		<section display-inline="no-display-inline" id="H92F174510BB34A4DA44E2845B794AE89" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote>Workplace Goods Job Growth and Competitiveness Act of
			 2006</quote>.</text>
		</section><section id="HA2778AAC1D984989AF522DA34CACFCE"><enum>2.</enum><header>Statute of repose for
			 durable goods used in a trade or business</header>
			<subsection id="H3DEC47EE02ED4B19B417545F7DFB8B4"><enum>(a)</enum><header>In
			 general</header><text>Except as otherwise provided in this Act—</text>
				<paragraph id="HD19EC728F6394909B888D0083932D09E"><enum>(1)</enum><text>no civil action may be
			 filed against the manufacturer or seller of a durable good for damage to
			 property allegedly caused by that durable good if the damage to property
			 occurred more than 12 years after the date on which the durable good was
			 delivered to its first purchaser or lessee; and</text>
				</paragraph><paragraph id="H963B20234DB94428BCE0D900DBCB7606"><enum>(2)</enum><text>no civil action may be
			 filed against the manufacturer or seller of a durable good for damages for
			 death or personal injury allegedly caused by that durable good if the death or
			 personal injury occurred more than 12 years after the date on which the durable
			 good was delivered to its first purchaser or lessee and if—</text>
					<subparagraph id="HE0287F8C58D24F3489A5E9D900844988"><enum>(A)</enum><text>the claimant has received
			 or is eligible to receive worker compensation; and</text>
					</subparagraph><subparagraph id="HD80A53BF0EB04FF989C66984C121E617"><enum>(B)</enum><text>the injury does not
			 involve a toxic harm (including, but not limited to, any asbestos-related
			 harm).</text>
					</subparagraph></paragraph></subsection><subsection id="HFF3C68E7625B45F8959C009F98045C49"><enum>(b)</enum><header>Exceptions</header>
				<paragraph id="HB6099484C87E41B79FF4EDD9B7ECE13E"><enum>(1)</enum><header>In
			 general</header><text>A motor vehicle, vessel, aircraft, or train, that is used
			 primarily to transport passengers for hire, shall not be subject to this
			 Act.</text>
				</paragraph><paragraph id="H6819D40659CD411B8614B8172B2E2442"><enum>(2)</enum><header>Certain express
			 warranties</header><text display-inline="yes-display-inline">This Act does not
			 bar a civil action against a defendant who made an express warranty in writing,
			 for a period of more than 12 years, as to the safety or life expectancy of a
			 specific product, except that this Act shall apply at the expiration of that
			 warranty.</text>
				</paragraph><paragraph id="HBB2D987DDD394AFA9257FB24D1685600"><enum>(3)</enum><header>Aviation limitations
			 period</header><text>This Act does not affect the limitations period
			 established by the General Aviation Revitalization Act of 1994 (49 U.S.C. 40101
			 note).</text>
				</paragraph><paragraph id="HEFD898E28E3141B3A036288B7FE617CF"><enum>(4)</enum><header>Actions involving the
			 environment</header><text>Subsection (a)(1) does not supersede or modify any
			 statute or common law that authorizes an action for civil damages, cost
			 recovery, or any other form of relief for remediation of the environment (as
			 defined in section 101(8) of the <act-name parsable-cite="CERCL">Comprehensive
			 Environmental Response, Compensation, and Liability Act of 1980</act-name> (42
			 U.S.C. 9601(8)).</text>
				</paragraph><paragraph id="H64AC0CE0A36149498731FB6179E9451E"><enum>(5)</enum><header>Regulatory
			 actions</header><text>This Act does not affect regulatory enforcement actions
			 brought by State or Federal agencies.</text>
				</paragraph><paragraph id="HA4874A1762874BF1B2288201527650CE"><enum>(6)</enum><header>Actions involving
			 fraudulent concealment</header><text>This Act does not bar a civil action
			 against a manufacturer or seller of a durable good who fraudulently concealed a
			 defect in the durable good.</text>
				</paragraph></subsection><subsection id="HFCFA79924FF24144A28B4DBF8D8F4D2"><enum>(c)</enum><header>Effect on State law;
			 preemption</header><text display-inline="yes-display-inline">Subject to
			 subsection (b), this Act preempts and supersedes any State law that establishes
			 a statute of repose to the extent such law applies to actions covered by this
			 Act. Any action not specifically covered by this Act shall be governed by
			 applicable State or other Federal law.</text>
			</subsection><subsection id="H32851D4F63364C80BE1056D34F36A447"><enum>(d)</enum><header>Transitional provision
			 relating to extension of repose period</header><text>To the extent that this
			 Act shortens the period during which a civil action could otherwise be brought
			 pursuant to another provision of law, the claimant may, notwithstanding this
			 Act, bring the action not later than 1 year after the date of the enactment of
			 this Act.</text>
			</subsection></section><section id="HA3414F2316A542EFAAD34C6ADAAF218"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="HCFE0A14F8EC54ECE9D8CA1C0ED604DDC"><enum>(1)</enum><header>Claimant</header><text>The
			 term <term>claimant</term> means any person who brings an action covered by
			 this Act and any person on whose behalf such an action is brought. If such an
			 action is brought through or on behalf of an estate, the term includes the
			 claimant’s decedent. If such an action is brought through or on behalf of a
			 minor or incompetent, the term includes the claimant’s legal guardian.</text>
			</paragraph><paragraph id="H0FCFB5C152F5462C8791682F8D4C7667"><enum>(2)</enum><header>Durable
			 good</header><text>The term <term>durable good</term> means any product, or any
			 component of any such product, which—</text>
				<subparagraph id="HA6A647E1CAAD4B208761262F1662DEC4"><enum>(A)</enum><clause commented="no" display-inline="yes-display-inline" id="H97AF290BB37C4AF28BB2EE8C03432D88"><enum>(i)</enum><text>has a normal life
			 expectancy of 3 or more years; or</text>
					</clause><clause changed="added" committee-id="HJU00" id="H52FB1534539D4D88ABBD82DF66F62B9B" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text>is of a character
			 subject to allowance for depreciation under the Internal Revenue Code of 1986;
			 and</text>
					</clause></subparagraph><subparagraph id="H86666BCC9E69495AA1B000627E54C49"><enum>(B)</enum><text>is—</text>
					<clause id="HBC7888215F204EA383F6C4A3C7425E08"><enum>(i)</enum><text>used in a trade or
			 business;</text>
					</clause><clause id="H0FE642A04AEE48FDBDEE7C42B54C8CF5"><enum>(ii)</enum><text>held for the production
			 of income; or</text>
					</clause><clause id="HFCEB7AF76E084DBF83B54EECADD04660"><enum>(iii)</enum><text>sold or donated to a
			 governmental or private entity for the production of goods, training,
			 demonstration, or any other similar purpose.</text>
					</clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HD5F766E6B3CC4956B86BEBAEE7513C15"><enum>(3)</enum><header>Fraudulently
			 concealed</header><text display-inline="yes-display-inline">With respect to a
			 durable good, the term “fraudulently concealed” means that—</text>
				<subparagraph id="H08438890514243F09FDE71592B50423F"><enum>(A)</enum><text display-inline="yes-display-inline">the manufacturer or seller of the durable
			 good had actual knowledge of a defect in the durable good;</text>
				</subparagraph><subparagraph id="HFA91F808248644D2A958B170C579B13C"><enum>(B)</enum><text display-inline="yes-display-inline">the defect in the durable good was the
			 proximate cause of the harm to the claimant; and</text>
				</subparagraph><subparagraph id="HA8F15E5F9EFE4866B72C99028D745DD4"><enum>(C)</enum><text display-inline="yes-display-inline">the manufacturer or seller of the durable
			 good affirmatively suppressed or hid, with the intent to deceive or defraud,
			 the existence of such defect.</text>
				</subparagraph></paragraph><paragraph id="HF8555788E0A0442DAD998152FC0465F2"><enum>(4)</enum><header>Seller</header><text>The
			 term <quote>seller</quote> means any dealer, retailer, wholesaler, or
			 distributer in the stream of commerce of a durable good concluding with the
			 sale or lease of the durable good to the first end-user.</text>
			</paragraph><paragraph id="HE5BEF329D2154496B01F5976AB00FFE8"><enum>(5)</enum><header>State</header><text>The
			 term <term>State</term> means any State of the United States, the District of
			 Columbia, the Commonwealth of Puerto Rico, the Northern Mariana Islands, the
			 Virgin Islands, Guam, American Samoa, any other territory or possession of the
			 United States, and any political subdivision of any of the foregoing.</text>
			</paragraph></section><section id="HDF9BE92DD784486EBEA3AB316D17BB73"><enum>4.</enum><header>Effective date;
			 application of Act</header>
			<subsection id="H9641C579074D483687FCA5A06449CFC3"><enum>(a)</enum><header>Effective
			 date</header><text>Except as provided in subsection (b), this Act shall take
			 effect on the date of the enactment of this Act without regard to whether the
			 damage to property or death or personal injury at issue occurred before such
			 date of enactment.</text>
			</subsection><subsection id="H70AF682C836B49910000A89653A83444"><enum>(b)</enum><header>Application of
			 Act</header><text>This Act shall not apply with respect to civil actions
			 commenced before the date of the enactment of this Act.</text>
