<official-title>To provide an extension of administrative expenses for highway, highway safety, motor carrier safety, transit, and other programs funded out of the Highway Trust Fund pending enactment of a law reauthorizing the Transportation Equity Act for the 21st Century. </official-title>

<section id="H62A28B0873704997AA20D92FAC7CD000" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Surface Transportation Extension Act of 2005, Part VI</short-title></quote>.</text></section> 
<section id="H375845EA69134DCA91474C1998C97D54" section-type="subsequent-section"><enum>2.</enum><header>Administrative expenses for Federal-aid highway program</header> 
<subsection id="H85B253E08A4A4EAD93AB00006C029385"><enum>(a)</enum><header>Authorization of contract authority</header><text display-inline="yes-display-inline">Section 4(a) of the Surface Transportation Extension Act of 2004, Part V (118 Stat. 1147, 119 Stat. 325) is amended by striking <quote>$292,179,920</quote> and inserting <quote>$309,260,880</quote>.</text></subsection> 
<subsection id="H6DC835039839476F9C3C2474A7D3E4D"><enum>(b)</enum><header>Limitation on obligations</header><text display-inline="yes-display-inline">Of the obligation limitation made available for Federal-aid highways and highway safety construction programs for fiscal year 2005 by division H of <external-xref legal-doc="public-law" parsable-cite="pl/108/447">Public Law 108–447</external-xref> (118 Stat. 3204) not more the $17,080,960 shall be available, in addition to any obligation limitation previously provided, for administrative expenses of the Federal Highway Administration for the period of July 30, 2005, through August 14, 2005.</text></subsection> 
<subsection id="HF3559BB98AB44B8DA702FEF7B6F3F3C"><enum>(c)</enum><header>Conforming amendment</header><text>Section 2(e)(3) of such Act (118 Stat. 1146, 119 Stat. 325) is amended by striking <quote>July 30</quote> and inserting <quote>August 14</quote>.</text></subsection></section> 
<section id="HA7B745039BF0466FA1000920E9B5F2D4"><enum>3.</enum><header>Administrative expenses for National Highway Traffic Safety Administration</header> 
<subsection id="HB26EBDD4B7CE4683B26F23FEAE084C0"><enum>(a)</enum><header>In general</header><text>There shall be available from the Highway Trust Fund (other than the Mass Transit Account) for the Secretary of Transportation to pay the administrative expenses of the National Highway Traffic Administration in carrying out the highway safety programs authorized by sections 157 and 163 of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code, and sections 402, 403, 405, and 410 of chapter 4 of such title, the National Driver Register under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/303">chapter 303</external-xref> of title 49, United States Code, the motor vehicle safety program under chapter 301 of such title 49, and the motor vehicle information and cost savings program under part C of subtitle VI of such title 49 $4,125,000 for the period of July 30, 2005, through August 14, 2005.</text></subsection> 
<subsection id="HC4168CF1E9CE4AE6BC58D6FE9652DD2"><enum>(b)</enum><header>Contract authority</header><text>Funds made available by this section shall be available for obligation in the same manner as if such funds were apportioned under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/23/1">chapter 1</external-xref> of title 23, United States Code; except that such funds shall remain available until expended.</text></subsection></section> 
<section id="HEE6DF54F17CE44ED00B9CD088FB71E86"><enum>4.</enum><header>Administrative expenses for Motor Carrier Safety Administration program</header><text display-inline="no-display-inline">Section 7(a)(1) of the Surface Transportation Extension Act of 2004, Part V (118 Stat. 1153; 119 Stat. 330) is amended—</text> 
<paragraph id="HBEC7126AEA5F433DA0FD34D0D35420B2"><enum>(1)</enum><text>by striking <quote>$213,799,290</quote> and inserting <quote>$224,383,414</quote>; and</text></paragraph>

<subsection id="H075349AADACF49209F551D26E95B88D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5001(a)(4) of the Transportation Equity Act for the 21st Century (112 Stat. 420; 118 Stat. 1150; 119 Stat. 327; 119 Stat. 346; 119 Stat. 379; 119 Stat. 394) is amended by striking <quote>$25,730,000 for the period of October 1, 2004, through July 30, 2005</quote> and inserting <quote>$27,000,000 for the period of October 1, 2004, through August 14, 2005</quote>.</text></subsection>

<paragraph id="H81EE0831FEFE4CF0B54CECC2D68D4300"><enum>(1)</enum><header>Sport fish restoration account</header><text>Paragraph (2) of <external-xref legal-doc="usc" parsable-cite="usc/26/9504">section 9504(b)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following: <quote>Subparagraphs (A), (B), and (C) shall each be applied by substituting <quote>Surface Transportation Extension Act of 2005, Part VI</quote> for <quote>Surface Transportation Extension Act of 2005, Part V</quote>.</quote>.</text></paragraph> 
<paragraph id="H7A476DB74CFD4E3FAEA0471302756E24"><enum>(2)</enum><header>Boat safety account</header><text>Subsection (c) of section 9504 of such Code is amended—</text>

<paragraph id="H3F0BAFE53DAB4CC5B58B4DDE00F44192"><enum>(3)</enum><header>Exception to limitation on transfers</header><text>Paragraph (2) of section 9504(d) of such Code is amended by adding at the end the following new sentence: <quote>The preceding sentence shall be applied by substituting <quote>August 15, 2005</quote> for the date therein.</quote>.</text></paragraph></subsection> 
<subsection id="H1CE2CF57EE1A4E98001BE6A2F84BFD11"><enum>(c)</enum><header>Temporary rule regarding adjustments</header><text>During the period beginning on the date of the enactment of the Surface Transportation Extension Act of 2003 and ending on August 14, 2005, for purposes of making any estimate under <external-xref legal-doc="usc" parsable-cite="usc/26/9503">section 9503(d)</external-xref> of the Internal Revenue Code of 1986 of receipts of the Highway Trust Fund, the Secretary of the Treasury shall treat—</text> 
<paragraph id="H14414FF5DC0740C7AA029BEC99005D85"><enum>(1)</enum><text>each expiring provision of paragraphs (1) through (4) of section 9503(b) of such Code which is related to appropriations or transfers to such Fund to have been extended through the end of the 24-month period referred to in section 9503(d)(1)(B) of such Code, and</text></paragraph> 
<paragraph id="H62381AC8912944DFA08DB5EC6006C848"><enum>(2)</enum><text>with respect to each tax imposed under the sections referred to in section 9503(b)(1) of such Code, the rate of such tax during the 24-month period referred to in section 9503(d)(1)(B) of such Code to be the same as the rate of such tax as in effect on the date of the enactment of the Surface Transportation Extension Act of 2003.</text></paragraph></subsection> 
<subsection id="H7A74316E76FC4B15AEDFC6D3EE13D4D9"><enum>(d)</enum><header>Subsequent repeal of certain temporary provisions</header><text>Each of the following provisions of the Internal Revenue Code of 1986 are amended by striking the last sentence thereof:</text>

<paragraph id="HAC98B5E712D345C99E8B44B42C852CA2"><enum>(3)</enum><text>Section 9504(d)(2).</text></paragraph></subsection> 
<subsection id="H1795002465EC4F9298D30131C2B73E43"><enum>(e)</enum><header>Effective date</header> 
<paragraph id="H9FBF3C3AAFF040CA88B600B47367747F"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), the amendments made by this section shall take effect on the date of the enactment of this Act.</text></paragraph> 
<paragraph id="H35B8C36A21A948F2B6F83455D9002C19"><enum>(2)</enum><header>Subsequent repeal</header><text>The amendments made by subsection (d) shall take effect on the date of the enactment of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users and shall be executed immediately before the amendments made by such Act.</text></paragraph></subsection></section>
