dispensed after the date of enactment of this Act.</text> </subsection></section>
