<official-title>To require the Food and Drug Administration to carry out certain activities with respect to food choking hazards to children, including a program to provide education to the public.</official-title>

<section id="HA2AEEE9A2B7C411E993600A3E923C869" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Food Choking Prevention Act</short-title></quote>.</text></section> 
<section id="HCA15686E21224C69983831288817E88D"><enum>2.</enum><header>Food choking hazards in children</header> 
<subsection id="H7C831473263749F38122F68E3D24636D"><enum>(a)</enum><header>Education</header> 
<paragraph id="HD3F9E4D85987425DB21D08D800AF2F83"><enum>(1)</enum><header>In general</header><text>The Secretary of Health and Human Services, acting through the Commissioner of Food and Drugs (referred to in this section as the <quote>Commissioner</quote>), shall carry out a program to provide education to the public on food choking hazards to children, including education on preventing such hazards and performing life-saving procedures in the event of food choking.</text></paragraph> 
<paragraph id="H2F9D1584CF8546A396D82FD92247D571"><enum>(2)</enum><header>Certain requirements</header><text>The following applies with respect to the the program under paragraph (1):</text> 
<subparagraph id="H4A599F115EEF4228B983769422CA3608"><enum>(A)</enum><text>The Commissioner shall give priority to providing education to parents of children who are 14 years of age or younger, and to such children directly.</text></subparagraph> 
<subparagraph id="H5791CA6E823B4289A9DEC35EB5B64FFE"><enum>(B)</enum><text display-inline="yes-display-inline">The means through which such education is provided shall include the preparation of education materials to be distributed by pediatricians, hospitals, day care centers, and schools.</text></subparagraph> 
<subparagraph id="H8B2B893638B9454290DF2CA5A0A7C419"><enum>(C)</enum><text>Each year the Commissioner shall designate a particular week during which the activities of the program will be intensified to provide for the broad dissemination to the public of the information with which the program is concerned (referred to in this subsection as <quote>prevention week</quote>). The Commissioner shall provide a name for the prevention week, and shall make references to such name in promoting the week.</text></subparagraph></paragraph></subsection> 
<subsection id="H3DFDF908F4784E8BAAF2E9E741ADFE58"><enum>(b)</enum><header>Classes during prevention week</header><text display-inline="yes-display-inline">The Commissioner may make awards of grants or contracts for the purpose of holding, during the prevention week under subsection (a)(2)(C), classes for the public on preventing food choking hazards and performing life-saving procedures in the event of food choking, including instruction on performing the technique known as cardiopulmonary resuscitation.</text></subsection> 
<subsection id="H1ECFF0049D224148BBD273B35F5A3C3"><enum>(c)</enum><header>Study by national academy of sciences</header> 
<paragraph id="HDF8DF4820E4A4B588FF5C1E1B6671BE0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Commissioner shall request the National Academy of Sciences to enter into an agreement to conduct, with respect to food choking hazards to children, a comprehensive study—</text> 
<subparagraph id="H80BBBB63D4484D71BBB7D6C3B7206DDA"><enum>(A)</enum><text>to assess the accuracy and adequacy of current data and data collection efforts;</text></subparagraph> 
<subparagraph id="H667B3E40D83644B88FB2733DA29D7E82"><enum>(B)</enum><text>to document the number and nature of incidents of food choking-related deaths and injuries by age group annually;</text></subparagraph> 
<subparagraph id="H06A65341D5584415B4AA76002D1D9391"><enum>(C)</enum><text>to consider the nature and causes of childhood food choking incidents;</text></subparagraph> 
<subparagraph id="HB7CBE9B5FC3C49088290BE7D0232877D"><enum>(D)</enum><text>to establish criteria for determining whether a food poses a significant choking hazard to children; and</text></subparagraph> 
<subparagraph id="H935C1A81802844DD8894CB1B00D2A31B"><enum>(E)</enum><text>to assess the opportunities and key impediments to congressional, regulatory, and private sector initiatives to reduce the number of child deaths and injuries due to food choking.</text></subparagraph></paragraph> 
<paragraph id="H0A4B780B78F64A6EACF498E12FEC8F1"><enum>(2)</enum><header>Committee of leading experts</header><text>The Commissioner shall ensure that the agreement under paragraph (1) provides that, in conducting the study under such paragraph, the National Academy of Sciences will convene a committee of leading experts and key stakeholders in the medical, consumer protection, and business communities.</text></paragraph> 
<paragraph id="H0FF121D08ED844A5A8DA8DA235F067CC"><enum>(3)</enum><header>Report</header><text display-inline="yes-display-inline">The Commissioner shall ensure that the agreement under paragraph (1) provides that, not later than one year after the date on which the agreement is entered into, the study under such paragraph will be completed and a report providing the findings of the study will be submitted to the Commissioner and to the appropriate committees of the Congress.</text></paragraph> 
<paragraph id="H356E889BAF8641C682617640CEA07077"><enum>(4)</enum><header>Authorization of appropriations</header><text>For the purpose of carrying out this subsection, there is authorized to be appropriated $800,000.</text></paragraph></subsection> 
<subsection id="HEFFA33F519904C90BDBC6E7BBE81764"><enum>(d)</enum><header>Report on system for data collection on deaths</header><text display-inline="yes-display-inline">Not later than six months after the date of the enactment of this Act, the Commissioner shall report to the Congress on the reliability and utility of current systems for the collection of data on food choking-related deaths.</text></subsection> </section>
