<official-title>To amend title 10, United States Code, to enhance the protection of members of the Armed Forces and their spouses from unscrupulous financial services sales practices through increased consumer education, and for other purposes.</official-title>

<section section-type="section-one" id="HE7A99EDAC57C445FAF3D5E642C9CB47B" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Personnel Financial Services Education Act of 2005</short-title></quote>.</text></section> 
<section id="HC551E70DF14E43AAB38EDEBF1FE741EB"><enum>2.</enum><header>Consumer education for members of the Armed Forces and their spouses on insurance and other financial services</header> 
<subsection id="H08D8DAEEBA39458780B7193C1C9BA50"><enum>(a)</enum><header>Education and counseling requirements</header> 
<paragraph id="H7C5DE4309C5049CAAC3F01E4CEA2C31"><enum>(1)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/10/50">Chapter 50</external-xref> of title 10, United States Code, is amended by adding at the end the following new section:</text>

<section id="HEBC4F8923A464D03B9DD70246C418EBD"><enum>992.</enum><header>Consumer education: financial services</header> 
<subsection id="H7E7B31A5260E40D38982142B25BFB3D"><enum>(a)</enum><header>Requirement for consumer education program for members</header> 
<paragraph display-inline="yes-display-inline" id="H19F75E03A02D4831BA37A2ED05CB2B1"><enum>(1)</enum><text>The Secretary concerned shall carry out a program to provide comprehensive education to members of the armed forces under the jurisdiction of the Secretary on—</text> 
<subparagraph id="H9567D86E610A4F01BA2086EBB07DA65" indent="up1"><enum>(A)</enum><text>financial services that are available under law to members;</text></subparagraph> 
<subparagraph id="H8410B871CB454853A100095C8886E373" indent="up1"><enum>(B)</enum><text>financial services that are routinely offered by private-sector sources to members;</text></subparagraph> 
<subparagraph id="H07F685ACDAF84B30B75437ECF39D1E69" indent="up1"><enum>(C)</enum><text>practices relating to the marketing of private-sector financial services to members;</text></subparagraph> 
<subparagraph id="H6E35BE20B4A04735BD8207409B3F614C" indent="up1"><enum>(D)</enum><text>such other matters relating to financial services available to members, and the marketing of financial services to members, as the Secretary considers appropriate; and</text></subparagraph> 
<subparagraph id="HADBEA4A116664156875DC794C57D63B9" indent="up1"><enum>(E)</enum><text>such other financial practices as the Secretary considers appropriate.</text></subparagraph></paragraph> 
<paragraph id="HB26DB2212C13441F979F8CEC6DCEA0C8" indent="up1"><enum>(2)</enum><text>Training under this subsection shall be provided to members—</text> 
<subparagraph id="HDC1981987AD4486FB8C2097085DDB2CC"><enum>(A)</enum><text>as a component of the members’ initial entry training;</text></subparagraph> 
<subparagraph id="H5D527729250341B9838868D000E0077"><enum>(B)</enum><text>as a component of each level of the members’ professional development training that is required for promotion; and</text></subparagraph> 
<subparagraph id="HFD760F8519494A8FBB05AD510004A696"><enum>(C)</enum><text>as a component of periodically recurring required training that is provided for the members at military installations.</text></subparagraph></paragraph> 
<paragraph id="HC407A476E8094EA79EF5A787AB615504" indent="up1"><enum>(3)</enum><text>The training provided at a military installation under paragraph (2)(C) shall include information on any financial services marketing practices that are particularly prevalent at that military installation and in the vicinity.</text></paragraph></subsection> 
<subsection id="HC287C05DDE6340C4BAFA581575CD3643"><enum>(b)</enum><header>Counseling for members and spouses</header> 
<paragraph display-inline="yes-display-inline" id="HF58D26C77EE74212B49F06AC7D3F00CB"><enum>(1)</enum><text>The Secretary concerned shall provide counseling on financial services to each member of the armed forces under the jurisdiction of the Secretary.</text></paragraph> 
<paragraph id="H5FBE9A017BD0477FB0B5C1BDDCF02900" indent="up1"><enum>(2)</enum><text>The Secretary concerned shall, upon request, provide counseling on financial services to the spouse of any member of the armed forces under the jurisdiction of the Secretary.</text></paragraph> 
<paragraph id="H0049C1BC943242C88DE8D0A7821D00EF" indent="up1"><enum>(3)</enum><text>The Secretary concerned shall provide counseling on financial services under this subsection as follows:</text> 
<subparagraph id="H8A733187D4574E26B04E52E1503E7600"><enum>(A)</enum><text>In the case of members, and the spouses of members, assigned to a military installation to which at least 750 members of the armed forces are assigned, through a full-time financial services counselor at such installation.</text></subparagraph> 
<subparagraph id="H9D2FE2AA00F14A3D8C88F43C40B23C74"><enum>(B)</enum><text>In the case of members, and the spouses of members, assigned to a military installation other than an installation described in subparagraph (A), through such mechanisms as the Secretary considers appropriate, including through the provision of counseling by a member of the armed forces in pay grade E–7 or above, or a civilian, at such installation who provides such counseling as a part of the other duties performed by such member or civilian, as the case may be, at such installation.</text></subparagraph></paragraph> 
<paragraph id="H943B4829163943C48106D618E73875BC" indent="up1"><enum>(4)</enum><text>Each financial services counselor under paragraph (2)(A), and each individual providing counseling on financial services under paragraph (2)(B), shall be an individual who, by reason of education, training, or experience, is qualified to provide helpful counseling to members of the armed forces and their spouses on financial services and marketing practices described in subsection (a)(1). Such individual may be a member of the armed forces or an employee of the Federal Government.</text></paragraph> 
<paragraph id="H5B3D9CD1C8714B6EBE3B266F30D9A1F5" indent="up1"><enum>(5)</enum><text>The Secretary concerned shall take such action as is necessary to ensure that each financial services counselor under paragraph (2)(A), and each individual providing counseling on financial services under paragraph (2)(B), is free from conflicts of interest relevant to the performance of duty under this section and, in the performance of that duty, is dedicated to furnishing members of the armed forces and their spouses with helpful information and counseling on financial services and related marketing practices.</text></paragraph> 
<paragraph id="H2FA754DC638445ADA2C6C42D44EEBC5" indent="up1"><enum>(6)</enum><text>The Secretary concerned may authorize financial services counseling to be provided to members of a unit of the armed forces by unit personnel under the guidance and with the assistance of a financial services counselor under paragraph (2)(A) or an individual providing counseling on financial services under paragraph (2)(B), as applicable.</text></paragraph></subsection> 
<subsection id="H836E80AB3DB641C800FCA006B00CEF"><enum>(c)</enum><header>Life insurance</header> 
<paragraph display-inline="yes-display-inline" id="H35390D0D5C804AC5B42EAEA2B57CFC"><enum>(1)</enum><text>In counseling a member of the armed forces, or the spouse of a member of the armed forces, under this section regarding life insurance offered by a private-sector source, a financial services counselor under subsection (b)(2)(A), or an individual providing counseling on financial services under subsection (b)(2)(B), shall furnish the member or spouse, as the case may be, with information on the availability of Servicemembers’ Group Life Insurance under subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/19">chapter 19</external-xref> of title 38, including information on the amounts of coverage available and the procedures for electing coverage and the amount of coverage.</text></paragraph> 
<paragraph id="HEF4CEC4F609C46638F273193FA2C901" indent="up1"><enum>(2)</enum> 
<subparagraph display-inline="yes-display-inline" id="HDA2338E841D54CDDACA671418F3720F7"><enum>(A)</enum><text>A junior enlisted member may not authorize payment to be made for private-sector life insurance by means of an allotment of pay to which the member is entitled under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/37/3">chapter 3</external-xref> of title 37 unless the authorization of allotment is accompanied by a written certification by a commander of the member, or by a financial services counselor referred to in subsection (b)(2)(A) or an individual providing counseling on financial services under subsection (b)(2)(B), as applicable, that the member has received counseling under paragraph (1) regarding the purchase of coverage under that private-sector life insurance.</text></subparagraph> 
<subparagraph id="H79997EC4BE24447600E5AF6EDC7B91BC" indent="up1"><enum>(B)</enum><text>Subject to subparagraph (C), a written certification described in subparagraph (A) may not be made with respect to a member’s authorization of allotment as described in subparagraph (A) until 7 days after the date of the member’s authorization of allotment in order to facilitate the provision of counseling to the member under paragraph (1).</text></subparagraph> 
<subparagraph id="H325E48FA53C14C70923393F3AC0804BE" indent="up1"><enum>(C)</enum><text>The commander of a member may waive the applicability of subparagraph (B) to a member for good cause, including the member’s imminent change of station.</text></subparagraph> 
<subparagraph id="HA96C6D2D25394BC787A18D9D7D2328D6" indent="up1"><enum>(D)</enum><text>In this paragraph, the term <term>junior enlisted member</term> means a member of the armed forces in any of pay grades E–1 through E–4.</text></subparagraph></paragraph></subsection> 
<subsection id="H64D31DA19C654713BD31F44EB5213662"><enum>(d)</enum><header>Financial services defined</header><text>In this section, the term <term>financial services</term> includes the following:</text> 
<paragraph id="HBDD0C3FAE14F49FE8BE6934FCE92AD7B"><enum>(1)</enum><text>Life insurance, casualty insurance, and other insurance.</text></paragraph> 
<paragraph id="H49DEEBF01CE541E29FC89DBCB1177547"><enum>(2)</enum><text>Investments in securities or financial instruments.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HC64AE5C5AD574AEBA0537D34873F1172"><enum>(2)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text>

<toc-entry level="section">992. Consumer education: financial services</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HE9ED651FFB654D2580B094210000B152"><enum>(b)</enum><header>Continuing effect of existing allotments for life insurance</header><text>Subsection (c)(2) of <external-xref legal-doc="usc" parsable-cite="usc/10/992">section 992</external-xref> of title 10, United States Code (as added by subsection (a)), shall not affect any allotment of pay authorized by a member of the Armed Forces before the effective date of such section.</text></subsection> 
<subsection id="H0318ECDCD2254DB5B600840038598EC2"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the first day of the first month that begins more than 120 days after the date of the enactment of this Act.</text></subsection></section>
