<official-title>To prohibit discrimination in the provision of life insurance on the basis of a person’s previous lawful travel experiences.</official-title>

<section section-type="section-one" id="H192C5215A0074F19B2245652C7CC37CE" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Life Insurance Anti-Discrimination in Travel Act</short-title></quote>.</text></section>
<section id="H0CB465CF835D406A81E9DE3395D30832"><enum>2.</enum><header>Prohibition of discrimination based on previous lawful travel experiences</header>
<subsection id="H719B11DC3E1F490DA2ACC1280027AA24"><enum>(a)</enum><header>In general</header><text>It shall be unlawful to deny any person life insurance coverage, or to make any distinction or otherwise discriminate in the issuance, cancellation, terms (including premium rates), or conditions of life insurance coverage, based upon the past lawful travel experiences of such person.</text></subsection>
<subsection id="H9A6A2C4C05884322BD85FB44A210B5C8"><enum>(b)</enum><header>Definition</header>
<paragraph id="HD97988636F0348D6AEADBF676604F6F8"><enum>(1)</enum><header>In general</header><text>For purposes of this Act, the term <term>life insurance</term> means insurance for which the probabilities of the duration of human life or the rate of mortality are an element or condition of insurance.</text></paragraph>
<paragraph id="H6C0893E4E6B04704BC44B5FA60A718FE"><enum>(2)</enum><header>Included insurance</header><text>Such term includes the granting of—</text>
<subparagraph id="H7CC40EFDB88942A9B9AF01CB6174A0EB"><enum>(A)</enum><text>endowment benefits;</text></subparagraph>
<subparagraph id="H17D3FFEFE3A24188A1185CE68EEF1024"><enum>(B)</enum><text>additional benefits in the event of death by accident or accidental means;</text></subparagraph>
<subparagraph id="H36015B7BD5BC4A91AA5C29E363F056D"><enum>(C)</enum><text>disability income benefits;</text></subparagraph>
<subparagraph id="HF95893C19EFA48AE82BA388C2DD7DCD4"><enum>(D)</enum><text>additional disability benefits that operate to safeguard the contract from lapse or to provide a special surrender value, or special benefit in the event of total and permanent disability;</text></subparagraph>
<subparagraph id="HE037C580C0D7448EB39DBB2FA342DDBF"><enum>(E)</enum><text>benefits that provide payment or reimbursement for long-term home health care, or long-term care in a nursing home or other related facility;</text></subparagraph>
<subparagraph id="H881A62232D62421899A32CC0F5C1BB33"><enum>(F)</enum><text>burial insurance; and</text></subparagraph>
<subparagraph id="H71FFA448DF4F4CC9BB267C67D553A559"><enum>(G)</enum><text>optional modes of settlement of proceeds of life insurance.</text></subparagraph></paragraph>
<paragraph id="H13C805AF23A044D09684BC5750B91266"><enum>(3)</enum><header>Exclusions</header><text>Such term does not include property and casualty insurance, health insurance (except as otherwise provided in paragraph (2)), or workers compensation insurance.</text></paragraph></subsection></section>
<section id="HB581C5DFF6014E5C9D1DB45D349C7E71"><enum>3.</enum><header>Enforcement</header><text display-inline="no-display-inline">A violation of this section constitutes an unfair method of competition and an unfair or deceptive act or practice under section 5(a)(1) of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/45">15 U.S.C. 45(a)(1)</external-xref>).</text></section>
<section id="H1580E7E1FA654E1F9365D3A720F4AA12"><enum>4.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act shall take effect upon the expiration of the 60-day period beginning on the date of the enactment of this Act and shall apply to any policy for life insurance coverage issued, renewed, altered, or modified after the expiration of such period.</text></section>
