<official-title>To extend the protections of the Truth in Lending Act to overdraft protection programs and services provided by depository institutions, to require customer consent before a depository institution may initiate overdraft protection services and fees, to enhance the information made available to consumers relating to overdraft protection services and fees, to prohibit systematic manipulation in the posting of checks and other debits to a depository account for the purpose of generating overdraft protection fees, and for other purposes.</official-title>

<section id="HFB0681D00E6A46D3A65369D082BE53C1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Consumer Overdraft Protection Fair Practices Act</short-title></quote>.</text></section> 
<section id="H46444DAD12F24BB58353F3BF21BDF7C5"><enum>2.</enum><header>Restrictions on overdraft protection programs or services</header> 
<subsection id="HE4B2DF62042C4F0D9B6C8FEC686E2E9"><enum>(a)</enum><header>Truth in Lending Act amendments</header> 
<paragraph id="HAC78DC4F262446A898204760E900C317"><enum>(1)</enum><header>Definition</header><text>Section 103 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1602">15 U.S.C. 1602</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H0F2C6B2F959443FD846416565F2117E"><enum>(cc)</enum><header>Terms relating to short-term extensions of credit under overdraft protection programs</header> 
<paragraph id="HDD84B48CD3A04920B2AF91C854E3D3F3"><enum>(1)</enum><header>Overdraft protection fee</header><text display-inline="yes-display-inline">The term <quote>overdraft protection fee</quote> means any fee or charge imposed in connection with any account on which checks or other debits are paid by the institution in which such account is held even though there are insufficient funds in the account to cover such checks or other debits, unless such fee or charge—</text> 
<subparagraph id="HCB986C4ACCAE4D4181E995DAB7F7906"><enum>(A)</enum><text>is imposed on an incidental basis as a customer accommodation and no more than 3 such overdraft fees are imposed during any calendar year; </text></subparagraph> 
<subparagraph id="HEA4C6B2EC186461EB3DD26308263FEB"><enum>(B)</enum><text display-inline="yes-display-inline">is imposed in connection with an extension of credit to a transaction account of a consumer under a written open end consumer credit plan the purpose of which is to cover any check presented against, electronic fund transfer from, or other debit of the account for the payment of which there are insufficient funds in the account; or </text></subparagraph> 
<subparagraph id="H3BCE6214B3C943F4AFC676937DD4CBE"><enum>(C)</enum><text>has been disclosed in connection with a program under which the overdraft is covered by funds transferred from another deposit, share, or other asset account.</text></subparagraph></paragraph> 
<paragraph id="HAC0C878E0C16422A8BE0CDFF29224E54"><enum>(2)</enum><header>Other terms</header> 
<subparagraph id="HB4AE1D33AD8347FDAC87E75B5C5CF4F6"><enum>(A)</enum><header>Check</header><text>The term <quote>check</quote> has the same meaning as in section 3(6) of the Check Clearing for the 21st Century Act.</text></subparagraph> 
<subparagraph id="HB7AF029CDC9D4D5F89192585ADF53739"><enum>(B)</enum><header>Other debits</header><text>The term <quote>other debits</quote> includes withdrawals from an account by the consumer through an automated teller machine and electronic fund transfers from an account that are initiated or authorized by the consumer.</text></subparagraph> 
<subparagraph id="H164F2F38C96C4BFAB26FE43DBB9542E7"><enum>(C)</enum><header>Electronic fund transfer</header><text>The term <quote>electronic fund transfer</quote> has the same meaning as in section 903.</text></subparagraph> 
<subparagraph id="H177DBD0E05744D0896CBEA2200951836"><enum>(D)</enum><header>Account</header><text display-inline="yes-display-inline">The term <quote>account</quote> means any account intended for use by and generally used by a consumer primarily for personal, family, or household purposes into which the consumer deposits funds.</text></subparagraph> 
<subparagraph id="HEDED354D8C4840F4BEB4E9314400E662"><enum>(E)</enum><header>Transaction account</header><text>The term <quote>transaction account</quote> has the same meaning as in section 19(b)(1)(C) of the Federal Reserve Act.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H15DD35BF723B414281E17CAE472C096D"><enum>(2)</enum><header>Restrictions on overdraft protection programs or services</header> 
<subparagraph id="H437B7AA274524072BFE59150D2DC06FC"><enum>(A)</enum><header>In general</header><text>Chapter 2 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1631">15 U.S.C. 1631 et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section id="H33C0507BA8794B1997C6F662DA37A608"><enum>140.</enum><header>Restrictions on overdraft protection programs or services</header> 
<subsection id="H4A459168F60343D0B11976701D2977D8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">In the case of any transaction account of a consumer at any institution, no overdraft protection fee may be imposed on such account for any extension of funds by the institution to cover any check or other debit for which there are insufficient funds in the consumer’s account to pay such check or other debit, unless—</text> 
<paragraph id="H4653666EC29D48F9B7EB515C6300EE14"><enum>(1)</enum><text>the consumer has provided specific written consent to any program or service that provides for charging of such fees in connection with any such extension of funds; </text></paragraph> 
<paragraph id="H1582E5A513354E5DA48EBFE347679D4C"><enum>(2)</enum><text>such fee is imposed pursuant to the terms of a written agreement with the consumer which discloses, in a clear and conspicuous manner—</text> 
<subparagraph id="HC04EFC3ACC2A419FB99D00C019928B12"><enum>(A)</enum><text>the amount of any fee imposed in connection with paying an overdraft;</text></subparagraph> 
<subparagraph id="HD7814C58005E442F81CF533488FD818"><enum>(B)</enum><text>any applicable disclosure required by this title in connection with such extension of credit, including the amount of the finance charge in connection with such fee or fees, as required by section 106;</text></subparagraph> 
<subparagraph id="HBC2191C896514FDCB3526EC95DACA600"><enum>(C)</enum><text>the categories of transactions for which a fee for payment of an overdraft may be imposed, including whether an overdraft created by withdrawals at automated teller machines or other electronic fund transfers will be covered and a fee imposed;</text></subparagraph> 
<subparagraph id="HA8ECAD15F961493AAC991F13EF78C4F3"><enum>(D)</enum><text>the time period by which the consumer must repay or cover any extension of credit in the form of payment of an overdraft; and</text></subparagraph> 
<subparagraph id="H40ABE5660AFF4DC99C173700F8425391"><enum>(E)</enum><text>the circumstances under which the institution in which an account is held will not pay an overdraft; and</text></subparagraph> 
<subparagraph id="H177C36E53C794CD98FF628007E3CFFE"><enum>(F)</enum><text>other information required to be disclosed by regulation;</text></subparagraph></paragraph> 
<paragraph id="H0FFFA122EC1748E7B0D11B86478C22B9"><enum>(3)</enum><text display-inline="yes-display-inline">such fee is separately and conspicuously disclosed, each time the fee is imposed, in any periodic statement provided to the consumer with respect to such account.</text></paragraph></subsection> 
<subsection id="H1D7E3AC48B1240C38FFE890521ADD810"><enum>(b)</enum><header>Clarification relating to overdraft fees</header><text display-inline="yes-display-inline">In the case of any transaction account of a consumer at any institution, the prohibition against an overdraft protection fee under subsection (a) shall apply regardless of whether the amount of such fee is the same as, or less than, any fee imposed by the institution with respect to such account for a check or other debit that is returned unpaid.</text></subsection> 
<subsection id="HA5EEBB1E1F1345D7A2D6B22481C3E47"><enum>(c)</enum><header>Prohibition on misrepresentations</header><text display-inline="yes-display-inline">If any institution—</text> 
<paragraph id="H700587C25D3D4B2D879D7B6D66A5F8E1"><enum>(1)</enum><text display-inline="yes-display-inline">will not extend funds under specific circumstances to cover an overdraft in any transaction account of a consumer at the institution; or</text></paragraph> 
<paragraph id="H272D7290FC5E4E4B87B2CFDDBD95CAC4"><enum>(2)</enum><text display-inline="yes-display-inline">reserves the right to extend funds to pay any such overdraft on a discretionary basis,</text></paragraph><continuation-text continuation-text-level="subsection">any representation by such institution that the institution will extend credit to cover all overdrafts on such account shall be a violation of this title.</continuation-text></subsection> </section><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H57BBDEEC3514420E81BA5059957F3309"><enum>(B)</enum><header>Clerical amendment</header><text>The table of sections for chapter 2 of the Truth in Lending Act is amended by inserting after the item relating to section 139 the following new item:</text>

<subparagraph id="HFC0C907FBB2A4A4A8D9B8056DB2CE195"><enum>(A)</enum><header>In general</header><text>Chapter 3 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1661">15 U.S.C. 1661 et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section id="H4ECE528AE8894002800020D8989DB079"><enum>148.</enum><header>Restrictions on advertising of overdraft protection programs or services</header> 
<subsection id="HDF3CAF3105924BC5B719C792BDCBB779"><enum>(a)</enum><header>In general</header><text>In the case of an institution that maintains transaction accounts for consumers and offers a program or service under which the institution pays any overdraft on the account in exchange for payment of an overdraft protection fee, the institution may not make any of the following representations or statements with respect to such program or service in any advertisement or promotion:</text> 
<paragraph id="HB642EB18887F48B5826410CD37E00064"><enum>(1)</enum><text>Any representation or statement describing a transaction account as free or no cost if the account includes, or is promoted as including, overdraft protection services that involve the payment of overdraft protection fees.</text></paragraph> 
<paragraph id="HC3AB778888EF4338900661C76B4F92AF"><enum>(2)</enum><text>Any representation or statement encouraging use of the account as a service to meet short-term credit needs or to obtain advances on a consumer’s next payment of salary or wages.</text></paragraph> 
<paragraph id="HC3DCED8C7A094C4E0024DA332DC40010"><enum>(3)</enum><text>Any representation or statement that the financial institution will honor all checks or other debits presented against the account, if the institution retains discretion at any time not to honor any check or other debit presented.</text></paragraph> 
<paragraph id="H6ADB555C750440D1B6B6F1D9E242CFF8"><enum>(4)</enum><text>Any representation or statement that consumers may overdraw their accounts and maintain a negative balance, if the terms of the account require the consumer to promptly repay or cover any overdraft.</text></paragraph></subsection> 
<subsection id="H53B864CB63AE43F4BCB662EA80B06867"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Board shall prescribe regulations implementing the restrictions set forth in subsection (a) pursuant to the authority of the Board under section 18(f) of the Federal Trade Commission Act, and may, by regulation or order, restrict such additional acts or practices that the Board finds to be unfair or deceptive in connection with the offering, operation, and advertising of overdraft protection programs and services.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H9BB5F190E9984F6D953BF53CD4F6327"><enum>(B)</enum><header>Clerical amendment</header><text>The table of sections for chapter 3 of the Truth in Lending Act is amended by inserting after the item relating to section 147 the following new item:</text>

<paragraph id="H23C7BF9D287D4AE2BA765B14F5C5B9CF"><enum>(4)</enum><header>Clarification of finance charge</header><text>Section 106(a) of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1605">15 U.S.C. 1605(a)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H3F952A914945457D962CB8587CFE257"><enum>(7)</enum><text display-inline="yes-display-inline">Overdraft protection fee.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H1E45D3883A0E4509B781A2FAC4F4A903"><enum>(b)</enum><header>Electronic Fund Transfer Act amendments</header><text>Section 904 of the Electronic Fund Transfer Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1693b">15 U.S.C. 1693b</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block style="USC" id="HA99670A7C72E473C89C6232460D2F16E" display-inline="no-display-inline"> 
<subsection id="HDE01E8715AE14515AE5B4F165363603B"><enum>(e)</enum><header>Restrictions on overdraft protection services and fees</header> 
<paragraph id="HD24BE2CF5EAB4FBC89372F4283D5F49F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A financial institution that holds a consumer’s account may not impose an overdraft protection fee on the account in connection with any payment of an electronic fund transfer initiated by the consumer at an automated teller machine operated by the financial institution in spite of a lack of sufficient funds in the consumer’s account to pay such electronic fund transfer, unless—</text> 
<subparagraph id="H50315A86C9AD464CA1007DCEB0F52CE"><enum>(A)</enum><text display-inline="yes-display-inline">the consumer has affirmatively requested such service pursuant to section 140(a)(1);</text></subparagraph> 
<subparagraph id="HDA29E0BBE77D48C3A5A615BBFB2C7765"><enum>(B)</enum><text display-inline="yes-display-inline">the financial has provided a notice to the consumer, on the screen of the automated teller machine, or on a paper notice issued from such machine, after the transaction is initiated and before the consumer is irrevocably committed to completing the transaction, that the electronic fund transfer the consumer has requested may initiate an overdraft protection fee, together with the amount of any such fee;</text></subparagraph> 
<subparagraph id="H2DA19E3E88F240CE8E4600D1009E5BDC"><enum>(C)</enum><text display-inline="yes-display-inline">the consumer elects to continue in the manner necessary to effect the requested electronic fund transfer after receiving such notice; and</text></subparagraph> 
<subparagraph id="H8AD108D9E5874666A91C8DBD00489897"><enum>(D)</enum><text display-inline="yes-display-inline">the overdraft protection fee imposed in connection with such transaction is clearly disclosed in the written documentation of the electronic fund transfer required by section 906(a).</text></subparagraph></paragraph> 
<paragraph id="HCA5B5E2BB37D4A708980BCD11C1FBEF0"><enum>(2)</enum><header>Disclosure of account balances</header><text display-inline="yes-display-inline">In the case of any financial institution that offers a program or service under which the institution pays any overdraft on a consumer’s account in exchange for the imposition of an overdraft protection fee in accordance with paragraph (1), the financial institution shall, in response to a balance inquiry initiated by the consumer at an automated teller machine operated by the financial institution, disclose only the actual dollar balance in the consumer’s account at the time of the request, which shall not include any additional amount of credit or overdraft protection the financial institution will pay under any agreement with the consumer that permits the imposition of the overdraft protection fee.</text></paragraph> 
<paragraph id="H615F1413E07640A08F1430E76CA1EC89"><enum>(3)</enum><header>Overdraft protection fee defined</header><text>For purposes of this subsection, the term <quote>overdraft protection fee</quote> has the same meaning as in section 103(cc)(1).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE8895E1393E94573B1D3D09242F8A2F6"><enum>(c)</enum><header>Expedited Funds Availability Act amendments</header> 
<paragraph id="H5F7DEC7B5E9E4362B15F451E85F8BA56"><enum>(1)</enum><header>Definition</header><text>Section 602 of the Expedited Funds Availability Act (<external-xref legal-doc="usc" parsable-cite="usc/12/4001">12 U.S.C. 4001</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H304630424EFE4871B1252BF1033C007E"><enum>(26)</enum><header>Overdraft protection fee</header><text>The term <quote>overdraft protection fee</quote> has the same meaning as in section 103(cc)(1) of the Truth in Lending Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HF9E9DFDB550746F8B698A3E4B2B3069"><enum>(2)</enum><header>Restrictions on overdraft protection fees</header><text display-inline="yes-display-inline">Section 607 of the Expedited Funds Availability Act (<external-xref legal-doc="usc" parsable-cite="usc/12/4006">12 U.S.C. 4006</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="HA827EC16465F4DA3887BB55EDFA6DF00"><enum>(f)</enum><header>Restrictions on overdraft protection fees</header><text display-inline="yes-display-inline">A depository institution may not—</text> 
<paragraph id="HB7F05B99120D4085BE717E69B5E18591"><enum>(1)</enum><text display-inline="yes-display-inline">impose an overdraft protection fee on an account at such institution for paying any check drawn on the account in spite of a lack of sufficient funds in the account to pay such check or any similarly activity unless the accountholder has affirmatively requested such service pursuant to section 140(a)(1) of the Truth in Lending Act; or</text></paragraph> 
<paragraph id="HC2F0D881BA75410690BA4CDAA00EDD1"><enum>(2)</enum><text display-inline="yes-display-inline">engage in a pattern or practice of delaying the posting of any deposit in an account, or manipulating the process of posting any check or other debit against an account, for the purpose of initiating 1 or more overdrafts that trigger payment by the accountholder of an overdraft protection fee.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H5D8D75C74F4C4B0B895FDD26365BF37E"><enum>(d)</enum><header>Federal reserve board study of overdraft protection programs offered by financial institutions</header> 
<paragraph id="H4FD2D0AA53D04C83A540AE4F53F00DC"><enum>(1)</enum><header>Study required</header> 
<subparagraph id="H7DDB26E2C09540E3B8C40329D8E12862"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">The Board of Governors of the Federal Reserve System shall conduct a study of overdraft protection or avoidance programs and services offered by financial institutions to determine the extent to which such programs or services are available to consumers, the differences in operation and cost of such programs or services, and the benefits and risks of such programs or services for consumers. </text></subparagraph> 
<subparagraph id="H66D743DD7ED54474B21D65EDD477A4F3"><enum>(B)</enum><header>Areas for study</header><text>In conducting the study under subparagraph (A), the Board shall consider, among other issues—</text> 
<clause id="H876E528533DC43528620D98768EE2700"><enum>(i)</enum><text>the criteria used by financial institutions in designing or selecting overdraft protection programs and services; </text></clause> 
<clause id="HDCB48633F6EA4D47986522EEBDD255D2"><enum>(ii)</enum><text>the extent to which financial institutions exercise discretion on whether to not to cover an overdraft and criteria used in exercising such discretion; </text></clause> 
<clause id="H951386B988E9439188253E8EAAFAFB6B"><enum>(iii)</enum><text>the adequacy of information provided to customers regarding alternative overdraft protection programs or services and the cost and terms of such programs and services; </text></clause> 
<clause id="HA87B1EA5B7C14A959959319FD759CA3"><enum>(iv)</enum><text>the adequacy of disclosures in promotions and advertising relating to overdraft protection services; </text></clause> 
<clause id="H84C59DD8B15349D4A729FAE092546CB4"><enum>(v)</enum><text>the extent to which overdraft protection programs and services are conducted by third-party vendors, the basis for structuring vendor compensation arrangements for these programs and services, and the impact, if any, of linking vendor compensation to increases in fee revenue on the quality and cost of overdraft protection services; and</text></clause> 
<clause id="H1841C5BAD49B4B5AA1685CEED9217E77"><enum>(vi)</enum><text>the feasibility of providing notice in connection with point of sale debit transactions that a transaction initiated by the consumer will result in an overdraft protection fee if completed by the consumer and the potential benefit of such disclosure to consumers.</text></clause></subparagraph> 
<subparagraph id="HFD9186FECDDB4BC786549315E8F13066"><enum>(C)</enum><header>Consultation required</header><text display-inline="yes-display-inline">The Board of Governors of the Federal Reserve System shall—</text> 
<clause id="H8F0BA1B8B88C42B9B0BBB21110ED64E3"><enum>(i)</enum><text>consult with the other Federal banking agencies (as defined in section 3 of the Federal Deposit Insurance Act) and the National Credit Union Administration Board in formulating and conducting the study required under subparagraph (A); and</text></clause>

<paragraph id="HBA74284CBA0C417E8FFB2846BF2FF012"><enum>(2)</enum><header>Report required</header><text display-inline="yes-display-inline">Before the end of the 1-year period beginning on the date of the enactment of this Act, the Board of Governors of the Federal Reserve System shall submit a report to the Committee on Banking, Housing and Urban Affairs of the Senate and the Committee on Financial Services of the House of Representatives containing a detailed summary of the finding and conclusions of the study under this subsection, together with such recommendations for legislative or administrative actions as the Board may determine to be appropriate.</text> </paragraph></subsection></section>
