<official-title>To amend title 31, United States Code, to allow certain local tax debt to be collected through the reduction of Federal tax refunds.</official-title>

<section section-type="section-one" id="H66773D070C0944A3BDAD1F89A1047C1" display-inline="no-display-inline"><enum>1.</enum><header>Expansion of tax refund reduction provision to include certain local tax debt</header> 
<subsection id="H65A8CEA5EECF4A65BAA37722A5D6169C"><enum>(a)</enum><text><external-xref legal-doc="usc" parsable-cite="usc/31/3720A">Section 3720A</external-xref> of title 31, United States Code (relating to reduction of tax refund by amount of debt) is amended by adding at the end the following:</text>

<subsection id="HE9DC0D7EDA304D8D932B1060E9D0085"><enum>(j)</enum><header>Collection of past-due legally enforceable local government tax obligations</header> 
<paragraph display-inline="yes-display-inline" id="HE327C34055744506BFAF328C0C3EB00"><enum>(1)</enum><text>Upon receiving notice from any State on behalf of a local government that a named person owes a past-due, legally enforceable tax obligation to such local government, the Secretary of the Treasury shall, under such conditions as may be prescribed by the Secretary, determine whether any amounts, as refunds of Federal taxes paid, are payable to such person. If the Secretary of the Treasury finds that any such amount is payable, he shall—</text> 
<subparagraph indent="up1" id="HF816F369155444288842205B30BA68A5"><enum>(A)</enum><text>reduce such refunds by an amount equal to the amount of such debt;</text></subparagraph> 
<subparagraph indent="up1" id="H02A7C8C90827489F974B61096971FDCB"><enum>(B)</enum><text>pay the amount of such reduction to the State for purposes of payment by the State to the local government on behalf of which the State submitted the notice;</text></subparagraph> 
<subparagraph indent="up1" id="H5A61E6E2D8714C8D8100CFB1BE1102A0"><enum>(C)</enum><text>notify the State of the person’s name, taxpayer identification number, address, and the amount collected; and</text></subparagraph> 
<subparagraph indent="up1" id="H2BBB001671064DC99C6652B07D971272"><enum>(D)</enum><text>notify the person due the refund that the refund has been reduced by an amount necessary to satisfy a past-due, legally enforceable tax obligation.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="H8BDE57A32E664772B3A1B85ED29FE87"><enum>(2)</enum><header>Priorities for offset</header> 
<subparagraph display-inline="yes-display-inline" id="H9E43B772F0874D04845C0551D7CBAA90"><enum>(A)</enum><text>Any overpayment (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/6401">section 6401</external-xref> of the Internal Revenue Code of 1986) by a person shall be reduced pursuant to this subsection—</text> 
<clause indent="up1" id="H07A789BB66F243F3A607005CFED13CB9"><enum>(i)</enum><text>after such overpayment is reduced (I) with respect to any liability for any internal revenue tax on the part of the person who made the overpayment; (II) with respect to past-due support (as defined in section 464(c) of the <act-name parsable-cite="SSA">Social Security Act</act-name>); (III) with respect to any past-due, legally enforceable debt owed to a Federal agency; and (IV) with respect to any past-due, legally enforceable State income tax obligation (as defined in <external-xref legal-doc="usc" parsable-cite="usc/26/6402">section 6402(e)</external-xref> of the Internal Revenue Code of 1986); and</text></clause> 
<clause indent="up1" id="H2926EB3F0B064C67A1E9691C25FE7B78"><enum>(ii)</enum><text>before such overpayment is credited to the future liability for any Federal internal revenue tax of such person.</text></clause></subparagraph> 
<subparagraph indent="up1" id="H96B3680D02154354B681CE2DACFF5FB"><enum>(B)</enum><text>If the Secretary receives notice from one or more States (on behalf of local governments) of more than one tax obligation subject to paragraph (1) that is owed by such person to any local government, any overpayment by such person shall be applied against such debts in the order in which such notices were filed.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="H7672322A346D4B2181A0684930012EF"><enum>(3)</enum><header>Notice; consideration of evidence</header><text>No State may take action under this subsection on behalf of a local government until the local government certifies to the State that the local government—</text> 
<subparagraph id="H16AB38DE33464817A34D458EF6D65E40"><enum>(A)</enum><text display-inline="yes-display-inline"> has notified the person owing the past-due, legally enforceable tax obligation by certified mail with return receipt that the State (on behalf of the local government) proposes to take action pursuant to this section;</text></subparagraph> 
<subparagraph id="H12B4B5E673D24081ABF06955A2A0E522"><enum>(B)</enum><text>has given such person at least 60 days to present evidence that all or part of such liability is not past-due or not legally enforceable;</text></subparagraph> 
<subparagraph id="HCE155496D7BC4EA1946CC21161E906D8"><enum>(C)</enum><text>has considered any evidence presented by such person and has determined that an amount of such debt is past-due and legally enforceable; and</text></subparagraph> 
<subparagraph id="HD8395A92347146FC8DDF63BD321CA82"><enum>(D)</enum><text>has satisfied such other conditions as the Secretary may prescribe to ensure that the determination made under subparagraph (C) is valid and that the local government has made reasonable efforts to obtain payment of such tax obligation.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="HB196EE60445C4E3291F4009DFCE88906"><enum>(4)</enum><header>Definition of past-due, legally enforceable tax obligation</header><text>In this subsection, the term <term>past-due, legally enforceable tax obligation</term> means a tax debt—</text> 
<subparagraph id="H7A3B23B07BA848B4976829ADDA0065CE"><enum>(A)</enum> 
<clause display-inline="yes-display-inline" id="HB2BD453664484AB39B09CA03EB9DEBF"><enum>(i)</enum><text>which resulted from—</text> 
<subclause indent="up1" id="H4FC30AA473C74282A9223BFDA7C9B73F"><enum>(I)</enum><text>a judgment rendered by a court of competent jurisdiction which has determined an amount of tax to be due; or</text></subclause> 
<subclause indent="up1" id="H19877F982CC54F448B25ED1E56F6B26C"><enum>(II)</enum><text>a determination after an administrative hearing which has determined an amount of tax to be due; and</text> 
<item indent="up2" id="H24C471C4CCE04F5488BEABF7924666FD"><enum>(ii)</enum><text>which is no longer subject to judicial review; or</text></item></subclause></clause></subparagraph> 
<subparagraph id="HF504B010794749799D52BE5900C76BC"><enum>(B)</enum><text>which resulted from a tax which has been assessed but not collected, the time for redetermination of which has expired, and which has not been delinquent for more than 10 years.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="H78042B5C3C094FA1BE1900C8E7B23817"><enum>(5)</enum><header>Regulations</header><text>The Secretary shall issue regulations prescribing the time and manner in which States (on behalf of local governments) must submit notices of past-due, legally enforceable tax obligations and the necessary information that must be contained in or accompany such notices. The regulations shall specify the types of taxes and the minimum amount of debt to which the reduction procedure established by paragraph (1) may be applied. The regulations may require States (on behalf of local governments) to pay a fee to reimburse the Secretary for the cost of applying such procedure, and such fee may be reimbursed by local governments to States in accordance with applicable State law. Any fee paid to the Secretary pursuant to the preceding sentence shall be used to reimburse appropriations which bore all or part of the cost of applying such procedure. </text></paragraph> 
<paragraph indent="up1" id="HC80A949E636342E5A532C5D820698B9B"><enum>(6)</enum><header>Erroneous payment to State</header><text>Any State receiving notice from the Secretary that an erroneous payment has been made to such State with respect to a notice by the State on behalf of a local government under paragraph (1) shall pay promptly to the Secretary, in accordance with such regulations as the Secretary may prescribe, an amount equal to the amount of such erroneous payment (without regard to whether any other amounts payable to such State under such paragraph have been paid to such State). </text></paragraph></subsection> 
<subsection id="HF66B2BA08A5B49049B68008562FB65C"><enum>(k)</enum><header>Treatment of payments made to States</header><text>The Secretary may provide that, for the purposes of determining interest, the payment of any amount withheld under subsection (j) to a State (on behalf of a local government) shall be treated as a payment to the person or persons making the overpayment.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE94AFB61A77743088C1C27E1642DB4E5"><enum>(b)</enum><header>Disclosure of certain information to agencies of States requesting refund offsets for past-due, legally enforceable tax obligations</header><text>Paragraph (10) of <external-xref legal-doc="usc" parsable-cite="usc/26/6103">section 6103(l)</external-xref> of the Internal Revenue Code of 1986 is amended—</text> 
<paragraph id="HC3E05A3DD29F4E9B90746012FA882AD"><enum>(1)</enum><text>in the paragraph heading, by inserting after <quote><header-in-text level="paragraph" style="OLC">6402</header-in-text></quote> the following: <quote><header-in-text level="paragraph" style="OLC">or under subsection <enum-in-header>(j)</enum-in-header> of <external-xref legal-doc="usc" parsable-cite="usc/31/3720A">section 3720A</external-xref> of title 31, united states code</header-in-text></quote>;</text></paragraph> 
<paragraph id="H00978FEBCFBB44929BACFF68C792F28"><enum>(2)</enum><text>in subparagraph (A), by inserting after <quote>6402</quote> the following: <quote>or subsection (j) of <external-xref legal-doc="usc" parsable-cite="usc/31/3720A">section 3720A</external-xref> of title 31, United States Code,</quote>; and</text></paragraph> 
<paragraph id="HF5432475375545A3867D05884F54FBDD"><enum>(3)</enum><text>in subparagraph (B)—</text> 
<subparagraph id="H77E385E494C941929BA7D2AB259939A5"><enum>(A)</enum><text>by striking <quote>section 6402 is</quote> and inserting <quote>section 6402 or under subsection (j) of <external-xref legal-doc="usc" parsable-cite="usc/31/3720A">section 3720A</external-xref> of title 31, United States Code, is</quote>; and</text></subparagraph> 
<subparagraph id="HCE68817533CC49FBB557F4321D5144CF"><enum>(B)</enum><text>by striking <quote>section 6402.</quote> and inserting <quote>section 6402 or under subsection (j) of <external-xref legal-doc="usc" parsable-cite="usc/31/3720A">section 3720A</external-xref> of title 31, United States Code.</quote>.</text></subparagraph></paragraph></subsection></section>
