<official-title>To amend title I of the Employee Retirement Income Security Act of 1974 to require persons who are plan administrators of employee pension benefit plans or provide administrative services to such plans, and who also provide automobile insurance coverage or provide persons offering such coverage identifying information relating to plan participants or beneficiaries, to submit to the Federal Trade Commission certain information relating to such automobile insurance coverage.</official-title>

<section section-type="section-one" id="H3C3F1CF406C947DF9EE8ED77E2DD132B" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Truth in Automobile Insurance Rates Act of 2005</short-title></quote>.</text></section>
<section id="H69DBAB051E234CD0BAA40040355D2950"><enum>2.</enum><header>Information required to be submitted to the Federal Trade Commission relating to automobile insurance coverage</header>
<subsection id="HCC187EC2487646228EFE7008B78CFAC"><enum>(a)</enum><header>In general</header><text>Section 101 of the <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of 1974</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/29/1021">29 U.S.C. 1021</external-xref>) is amended—</text>
<paragraph id="H347AE6165DE7437B94B872E0ACEF50B8"><enum>(1)</enum><text>by redesignating subsection (j) as subsection (k); and</text></paragraph>
<paragraph id="HC826EFF2ED7E4D1FB7F60866A4A13215"><enum>(2)</enum><text>by inserting after subsection (i) the following new subsection:</text>

<subsection id="H8DDE5B7D67B94B08A2FAF5045DB49236"><enum>(j)</enum><header>Submission to the Federal Trade Commission of certain information relating to automobile insurance coverage</header>
<paragraph id="H511815BEEE774AC3ABD238DFB12E7E97"><enum>(1)</enum><header>In general</header><text>Any person who is, during any calendar year, the plan administrator of an employee pension benefit plan or provides administrative services to such a plan and who—</text>
<subparagraph id="HCA9A9BB1869240CAB656B47000F9A640"><enum>(A)</enum><text>also offers automobile insurance coverage during such year in a State in which a participant or beneficiary under the plan resides, or</text></subparagraph>
<subparagraph id="H6DD4989E9C1E4FA991D90638848DF7B"><enum>(B)</enum><text>provides during such calendar year to any person offering automobile insurance coverage in such state any identifying information relating to any participant or beneficiary under the plan, </text></subparagraph><continuation-text continuation-text-level="paragraph">shall provide annually to the Federal Trade Commission the information described in paragraph (2). Such person shall certify annually to the Secretary compliance with the requirements of this subsection.</continuation-text></paragraph>
<paragraph id="H7BBA1350FF82441EBA79BE51005BBB8E"><enum>(2)</enum><header>Required information</header>
<subparagraph id="H28AF8364362C4BE2BBE900862710A92F"><enum>(A)</enum><header>In general</header><text>The information described in this paragraph consists of the following:</text>
<clause id="HF760E3362D65431C8115526FE3006609"><enum>(i)</enum><text>The total amount collected in the year reported on, by each person specified in subparagraph (B), in insurance premiums on automobile insurance from automobile insurance policyholders in the State.</text></clause>
<clause id="HA1276D69DE284418B363C4D074248D61"><enum>(ii)</enum><text>The total amount that each person specified in subparagraph (B) paid out in the year reported on in automobile insurance claims in response to the claims filed by automobile insurance policyholders in such State.</text></clause>
<clause id="HCC739256A44A4F7296A4EF4B580037FB"><enum>(iii)</enum><text>The total amount added in the year reported on, by each person specified in subparagraph (B), to such person’s reserve balance for automobile insurance claims filed by automobile insurance policyholders in such State.</text></clause></subparagraph>
<subparagraph id="H64B94583D699492D96CEF8FB14CF9575"><enum>(B)</enum><header>Specified persons</header><text>The persons specified in this subparagraph are the person described in paragraph (1), each person provided identifying information (as described in paragraph (1)(B)) by the person described in paragraph (1), and each person related to any of the foregoing.</text></subparagraph></paragraph>
<paragraph id="HBA65C7FB7150426F9789264E6F790020"><enum>(3)</enum><header>Related person</header><text>For purposes of this subsection—</text>
<subparagraph id="H3E683578A1674D46B7B347EA525580A5"><enum>(A)</enum><text>a person is <quote>related</quote> to any other person if such persons are under common control, and</text></subparagraph>
<subparagraph id="H77E00C3BF999491491DDB27B00500100"><enum>(B)</enum><text>the determination of whether two or more persons are under <quote>common control</quote> shall be made under regulations of the Secretary which are consistent and coextensive with regulations prescribed for similar purposes by the Secretary of the Treasury under subsections (b) and (c) of <external-xref legal-doc="usc" parsable-cite="usc/26/414">section 414</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
<section id="HCA612D7DB9424D58A3B515613E7B25B5"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply with respect to plan years beginning on or after January 1, 2007.</text></section>
