<official-title>To transfer certain land in Riverside County, California, and San Diego County, California, from the Bureau of Land Management to the United States to be held in trust for the Pechanga Band of Luiseno Mission Indians, and for other purposes.</official-title>

<section id="H60FFE7045FFB4BE50079460682EB6272" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Pechanga Band of Luiseno Mission Indians Land Transfer Act of 2005</short-title></quote>.</text></section> 
<section id="H41873E934D224D67A8D8DCFDEFD4A300"><enum>2.</enum><header>Transfer of land in trust for pechanga band of luiseno mission indians</header> 
<subsection id="HB54A7F43437C4B719C81D212DCB12D4F"><enum>(a)</enum><header>Transfer and Administration</header> 
<paragraph id="HDFE31DD8D5AD44450097003512D53AD"><enum>(1)</enum><header>Transfer</header><text>Effective on the date of the enactment of this Act and subject to valid existing rights, all right, title, and interest of the United States in and to the Federal lands described in subsection (b), including all improvements thereon, appurtenances thereto, and rights to all minerals thereon or therein, including oil and gas, water, and related resources, shall be held by the United States in trust for the Pechanga Band of Luiseno Mission Indians, a federally recognized Indian tribe.</text></paragraph> 
<paragraph id="H686687EB8F9E4FAB8BF2801CA62133A5"><enum>(2)</enum><header>Administration</header><text>The transferred land shall be declared part of the Pechanga Indian Reservation and administered in accordance with—</text> 
<subparagraph id="H90EAEC15C4C14ECD850067ED1EDBA9CD"><enum>(A)</enum><text>the laws and regulations generally applicable to property held in trust by the United States for an Indian tribe; and</text></subparagraph> 
<subparagraph id="H10C7236CE057409B9CF1271DFD5B64C7"><enum>(B)</enum><text display-inline="yes-display-inline">a memorandum of understanding entered into between the Pechanga Band of Luiseno Mission Indians and the United States Fish and Wildlife Service. </text></subparagraph></paragraph></subsection> 
<subsection id="H80A580EF4E7042ECB0C52E86D91C782B"><enum>(b)</enum><header>Description of Land</header><text>The lands referred to in subsection (a) consist of approximately 990.74 acres in Riverside County, California, and San Diego County, California, as referenced on the map titled, <quote>H.R. 4908, Pechanga Land Transfer Act</quote> and dated September 13, 2004, which, before the transfer under such subsection, were administered by the Bureau of Land Management and are more particularly described as follows:</text> 
<paragraph id="H391B4DCA51C54A288628B88FC4F13F9"><enum>(1)</enum><text>Sections 29, 30, and 32 of township 8 south, range 2 west, San Bernardino base and meridian.</text></paragraph> 
<paragraph id="HD1E5D0999FD84974AD1B246C5DCFE695"><enum>(2)</enum><text>Section 6 of township 9 south, range 2 west, San Bernardino base and meridian.</text></paragraph> 
<paragraph id="H146E81B38E77421287A89BDDEF306052"><enum>(3)</enum><text>Mineral Survey 3540, section 22 of township 5 south, range 4 west, San Bernardino base and meridian.</text></paragraph></subsection> 
<subsection id="HFF451C960174420C8072D6D22DE1BB36"><enum>(c)</enum><header>Survey</header><text>Not later than 180 days after the date of the enactment of this Act, the Office of Cadastral Survey of the Bureau of Land Management shall complete a survey of the lands transferred under subsection (a) for the purpose of establishing the boundaries of the lands.</text></subsection> 
<subsection id="H1426747CB5A54EB991A07C71F82F209"><enum>(d)</enum><header>Map on File</header><text>The map referred to in subsection (b) shall be on file in the appropriate offices of the Bureau of Land Management.</text></subsection> 
<subsection id="H33FD181D95E9403FB016FE2B00131122"><enum>(e)</enum><header>Legal Descriptions</header> 
<paragraph id="H26300484F82E420FBA64D1D9A972C8E7"><enum>(1)</enum><header>Publication</header><text>On approval of the survey completed under subsection (c) by the duly elected tribal council of the Pechanga Band of Luiseno Mission Indians, the Secretary of the Interior shall publish in the Federal Register—</text> 
<subparagraph id="H19698A43885A463991EA66BE6F320903"><enum>(A)</enum><text>a legal description of the boundary lines; and</text></subparagraph> 
<subparagraph id="H50DFAD7FE96F4C2C00E1B50383950E6"><enum>(B)</enum><text>legal description of the lands transferred under subsection (a).</text></subparagraph></paragraph> 
<paragraph id="HA5046BF3548A4CD9999F6E006D895318"><enum>(2)</enum><header>Effect</header><text>Beginning on the date on which the legal descriptions are published under paragraph (1), such legal descriptions shall be the official legal descriptions of the boundary lines and the lands transferred under subsection (a).</text></paragraph></subsection> 
<subsection id="H9346EDE00BBB47EFA865F215D6831346"><enum>(f)</enum><header>Rules of Construction</header><text>Nothing in this Act shall—</text> 
<paragraph id="H5F8C1BDD413B4949832D00804BC671BB"><enum>(1)</enum><text>enlarge, impair, or otherwise affect any right or claim of the Pechanga Band of Luiseno Mission Indians to any land or interest in land that is in existence before the date of the enactment of this Act; or</text></paragraph> 
<paragraph id="H204C579B892D4DE08038A2C4D6DCD00"><enum>(2)</enum><text>affect any water right of the Pechanga Band of Luiseno Mission Indians in existence before the date of the enactment of this Act.</text></paragraph></subsection> 
<subsection id="HB1E8B9E8556A4C7E9DF8C9CB215AFD5"><enum>(g)</enum><header>Restricted Use of Transferred Lands</header><text>The lands transferred under subsection (a) may be used only for the protection, preservation, and maintenance of the archaeological, cultural, and wildlife resources thereon.</text></subsection></section>
