<official-title>To confer standing on Members of Congress to bring suit in Federal district court to compel compliance with congressional intent in enacting laws to protect the people of the United States against national security threats.</official-title>

<section id="H6D497CC8A08E485DAA3093532363A100" section-type="section-one"><enum>1.</enum><header>Congressional standing to seek judicial review</header> 
<subsection id="H0CDC0262569E4233AA187D3980759500"><enum>(a)</enum><header>Representatives</header><text>Any Member of the House of Representatives, and any Delegate or Resident Commissioner to the House of Representatives, upon the adoption of a resolution by the House of Representatives authorizing suit on behalf of the body, shall have standing to bring an action on the ground that action or inaction by an officer or employee of the Department of Homeland Security or the Department of the Treasury is inconsistent with the intent of the Congress, as expressed in the text of the laws referred to in subsection (k), and the legislative history of such laws, and to enforce compliance with such intent, so as to protect the people of the United States against the threat of terrorism, to intercept and obstruct acts of terrorism, and to maintain the integrity of the border security systems of the United States.</text></subsection> 
<subsection id="H1FF0EBA45BE645508809F2E6D0D557A5"><enum>(b)</enum><header>Senators</header><text display-inline="yes-display-inline">Any Senator, upon the adoption of a resolution by the Senate authorizing suit on behalf of the body, shall have standing to bring any action on the ground that action or inaction by an officer or employee of the Department of Homeland Security or the Department of the Treasury is inconsistent with the intent of the Congress, as expressed in the text of the laws referred to in subsection (k), and the legislative history of such laws, and to enforce compliance with such intent, so as to protect the people of the United States against the threat of terrorism, to intercept and obstruct acts of terrorism, and to maintain the integrity of the border security systems of the United States.</text></subsection> 
<subsection id="H0E3BA5B6221F48C8BA7E09FDE3D8D2E"><enum>(c)</enum><header>Venue</header><text>An action under subsection (a) or (b) may be brought only in a district court of the United States for a judicial district that includes, in whole or in part, the geographic area represented by one of the authorized plaintiffs.</text></subsection> 
<subsection id="HBDCA756D84CA4FAC95269CEEA247B3F2"><enum>(d)</enum><header>Relief</header><text>Relief in any action brought under subsection (a) or (b) shall be limited to injunctive relief, declaratory relief, or both.</text></subsection> 
<subsection id="H6D667151AEC5408600B37C692E67999E"><enum>(e)</enum><header>No sanctions for suit</header><text>No person authorized to bring an action under subsection (a) or (b) may be subject to monetary sanctions for bringing, or participating in, such action.</text></subsection> 
<subsection id="HE89CBDEC7C324D60B6AFF92E2379E2EB"><enum>(f)</enum><header>Expedition</header><text>A court having jurisdiction over an action brought under this section shall take all necessary and appropriate actions to advance on the docket and to expedite to the greatest possible extent the disposition of any matter brought under this section.</text></subsection> 
<subsection id="H4B2A7D7C451C4423A6CB8C947CDE5440"><enum>(g)</enum><header>Legal representation</header><text>A person bringing an action under subsection (a) or (b) shall be represented by the United States attorney for the judicial district in which the action is brought, unless another provision of law prohibits such representation.</text></subsection> 
<subsection id="H203D1188184045C5A29520C4BDDB1456"><enum>(h)</enum><header>Cumulative rights</header><text>The rights created by this section are in addition to the rights of any person under law.</text></subsection> 
<subsection id="H2BA631CCF6224B3D85BD00160918F100"><enum>(i)</enum><header>Intervention</header><text>A copy of any complaint in an action brought under this section shall be promptly delivered to the Secretary of the Senate and Clerk of the House of Representatives, and each House of Congress shall have the right to intervene in any such action upon the adoption of a resolution by the body authorizing intervention on behalf of the body.</text></subsection> 
<subsection id="HDE20A32870054E608642EC23F89461AE"><enum>(j)</enum><header>Severability</header><text display-inline="yes-display-inline">If any provision of this section, or the application of such provision to any person or circumstance, is held invalid, the remainder of this section, or the application of such provision to persons or circumstances other than those to which such provision is held invalid, shall not be affected thereby. </text></subsection> 
<subsection id="H1E7BC619E96842C0BD6B018F530040D2"><enum>(k)</enum><header>Laws</header><text>The laws referred to in this subsection are the following:</text> 
<paragraph id="H36578D99CB7047F5851E778C29322738"><enum>(1)</enum><text display-inline="yes-display-inline">The Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101 et seq.</external-xref>).</text></paragraph> 
<paragraph id="H2707809945B14E63B38ECED69C400089"><enum>(2)</enum><text>The Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101 et seq.</external-xref>).</text></paragraph>
