<official-title>To amend the Cheyenne River Sioux Tribe Equitable Compensation Act to provide compensation to members of the Cheyenne River Sioux Tribe for damage resulting from the Oahe Dam and Reservoir Project, and for other purposes.</official-title>

<section id="H035AA3078107422C99CF95E3DCD949B6" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Cheyenne River Sioux Tribe Equitable Compensation Amendments Act of 2005</short-title></quote>.</text></section> 
<section id="H6A27EF729646492285FA854E599E63C7" section-type="subsequent-section"><enum>2.</enum><header>Findings</header> 
<subsection id="HE4CC18EBFDD6445E9DB79793D7F664C"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds that—</text> 
<paragraph id="HD34CFC6ABEF9442B8F827F74E09709F3"><enum>(1)</enum><text>the Pick-Sloan Missouri River Basin program, authorized by section 9 of the Act of December 22, 1944 (commonly known as the <quote>Flood Control Act of 1944</quote>) (58 Stat. 891), was intended to promote the general economic development of the United States;</text></paragraph> 
<paragraph id="HB70323AD52514ABCB579ED5ED4F434F1"><enum>(2)</enum><text>the Oahe Dam and Reservoir Project—</text> 
<subparagraph id="H4C132FBC7DAC46D0B5149B659D009DFE"><enum>(A)</enum><text>is a major component of the Pick-Sloan Missouri River Basin program; and</text></subparagraph> 
<subparagraph id="HBE927843F4404C588E565827E6278502"><enum>(B)</enum><text>contributes to the national economy;</text></subparagraph></paragraph> 
<paragraph id="H3E9772CBC95241B4BD53B3F3E2B207B3"><enum>(3)</enum><text>the Oahe Dam and Reservoir Project flooded the fertile bottom land of the Cheyenne River Sioux Reservation, which greatly damaged the economy and cultural resources of the Cheyenne River Sioux Tribe and caused the loss of many homes and communities of members of the Tribe;</text></paragraph> 
<paragraph id="H991073992EDD433093D818E5C14898C6"><enum>(4)</enum><text>Congress has provided compensation to several Indian tribes, including the Cheyenne River Sioux Tribe, that border the Missouri River and suffered injury as a result of 1 or more of the Pick-Sloan projects;</text></paragraph> 
<paragraph id="H4C756C0A8C994B0EAD38A9B900B2F5AF"><enum>(5)</enum><text>on determining that the compensation paid to the Cheyenne River Sioux Tribe was inadequate, Congress enacted the Cheyenne River Sioux Tribe Equitable Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/106/511">Public Law 106–511</external-xref>; 114 Stat. 2365), which created the Cheyenne River Sioux Tribal Recovery Trust Fund; and</text></paragraph> 
<paragraph id="H4781EDFA6B3D460F008C33B361D864EE"><enum>(6)</enum><text>that Act did not provide for additional compensation to members of the Cheyenne River Sioux Tribe that lost land as a result of the Oahe Dam and Reservoir Project.</text></paragraph></subsection> 
<subsection id="H27E7683FAD61402BB06B7EBC696442B3"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text> 
<paragraph id="H9C3FBFB0AE474B4A890450A213400000"><enum>(1)</enum><text>to provide that the Cheyenne River Sioux Tribal Recovery Trust Fund may be used to provide compensation to members of the Cheyenne River Sioux Tribe that lost land as a result of the Oahe Dam and Reservoir Project; and</text></paragraph> 
<paragraph id="HAF9B0AAF7FA644838843E8D66889BA8C"><enum>(2)</enum><text>to provide for the capitalization of the Cheyenne River Sioux Tribal Recovery Trust Fund.</text></paragraph></subsection></section> 
<section id="H56E4B9A41E144680B9A8FDE7E8DC6F2"><enum>3.</enum><header>Cheyenne river sioux tribe equitable compensation</header> 
<subsection id="H52B864A3ACBE466EB152FE27B782535E"><enum>(a)</enum><header>Findings and purposes</header><text display-inline="yes-display-inline">Section 102 of the Cheyenne River Sioux Tribe Equitable Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/106/511">Public Law 106–511</external-xref>; 114 Stat. 2365) is amended—</text> 
<paragraph id="H7A4617905EA84039AA71C0873610D88"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(3), by striking subparagraphs (A) and (B) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H9D010C6AB9484073A8E5F548EDAE2040" style="OLC"> 
<subparagraph id="H84FA52EA5AF24D2E93CC4D933DB5C94B"><enum>(A)</enum><text>the United States did not justify, or fairly compensate the Tribe and member landowners for, the Oahe Dam and Reservation project, under which the United States acquired 104,492 acres of land of the Tribe and member landowners; and</text></subparagraph> 
<subparagraph id="H550924FAF2E14E75B8CFD05224560076"><enum>(B)</enum><text>the Tribe and member landowners should be adequately compensated for that land;</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H6C22C61939B148258400836DBC17D07"><enum>(2)</enum><text>in subsection (b)(1), by inserting <quote>and member landowners</quote> after <quote>Tribe</quote> each place it appears.</text></paragraph></subsection> 
<subsection id="HD32F6753591D489700088C95EBF139C8"><enum>(b)</enum><header>Definitions</header><text>Section 103 of the Cheyenne River Sioux Tribe Equitable Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/106/511">Public Law 106–511</external-xref>; 114 Stat. 2365) is amended—</text> 
<paragraph id="H55999F1461014476845D9468DB76A883"><enum>(1)</enum><text>by redesignating paragraphs (1) and (2) as paragraphs (4) and (3), respectively, and moving the paragraphs so as to appear in numerical order; and</text></paragraph> 
<paragraph id="H677FE106573D496D9FA69B2B9E661A1"><enum>(2)</enum><text>by inserting before paragraph (3) (as redesignated by paragraph (1)) the following:</text>

<paragraph id="HAE592AF6E09E4507A2C69C6EFBF6CC43"><enum>(1)</enum><header>Member landowner</header><text>The term <term>member landowner</term> means a member of the Tribe (or an heir of such a member) that owned land (including land allotted under the Act of February 8, 1887 (24 Stat. 388, chapter 119)) located on the Cheyenne River Sioux Reservation that was acquired by the United States for the Oahe Dam and Reservoir Project.</text></paragraph> 
<paragraph id="HE4197F0D1D654DFF8F4B90F9AD6763B4"><enum>(2)</enum><header>Power program</header><text>The term <term>power program</term> means the power program under the Pick-Sloan Missouri River Basin program.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HFB28D7E2B1D34011B02B87D7AA800062"><enum>(c)</enum><header>Cheyenne River Sioux Tribal Recovery Trust Fund</header><text>Section 104 of the Cheyenne River Sioux Tribe Equitable Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/106/511">Public Law 106–511</external-xref>; 114 Stat. 2365) is amended—</text> 
<paragraph id="HA5A63E23EC13428E859409D862DC13B1"><enum>(1)</enum><text>by striking subsection (b) and inserting the following:</text>

<subsection id="H037557ECA4C9409ABB88D8A0509D629C"><enum>(b)</enum><header>Funding</header> 
<paragraph id="H952D1DCECDD849C18FAFF4D618100008"><enum>(1)</enum><header>In general</header><text>The Secretary of the Treasury shall deposit into the Fund an amount equal to 25 percent of the amount deposited into the Treasury from the power program during the preceding fiscal year for the period—</text> 
<subparagraph id="H1082991B4F1C4FD59116062B391D5B41"><enum>(A)</enum><text>beginning on October 1, 2004; and</text></subparagraph> 
<subparagraph id="H2058A036CD7A41CFB73EFFA5DFF862E"><enum>(B)</enum><text>ending on the last date of the fiscal year during which the total amount deposited into the Treasury from the power program equals the amount described in paragraph (2).</text></subparagraph></paragraph> 
<paragraph id="HD4CC353FD1904B0CAAD3DD00F49E739D"><enum>(2)</enum><header>Description of amount</header> 
<subparagraph id="HFBB98832BE754E09AD5120C73022FBF4"><enum>(A)</enum><header>In general</header><text>The amount referred to in paragraph (1)(B) is an amount equal to the sum of—</text> 
<clause id="H0D0664FA872F4DCC9F7889299B819300"><enum>(i)</enum><text>$290,722,958; and</text></clause> 
<clause id="H8BD219085CE94409A441E7D87633ED1C"><enum>(ii)</enum><text>an amount equal to the amount of interest or earnings that would have accrued on the amount described in clause (i) if that amount had been invested in accordance with subsection (c) as of October 1, 2001.</text></clause></subparagraph> 
<subparagraph id="HAA3BDD8D740E4F5DB92891642838CE03"><enum>(B)</enum><header>Calculation of interest</header><text>The amount of interest and earnings described in subparagraph (A)(ii) shall be determined by applying the Lehman Government Bond Index (or a similar index, as determined by the Secretary of the Treasury, in consultation with the Tribal Council).</text></subparagraph></paragraph></subsection><after-quoted-block>; </after-quoted-block></quoted-block></paragraph> 
<paragraph id="H9294DAE962F34BE6A7C2574C61FAFAA2"><enum>(2)</enum><text>in subsection (d)(1), by striking <quote>Beginning on the first day of the 11th fiscal year after the date of enactment of this Act</quote> and inserting <quote>Beginning on October 1, 2005,</quote>; and</text></paragraph> 
<paragraph id="H56187E970CB3411892BFC44F07E4854"><enum>(3)</enum><text>in subsection (f)—</text> 
<subparagraph id="H173377C7E4B741D0B3A4F1AEFC9811E6"><enum>(A)</enum><text>by redesignating paragraphs (3) and (4) as paragraphs (4) and (5), respectively; and</text></subparagraph> 
<subparagraph id="HE78BF8DFFBD14DCABF258360CAB78BD1"><enum>(B)</enum><text>by inserting after paragraph (2) the following:</text>

<paragraph id="H52D3C1E0660349E29163FE66BE38EBB"><enum>(3)</enum><header>Member landowners</header> 
<subparagraph id="H67A6DE9BD2B14B9490FB5574D7E17FA3"><enum>(A)</enum><header>In general</header><text>The plan may provide for the payment of additional compensation to member landowners for acquisition of land by the United States for use in the Oahe Dam and Reservoir Project.</text></subparagraph> 
<subparagraph id="H44D5B31EA16540C2A83CA5513D71B25E"><enum>(B)</enum><header>Provision of records</header><text>To assist the Tribe in processing claims of heirs of member landowners for land acquired by the United States for use in the Oahe Dam and Reservoir Project, the Secretary of the Interior shall provide to the Tribe any record requested by the Tribe to identify the heirs of member landowners by the date that is 60 days after the date of receipt of a request from the Tribe.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="H48B1908AC0BD435AB0009D9F21A37E36"><enum>(d)</enum><header>Eligibility of Tribe for certain programs and services</header><text>Section 105 of the Cheyenne River Sioux Tribe Equitable Compensation Act (<external-xref legal-doc="public-law" parsable-cite="pl/106/511">Public Law 106–511</external-xref>; 114 Stat. 2365) is amended in the matter preceding paragraph (1) by inserting <quote>or any member landowner</quote> after <quote>Tribe</quote>.</text></subsection></section>
