<official-title>To amend the Real Estate Settlement Procedures Act of 1974 to provide for homeowners to recover treble damages from mortgage escrow servicers for failures by such servicers to make timely payments from escrow accounts for homeowners insurance, taxes, or other charges, and for other purposes.</official-title>

<section section-type="section-one" id="HD9FB7C2936724F96B79FAB199329CF06" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Homeowners’ Escrow Payments Assurance Act</short-title></quote>.</text></section> 
<section id="HB6D57C5D5B3944FDBFBC6FDCAFC2F93"><enum>2.</enum><header>Treble damages for failure to make payments from escrow account</header><text display-inline="no-display-inline">Section 6(f) of the Real Estate Settlement Procedures Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/12/2605">12 U.S.C. 2605(f)</external-xref>) is amended—</text> 
<paragraph id="H998850F525A045E685D0D35986B755EE"><enum>(1)</enum><text>in paragraph (1), by striking subparagraph (A) and inserting the following new subparagraph:</text>

<subparagraph id="H6E61097E44984A36969190E904F1CE00"><enum>(A)</enum> 
<clause display-inline="yes-display-inline" id="HC024B18A3DFD49DCBD49325E98EB0073"><enum>(i)</enum><text>except as provided in clause (ii), any actual damages to the borrower as a result of the failure; or</text></clause> 
<clause indent="subparagraph" id="H3D4DE9F7C9D54FA9AA9BC1ED9E193330"><enum>(ii)</enum><text>in the case of an action for a failure to comply with the requirements of subsection (g), 3 times any such actual damages; and</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HC6F380E11EB4452DB2F500D5AF335329"><enum>(2)</enum><text>in paragraph (2), by striking subparagraph (A) and inserting the following new subparagraph:</text>

<clause display-inline="yes-display-inline" id="H28AFD5E169E54C9EB572D4BEFDE16F1"><enum>(i)</enum><text>except as provided in clause (ii), any actual damages to each of the borrowers in the class as a result of the failure; or</text></clause> 
<clause indent="subparagraph" id="H9EAB16288BCA4CE1A8FA41E9EA9B2F71"><enum>(ii)</enum><text>in the case of an action for a failure to comply with the requirements of subsection (g), 3 times any such actual damages; and</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H69813123D8BB45969E1C41A2FA662F98"><enum>3.</enum><header>Fine for failure to make payments from escrow account resulting in lapse in insurance coverage</header><text display-inline="no-display-inline">Section 6 of the Real Estate Settlement Procedures Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/12/2605">12 U.S.C. 2605</external-xref>) is amended—</text> 
<paragraph id="HEACF31A3977C41DB8D440000F9DEABD"><enum>(1)</enum><text>by redesignating subsections (h) through (j) as subsections (i) through (k), respectively; and</text></paragraph> 
<paragraph id="H7E4561AF1D0840679814DD67C4DB3E5"><enum>(2)</enum><text>by inserting after subsection (g) the following new subsection:</text>

<subsection id="HC7F2591E840F4EF08148F9612940514"><enum>(h)</enum><header>Fine for failure to make payments from escrow account resulting in lapse in insurance coverage</header> 
<paragraph id="HE435C72A54604B688FEE8E77F1A148E5"><enum>(1)</enum><header>In general</header><text>If the servicer of a federally related mortgage loan collects payments from the borrower for deposit into an escrow account for the purpose of assuring payment of insurance premiums and a failure by the servicer to make timely payments from the escrow account for such insurance premiums results in a lapse in such insurance coverage for any period of time, the Secretary shall assess against the servicer a civil penalty of $1,000 for each full or partial day of such lapse.</text></paragraph> 
<paragraph id="H6324C3813DAC4117A6AC2D67C2E9C0EF"><enum>(2)</enum><header>Use of amounts</header><text>The amounts collected by the Secretary from fines under this section shall be available to the Secretary, to the extent provided in appropriation Acts, as follows:</text> 
<subparagraph id="H52B34013C5F34AC6BBFFE288587B8D37"><enum>(A)</enum><header>Downpayment assistance</header><text>90 percent of any such amounts shall be available only for the Secretary to carry out a program to provide assistance to low-income families (as such term is defined in section 3(b) of the <act-name parsable-cite="USHA">United States Housing Act of 1937</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1437a">42 U.S.C. 1437a(b)</external-xref>) for use as downpayments for the acquisition of principal residences.</text></subparagraph> 
<subparagraph id="H60E99C85488A49D684462E4698AA325B"><enum>(B)</enum><header>Consumer advocacy assistance</header><text>10 percent of any such amounts shall be available only for the Secretary to provide assistance for nonprofit organizations that engage in legal advocacy activities relating to protection of consumer rights, which shall be selected by the Secretary in consultation with the Attorney General.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
