<section section-type="section-one" id="HB7417734DB994E8CBD86D8D88531DEC5" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Voter Outreach and Turnout Expansion Act of 2005</short-title></quote>.</text></section>
<title id="H25FC31D614324108B64065A76B62A898"><enum>I</enum><header>Expansion of election administration requirements</header>
<section id="HCD9CEECB9E524217BC35117900B755CB"><enum>101.</enum><header>Same-day voter registration</header>
<subsection id="HFE626246D684416CA11935D61F717041"><enum>(a)</enum><header>In general</header><text>Section 303 of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483</external-xref>) is amended—</text>
<paragraph id="HAFFB9BBE671B4E74AF2D6D4EA6C1AB50"><enum>(1)</enum><text>by redesignating subsection (d) as subsection (e); and</text></paragraph>
<paragraph id="HA05855EEA5E0434495F91FD9C0B8CF2B"><enum>(2)</enum><text>by inserting after subsection (c) the following new subsection:</text>

<subsection id="H0A30EE55DF6347DF9F48ED4DFBB9674E"><enum>(d)</enum><header>Permitting voter registration on date of election</header>
<paragraph id="H26FB018D65304239AB07F16801F37A2"><enum>(1)</enum><header>In general</header><text>At each polling place in a State at which ballots are cast in an election for Federal office, an individual may register to vote on the date of the election, and may cast a vote at the polling place in the election, if the individual—</text>
<subparagraph id="HD43BE5C309864F09B98FE311B27D5675"><enum>(A)</enum><text>completes an application for voter registration in accordance with the requirements of this Act and other applicable law; and</text></subparagraph>
<subparagraph id="HF0875E1AA29649A0A6DA7FD3D31B3632"><enum>(B)</enum><text>executes a written affirmation before an election official at the polling place stating that the individual is eligible to register to vote in the jurisdiction in which the individual desires to vote and has not already voted in the election.</text></subparagraph></paragraph>
<paragraph id="HFD6DCE6C9BB44BD59298CFAFE01017BC"><enum>(2)</enum><header>Transmittal of completed applications to State election official</header><text>An appropriate official at a polling place shall transmit any voter registration application accepted under this subsection to the appropriate State election official at the time the official at the polling place transmits the ballots cast at the polling place to the official.</text></paragraph>
<paragraph id="HE04A9132D4DD4C2D8BB69B32D15C31DF"><enum>(3)</enum><header>Notice to individuals filing voter registration applications after deadline</header><text>If an individual’s application for voter registration prior to the date of an election is received by the appropriate election official after the deadline for receipt of applications with respect to the election under State law, the official shall transmit a notice to the individual stating that the application was received after the deadline and that the individual may register to vote at the polling place on the date of the election in accordance with this subsection.</text></paragraph>
<paragraph id="H80039AC9F3C04C6DB4865184EF49331C"><enum>(4)</enum><header>Requirements under National Voter Registration Act of 1993</header><text>In carrying out this subsection, a polling place in a State shall meet the requirements applicable to a voter registration agency designated by the State under section 7(a)(2) of the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/42/1973gg-5">42 U.S.C. 1973gg–5(a)(2)</external-xref>), except that clauses (i), (ii), and (iii) of section 7(a)(6)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1973gg-5">42 U.S.C. 1973gg–5(a)(6)(B)</external-xref>) shall not apply with respect to any of the voter registration forms distributed by the polling place pursuant to this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H3BCD41955DC547E993F0497E9FED494B"><enum>(b)</enum><header>Inclusion in voting information requirements</header><text>Section 302(b)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/14582">42 U.S.C. 14582(b)(2)</external-xref>) is amended—</text>
<paragraph id="HD874927F16D749E7BF0538CC39FDA17C"><enum>(1)</enum><text>in subparagraph (E), by inserting <quote>and the right to register to vote at the polling place on the date of an election and vote in that election</quote> after <quote>provisional ballot</quote>;</text></paragraph>
<paragraph id="HCB3DE8249E4A495BA61CB54893190432"><enum>(2)</enum><text>by redesignating subparagraphs (E) and (F) as subparagraphs (F) and (G); and</text></paragraph>
<paragraph id="H21BDB1F21ECB4089B06C9C4B64F87505"><enum>(3)</enum><text>by inserting after subparagraph (D) the following new subparagraph:</text>

<subparagraph id="H0A9B49A6AE5644938F5849D68096D4B"><enum>(E)</enum><text>instructions for individuals registering to vote at the polling place under section 303(d);</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="HFD15836702A84BBFB3008588C5EAEAA"><enum>(c)</enum><header>Effective date</header><text>Section 303(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(e)</external-xref>), as redesignated by subsection (a), is amended by adding at the end the following new paragraph:</text>

<paragraph id="HAFFBF0F54B254769A32BEC49E9A84788"><enum>(3)</enum><header>Requirement for voter registration on date of election</header><text>Each State and jurisdiction shall be required to comply with the requirements of subsection (d) on and after January 1, 2006.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="HFD064814DDB0402E82DC376FEBE508D"><enum>102.</enum><header>Permitting voters to cast ballots prior to election; permitting voters to obtain absentee ballots for any reason</header>
<subsection id="HBC57250371FC47C8BF219CED00A18686"><enum>(a)</enum><header>In general</header><text>The Help America Vote Act of 2002 is amended—</text>
<paragraph id="H324B2F31E4FE41A8AE557800CAAA7863"><enum>(1)</enum><text>by redesignating sections 304 and 305 as sections 305 and 306; and</text></paragraph>
<paragraph id="H755C8EAC4E664C2AB5B4B20423E1FBC2"><enum>(2)</enum><text>by inserting after section 303 the following new section:</text>

<section id="HB301935B22494188B4B8798F33C6004B"><enum>304.</enum><header>Promoting early and absentee voting</header>
<subsection id="HBA33240DCBB14543A7E4005150F86C03"><enum>(a)</enum><header>Requiring jurisdictions to establish early voting sites</header>
<paragraph id="HE1C74C9776574056BC73BF83B94FCA58"><enum>(1)</enum><header>In general</header><text>Each jurisdiction in a State which administers an election for Federal office shall designate early voting sites within the jurisdiction to serve as polling places for the election prior to the date of the election, and shall permit any individual who is registered to vote in the election and eligible to cast a ballot at any polling place within the jurisdiction to cast the ballot at the site.</text></paragraph>
<paragraph id="HCBA3C184A9D146E4A33ED7CF52D1B63"><enum>(2)</enum><header>Treatment of ballots cast at sites</header><text>After a ballot is cast for an election at an early voting site under this subsection, the ballot shall be held and tabulated by the jurisdiction in the same manner as an absentee ballot cast for the election.</text></paragraph>
<paragraph id="HA490373653574A79B5DF1679FAC8B13"><enum>(3)</enum><header>Period of operation</header><text>The jurisdiction shall operate the early voting sites designated under this subsection for an election during such period as it considers appropriate, except that—</text>
<subparagraph id="H91700F16EE6440438548935CF6A21219"><enum>(A)</enum><text>the period may not begin later than the 22nd day before the date of the election or the date on which the ballots for the election are available to be cast (whichever occurs later); and</text></subparagraph>
<subparagraph id="HDEFCAB2CDDA04270B87F6C67B1526717"><enum>(B)</enum><text>at least 2 of the days during the period shall be weekend days.</text></subparagraph></paragraph>
<paragraph id="H131DD07355014C7500E447AB4118E7CE"><enum>(4)</enum><header>Conditions for designation and distribution of sites</header><text>The number of early voting sites of a jurisdiction and the location of such sites within the jurisdiction shall be determined by the jurisdiction, subject to the following conditions:</text>
<subparagraph id="H8CDE76C2C1F84D20AF77221E400530C7"><enum>(A)</enum><text>To the greatest extent practicable, the jurisdiction shall designate sites which are also designated as voter registration agencies under section 7 the National Voter Registration Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/42/1973gg-5">42 U.S.C. 1973gg–5</external-xref>).</text></subparagraph>
<subparagraph id="HD1A106282C61493FBD31F1A6D2B300CC"><enum>(B)</enum><text>The aggregate number of voting systems used in all such sites in the jurisdiction may not be less than 25 percent of the total number of voting systems which will be used in all polling places in the jurisdiction on the date of the election.</text></subparagraph>
<subparagraph id="H2D03CE9191B24492B3F366D09D0017D6"><enum>(C)</enum><text>At least one of the sites selected, and the voting system used at such site, shall be accessible for individuals with disabilities (including the blind and visually impaired).</text></subparagraph>
<subparagraph id="H82F6730C33E745E2AA8B9B86A61D98BC"><enum>(D)</enum><text>The geographic distribution of the sites shall reflect the geographic distribution of the voting age population of the jurisdiction.</text></subparagraph>
<subparagraph id="H3419EE9B7A364E3F00B261772F0088A7"><enum>(E)</enum><text>In establishing sites, the jurisdiction shall comply with the applicable requirements of the <act-name parsable-cite="VRA65">Voting Rights Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1973">42 U.S.C. 1973 et seq.</external-xref>).</text></subparagraph></paragraph></subsection>
<subsection id="HF6B51D763AF84C1582F2FF06F3F4D9F5"><enum>(b)</enum><header>Permitting voters to obtain absentee ballots for any reason</header><text>No State election official may require an individual who requests an absentee ballot for an election to provide a reason for the request, or to otherwise provide any proof of the individual’s need for an absentee ballot, as a condition of obtaining the ballot.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="HCB97CC240CF64E5DBF6E059D63B50019"><enum>(b)</enum><header>Conforming amendments</header>
<paragraph id="H26AAB27412094672B13316EA598803E"><enum>(1)</enum><header>Deadline for adoption of voluntary guidance by election assistance commission</header><text>Section 311(b) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15501">42 U.S.C. 15501(b)</external-xref>) is amended—</text>
<subparagraph id="H3C479BC10261400FB4D82B07A172F9E1"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of paragraph (2);</text></subparagraph>
<subparagraph id="HCD9D272CDB6C470BAFE4AF3B394B8970"><enum>(B)</enum><text>by striking the period at the end of paragraph (3) and inserting <quote>; and</quote>; and</text></subparagraph>
<subparagraph id="H8108F205F9864A3ABB4809BD4DE81532"><enum>(C)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H66D6796097FD444695DDC71E134632C0"><enum>(4)</enum><text>in the case of recommendations with respect to section 304, January 1, 2006.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph id="H512FAFF7FF434B088B4DAAB112EB84F"><enum>(2)</enum><header>Enforcement</header><text>Section 401 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/15511">42 U.S.C. 15511</external-xref>) is amended by striking <quote>and 303</quote> and inserting <quote>303, and 304</quote>.</text></paragraph></subsection>
<subsection id="H291C5D34D69A49698B01F4C0D6583FC0"><enum>(c)</enum><header>Clerical amendment</header><text>The table of sections for subtitle A of title III of such Act is amended—</text>
<paragraph id="HD113D1359EF543AEBB1C669265F2BB00"><enum>(1)</enum><text>by redesignating the items relating to sections 304 and 305 as items relating to sections 305 and 306; and</text></paragraph>
<paragraph id="H2A0C3A8F9D7543F0A4AB743FC01900B4"><enum>(2)</enum><text>by inserting after the item relating to section 303 the following new item:</text>

<toc-entry level="section">Sec. 304. Promoting early and absentee voting</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
<section id="H0751A3A1FD054DA2BDF4DADC5AE24D8"><enum>103.</enum><header>Clarification of requirement to permit individuals to complete incomplete mail-in voter registration applications</header><text display-inline="no-display-inline">Section 303(b)(4)(B) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15483">42 U.S.C. 15483(b)(4)(B)</external-xref>) is amended to read as follows:</text>

<subparagraph id="H8C6659665E0E46638D634CF4BD00CFCA"><enum>(B)</enum><header>Incomplete forms</header><text>If an applicant for voter registration with respect to an election fails to answer any of the questions included on the mail voter registration form pursuant to subparagraph (A), or otherwise fails to provide any information required to be provided on the form, the registrar shall—</text>
<clause id="H023299082E12433CA8CBE95C11C4DCB7"><enum>(i)</enum><text>notify the applicant of the failure and of the opportunity for the applicant to register to vote at the polling place on the date of the election in accordance with subsection (d); and</text></clause>
<clause id="H8466A808E8DB46FA9E86CD3D4D1B75A6"><enum>(ii)</enum><text>if the form was received by the registrar within the deadline under State law for the receipt of voter registration applications with respect to the election, provide the applicant with an opportunity to complete the form in a timely manner to allow for the completion of the registration form prior to the election.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="HA9B31D51FEB8497AB02F9F55FD65176F"><enum>104.</enum><header>Additional funding</header><text display-inline="no-display-inline">Section 257(a) of the Help America Vote Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/42/15407">42 U.S.C. 15407(a)</external-xref>) is amended—</text>
<paragraph id="H1B070355B99A4B29A31867A2647B2715"><enum>(1)</enum><text>in paragraph (1), by striking <quote>$1,400,000,000</quote> and inserting <quote>$1,405,000,000</quote>;</text></paragraph>
<paragraph id="H4398112019F04AA28870BC9B7D08F3E"><enum>(2)</enum><text>in paragraph (2), by striking <quote>$1,000,000,000</quote> and inserting <quote>$1,005,000,000</quote>; and</text></paragraph>
<paragraph id="HA2C02592E1F94428BDA409DAAFCECCC7"><enum>(3)</enum><text>in paragraph (3), by striking <quote>$600,000,000</quote> and inserting <quote>$605,000,000</quote>.</text></paragraph></section>
<section id="HF72AD66F9FD2422A85F437511C8CDFCB"><enum>105.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this title shall take effect as if included in the enactment of the Help America Vote Act of 2002.</text></section></title>
<title id="HCC31BDA5E5B249338409D08E337BA9A7"><enum>II</enum><header>Removing other barriers to voting</header>
<section id="H372476073C2048C086C6BB3B6E40EE54"><enum>201.</enum><header>Treatment of Election Day in same manner as Veterans Day for purposes of Federal employment</header>
<subsection id="H8E455C05B3F74D97926F4D5C3703DFB5"><enum>(a)</enum><header>Sense of Congress</header><text>It is the sense of Congress that—</text>
<paragraph id="H1733301225AD44D699A4F7565386068D"><enum>(1)</enum><text>many Americans do not vote on Election Day because of conflicting work schedules;</text></paragraph>
<paragraph id="H37715C4D5F7045E780B470368477375B"><enum>(2)</enum><text>Federal, State, and local governments should share the responsibility for increasing voter turnout on Election Day;</text></paragraph>
<paragraph id="H106488BC60C54F30B900B1ED6CE193E6"><enum>(3)</enum><text>States should establish Election Day as a legal public holiday in each year and should provide full paid leave for State government employees on Election Day; and</text></paragraph>
<paragraph id="H619E3F34CBF14AAB80E34F9858408579"><enum>(4)</enum><text>the treatment of Election Day in the same manner as Veterans Day for purposes of laws relating to Federal employment will lead to increased voter turnout and will increase the availability of poll workers and suitable polling places.</text></paragraph></subsection>
<subsection id="H874BFAE44BA742E2BB07DB5C3BDB40FE"><enum>(b)</enum><header>Treatment of Election Day in same manner as Veterans Day for purposes of Federal employment</header><text>For purposes of any law relating to Federal employment, the Tuesday next after the first Monday in November in 2006 and each even-numbered year thereafter shall be treated in the same manner as November 11.</text></subsection></section>
<section id="H20F19A07E898404F9200863BE7A374ED"><enum>202.</enum><header>Voting leave</header>
<subsection id="H172C7033208A4B53A4A0D6004694F6A0"><enum>(a)</enum><header>In general</header><text>Each employee of an employer may take up to 2 hours of leave (or up to 3 hours of leave, in the case of an employee whose workplace is further than 25 miles from the polling place at which the employee is eligible to cast a ballot under State law) in order to vote on any workday on which an election for Federal office is held.</text></subsection>
<subsection id="H8879C98F018A4A85BA8E199094883B8B"><enum>(b)</enum><header>Unpaid or paid leave permitted</header><text>Notwithstanding any other provision of law, leave granted under this subsection may be unpaid leave or paid leave.</text></subsection>
<subsection id="HFC06D079894A41F4BE805817DFDDF792"><enum>(c)</enum><header>Duties of employee</header><text>An employee taking leave under this subsection shall make a reasonable effort to schedule the leave so as not to disrupt unduly the operations of the employer, shall provide such notice prior to taking leave as is practicable, and shall make a reasonable effort to vote.</text></subsection>
<subsection id="HAA65D0BC9E4A49FCA8D52C26559EC5BA"><enum>(d)</enum><header>No loss of benefits</header><text>The taking of leave under this subsection shall not result in the loss of any employment benefit accrued prior to the date on which the leave commenced.</text></subsection>
<subsection id="HE50FE503CA2A4CBFA60022F996F859B5"><enum>(e)</enum><header>Prohibited acts</header>
<paragraph id="H803005C9AFD04847A1132D535600ADAC"><enum>(1)</enum><header>Exercise of rights</header><text>It shall be unlawful for any employer to interfere with, restrain, or deny the taking of or the attempt to take any leave provided under this subsection.</text></paragraph>
<paragraph id="H671CEB69347F4FE0AD08AD08E0D572DF"><enum>(2)</enum><header>Discrimination</header><text>It shall be unlawful for any employer to discharge or in any other manner discriminate against any individual for—</text>
<subparagraph id="H9795BA53F18B4E84B9945199FE278D19"><enum>(A)</enum><text>opposing any practice made unlawful by this subsection;</text></subparagraph>
<subparagraph id="H8E972DDA734043CC9E2C00E0ACAE2D76"><enum>(B)</enum><text>filing any charge, or instituting or causing to be instituted any proceeding, under or related to this subsection;</text></subparagraph>
<subparagraph id="HF5AC4EC590DE4367861DBC9DD4864E7F"><enum>(C)</enum><text>giving or preparing to give any information in connection with any inquiry or proceeding relating to any leave provided under this subsection; or</text></subparagraph>
<subparagraph id="HC44E7825D29544FABB06EAD1F6D48FFB"><enum>(D)</enum><text>testifying or preparing to testify in any inquiry or proceeding relating to any leave provided under this subsection.</text></subparagraph></paragraph></subsection>
<subsection id="H172742ADE84047709F647133BBC3F3F9"><enum>(f)</enum><header>Investigative authority</header><text>The Secretary of Labor shall have investigative authority with respect to the provisions of this subsection in the same manner and under the same terms and conditions as the investigative authority provided under section 106 of the Family and Medical Leave Act of 1993, and the requirements of section 106 of such Act shall apply to employers under this subsection in the same manner as such requirements apply to employers under section 106 of such Act.</text></subsection>
<subsection id="H3412D0F683104676B60097F2F4B100AF"><enum>(g)</enum><header>Enforcement</header><text>The provisions of section 107 of the Family and Medical Leave Act of 1993 shall apply with respect to the enforcement of the requirements of this subsection in the same manner and under the same terms and conditions as such provisions apply with respect to the enforcement of the requirements of title I of such Act.</text></subsection>
<subsection id="H86C4CD72F6B64B3CBA0037DE1C6EE618"><enum>(h)</enum><header>Employer defined</header><text>In this section, the term <term>employer</term> means any person engaged in commerce or in any industry or activity affecting commerce who employs 25 or more employees during a calendar year, and includes any person who acts, directly or indirectly, in the interest of an employer to any of the employees of such employer and any successor in interest of an employer. In the previous sentence, the terms <term>commerce</term> and <term>industry or activity affecting commerce</term> have the meaning given such terms in section 101(1) of the Family and Medical Leave Act of 1993.</text></subsection>
<subsection id="H2E3F3F8522E64A87A6AF12A45359DBC4"><enum>(i)</enum><header>Nondiscrimination</header><text>The implementation and enforcement of this section shall be in compliance with the <act-name parsable-cite="VRA65">Voting Rights Act of 1965</act-name>.</text></subsection>

<section id="HCBDBDAB4C73D4D19866742B76347A778"><enum>203.</enum><header>Sense of Congress regarding distribution of sample ballots and voting materials</header><text display-inline="no-display-inline">It is the sense of Congress that the distribution of sample ballots, information on voting, and other voter education materials will help to prevent errors by voters at the polls and to reduce the rates of spoiled ballots, and Congress encourages States and other jurisdictions which administer elections to distribute these materials to registered voters prior to elections.</text></section></title>
